Il Pilastro Europeo dei Diritti Sociali e le tradizioni costituzionali degli Stati membri. Verso una protezione sociale europea?
Get PDFThe new economical challenges have turned on the attention on corrective measures for market processes, particularly focusing on social Europe or the so-called «European social model». This is because the economic and social phenomena increasingly require international answers, especially across the entire European territory. The same holds true in the field of security and social protection, as a function that the European welfare state has taken on in the 20th century, aligning with the progressive liberalization of the continental market. After reflecting on the common constitutional tradition of the welfare systems of member states, this paper chronicles the regulatory evolution of the European social model regarding social protection. This will help identify how the European Pillar of Social Rights in 2017 represents a milestone in the path toward European integration in the protection of European citizens, especially in light of recent European actions, addressing the pandemic emergency. The theoretical observations in the conclusion highlight how the state of art may shape the future of the European Union legal framework and European welfareLe nuove sfide economiche hanno riacceso l’attenzione sui correttivi alle dinamiche di mercato e, perciò, anche sull’Europa sociale o sul cosiddetto «modello sociale europeo». Ciò è conseguenza del fatto che i fenomeni economici e sociali richiedono sempre più una trattazione internazionale e, in particolare, analoga su tutto il territorio europeo. Lo stesso richiede nel settore della sicurezza e della protezione sociale, quale funzione che il Welfare State di stampo europeo ha assunto nel XX secolo e che si è rapportato con la progressiva liberalizzazione del mercato unico continentale. L’elaborato, dopo aver riflettuto su quale sia la tradizione costituzionale comune dei sistemi di welfare degli Stati membri, ripercorre diacronicamente l’evoluzione normativa del modello sociale europeo in tema di protezione sociale. Ciò consentirà di rilevare in che modo il Pilastro Europeo dei Diritti Sociali del 2017 rappresentano costituisca la tappa del percorso verso l’integrazione europea nella protezione del cittadino europeo, anche alla luce delle recenti azioni europee in contrasto all’emergenza pandemica. Le osservazioni teoriche di cui alla conclusione evidenziano come lo stato dell’arte potrà evolvere il futuro dell’ordinamento dell’Unione e del welfare europeo

The collapse of the party system is now accompanied by a more general breakdown of the democratic system: the crisis of the community – representative system. The friction generated by this event builds a new legal system, that is to say, the democracy of conflict. Citizens find in the world of law new democratic instruments for participation and vindication of their demands, the political conflict moves from the parliamentary arena to the judicial one. In this panorama the common goods represent the chosen ground in which a new dialectic develops between citizen, public power and role of the Judge. This conflict is plastically represented in the judicial and administrative events that took place in Neapolitan territory, where a group of organized citizens fought for free access to the sea, affirming, in judicial measures, very relevant principles on public goods and free use of beaches, building a dialectic that has at its center the sea as common goodLa democrazia della rappresentanza appare in profonda crisi. Al crollo del sistema dei partiti è oramai accompagnato uno scollamento più generale del sistema democratico: la crisi del sistema comunità – rappresentante. L’attrito che si genera da tale accadimento costruisce un nuovo sistema giuridico, ovverosia quello della democrazia del conflitto. I cittadini trovano nel mondo del diritto nuovi strumenti democratici di partecipazione e rivendicazione delle loro istanze, il conflitto politico si sposta dall’arena parlamentare a quella giurisdizionale. In questo panorama i beni comuni rappresentano il terreno di elezione in cui si sviluppa una nuova dialettica tra cittadino, potere pubblico e ruolo del Giudice. Questo conflitto viene plasticamente rappresentato nelle vicende giudiziarie e amministrative avvenute in territorio napoletano, ove un gruppo di cittadine e cittadini organizzati si è battuto per il libero accesso al mare, riuscendo a far affermare in provvedimenti giudiziari principi rilevantissimi in tema di beni pubblici e libera fruizione delle spiagge, costruendo una dialettica che ha al centro il mare come bene comun

Promoting a local and just green deal. School open spaces as a strategic opportunity for the city in the ecological transition
No full textRecent global policies like the United Nations 2030 Agenda, Paris Agreements, and European Green Deal emphasise the urgency of sustainable lifestyles, production, and mobility. However, there are associated risks, including the exacerbation of socioeconomic inequalities and an overemphasis on large infrastructure projects. The ongoing debate recognizes the need for a place-based approach, with cities at the core of the European transition and active citizen engagement. European institutions address these challenges through initiatives like the "Green Deal Going Local" by the Committee of the Regions, the European Commission's "Local Green Deals," and the "New European Bauhaus" for cultural and social transition. This paper argues that schools, especially open spaces, can play a key role in implementing a local, sustainable and equitable green deal. They can facilitate participatory processes, promote a sense of citizenship and function as laboratories for green urban regeneration. To verify this hypothesis, the paper examines European policies and best practices in the regeneration of school open spaces in Europe from 2019 to the present. These practices are assessed on the basis of key strategic issues and governance principles for a local and fair transition. Finally, research results are discussed together with potential pathways for the implementation of actions related to the local Green Deal

No full textThe shape of the city is described in various ways, but it's not incorrect to view it as the result of intricate connections between tangible components and intangible influences, specifically the behaviors of its inhabitants. Over the last century, through the Modern Movement and the impulses of the CIAM, the studies of typological, technological, and stylistic innovation necessary to give the character of ‘rationality’ to the shape construction, summarized in the metaphor of ‘machinist civilization’, have produced infrastructures and urban spaces dedicated to the automobile efficiency. Today, the issue of sustainability is bursting into all sectors, shaping new urban and mobility models, mainly based on non-motorized travel. A situation not too different from that which has characterized cities in the past, in particular Italian realities. Starting from these conditions and from the identification of a strong link between urban structure and mobility, the paper gives an interpretation of Italian cases able to connect the different components of the city, made up of spatial dimensions, represented by the urban structure, and temporal dimensions, identified in mobility patterns. Beginning with the walking city model, which is 30-minute walkable, the historic city, the rationalist one of the automobile city, and the polycentric structures are investigated to trace examples of design that can still be valid today and understand the possibilities to reuse the automobile-age spaces

No full textStarting from the relationship between urban planning and mobility management, TeMA has gradually expanded the view of the covered topics, always remaining in the groove of rigorous scientific in-depth analysis. This section of the Journal, Review Notes, is the expression of continuously updating emerging topics concerning relationships between urban planning, mobility and environment, through a collection of short scientific papers written by young researchers. The Review Notes are made of four parts. Each section examines a specific aspect of the broader information storage within the main interests of TeMA Journal. In particular, the Urban strategies, programmers and tools section presents the different strategies and tools for active mobility implemented internationally. The purpose of this review is to provide an overview of the instruments and strategies implemented in Europe to encourage active mobility. In addition, some solutions to promote active transport implemented in several European cities have been reported. These initiatives represent an opportunity for European communities to act in a necessary, indispensable and continuous process of improving urban mobility in the direction of environmental sustainability.These measures, enhanced by dedicated tools such as SUMPs, promote behavioral change and support mobility planning, setting active mobility as a winning strategy to improve city life and urban efficiency
