Benda Budaya Pra-Islam di Kota Kudus: Identifikasi dan Pemaknaan dalam Konteks Sejarah
Abstract
This paper identivication the Kuna Hindu in Kudus pra-Islam the Minaret. Data were qualitative-description by interview, observation, and literature. Result, condition minaret reserve relic Hindu in Kudus Old City (1) renovation colonial era at years of 1880, 1913, 1933 and BPCB Central Java 0f 1980, 2911, 2013, 2014. The condition now don’t original although the shape is still intact. The minaret is damaged because get rained on, weather, vibration due to the car, (2) two gate (kori) in the masque al-Aqsha good condition and intact, (3) Makala/kalla in ablution place. To preserve holy government Kudus need to schedule the city heritage.
Abstrak
Naskah ini ditulis untuk mengidentifikasi jejak Hindu Kuno pra-Islam di Kawasan Kota Lama Kudus, Jawa Tengah. Metode riset ini deskriptif kualitatif dengan mendedahkan dan menganalisis data berupa bangunan kuno berupa Menara, kala/makara, dan gapura kembar (kori) di Masjid al-Aqsha. Riset ini data dari observasi dan kajian pustaka. Hasilnya, benda cagar budaya yang serupa peninggalan Hindu pra-Islam di Kudus (1) Menara direnovasi masa kolonial (1880, 1913, 1933) dan oleh Balai Pelestarian Cagar Budaya (BPCB) Jawa Tengah pada 1980, 2011, 2013, dan 2014. Kondisi Menara tidak lagi genuine bahannya karena direnov dan bentuknya utuh, 80 % hasil renovasi BPCB Jateng. Perenovasian akibat terpaan angin, hujan, panas, dan getaran kendaraan yang melaju di depan Menara, (2) dua gapura (kori) di serambi dan di dalam Masjid kondisinya baik dan utuh, dan (3) kala/makara posisinya ada di tempat wudlu pun utuh. Untuk merawat Kawasan Kota Lama agar lestari, Pemda Kudus perlu merawat dan pencanangan Kota Pusaka.

Penal Policy Cybercrime Artificial Intelligence (AI) Era Society 5.0 Presfektif Fiqih Jinayah dan Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik
Cybercrime is increasing in line with the advancements of the era, triggering the need for legal protection governing the use of Artificial Intelligence (AI). This research aims to develop a penal policy that provides protection for victims of AI-based cybercrime by addressing two main issues: 1) the concept of prohibiting AI-based cybercrime in the Society 5.0 era from the perspective of Fiqh Jinayah and 2) the urgency of penal policies in protecting victims of AI-based cybercrime in this era. Using a qualitative normative approach, the study analyzes legal frameworks, including Law Number 19 of 2016 on Electronic Information and Transactions, and integrates the theories of Penal Policy and Fiqh Jinayah as analytical foundations. The findings reveal that, from the Fiqh Jinayah perspective, AI-based cybercrime is categorized as jarimah, subjecting perpetrators to hudud punishments under Law Number 1 of 2024. Furthermore, the urgency of penal policies lies in strengthening government regulations, requiring official registration of all internet applications through the Ministry of Communication and Information (Kemeninfo). Recommendations include fostering inter-agency collaboration, involving IT experts in mapping hacking threats, and focusing on enhanced cybersecurity measure
Geopolitics of Power Shifts: Analyzing Hay'at Tahrir al-Sham's Victory Over Assad and the Humanitarian Crisis in Syria
This study examines the factors contributing to Hay’at Tahrir al-Sham’s (HTS) military success against the Bashar al-Assad regime and analyzes the subsequent humanitarian governance challenges faced by HTS-led interim authorities in Syria. Employing a qualitative methodology grounded in historical and geopolitical analysis, the research utilizes library-based data to assess: (1) HTS’s effective guerrilla warfare strategies, (2) the impact of external actor involvement (particularly Turkey’s support for HTS versus diminished Russian or Iranian backing for Assad), and (3) the socioeconomic consequences of prolonged conflict. Findings reveal that HTS’s ascendancy stems from tactical military proficiency combined with the Assad regime’s weakening under Western sanctions and reduced support from traditional allies (Russia, Iran, Hezbollah, and the Houthis). However, the group’s political consolidation has exacerbated Syria’s preexisting humanitarian crisis, with interim governance structures proving inadequate to address postwar displacement, infrastructure collapse, and international isolation. The study concludes by emphasizing the urgent need for coordinated international engagement to: (a) mitigate large-scale human suffering, and (b) develop conflict-sensitive governance frameworks that account for Syria’s complex geopolitical realities. These insights contribute to broader discussions on non-state actor transitions to governance and humanitarian management in contested states.

Penelitian ini menggunakan pendekatan kualitatif metode library research dengan kerangka historis dan geopolitik untuk mengeksplorasi strategi militer, pengaruh aktor regional dan internasional, serta tantangan sosial-politik dan krisis kemanusiaan bagi pemerintahan sementara Suriah yang dibentuk HTS. Temuan menunjukkan bahwa keberhasilan HTS disebabkan oleh taktik perang gerilya yang efektif, melemahnya kekuatan rezim Assad akibat sanksi ekonomi Barat, bantuan logistik dan persenjataan militer dari Turkiye untuk HTS, serta berkurangnya dukungan Rusia, Iran dan kelompok non negara seperti; Hizbullah di Lebanon dan Houthi di Yaman yang selama ini menjadi pendukung rezim Assad. Namun, naiknya HTS sebagai pemegang kendali Suriah memiliki konsekuensi besar atas krisis kemanusiaan hasil dari perang saudara berkepanjangan. Penelitian ini menyimpulkan bahwa dunia internasional harus mengadopsi strategi yang lebih efektif untuk menangani tantangan sosial-politik pemerintahan sementara Suriah dibawah HTS dan upaya taktis untuk mengatasi krisis kemanusiaan pasca perang.

