    Queer representation in the web series “Carmilla” and “The Carmilla Movie”

    Medien im Allgemeinen und visuelle Medien im Besonderen haben die Fähigkeit, zu beeinflussen, wer wir sind und wie wir die Welt sehen. Für einige sind Medien der erste Berührungspunkt mit bestimmten randständigen Gruppen, wodurch die Bilder und Geschichten, mit denen sie konfrontiert sind, noch bedeutsamer werden. Sowohl queere als auch nicht-queere Zuseher:innen können gleichermaßen durch die Darstellungen, denen sie ausgesetzt sind, lernen, was es bedeutet, Teil der LGBTQIA+ community zu sein. Dadurch werden diese zu einer wertvollen Ressource, um Ansichten von und über eine bestimmte Gruppe zu verstehen und zu formen. Eine Erforschung dieser Darstellungen kann nicht nur Einblicke in die einzelnen spezifischen Repräsentationen selbst geben, sie hat weiters das Potenzial, einen Leitfaden für zukünftige Texte anzubieten. Daher ist es der Zweck dieser These, die queere Repräsentation in der Webserie Carmilla und The Carmilla Movie zu untersuchen. Die kanadische Webserie Carmilla wurde 2014 auf YouTube veröffentlicht und erreichte in kürzester Zeit unerwartete Beliebtheit, welche 2017 zur Veröffentlichung des Spielfilms The Carmilla Movie führte. Es handelt sich hier um eine moderne, feministische Adaption der gleichnamigen Novelle des Autors Sheridan Le Fanu aus dem Jahre 1872. Anstelle einer Geschichte über die zerstörerische Macht der weiblichen (Homo‑)Sexualität findet sich hier eine Wertschätzung und Feier von queer-sein und queerer Liebe. Mit einer Fülle an queeren Charakteren und Handlungssträngen bieten die Serie und der Film einen regelrechten Überschuss an Repräsentation. Es ist jedoch nicht allein dieses Volumen an Darstellungen, welches Carmilla zu einem positiven Beispiel macht. Carmilla bietet komplexe Darstellungen, die sich weder auf die queere Identität der Charaktere verlassen noch davon abhängen. Eine Analyse der Gesamtdarstellung sowie der bedeutendsten Charaktere und Handlungsstränge zeigt ein Bild einer Show, die trotz Widerstand und Zensur erfolgreich war. Carmilla liefert realistische, komplexe und facettenreiche Darstellungen, die darauf abzielen, schädliche Stereotypen und Tropen zu umgehen und umzukehren. Obgleich die beinhalteten Darstellungen keineswegs fehlerfrei sind, haben diese dennoch das Potenzial, eine Basis für zukünftige Charaktere und Handlungen zu bieten.Media in general, and visual media in particular, has the power to shape who we are and how we see the world. For some, media is their first introduction to certain marginalised groups, making the images and stories they are presented with all the more important. Queer and non-queer viewers alike may learn what it means to be part of the LGBTQIA+ community through the depictions they are exposed to, making these a valuable resource in comprehending and shaping the perceptions of a certain group. Studying these depictions may not only yield insights into the specific representation found within the primary text itself but also carry the potential to offer a guide for future stories. As such, it is the purpose of this thesis to examine the queer representation offered within the web series Carmilla and The Carmilla Movie. The Canadian web series Carmilla was released on YouTube in 2014 and quickly gained unexpected levels of popularity, leading to the release of a feature film, The Carmilla Movie, in 2017. This modern feminist adaptation of Sheridan Le Fanu’s 1872 novella about a female vampire took a story of the corrupting force of female (homo-)sexuality and turned it into a celebration of queerness and queer love. With a plethora of queer characters and storylines, the series and the movie offer an abundance of representation. However, it is not only the volume of representation that makes Carmilla a positive example; it offers complex depictions that do not rely or hinge on the characters’ queerness. An analysis of the overall representation, as well as its most significant characters and storylines, reveals an image of a show that succeeded despite pushback and censorship. Carmilla delivers realistic, intricate, and multifaceted portrayals that aim to circumvent and invert harmful stereotypes and tropes.     How is the Socio-Demographic Background of Researchers in AI & ML related to the Values Reflected in their Publications?

