This article analyses a number of Quiroga’s short stories where death is caused by the power of nature (in the region of Misiones) and by the weakness of the men who live in it. It reveals in those stories a poetics of death that Quiroga deploys in order to develop this subject matter. Accordingly, this article posits the thesis that some of Quiroga’s short stories are literature dramatising the struggle of men against nature in their efforts to bring civilisation to the inland wilderness of the South-American continent.
Legislación, racionalidad y argumentación en Aristóteles / Legislation, rationality and argumentation in Aristotle
This paper purports a reconstruction of Aristotle’s ideas on laws (nomoi) from the point of view of contemporary theory of legislative argumentation. A claim is made for the strictly philosophical approach of Aristotle on the matter, in contrast to a technical or scientific one. The main thesis to be defended is the priority of the justificatory dimension in law-making rationality and its framing as a complex modality of practical reasoning of an ethical-political nature. After discussing the legislator’s reasoning as a kind of balancing in which the different values that Aristotle considers as elements of justice —a second-order value itself centered on equality— come into play, reference is made to the dialectical and rhetorical implications of legislative argumentation. Keywords: Aristotle, balancing, dialectics, equality, justice, law-making, legislation, nomoi, practical reasoning, rhetoric, rule of law.
The paper reports on a Socratic exercise that introduces participants to the norm of rational entitlement, as distinct from political entitlement, and the attendant norm of rational responsibility. The exercise demonstrates that, because participants are not willing to exchange their own opinion at random for another differing opinion to which the owner is, by the participants’ own admission, entitled, they treat their entitlement to their own opinion differently, giving it a special status. This gives rise to rational obligations such as the obligation to provide reasons, and a willingness to risk those opinions to the force of the better reason.
The role of argumentation in the brazilian Supreme Court
In the Brazilian Supreme Court, unlike others Supreme Courts, only the relator has the obligation to justify his vote, and to the counting of votes it doesn\u27t matter whether there is consensus among the judges or not. This non obligatory justification of the vote leads to the practice of "voting with the relator", what suggests a double understanding: it can mean that one agrees entirely with his decision as well as with his justification, but it can also mean that one agrees only with his decision and not with his justifications. The lack of demand for a consensus of the majority, on the other hand, leads to cases in which the decision of the court is made by a majority that was not only formed behind a common argument, but by divergent arguments, there being even occurrences of incompatible arguments. A genuine example of this type of occurrence is presented and discussed. Keywords: Argumentative justification, Brazil, Supreme Court.
This article addresses two basic questions: 1) Why do humans engage in argumentation? 2) Why are certain argumentative schemes more compelling than others? We answer these questions through a narrative that illustrates how, in the history of human societies as well as in the psychological development of individuals, human beings learn to use argumentative discourse as a tool of mediation in order to avoid fighting for the goods under dispute. People use arguments to defend their rights and their property, which always involves taking a stand against certain interlocutors. Arguments are convincing insofar as they embody a sense of justice, i.e. they strike a fair balance between the conflicting parties. Keywords: Argumentation, Chaim Perelman, equilibration, Juan Samaja, ownership, reciprocity, rule of justice, social pact.
When we argue, we express reasons with the aim of inducing in our interlocutor the formation of certain judgments or the revision of previously formed judgments. But what does explain the fact that an assertion can constitute a reason authentically able to support another assertion? Our central aim is to address this question. In order to do this, we will make use of the British philosopher Christopher Peacocke’s theory of concepts, as elaborated in his seminal work A Study of Concepts (1992). In this book, our concepts are primarily elucidated in terms of the reasons that authorize their application. This approach is particularly relevant for the study of argumentation. A pair of examples will be discussed and, in the final section of our work, we will employ again Peacocke’s ideas (2008) to try also to show how an assertion can constitute a reason authentically able to refute another assertion.
The present work analyzes the poems «III» and «XXVIII» of Trilce (1922) of the Peruvian writer Cesar Vallejo, considering that its theme deals with the idealized composition of the family from an unfavorable position for the poetic self and that, when it is established from that way, he achieves the perlocution in the reader (persuades him and convinces him of a specific reality). This semantic configuration is demonstrated by the analysis of rhetorical discourse, investigated by C. Fernandez Cozman, who adopts the postulates of G. Lakoff and M. Johnson, who resort to macro concepts (megametaphors) and micro (specific metaphors), essential for the formation of the typological classification, arranged in orientational, ontological and structural metaphors. Likewise, it is confronted with associated approaches, such as those of the interlocutors, the cosmovision and interdiscursivity.
In this article I conceptually analyze some proposals that have been made to define the notion of argumentative force and I propose a definition that includes the rhetorical perspective, absent, until now, in my opinion, from the different proposals that I have analyzed. The definitions that have been most popular have privileged logical and dialectical perspectives and, consequently, the rhetorical perspective has been left in the background. The rhetorical perspective includes argumentation as a natural process of persuasive communication where certain discursive techniques are used to induce or increase adherence to a thesis. The daily arguments, the public debates almost never do without the rhetorical elements, such as the emotion and the spirit that permeates a determined social conglomerate, that is to say, the ethos; understanding by this the catalog of attitudes, values and customs rooted in a social group.
In this paper, we present a proposal for teaching argumentation that involves the writing of argumentative genres contextualized in a school newspaper project. Our proposal assumes the conception of argument presented by Perelman and Olbrechts-Tyteca (2014) in the Argumentation Treaty. We also resort to the studies of Grácio (2013a, 2013b) in the scope of rhetoric and argumentation theory, seeking to establish relationships between argumentation and the teaching of argumentation, and to commentators such as Ferreira (2010) and Plantin (2008). We also established a relationship between the conception of argumentative reading, proposed in Grácio (2013a), and the development of argumentative capacities, addressed by Dolz and Schneuwly (2004) and Azevedo (2013, 2016a, 2016b). This teaching material is aimed at students at the end of elementary school II and aims to provide contact with language practices specific to the journalistic sphere. Thus, it is organized through didactic sequences that can favor argumentative reading and the development of argumentative capacities.
