The non-productive philosophical reality of school through leisure
La presente investigación teórica tiene como objetivo principal repensar, para su revalorización, la dimensión no productiva del tiempo y el espacio escolar, centrándose en la dimensión del ocio. Para ello, haciendo uso de la metodología cualitativa de análisis documental y lectura hermenéutica, se presenta la filosofía para niños (FpN), como fin en sí misma, pero también como una herramienta transversal a cualquier disciplina y sus competencias, debido a las similitudes que plantea con la naturaleza del ocio. Es por ello, que, se vuelve altamente deseable tenerlas en cuenta si pretendemos exportar una ciudadanía que pueda experimentar unas condiciones saludables y sostenibles de desarrollo personal revalorizando incluso el mismo, el cual, ha estado denostado o sometido a la exclusiva adquisición de habilidades para un oficio y de pautas de comportamiento para vivir en sociedad. Los resultados obtenidos en la investigación demuestran la siguiente conclusión: tanto la filosofía como el ocio resultan altamente deseables puesto que tienen un impacto en el bienestar debido a los aspectos del desarrollo que fomenta. La capacidad de dialogar, de razonar de manera crítica y creativa, de dotar de sentido al tiempo propio o de elegir qué hacer con dicho tiempo son algunas de las ventajas que repercuten finalmente en la autonomía de las personas para un gobierno saludable y sostenible de sus propias vidas. Si el fin último de la educación es formar personas autónomas y libres, ambas dimensiones no deben de pasar inadvertidas en el mundo de la investigación educativa ni de la PedagogíaThe present theoretical research aims to rethink, for its revaluation, the non-productive dimension of time and school space, focusing on the dimension of leisure. To do this, using the qualitative methodology of documentary analysis and hermeneutic reading, philosophy for children (PfC) is presented as an end, but also as a tool that cuts across any discipline and its competencies, due to the similarities it presents with the nature of leisure. It is therefore highly desirable to take them into account if we intend to export a citizenship that can experience healthy and sustainable conditions of personal development, revaluing even the same, which has been denigrated or subjected to the exclusive acquisition of skills for a trade and behavioral patterns for living in society. The results obtained in the research demonstrate the following conclusion: both philosophy and leisure are highly desirable as they have an impact on well-being due to the aspects of development they promote. The ability to dialogue, to reason critically and creatively, to give meaning to one\u27s own time or to choose what to do with that time are some of the advantages that ultimately impact the autonomy of individuals for a healthy and sustainable self-government. Systematization of an experience: Design and application of interactive videos in a biomechanics course
Este artículo expone el proceso y los resultados del uso de vídeos interactivos para la evaluación de aprendizajes en un curso de biomecánica en el año 2022. Los participantes son un grupo de 31 estudiantes universitarios (64.52 % hombres y 35.48 % mujeres) de una universidad pública de Costa Rica con edades comprendidas entre 19 y 26 años (21.1 ± 2.31). Se diseñaron y aplicaron 15 videos interactivos para la enseñanza y evaluación por medio de la aplicación EdPuzzle. Se aplicó un instrumento de diseño propio que comprendía un cuestionario de 6 ítems y una entrevista semiestructurada de 2 preguntas abiertas para conocer las percepciones de las personas estudiantes acerca de la experiencia. Los resultados registraron las variables establecidas, mostrando la escala una validez interna aceptable (α= 0.789). Se identificaron 17 subcategorías de percepciones positivas y 8 de percepciones negativas acerca de la experiencia. Se confirma que el uso de vídeos interactivos como medio de enseñanza y evaluación es percibido como útil, innovador y atractivo por el grupo del estudio, empero, se observan algunos factores a tomar en consideración como la duración de los vídeos, el acceso al internet y la posibilidad de atención sincrónica. Como conclusión se debe de continuar desarrollando este tipo de intervenciones para generar procedimientos efectivos de planeación y elaboración de experiencias educativas con vídeos interactivos y otras herramientas afines que puedan potenciar el aprendizajeThis article presents the process and results of using interactive videos for assessing learning in a biomechanics course in 2022. Seventeen subcategories of positive perceptions and eight negative perceptions regarding the experience were identified. It is confirmed that the use of interactive videos as a means of teaching and assessment is perceived as useful, innovative, and engaging by the study group; however, some factors need to be considered, such as the duration of the videos, internet access, and the possibility of synchronous attention. "Enseñanza e innovación educativa en el ámbito universitario," coordinado por las profesoras Mª del Carmen Llorente Cejudo, Raquel Barragán Sánchez, Noelia Pérez Rodríguez y Lorena Martín Párraga, ofrece una visión integral de las tendencias pedagógicas actuales en la educación universitaria. Mercancía, mediación social y pensamiento identitario: el ecologismo frente a la fetichización del capital