    Diese Masterarbeit untersucht die soziodemografischen Faktoren, die die Produktion einflussreicher Forschung im Bereich der Künstlichen Intelligenz (KI) und des Maschinellen Lernens (ML) beeinflussen. Aufbauend auf früheren Studien, die eine Überrepräsentation machtzentrierter Werte sowie eine Unterrepräsentation von nutzerrechtlichen und ethischen Prinzipien in KI- und ML-Publikationen festgestellt haben, wird hier untersucht, welchen Einfluss die soziodemografische Zusammensetzung der Forscher*innen auf die Werte ihrer Publikationen hat. Analysiert werden die meistzitierten Publikationen der Konferenzen NeurIPS und ICML aus den Jahren 2008, 2009, 2018 und 2019. Um die Einschränkungen durch die Unterrepräsentation moralischer Werte zu adressieren, wurde ein angereicherter Datensatz aus Open-Access-Forschungsplattformen wie Semantic Scholar und OpenAlex erstellt. Mithilfe dieses Datensatzes werden die Publikationen mittels netzwerkbasierter Methoden in zwei Gruppen eingeteilt: (i) die moralische und (ii) die nicht-moralische Gruppe. Anschließend wird für jede Kollaboration einer Publikation ein Diversitäts-Score berechnet, um zu untersuchen, ob Diversität der Kollaboration mit der moralischen Kategorisierung der Publikationen zusammenhängt. Die Ergebnisse zeigen, dass die entwickelte Methode zwar erfolgreich ein auf Ähnlichkeit basierendes Maß konstruiert, jedoch nicht zuverlässig auf gemeinsame moralische Werte schließen lässt. Darüber hinaus, zeigt die Diversität innerhalb der Kollaborationen keinen statistisch signifikanten Zusammenhang mit der moralischen oder nicht-moralischen Kategorisierung der Publikationen. Während ein gewisses Maß an Diversität in den untersuchten Kollaborationen vorhanden ist, zeigen die allgemeinen Beobachtungen dennoch eine erhebliche Unterrepräsentation von Frauen sowie eine Konzentration von Forschenden aus wenigen Ländern, Eliteeinrichtungen und Technologieunternehmen, vorwiegend aus dem globalen Norden.This Masters’ Thesis investigates the socio-demographic factors influencing the production of influential Artificial Intelligence (AI) and Machine Learning (ML) research. Building upon prior work, which identified a predominance of power-centralizing values and an underrepresentation of user rights and ethical principles in AI & ML publications, this study analyzes whether the socio-demographic composition of authors influences the prevalence of these values. The most cited papers presented at top-tier conferences NeurIPS and ICML in four selected years: 2008, 2009, 2018, and 2019 are being analyzed. To expand the analysis, an enriched dataset is constructed from open-access research platforms such as Semantic Scholar and Open Alex, encompassing the broader population from which the initial dataset is drawn. Using this dataset, papers are identified as closely related to one of two groups derived from the initial annotations: (i) Moral Group and (ii) Non-Moral Group. This is achieved by applying Jaccard Similarity reference overlap between paper pairs, followed by backbone extraction and ego network extraction. Diversity scores for research collaborations are calculated enabling a statistical analysis with the two groups of papers. The results reveal that despite the developed method successfully constructs a similarity-based measure it does not reliably infer shared moral values. Papers closely tied to a paper categorized as moral do not necessarily share the same values, despite having a high overlap based on shared references. Additionally, the diversity characteristics of research collaborations in both groups show no statistically significant relationship with the moral classification of papers. While there is some diversity, the general observations, however, show a significant underrepresentation of women and a concentration of researchers from a few nationalities, elite institutions, and technology companies, predominantly from the Global North.Paula NautaMasterarbeit Universität Graz 202

    Law and Practice of the Austrian Police Forces in the Field of Immigration Law

    Die primäre Aufgabe der österreichischen Sicherheitsexekutive besteht im Schutz der Menschenrechte durch die Erfüllung der ersten allgemeinen Hilfeleistung, der Abwehr von gefährlichen Angriffen, der Aufrechterhaltung der öffentlichen Ordnung oder der Verfolgung von Straftaten. Im Zuge der Vollziehung ihrer Aufgaben greift die Polizei aber immer wieder in Menschenrechte ein oder verletzt diese, wenn ein Eingriff unverhältnismäßig ist. Insbesondere im Bereich des Fremdenrechts stand die Polizei in den letzten Jahren im Fokus der Öffentlichkeit, wurde als Verletzerin der Menschenrechte bezeichnet und in ein schlechtes Licht gerückt. Es ist deshalb von Bedeutung, die Rolle der österreichischen Exekutive sowohl als Hüterin als auch als Verletzerin verfassungsrechtlich gewährleisteter Rechte im Bereich des Fremdenrechts zu veranschaulichen. Da staatliches Handeln im Einklang mit