Cuestiones críticas y perspectivas futuras del third-party litigation funding
No full textAlthough it is a very ancient phenomenon, the third-party litigation funding has only recently begun to acquire a relevant role in the European Union. The institutions have realised its implications and have introduced an ad hoc discipline in directive 2020/1828, around a broader reform on representation actions. There are three aims of this work: to analyse the directive and in particular its art. 10 on the financing of claims; to observe, from a comparative perspective, as the Spanish and Italian legal systems have addressed the transposition of the discipline, despite its critical issues; finally, reflect on the prospects of the subject, considering the latest initiatives of the European legislator.Aunque se trate de un fenómeno antiquísimo, el third-party litigation funding ha empezado solo recientemente a adquirir un papel relevante en la Unión europea. Las instituciones se han dado cuenta de sus implicaciones y han introducido una disciplina ad hoc en la directiva 2020/1828, en el ámbito de una reforma más amplia sobre acciones de representación. Tres son los objetivos de este trabajo: analizar la directiva y especialmente su art. 10 sobre financiación de las acciones de representación resarcitorias; observar, desde una perspectiva comparada, como los ordenamientos de España e Italia han abordado la transposición de la disciplina, a pesar de sus cuestiones críticas; por último, reflexionar sobre las perspectivas futuras de la materia, teniendo en cuenta las últimas iniciativas del legislador europeo

No full textThis article aims to provide a wide-ranging overview of the research dynamics in the cave-necropolis of the Portuguese Estremadura. With nearly 160 years of active research, these Neolithic and Chalcolithic burials constitute a case study of particular interest to the History of Archaeology in Portugal. Indicators from this site typology have accumulated in recent years and are now among the most relevant for the Late Prehistory of the Central and Southern regions of the current Portuguese territory. It’s important to understand the nature of the research, focusing on the objectives and methods that make up the current legacy and form the basis for some of the ongoing projects.
The analysis of over a hundred cave burials has revealed an interesting distribution, alternating periods of high activity with others of a decline in that same activity. The number of old interventions is still higher than the most recent ones, drawing attention to their integration into contemporary archaeological discourseEste artigo pretende realizar uma apresentação exaustiva da dinâmica de investigação em grutas-necrópole da Estremadura portuguesa. Com quase 160 anos de investigação ativa, estes sepulcros neolíticos e calcolíticos constituem um caso de estudo com interesse particular para a História da Arqueologia em Portugal. Os indicadores provenientes desta tipologia de sítio têm-se acumulado nos últimos anos e são hoje dos mais relevantes para a Pré-História Recente do Centro e Sul do atual território português. Importa compreender o caráter das pesquisas, focando nos objetivos e métodos que constituem o legado atual e sobre o qual se baseiam alguns dos projetos atualmente em curso.
A análise sobre um conjunto de mais de uma centena de grutas-necrópole revelou uma distribuição interessante, alternando momentos de grande atividade com outros de quebra dessa mesma atividade. Al final de la ilusión: de la politización del arte a la estetización de la mercancía
No full textThe purpose of this paper is to investigate the meaning and scope of the phenomenon of the aestheticization of merchandise in the horizon of artistic capitalism, undermining the emancipatory potential of art in the vision of W. Benjamin, but also in the artistic praxis of the avant-garde historical. A profound subversion derives from this, a radical revolution of the relations between real and imaginary, in such a way that the visual ends the “game of illusion” through the game of reproduction, as the advertising pseudo-image irrefutably expresses. In the “age of the visual”, the image is “unhinged” from the world, leading to pressing social and political problems.El cometido del presente trabajo es indagar el significado y alcance del fenómeno de la estetización de la mercancía en el horizonte del capitalismo artístico, con menoscabo del potencial emancipatorio del arte en la visión de W. Benjamin, pero también en la praxis artística de las vanguardias históricas. De aquí se deriva una profunda subversión, una revolución radical de las relaciones entre real e imaginario, de tal suerte que lo visual acaba con el “juego de la ilusión” por el juego de la reproducción, como expresa fehacientemente la pseudoimagen publicitaria. No full textNavarra was the last viceroyalty of the Iberian Peninsula after the Nueva Planta decrees of the early 18th century. The idiosyncrasy of this territory characterized the performance of the viceroys and their relationship with the Kingdom and the City of Pamplona. This also necessarily conditioned the role of the vicereine consorts. This article aims to make a first approach to the figures of these women and their political and social influence through their participation in part of the ceremonial and festivities of the Navarrese capital. This seeks to begin to elucidate the degree of influence of these women on the political, social and cultural development of the moment.Navarra fue el último virreinato de la Península Ibérica tras los decretos de Nueva Planta de principios del siglo XVIII. La idiosincrasia de este territorio caracterizó el desempeño de los virreyes y su relación con el Reino y la ciudad de Pamplona. Ello también condicionó necesariamente el papel de las virreinas consortes. El presente artículo pretende realizar una primera aproximación a las figuras de estas mujeres y a su influencia política y social a través de su participación en parte del ceremonial y los festejos de la capital navarra. Los textos apócrifos atribuidos a Pigafetta, un análisis histórico y de contenido