Through the concept of social mediation in Karl Marx, we will try to show how capitalist commodity society establishes a totality whose link between subjects is produced through the value form and its categories —abstract labor, capital, money—. However, this form of social mediation remains hidden from its subjects, originating forms of subjectivity that Theodor Adorno understood asidentity thinking. Through both authors we intend to illustrate the difficulty of social movements in the mobilization of their political praxis, to find new ways and imaginaries capable of mediating in a radical transformation of society. We address the specific case of ecologism, which is currently trapped in this identity logic, losing its critical potential and its capacity to confront the ecological crisis of our century.A través del concepto de mediación social en Karl Marx, se tratará de mostrar cómo la sociedad mercantil capitalista establece una totalidad cuyo vínculo entre los sujetos se produce a través de la forma valor y sus categorías —trabajo abstracto, capital, dinero—. Sin embargo, esta forma de mediación social se mantiene oculta respecto a sus sujetos, dando lugar a formas de subjetividad que Theodor Adorno entendía como pensamiento identitario. Mediante ambos autores se pretenderá mostrar la dificultad de los movimientos sociales a la hora de movilizar políticamente su praxis, de encontrar nuevos espacios e imaginarios capaces de mediar en una transformación radical de la sociedad. El “páthos de la distancia” o la diferencia política
As early as Human, All Too Human,I, § 472, Nietzsche predicts “the deathof the State” as the inevitable consequence of “the death of God”. Having caught the last glimmers of the dying God,the State will in turn disappear. Whatwe have here is an aggravated nihilismcharacterised by the exclusive hegemonyof exchange value in a world entirelyabsorbed and levelled by internationalised capitalism. But on the other side ofthis gloomy diagnosis lies the possibilityof “an invention even more appropriatethan the State”. After abandoning, in1876, the micro-political perspective hehad developed with Wagner, the dangers of which Wagnerism had revealedto him, Nietzsche spent almost ten years— right up to Beyond Good and Evil —developing a new perspective, this timemacro-political. This led him to analysein depth the nature of what is knownas the “social bond”, which he replacedwith a keen sense of the irreducible difference between political subjects, whose equality is only valid if it safeguardsthe non-determination of identities. The“pathos of distance” is the oxymoronthat Nietzsche invents to think the “inter-” of the inter-relation of equal, butnot identical, political subjects. This article engages with the theme of this volume in multiple ways, attesting to the potency of “in-betwenness” in philosophical and political academic writing. In-betweenness can take many shapes and can be examined in terms of its loss as well as in terms of a possible recuperation of it. The article parts from a theoretical concern with the spaces in-between two important strands within the continental canon of philosophy which are sometimes presented as mutually contradictory: critical theory and theories of affect. It seeks to elucidate the points of contact between the two, and the ways in which they can complement each other when applied to the study of digital media and the way they have become incorporated in mobilization strategies. Its object of investigation is the ongoing decimation of the Palestinian population by the Israeli Defence Forces, and the way this has been transmitted to the writer over the course of the past year.Este artículo aborda el tema de este volumen de múltiples maneras, dando fe de la potencia de la «intermedialidad» en la escritura académica filosófica y política. La intermedialidad puede adoptar muchas formas y puede examinarse tanto en términos de su pérdida como de su posible recuperación. Reconocimiento y castigo: legislación e inclusión queer en España
This article develops a historical analysis of LGBT-related legislation in Spain in order to establish the analytical basis for what it deems to be an ongoing transformation from punishment through recognition towards punishment as recognition. That is, given that access to rights depends on legal recognition from the state, this study analyses the role currently played by the law in the inclusion of the queer subject. In doing so, it demonstrates the impossibility of achieving true equality under neoliberalism, on the basis that access to rights is framed within a punitive, zero?sum game through which the achievement of rights for some is dependent on the Other being devoid of them. The analysis rests upon two foundational claims —firstly, that discourse is a productive manifestation of power that is itself part of daily life; and secondly, that legislation, as a type of hegemonic discourse, is therefore involved in the process of subjectification by producing the subjects and categories it purportedly represents.