den Menschenrechten stehen muss, wird in dieser Arbeit besonderes Augenmerk auf die Ausübung der Befugnisse, die Hürden bei deren Umsetzung und mögliche Eingriffe oder Verletzungen in verfassungsgesetzlich gewährleistete Rechte gelegt.The primary task of the Austrian police is to protect human rights by providing first aid, defending against dangerous attacks, maintaining public order and prosecuting criminal offenses. In the course of carrying out their duties, the police repeatedly interfere with human rights or violate them if the interference is disproportionate. In the area of immigration law in particular, the police have been the focus of public attention in recent years, being labeled as violators of human rights and cast in a bad light. It is therefore important to illustrate the role of the Austrian police as both a guardian and a violator of constitutionally guaranteed rights in the area of immigration law.     How do psychotherapists present their work? : Analyzing psychotherapist websites using computational social science approaches with a focus on therapist descriptions of psychotherapy and alternative practices

    Persönliche Websites bieten Einblicke in die Online-Selbstdarstellung von Psychotherapeutinnen und Psychotherapeuten. In dieser Studie untersuche ich, wie österreichische Psychotherapeutinnen und Psychotherapeuten sich, ihre Therapieangebote, sowie alternative Praktiken außerhalb der klinischen Psychologie präsentieren. Nach dem Web-Scraping von Texten ihrer persönlichen Websites führte ich zwei Analysen mit dem Datensatz durch. Um Muster in der Selbstdarstellung von Therapeutinnen und Therapeuten zu finden, berechnete ich Structural Topic Models für Methoden- (N = 232) und Über mich- (N = 245) Seiten. Die Ergebnisse zeigen, dass Therapeutinnen und Therapeuten bestimmte Sprache verwenden, um Kompetenz zu signalisieren, jedoch keine konsistenten Muster zur Vermittlung von Wärme erkennbar waren. Außerdem zeigte sich, dass auf den Websites Psychotherapie durch logistische Informationen und Erklärungen von therapeutischen Ansätzen zugänglicher gemacht wurde. In einer zweiten Analyse untersuchte ich, wie oft Psychotherapeutinnen und Psychotherapeuten alternative Praktiken erwähnen und führte eine Clusteranalyse durch, um Muster in den Erwähnungen zu finden (N = 152). Verschiedene alternative Praktiken wurden genannt, wovon die meisten der am häufigsten erwähnten Anwendung in psychotherapeutischen Methoden in Österreich finden oder Gegenstand aktueller empirischer, psychologischer Forschung sind. Nichtsdestotrotz wurden diverse alternative Praktiken genannt, die in der etablierten psychologischen Wissenschaft nicht empfohlen werden. Die Ergebnisse werden im Kontext der Selbstdarstellung von Therapeutinnen und Therapeuten und der Konzeptualisierung von Psychotherapie in Österreich diskutiert.Personal websites provide useful insights into how medical professionals present themselves and their offered services online. In this study, we looked at the self-presentation of psychotherapists on their personal websites and how they talk about their offers of therapy as well as alternative practices outside of mainstream clinical psychology. After scraping texts from Austrian psychotherapist personal websites, we performed two types of analyses with the dataset. In order to find themes in therapist self-presentation, we calculated structural topic models for method- (N = 232) and about me- (N = 245) subpages. We found that therapists use language to signal competence but found no topics signalling warmth. Additionally, it emerged that therapists make therapy more accessible through logistical information and explanations of their therapeutic orientation. In a second analysis, we examined how often psychotherapists mention alternative practices and performed a cluster analysis to find themes in those mentions (N = 152). We found that diverse alternative practices occurred on the therapist websites, but most of the more commonly mentioned ones find application in psychotherapeutic methods in Austria or are at least a subject of current empirical psychology research. Nevertheless, therapists mentioned several practices that are not recommended by mainstream psychology and medicine.     The EU Data Act 2023 and Austrian private law

