    Euthanasia: the right to die between God’s will and the will of a man

    In recent decades, euthanasia has been an extremely current but also controversial issue from a legal, moral, ethical, and religious point of view. Supporters of its legalization emphasize the human right to a dignified death and the need to act humanely and respect the person's desire to choose death over life in suffering and pain. On the other hand, the opponents of euthanasia point out that the right to life, guaranteed and protected by law, basically opposes the legalization of the right to death, which as such does not exist in international legal documents. Also, the more religious opponents point out that God's will is birth, as well as dying, and that any interference in that process is inadmissible. The paper will give a brief overview of the European countries which laws allow some form of euthanasia, and a more detailed overview of the legislation in Belgium, as a country with the most relaxed approach to voluntary euthanasia today, where this practice is extended from physical to mental illness and includes children of all ages and felons. We will give a special overview of the case of Mortier v. Belgium. It is necessary to answer the question whether euthanasia is justified and valid in some cases from the aspect of humanity and compassion, and how these cases should be regulated, especially bearing in mind the proposal to decriminalize euthanasia by the new Civil Code of Serbia, which is currently being drafted

    Савремена правна наука суочава се са изазовима модерног доба. У покушају да одговори на актуелна врло комплексна питања, која су, осим за питања из области права, уско везана и за питања из области медицине, филозофије, психологије и социологије, отварају се биоетичке и моралне дилеме чије правилно разумевање подразумева одређено теолошко знање, будући да су питања живота и смрти основне религијске теме. Савремена биоетичка питања попут вантелесне оплодње, сурогат мајчинства, донације органа и еутаназије, нека су од најактуелнијих и најконтроверзнијих. Суочени са различитим личним биомедицинским дилемама, људи се често обраћају представницима Цркве, који свој одговор дају са аспекта црквене биоетике која се разликује од световне (секуларне) биоетике. Ауторка ће покушати да одговори на питање да ли став Цркве треба (и сме) да се занемари приликом утврђивања законског оквира који се тиче претходно наведених питања или је сарадња државе и Цркве нужнија и неопходнија него икад пре.     Today, at the beginning of the third decade of the 21st century, it is indisputable that football is not only a sport, but also a significant economic activity that brings huge incomes to football clubs, media companies, manufacturers of sports equipment and souvenirs, as well as countries themselves. Football is accepted all over the world, and contains many components in both psychological and social domains, which provokes emotions in both participants and spectators. Today, it is indisputable that it is the sport with the largest number of professionals engaged in it, as well as recreational players, with global popularity and the highest representation in various media. In this way, football has become a social phenomenon that is the most impressive symbol of today's globalization, mostly due to the contribution of new information technologies. Football is not only an industry, but also an instrument for promotion of a country in the world. Cherishing love for sports, especially football, which was instilled in me by my late father, as the author of this book, I wanted to contribute to that sport. Namely, I was aware that I would not be able to do that as a player or a coach, because I had chosen a different calling in life. However, I wanted to connect my professional vocation with my passion. Hence I came up with the idea to try to develop, not only sports law, but particularly football law, as its sub-branch, in our country. I believe that the help of lawyers is beneficial for football professionals in order to enable the creation of an appropriate legal framework for football in Serbia, as well as to promote the further development of football in our country. I will be glad, as is usually the case in science, to provide inspiration and further encouragement to my colleagues to continue to deal with this challenging issue together with me or after my professional and life path, without allowing the once lit torch to football law to be extinguished. In addition, I am guided by a dream. I dream that one day Serbia will win a big trophy in national football competitions. I would more than happy if writing of this book is to contribute just a tiny bit to the achieving that goal

    Misuse of digital assets: current legislation, challenges and recommendations

    In 2020, the Republic of Serbia adopted the Law on Digital Assets (Official Gazette of the Republic of Serbia no. 153/2020). Legal regulation of the issuance, use and circulation of digital assets is present in a very small number of European countries. Although the 2020 European Union Proposal for a Regulation on Markets in Crypto-assets encourages the regulation of the crypto-assets market at the national level of member states, the question can be raised whether the available mechanisms and means are effective enough in preventing the abuse of digital assets and in protecting the integrity of crypto-assets market. Bearing in mind that the international standards in the field of abuse prevention have been adopted recently, while some are still in the process of being established, we start from the assumption that it will be necessary to additionaly improve both legislation and institutional capacities in the mentioned area at the national level. In the first part of the paper, we first point out the emerging forms of abuse of digital assets, and then we will look at the international standards that define potential prevention mechanisms. After that, the legislation of the Republic of Serbia in the field of prevention of abuses related to digital assets and the crypto-assets market will be analysed. Therefore, the method of content analysis and the dogmatic method dominate in this paper. By applying the mentioned methodology, we try to give recommendations for improving the mechanisms of prevention of abuses at the national level