Situating itself within critical queer International Relations theory, the study develops an unhappy queer reading through a methodology that combines Sara Ahmed’s (2010) work on queer unhappiness with the Discourse-Historical Approach (DHA) of critical discourse analysis as defined by Martin Reisigl (2017). Taking a historical outlook to read legislation —considering it within its sociopolitical and economic context, rather than in isolation— facilitates noting changes in dominant discourses. Through this combined methodology, tracing the changes in state definitions of the so-called normative and deviant subjects becomes feasible, consequently enabling the identification of the mechanisms through which inclusion takes place. Ahmed’s work, apart from providing a specific focus on the queer subject, makes it possible to take a critical outlook on what is otherwise presented as progress, to be able to discern the wider consequences of seemingly innocuous narratives of safety and the protection of rights.
The argument presented throughout the article is that homonationalism and homocapitalism are these mechanisms that currently operate in tandem to create seemingly innocuous means to be assimilated into normativity, being respectively premised on national pride and the provision of economic profit. These means, however, require a temporal (re)definition of the deviant subject in order to properly function, thus ensuring the continuation of existing structures of privilege. Hegemonic discourses frame the desire to be assimilated into normativity as the means to reach the so-called good life. Not only that, but by resorting to the concept of resilience, they also frame the capacity to achieve it as being based purely on personal merit, therefore hindering the achievement of any profound changes at the structural level.
Spain has been selected as the basis for the study for two key reasons. Firstly, it constitutes a highly representative case to exemplify these existing lines of critical work within queer International Relations theory. The 2023 Trans law and the discourses surrounding it, which serve as the main case study for the second half of the article, exemplify and operate as part of these homonationalist and homocapitalist narratives of inclusion. The bases of these modes of inclusion can be identified through a historical outlook on Spain’s LGBT-related legislation, from its creation specifically for the repression of the queer subject to the evolution towards legislation aimed at the provision of rights. Secondly, its self?proclaimed status as a leader in the defence of LGBT rights offers a vital point of departure for critical engagement with this notion of legislative progress. That is, once homonormative discourses have settled, it becomes possible to be critical of the means through which this inclusion takes place, opening the path for imagining new means of inclusion beyond those premised in the existing system.
The article is structured in three main sections. The first section covers the theoretical framework and methodology in depth, defining the three key concepts for the ensuing analysis. In terms of the theoretical framework, it takes the concepts of homonationalism and homocapitalism as defined by Jasbir Puar (2007) and Rahul Rao (2020) respectively. The concepts are understood as the means through which neoliberal inclusion is premised, looking as well at the geopolitical hierarchies that they are meant to perpetuate. Then, the definition of resilience given by Alison Howell (2015) is applied to the reading of queer inclusion as being based on an individualised perspective aimed at the prevention of far-reaching structural change. Regarding methodology, the article first defines Ahmed’s (2010) conceptualisation of the good life, and the specific way in which it is combined with Reisigl’s (2017) definition of the Discourse-Historical Approach. This combined methodology serves to develop an unhappy queer reading —particularly in terms of providing a critique that is grounded on claims towards emancipation rather than on an unattainable analytical neutrality.