No full textAntonio Pigafetta\u27s manuscript narrating the first circumnavigation disappeared along with all its copies a few years after the expedition returned to Seville, as did its own author. The various accounts that have come down to us attributed to Pigafetta are a small group of interrelated documents, lacking traceability and of unknown authorship, of which the only thing that is known for sure is that they do not come from Pigafetta\u27s hand. Of these, the best known is the manuscript of the Ambrosian Library, of which different transcriptions have been made, the last one by Andrea Canova in 19993. In this article we will study all these texts and their interpretations, until we reach a reasoned conclusion about their first and common origin.El manuscrito de Antonio Pigafetta narrando la primera circunnavegación desapareció junto con todas sus copias pocos años después de que la expedición regresara a Sevilla, al igual que su propio autor. Los diversos relatos que nos han llegado atribuidos a Pigafetta son un pequeño grupo de documentos interrelacionados, carentes de trazabilidad y de autor desconocido, de los que lo único que se sabe con certeza es que no proceden de la mano de Pigafetta. De entre ellos el más conocido es el manuscrito de la Biblioteca Ambrosiana, del que se han ido realizando distintas transcripciones, la última por Andrea Canova en 19992. En este artículo estudiaremos todos estos textos y sus interpretaciones, hasta alcanzar una conclusión razonada sobre su origen primero y común
The teaching of music in students with motor difficulties
No full textThis article reports on the research carried out during the 2020-21 academic year that aimed to facilitate the teaching of music to students with motor difficulties within the framework of Music Conservatories. This work has compiled strategies and resources to promote the inclusion of these students, as well as answers to various questions about the musical practice and learning of these students. The methodological design is ethnographic through dialogue between researchers and teachers, musicians and students of Music Conservatories. The sample in this research has been 60 participants and includes people from different parts of Spain and other countries with diverse profiles: music teachers and specialists with experience in serving students with these characteristics, directors or leaders of musical groups, teachers of pedagogy, therapy and musical education, Conservatory and University professors, doctors, psychologists and students and musicians with motor difficulties of various types, among others. The results specify what difficulties these students have and what musical instruments best suit them, as well as didactic proposals to promote an inclusive education for this student in Music Conservatories. Finally, it is confirmed that there are resources and strategies that enhance the inclusion of students with motor disabilities in the classrooms of music conservatories, and that there are musical instruments that are better suited to these students, percussion being one of the main ones, although logically, depends on the type, grade and motor difficulty of the studentEste artículo informa sobre la investigación efectuada durante el curso 2020-21 que tuvo como objetivo facilitar la enseñanza de la música en el alumnado con dificultades motrices dentro del marco de los Conservatorios de Música. Este trabajo ha recopilado estrategias y recursos para favorecer la inclusión de estos estudiantes, así como también respuestas a diversas cuestiones sobre la práctica musical y el aprendizaje de este alumnado. El diseño metodológico es de tipo etnográfico a través del diálogo entre los investigadores y docentes, músicos y alumnado de Conservatorios de Música. La muestra en esta investigación ha sido de 60 participantes e integra personas de diferentes puntos de España y de otros países de diverso perfil: docentes de música y especialistas con experiencia en atender alumnado con estas características, directores o dirigentes de grupos musicales, maestros de pedagogía terapéutica y educación musical, catedráticos de Conservatorio y Universidad, médicos, psicólogos y alumnado y músicos con dificultades motrices de diversas tipologías, entre otros. Los resultados concretan qué dificultades tienen estos estudiantes y qué instrumentos musicales se ajustan mejor para ellos, así como propuestas didácticas para propiciar una educación inclusiva de este alumnado en los Conservatorios de Música. Finalmente, se confirma que hay recursos y estrategias que potencian la inclusión del alumnado con discapacidad motora en las aulas de los Conservatorios de música, y que hay instrumentos musicales que se ajustan mejor a estos estudiantes, siendo la percusión uno de los principales, aunque lógicamente, depende de la tipología, grado y dificultad motriz del alumnad

El cultivo de la curiosidad”, coordinada por Santiago Beruete, propone una visión de la educación inspirada en la naturaleza y la jardinería, donde el aprendizaje es un proceso lento, orgánico y cuidado. La obra, estructurada en cuatro partes —“Las raíces”, “El tronco”, “Las ramas y las hojas” y “Los frutos”—, ofrece una perspectiva bioinspirada para abordar los desafíos del siglo XXI. Beruete sostiene que los seres humanos son “aprendívoros” por naturaleza, motivados por la curiosidad, y critica tanto el tecnocentrismo como el pesimismo, proponiendo la “inteligencia ecológica”: una combinación de reflexión, conocimiento y cuidado del planeta. La metáfora de la “jardinosofía” ilustra un modelo educativo en el que el maestro actúa como jardinero, cultivando preguntas y fomentando el pensamiento crítico sin imponer, sino acompañando el crecimiento del alumno. Beruete expresa escepticismo hacia el sistema educativo actual, pero confía en su potencial de transformación si se adopta una pedagogía basada en la naturaleza y la resiliencia. Critica la educación superficial, automatizada y el impacto negativo de la tecnología, que puede manipular y distraer si no se usa éticamente. Aboga por un enfoque que valore la empatía, la diversidad y el cuidado mutuo, comparando las escuelas con bosques y jardines donde cada individuo puede florecer a su ritmo. No full textEste artículo analiza y ordena críticamente las fuentes dispersas gráfico documentales y plásticas que, entre el 25 de enero y el 27 de febrero de 1901, recogieron con detalle la enfermedad, defunción, velatorio y funeral de Giuseppe Verdi. Todo ello, demostrando que este pro- grama representacional es un modelo paradigmático del arte, de la fotografía y de las ilustraciones periodísticas comprometidas con la temática de lo social de principios del siglo XX; al tiempo de ser un fiel reflejo del posicionamiento contemporáneo ante la muerte, la cultura y la historia de su presente, personalizada en la mayoría de los casos por los héroes culturales de su época. De este modo, confeccionamos una crónica lineal histórico plástica que, a modo de experiencia visual, recoge pormenorizadamente este suceso, testificando a su vez a los autores que generaron dichas piezas, muchos de ellos poco tratados hasta el momento