    Diese Diplomarbeit beschäftigt sich mit dem Data Act 2023 der EU und dessen Auswirkungen auf das österreichische Privatrecht. Der „Data Act“ oder das „Datengesetz“ der EU wird mit 12.09.2025 in der gesamten Union unmittelbar anwendbar sein. Mit der Verordnung soll ein Rechtsrahmen für vernetzte Produkte geschaffen werden. Mit vernetzten Produkten werden insbesondere die mit dem Internet verbundenen Geräte des „Internet of Things“ (IoT-Geräte) gemeint. Fällt eine Funktion eines IoT-Geräts aus, ist häufig der Zugriff auf dessen Daten notwendig, um eine Reparatur durchführen zu können. Aus diesem Grund verfolgt der Data Act nun das Ziel, dass Nutzer, aber auch Dritte, Zugang zu diesen Daten erhalten. Zu Beginn dieser Arbeit soll auf den Kern dieser Thematik und damit auf die Charakteristika der Datenökonomie eingegangen werden. Des Weiteren soll auf die umstrittene rechtliche Zuordnung von Daten eingegangen werden. Der Data Act will, im Einklang mit der österreichischen hL, kein Eigentum an Daten schaffen. Vielmehr nimmt er eine Art mittelbare rechtliche Zuordnung von Daten vor, indem er den Nutzern von IoT-Geräten ein Datenzugriffsrecht auf die vom vernetzten Produkt generierten Daten einräumt. Der zentrale Fokus dieser Arbeit wird daher auf den Datenzugangsregelungen des Kapitels II des Data Acts liegen. Zunächst soll der sachliche und persönliche Anwendungsbereich der Datenzugangsbestimmungen (Art 3, 4, 5 Data Act) dargestellt werden. Unter das II. Kapitel fallen nur so genannte „Rohdaten“. Das bedeutet, dass abgeleitete Daten, die durch kostenverursachende Algorithmen erzeugt werden, nicht unter das Datenzugangsregime fallen. Darauffolgend wird auf die Definitionen der Verpflichteten des Datenzugangsgesetzes - Hersteller und Dateninhaber - sowie der Berechtigten - Nutzer und Dritte - eingegangen werden. Anschließend soll durch die nähere Betrachtung der einzelnen Bestimmungen, aber auch deren Zusammenspiel, die grundsätzliche Regelungssystematik des Data Acts deutlich gemacht werden. Die Herausgabe von Daten kann aufgrund von Geschäftsgeheimnissen gem Art 4 Abs 8 Data Act verweigert werden, es liegt jedoch auf der Hand, dass auch andere Rechtsvorschriften, wie zB das Datenschutzrecht oder das Wettbewerbsrecht, der Herausgabe bestimmter Informationen entgegenstehen können. Ziel dieser Arbeit ist es daher auch, mögliche Verweigerungsgründe für den Datenzugang aufzuzeigen. Darüber hinaus sieht Art 13 Data Act eine Missbrauchskontrolle von „einseitig auferlegten Klauseln“ vor. Dieser neue Begriff für eine Klauselkontrolle soll der klassischen AGB-Kontrolle gegenübergestellt und insbesondere deren Einordnung in das österreichische Privatrecht aufgezeigt werden. Abschließend soll die zentrale Forschungsfrage dieser Arbeit beantwortet werden: Welche privatrechtlichen Sanktionen ergeben sich aus dem Data Act in Österreich? Der Data Act sieht ähnlich wie die DSGVO und der DSA öffentlich-rechtliche Sanktionen vor. Im Gegensatz dazu hat der Data Act die privatrechtlichen Sanktionen bewusst unberührt gelassen. Gem Art 38 Abs 1 Data Act hat der Berechtigte „unbeschadet eines anderen verwaltungsrechtlichen oder gerichtlichen Rechtsbehelfs“ die Möglichkeit, Beschwerde bei der Behörde einzulegen. Diese wird aber von mehreren als unabdingbar für eine effektive Durchsetzung des Data Acts angesehen. Das könnte bedeuten, dass sich privatrechtliche Sanktionen wie Schadenersatz aus dem unionsrechtlichen Effektivitätsgrundsatz ergeben. Einer anderen Ansicht zufolge können sich privatrechtliche Ansprüche nur aus dem nationalen Recht ergeben. Denkbar wäre zB, dass sich in Österreich Gewährleistungsansprüche aus §§ 922 ABGB oder wettbewerbsrechtliche Ansprüche aus dem UWG ergeben. Diese Diplomarbeit schließt daher mit einer Darstellung der privatrechtlichen Folgen des Data Acts ab, die aus dem Rückgriff auf das österreichische Privatrecht resultieren.This thesis deals with the EU Data Act 2023 and its impact on Austrian private law. The Data Act will be directly applicable throughout the EU as of September 12, 2025. The regulation is intended to create a legal framework for connected products. Connected products refer to Internet of Things (IoT) devices connected to the Internet. If an IoT device malfunctions, access to this data is often necessary in order to carry out a repair. For this reason, the Data Act now aims to give users, but also third parties, access to this data. At the beginning of this paper, the core of this topic and thus the characteristics of the data economy will be discussed. Furthermore, the controversial legal allocation of data will be discussed. The Data Act, similar to Austrian law, does not aim to create ownership of data. Rather, it somewhat legally assigns data by granting the users of IoT devices a right of access to the data generated by the networked product. The central focus of this paper will therefore be on the data access regulations of Chapter II of the Data Act. First, the material and personal scope of application of the data access provisions (Art. 3, 4, 5 Data Act) will be presented. Chapter II only covers so-called “raw data”. This means that derived data generated by cost-generating algorithms is not covered by the data access regime. Furthermore, the definitions of the obligated parties under the Data Act - producers and data owners - as well as the authorized parties - users and third parties - will be discussed. Subsequently, the basic regulatory system of the Data Act will be made clear by taking a closer look at the individual provisions and their interaction. The disclosure of data can be refused on the grounds