The second section offers a historical overview of LGBT-related legislation in Spain. Starting with Francoism, it presents the conceptualisation of punishment through recognition by examining the legal definition of the category of the deviant subject and the inclusion of the queer subject within it. It also pays close attention to the establishment of biopolitical means of control of the population that were later to give rise to homocapitalist discourses, particularly through its framing of personhood as being dependent on productivity. Then, looking at the Democratic Transition period, it analyses the establishment of these bases for homonationalism instead, tracing the construction of the Other that emerged from Spain’s own self-proclaimed status as a democratic, modern state.
The third and last section takes these bases and demonstrates their embedment in current legislation to further explain how homonationalism, homocapitalism, and resilience are combined as a means for neoliberal inclusion. In particular, as mentioned above, the section focuses on analysing these discourses and their specific implications through an in?depth reading of the 2023 Trans law and the narratives surrounding it. It begins by looking at homonationalist discourses, exposing the ways in which the language of defending LGBT rights can be instrumentalised to simultaneously promote civilising discourses and anti-immigration narratives, both being based on a positive portrayal of repressive state apparatuses. This positive portrayal represents the change towards punishment as recognition, making protection become synonymous with the punishment of the Other. Regarding homocapitalism, it demonstrates that the neoliberal system of rights is purposedly fragile, making them conditional on the provision of economic profit. The article concludes by providing avenues for future research, encouraging further critique that aims to imagine the possibilities of inclusion beyond existing parameters and through the dismantling of structures of privilege.El presente estudio desarrolla un recorrido histórico de la legislación relacionada con las personas LGBT en España para sentar las bases de lo que plantea como la transformación desde el castigo a través del reconocimiento al castigo como reconocimiento. Se enmarca dentro de las líneas críticas de la teoría queer de las Relaciones Internacionales, desarrollando una lectura queer descontenta basada en una metodología que combina el trabajo de Sara Ahmed (2010) sobre la infelicidad queer con el Enfoque Histórico del Discurso definido por Martin Reisigl (2017). El discurso se entiende como una manifestación de poder productiva que forma parte de la vida diaria y, por tanto, la legislación se plantea como una forma de discurso dominante cuya función en el proceso de subjetivación es la producción de los sujetos y categorías que alega representar. El argumento central del artículo es que el homonacionalismo y el homocapitalismo constituyen mecanismos que prometen una supuesta entrada a la normatividad a través del orgullo nacional y la generación de beneficios económicos, algo únicamente posible mediante una redefinición temporal del sujeto desviado. Simultáneamente, a través del concepto de la resiliencia, los discursos dominantes plantean el anhelar esta posibilidad de entrada a la normatividad no solo como el medio para alcanzar la vida buena, sino también como un mérito personal, lo que en consecuencia obstaculiza el conseguir cambios a nivel estructural. El estudio se centra en España tanto por ser un caso representativo de estas líneas teóricas como también por presentar posibles nuevos puntos de partida críticos con los supuestos avances legislativos en materia LGBT. El artículo se divide en tres secciones principales. La primera se centra en la presentación del marco teórico y la metodología, definiendo los tres conceptos clave para el trabajo —homonacionalismo, homocapitalismo, y resiliencia— junto con la concepción de la vida buena de Ahmed (2010) y la forma específica en la que se aplica al Enfoque Histórico del Discurso para desarrollar una lectura queer descontenta. La segunda ofrece un recorrido histórico de la legislación relacionada con las personas LGBT durante el franquismo y la transición, analizando la concepción del castigo a través del reconocimiento y estableciendo las bases de control biopolítico de la población que dan lugar a los posteriores discursos homonacionalistas y homocapitalistas. Fortalecimiento de la autoridad de la Corte Internacional de Justicia en América Latina y el Caribe a partir de la disputa marítima de Nicaragua v. Colombia
This article seeks to empirically examine a current topic of interest for the Latin American and the Caribbean region. It focuses on analyzing the evolution of the International Public Authority (as conceptualized by von Bogdandy et al.) of the International Court of Justice (ICJ) in this region from a constructivist perspective. The text explores how ICJ rulings aim to reshape the international and legal relations of states in the region by examining three specific factors: ICJ procedures, the legal qualification of its decisions, and its mandate. Additionally, it analyzes the case study of Nicaragua v. Colombia regarding the territorial and maritime dispute in the Western Caribbean and the continental shelf, which unfolded between 2001 and 2023. This article aims to shed light on the present and future of the ICJ in the region within the context of the fragmentation of public international law and the proliferation of international courts.