    Pojam elektronskog glasanja označava upotrebu tehnološko-informacionih uređaja u izbornom postupku, bilo da je u kontrolisanom (DRE mašine) ili u nekontrolisanom okruženju, (internet glasanje). Kao takvo, ono je nezaobilazni činilac sve prisutnijeg pojma elektronske demokratije. U radu se, kroz jasno diferenciranje e-uprave i e-demokratije, ukazuje na razliku između digitalizacije političkih izbora i digitalizacije drugih sfera života, ali i nepolitičkih izbora (izbori unutar kompanije, univerziteta i sl.). Razlika se zasniva na važnosti koju ovi izbori imaju za uspostavljanje i legitimizaciju državne vlasti i demokratski karakter političkog sistema. Takođe se analizira praksa redovnih i ustavnih sudova suočenih sa pitanjima informatičke sigurnosti i jednakosti elektronskog glasanja. Autor kritički preispituje tezu da elektronsko glasanje nužno dovodi do veće izlaznosti i time rešavanja problema legitimacijskog deficita u savremenim demokratijama. Oblici elektronskog glasanja, iako nesumnjivo korisni, tretiraju posledice, ali ne i uzrok problema u savremenim demokratskim porecima

    Application of the principle of equality in the process of impact assessment of regulations and public policy documents in the Republic of Serbia

    Impact assessment of regulations and public policy documents is regulated by the Law on the Planning System of the Republic of Serbia and the accompanying Regulation on the Methodology of Public Policy Management, Impact Analysis of Public Policies and Regulations, and the Content of Individual Public Policy Documents. Impact assessment as an analytical process aims to determine the potential negative as well as positive effects that a regulation or a public policy document can cause on certain segments of society. In this paper, the author’s focus is on the social impact assessment in connection with the implementation of the provisions of the Law on Prohibition of Discrimination which introduces the rule that a public authority, when preparing a new regulation or a public policy document of importance for the realization of the rights of socioeconomically disadvantaged persons or groups of persons, makes an impact assessment of their compliance with the principle of equality. This provision introduced by the latest amendments to the Law on Prohibition of Discrimination, as an umbrella antidiscrimination law in the Republic of Serbia, contributes to the development of the human rights impact assessment

    Compliance officers in Serbia: employees or interim managers?

    The first part of the paper analyzes the principle of legality in business and the basic features of the compliance function. Taking into account that the principle of legality in business is one of the core pillars for achieving good corporate governance, having a person who will perform the compliance function is of great significance. The legal position of the compliance officer may be differently regulated, whether as an employee or an outsourced expert. The second part of the paper deals with these two options taking into account the standing practice in the United Kingdom and Germany, where the compliance function has a long tradition. These examples may be challenging for Serbia to follow, since its compliance function is at the very beginning, although having a compliance officer (team) as an employee should be the ultimate objective. In the meantime, the authors propose for Serbian companies to hire compliance officers as interim managers as a solution

    Nivoi pravne borbe protiv nameštanja rezultata fudbalskih utakmica

    Tokom poslednjih nekoliko decenija fudbal više nije samo igra, zabava miliona širom planete, vec nešto više, znacajna privredna aktivnost. Pored mnoštva pozitivnih aspekata usled ovakvog razvoja, postoje i negativni aspekti. Jedan od najvažnijih, ako i ne najvažniji, jeste problem nameštanja, odnosno dogovaranja rezultata fudbalskih utakmica. Ovaj problem je narocito postao akutan, a istovremeno i hronican sa razvojem sportskog klađenja širom sveta. Imajuci to u vidu, mnogobrojni subjekti su svesni važnosti borbe protiv ove pošasti u okviru sporta, a posebno fudbala. Ovim radom se istražuju, nakon postavljanja problema, nivoi pravne borbe protiv nameštanja rezultata fudbalskih utakmica. Ispituju se odgovarajuci instrumenti na nivou međunarodnog javnog prava, pojedinih država, ukljucujuci i Srbiju, te FIFA i UEFA. Na kraju, nude se i odgovarajuci zakljucci. Društvena opravdanost teme se ogleda u pružanju doprinosa izgradnji pravnog okvira kojim ce se zaštititi integritet i cistoca fudbalske igre

    Violence against the elderly and possibilities of prevention

    The elderly represents a particularly vulnerable social group. Due to their cognitive and physical predispositions, they are faced with various limitations and very often become victims of violence. Violence against the elderly is often perpetrated both by family members and employees of institutions for the care and accommodation of the elderly. In this paper, we deal with the phenomenology of this type of violence, as well as the possibilities of its prevention. We start from the assumption that the prevention of violence against the elderly isn’t recognized as one of the priority areas both at the global and national level, and that in the coming period, bearing in mind the accelerated aging of the population, it’s necessary to improve measures for the protection of the elderly, both from violence, as well as from poverty. In this paper, we deal not only with the analysis of the existing international and national legal framework, but also with the analysis of reports on the situation and dominant forms of violence against the elderly, which were carried out in the previous period at the international and level of the Republic of Serbia by different institutions and organizations. The goal of such analysis is to make recommendations for the improvement of various mechanisms for the prevention of violence against the elderly