of business secrets under Art 4 para 8 Data Act, but it is obvious that other legal provisions, such as data protection law or competition law, may also prevent the disclosure of certain information. The aim of this paper is therefore also to identify possible grounds for refusing access to data. In addition, Art 13 Data Act provides for an abuse control of “unilaterally imposed clauses”. This new concept of clause control is to be contrasted with the existing control of general terms and conditions and, in particular, its classification in Austrian private law is to be shown. Finally, the central research question of this thesis will be answered: What sanctions under private law result from the Data Act in Austria? Similar to the GDPR and the DSA, the Data Act provides for a public law sanction. In contrast, the Data Act has deliberately left private law enforcement untouched. According to Art 38 para 1 Data Act, the affected subject has the right to lodge a complaint with the authority “without prejudice to any other administrative or judicial remedy”. However, it is considered by many that private law sanctions will be necessary for an effective enforcement of the Data Act. Therefore, it is imaginable that sanctions under private law can arise from the principle of effectiveness under EU law. According to another view, these can only arise from national private law. It is conceivable that warranty claims in Austria could arise from §§ 922 ABGB or competition law claims from the UWG.     In cardiovascular mechanics, reaching consensus in simulation results within a physiologically relevant range of parameters is essential for reproducibility purposes. Although currently available benchmarks contain some of the features that cardiac mechanics models typically include, some important modeling aspects are missing. Therefore, we propose a new set of cardiac benchmark problems and solutions for assessing passive and active material behavior, viscous effects, and pericardial boundary condition.     This essay analyzes the complex dimensions of anti-Haitian sentiment and state policies in the Dominican Republic, addressing the central question: How does coloniality sustain anti-Haitianism across socio-cultural, politico-legal, and economic spheres? By focusing on historical and contemporary practices of racialization and economic exploitation, it reveals how Haitian migrants and their descendants are systematically marginalized. Drawing on decolonial theory, the essay demonstrates how colonial legacies and capitalist structures perpetuate racial hierarchies and injustices. Despite the essential role Haitian labor plays in the Dominican economy, it is dehumanized and exploited due to deep-rooted racial prejudices. Anti-Haitianism is not merely a sentiment or a reaction to economic pressures but a state-sanctioned practice that reinforces colonial and racial ideologies. The essay further examines how racialized language and symbolic representations depict Haitians as outsiders and scapegoats for broader social issues. It also analyzes how the denial of Blackness within the dominant construction of Dominican identity affects both Haitian migrants and Black Dominicans, perpetuating a cycle of racial discrimination and socio-economic inequality. Ultimately, it argues that a decolonial perspective is essential for understanding and dismantling the structural inequalities Haitians face in the Dominican Republic, underscoring the need for a more equitable and inclusive approach to racial and economic justice

    Climate change has emerged as one of the most pressing global challenges of the twenty-first century, permeating nearly every form of public discourse and media communication. Everyone is involved in it somehow, and people often take it as a mental burden on them. That is why climate change has become one of the most complex forms and sources of anxiety we face. Every year, environmental scientists present increasingly alarming models of the time humanity has to act to solve the problem. It can be very stressful to hear with little guidance on realizing it, let alone coping with it. Climate-related communication highlights that the younger generations will be left with the hard work of cleaning up the Earth. Even though it is not always explicit, teenagers manifest their ongoing anxieties in a wide range of worries about the planet’s future or their inability to act. My research aims to identify the narrative patterns of climate anxiety among teenagers.Furthermore, this study aims to identify the narrative codes through which adolescents’ underlying state of anxiety is expressed in their experiences and narrative related to climate change and nature. To achieve this, I recorded semi-structured interviews with teenagers aged 15-19. Results show that teenagers with general anxiety use unique narrative patterns to explain their anxiety, sometimes including even climate denial as a coping mechanism