It addresses a novel and relatively unexplored topic in the existing literature, aiming to promote an emerging field of research on Public International Law and Latin American international relations from a multilevel perspective. Moreover, it seeks to bridge the gap between the fields of Public International Law and International Relations, demonstrating how the evolution of these disciplines —traditionally developed in the Transatlantic sphere— is beginning to establish new hubs of growth in the Global South, grounded in a constructivist and functionalist perspective of International Relations. In this context, the debate surrounding the international jurisdiction of the ICJ in the Latin American and Caribbean region (LATAMC) gains significant relevance. This region has been key in promoting the jurisdiction of the ICJ, as well as being active before the Court since its creation. Therefore, it is pertinent to examine how the participation of these states has affected the authority of the ICJ.
This article explores the role of the ICJ in Latin America under the premises of the concept of International Public Authority by von Bogdandy et al. (2008) and De Facto Authority by Alter et al. (2016). These approaches help establish the parameters within which it is understood that the de jure authority of international courts finds its raison d\u27être in its transformation into de facto authority, one that can influence the actions of other actors in international society from a multilevel perspective, thus disregarding the need to appeal to a sociological criterion of legitimacy. The proposed analysis, therefore, aims to demonstrate whether the ICJ possesses authority from a multilevel perspective concerning other international agents in a case that is difficult to prove in the Latin American region. This research is framed within the approaches of constructivism and functionalism in International Relations. The first section of this article discusses the theoretical foundation for analyzing the ICJ\u27s international public authority. Secondly, it specifically explores the ICJ\u27s international public authority in the Latin American region through three factors: the ICJ\u27s procedures, the legal qualification of ICJ decisions, and the ICJ\u27s mandate. Finally, the article examines the case study of the Nicaragua v. Colombia dispute over the territorial and maritime conflict in the Western Caribbean and the continental shelf that developed between 2001 and 2023. Methodologically speaking, this dissertation embraces a multi-method approach. It involves a combination of quantitative and qualitative tools and analysis techniques from different methodological tradition built on the background of a deductive process. In this line, the article is divided into three parts with different methodological approaches and sources depending on the specific objective to cover.
This article concludes that the ICJ exercises international public authority in the region of Latin America and the Caribbean. When examining procedural factors, legal qualifications and mandate, it is plausible to affirm that the ICJ effectively exercises international public authority in the region. In particular, the Western Caribbean has emerged as a hub for initiatives seeking the peaceful resolution of disputes through the ICJ\u27s proceedings. The potential influence of ICJ decisions on the legal situation of states in the region under study appears consistent, as 40 out of the 199 instruments issued by the Court since its establishment have involved a state in the region. This is particularly evident in judgments on the merits, where 18 of the total 70 cases have involved a state in the region under scrutiny. Regarding the ICJ\u27s mandate, from a general perspective, the LATAMC region has 11 active unilateral declarations, which is a significant number compared to other macro-regions like Asia or Oceania. Additionally, the 1948 Bogotá Pact reinforces this mandate granted to the ICJ in the region. From a specific mandate perspective, Latin American countries are highly active in appearing before the ICJ in its contentious jurisdiction. Of the 156 cases opened before the Court, LATAMC countries have participated as claimants or respondents on 66 occasions, demonstrating a notable dynamism in the region. This active participation has intensified in recent decades, seemingly due to the dynamics among different states in the Western Caribbean, with Nicaragua being the focal point of major disputes in the region, especially after the landmark