Sengketa Penguasaan Hak Atas Tanah: Refleksi Terhadap Sengketa Tanah Antara TNI dan Masyarakat
This study aims to analyze disputes over land rights between the Indonesian National Armed Forces (TNI) and the community and their implications for land policy in Indonesia. This study explores the factors causing disputes, the legal basis used by each party, and potential solutions that can be applied. The methods used were library research and case analysis with a descriptive-qualitative approach. Data was obtained from legal documents, laws and regulations, and court decisions related to land dispute cases. The results showed that land disputes between the TNI and the community are generally caused by overlapping land rights claims, land administration discrepancies, and historical land ownership factors. Dispute resolution often faces legal and social obstacles, requiring more transparent and equitable policies. This study recommends strengthening the land administration system and a mediation approach to resolve conflicts in a sustainable manner
Ketegangan HAM dan Hukum Islam: Menelusuri Akar Masalah
This study aims to explore the root of the tension between human rights and Islamic law. It explores the main sources of disagreement between universal human rights principles and Islamic legal norms, as well as attempts at reconciliation between the two. The method used is library research with a descriptive-analytical approach. The research sources include international legal documents, classical and contemporary Islamic legal literature, and related academic studies. The results of the study show that this tension is rooted in epistemological differences, historical contexts, and legal interpretations that have developed in various Muslim regions. Despite these differences, a number of modern Muslim thinkers have attempted to harmonize human rights and Islamic law. This study emphasizes the importance of constructive dialogue to bridge differences without neglecting the fundamental principles of each legal system
Wali Nikah dan Kebebasan Perempuan: Studi Komparatif Hukum Keluarga Malaysia, Maroko, Tunisia dan Syiria
This study aims to compare the concept of guardian and women's freedom in family law in Malaysia, Morocco, Tunisia, and Syria. The method used is normative juridical research with a comparative law approach through the analysis of marriage laws in the four countries. The results show that Malaysia and Syria still maintain the obligation of a guardian for women, with certain limitations in granting permission. Meanwhile, Morocco provides flexibility by allowing adult women to marry without a guardian, while Tunisia completely abolishes the role of the marriage guardian as a condition of marriage. These differences reflect variations in the interpretation of Islamic law and state policies on women's rights in marriage. This study emphasizes that women's freedom to choose a spouse must maintain a balance between the principles of Islamic law and human rights
Suksesi Kepemimpinan Perspektif Ibn al-Farra'
This study aims to examine the concept of leadership succession from the perspective of Ibn al-Farrā', a classical Islamic political scholar. The method used is qualitative with a descriptive-analytical approach, through a literature review of Ibn al-Farrā's main works, especially Al-Aḥkām al-Sulṭāniyyah, as well as other references that discuss his thoughts. The results of the study show that Ibn al-Farrā' emphasized the importance of sharia legitimacy and political stability in the process of leadership succession. He argued that a leader must have competence, fairness, and the support of the community and scholars. This concept accommodates the principle of religious authority and the political realities of his time. This study emphasizes that Ibn al-Farrā's thinking is still relevant in discussions about the contemporary Islamic leadership system, especially in relation to the mechanisms of election and legitimacy of power
Konsep Kepemimpinan Rumah Tangga: Telaah Atas Pemikiran Asghar Ali Engineer
This study aims to examine the concept of household leadership in the perspective of Asghar Ali Engineer, a progressive Islamic thinker who highlights the issue of gender equality in Islam. Engineer interprets leadership in the household in an egalitarian manner, rejecting patriarchal domination, and emphasizing the principles of deliberation and justice between husband and wife. This study uses a qualitative method with a literature study approach, analyzing Engineer's works and her interpretation of verses from the Qur'an relating to household leadership. The results show that Engineer's concept of household leadership emphasizes cooperation and justice over an authoritative hierarchy. His perspective contributes to the modern discourse on gender roles in Muslim families. This study emphasizes that the interpretation of household leadership in Islam must consider the values of equality and justice in accordance with the spirit of maqashid sharia
Membincang Kembali Praktik Poligami di Indonesia: Telaah Sosiologi Hukum
This study aims to review the practice of polygamy in Indonesia through a sociological legal approach, by highlighting the dynamics between legal norms, social values, and the reality of practice in society. This study uses qualitative methods through literature studies and secondary data analysis, including statutory regulations and polygamous practices in a social context. The results show that although polygamy is strictly regulated in Marriage Law No. 1 of 1974, the practice still takes place with various social, cultural, and religious justifications. There is tension between restrictive positive law and permissive religious interpretation. From the perspective of the sociology of law, polygamy reflects the clash between formal legal norms and social norms of society. This study emphasizes the importance of a critical and holistic approach in formulating policies related to the practice of polygamy in Indonesia
Penyelesaian Sengketa Bidang Ekonomi Melalui Arbitrase dan Alternatif Penyelesaian Sengketa (APS)
This study aims to analyze the application of arbitration and alternative dispute resolution (ADR) in the economic field as an effective and efficient method of dispute resolution. Using a qualitative method with a case study approach, this study examines the practice of arbitration and ADR in resolving economic disputes, both at the national and international levels. The results show that arbitration and ADR can be a faster and more flexible alternative compared to the formal judicial process, but require clear regulations and transparency in their implementation. Another advantage is its ability to reduce the burden on the courts and maintain good relations between the parties in dispute. This study suggests the need for stronger regulations and a broader understanding of arbitration and ADR among economic actors