case of military and paramilitary activities in the 1980s. Regarding the situation of Nicaragua and Colombia in the Western Caribbean before the ICJ, the situation has been quite turbulent in recent decades. Nicaragua has strengthened its position in the region, demonstrating confidence in the ICJ\u27s international jurisdictional system. Meanwhile, Colombia has faced a complex and uncomfortable situation, trying to balance the defense of its international legal values with its local and regional interests following ICJ rulings. As a result of this situation, Colombia has struggled to adapt to the new legal reality. In addition to withdrawing from the 1948 Bogotá Pact, Colombia has avoided directly rejecting ICJ decisions, instead inefficiently using domestic strategies to delay compliance with the rulings. The 2023 ruling in favor of Colombia regarding the extended continental shelf provided some relief to Colombia’s and Nicaragua’s intertwined interests in the Western Caribbean. However, the 2012 and 2022 rulings have been key in altering bilateral relations between the two states and, consequently, their relations with other states in the region. This scenario suggests that, for now, the ICJ exercises limited authority in this specific situation. Nevertheless, the trend could evolve towards intermediate or full authority in the future, should the full transfer of sovereignty over the territory lost by Colombia to Nicaragua be confirmed in the years to come.Este artículo busca comprobar empíricamente un tema de interés actual para la región de América Latina y el Caribe. Se centra en el análisis de la evolución de la Autoridad Pública Internacional de la Corte Internacional de Justicia (CIJ) en esta región desde una perspectiva constructivista. Este texto examina cómo los fallos de la CIJ tienen vocación de modificar las Relaciones Internacionales y jurídicas de los estados de la región examinando tres factores particulares: el procedimiento de la CIJ, la cualificación legal de sus decisiones y su mandato. Adicionalmente, examina el estudio de caso del asunto Nicaragua v. Colombia sobre el conflicto territorial y marítimo en el Caribe Occidental y de la plataforma continental que se desarrolló entre el 2001 y 2023. Este artículo pretende arrojar luz sobre el presente y futuro de la CIJ en la región en un contexto de fragmentación del derecho internacional público y de proliferación de tribunales internacionales. Se plantea el análisis de un tema novedoso y relativamente poco explorado en lo que respecta a la literatura existente. Pretende impulsar un campo emergente de investigación sobre el Derecho Internacional Público y las Relaciones Internacionales latinoamericanas, desde una perspectiva multinivel. A su vez, sugiere tender un puente entre el campo del Derecho Internacional Público y las Relaciones Internacionales, y mostrar cómo la evolución de estas disciplinas, que tradicionalmente se desarrollan en el Transatlántico, también empiezan a tener otros ejes de evolución en el Sur Global. Este artículo concluye que la CIJ ejerce autoridad pública internacional en la región de América Latina y el Caribe. La influencia de las decisiones de la CIJ se evidencia en la situación jurídica y política de los estados en la región bajo estudio. Dicha autoridad parece estar concentrada en el Caribe Occidental, y se ha potencializado en las últimas décadas, aparentemente, a raíz de las dinámicas entre los diferentes Estados de esta subregión, que tiene a Nicaragua como eje articulador de las principales disputas que han surgido en la zona, en especial, luego del caso hito Actividades Militares y Paramilitares en y contra Nicaragua de los años ochenta
Presentación: Epistemología y filosofía de la argumentación
In what follows we present the fourth and last issue about the II Ibero-American Conference on Argumentation. The issue is entitled ‘Epistemology and Philosophy of Argumentation’ and is composed of fourteen papers. For the purposes of this presentation, and without any intention of systematicity, the papers have been organized into three groups: those that deal with questions related to the philosophy of argumentation, those that use concepts from other areas to address problems of argumentation theory, and those that adopt abstract or formal approaches to the study of argumentative practices.A continuación se presenta el cuarto y último monográfico dedicado al II Congreso Iberoamericano de Argumentación. El título es “Epistemología y filosofía de la argumentación” y está compuesto de catorce artículos.
