    U radu se analiziraju načela opšteg upravnog postupka, opravdanost i svrha njihovog propisivanja, kao i način na koji ona utiču na vođenje upravnog postupka. Predmet rada je i doprinos načela procesnoj regulativi uopšte, uz poređenje današnjeg zakonskog uređenja načela sa načinom na koji su ona bila regulisana pojedinim prethodno važećim zakonima o opštem upravnom postupku. Pritom, naglasak je na onim načelima opšteg upravnog postupka koja su novouvedena, ali i onima koja su izmenjena ili dopunjena u odnosu na ranija zakonska rešenja, ali i jednom koje bi trebalo uvesti u domaće zakonodavstvo. Cilj rada sastoji se u ispitivanju toga da li je postojeći način regulisanja načela adekvatan i pruža li osnov za kvalitetno vođenje upravnog postupka, da li su novine koje je u pogledu načela uveo važeći Zakon o opštem upravnom postupku neophodne i opravdane, kao i odnosa pojedinih načela upravne procedure

    Encrochat and Sky ECC Data as Evidence in Criminal Proceedings in Light of the CJEU Decision

    On April 30, 2024, the cjeu passed a decision in the case M.N. (EncroChat), clarifying some provisions of the Directive 2014/41/EU and indirectly imposing some conditions for the use of EncroChat material as evidence in criminal proceedings before national courts. This ruling is of particular importance as it represents the first ruling by a supranational judicial body related to the EncroChat communication platform. However, it has raised numerous dilemmas regarding its scope, implementation, and effects. The primary aim of this paper is to analyse the conditions imposed by the cjeu, with the goal of demonstrating that they embody fundamental values that should be upheld not only by EU Member States but also by candidate countries, which remain outside the European Investigation Order (eio) system. Special attention is given to the case law of the European Court of Human Rights (ECtHR), given that in matters of criminal law and justice, the EU has historically relied on Council of Europe standards. This paper also seeks to provide legal proposals and practical guidelines for addressing the complex legal issues arising from the widespread use of encrypted communication platforms

    Posledice nedostatka forme ugovora u evropskom pravu i pravima evropskih zemalja

    Predmet rada jeste utvrđivanje pravnih posledica nedostatka forme ugovora u građanskom pravu odabranih nacionalnih pravnih sistema kontinentalne pravne tradicije i u referentnim izvorima evropskog ugovornog prava koji predstavljaju pokušaj harmonizacije ugovornog prava na evropskom nivou, kao što su Principi evropskog ugovornog prava (Principles of European Contract Law – PECL, tzv. Lando principi) i Nacrt zajedničkog referentnog okvira za evropsko privatno pravo (Draft Common Frame of Reference – DCFR). Cilj rada je ukazivanje na raznovrsnost rešenja zastupljenih u srpskom, nemačkom i francuskom pravu, te ukazivanje na pravne i doktrinarne stavove država kojima su evropski izvori ugovornog prava bili naklonjeniji. Radi sveobuhvatne analize, neophodno je uvažiti podelu forme na zakonsku i ugovornu i podelu na formu koja je uslov punovažnosti ugovora (ad solemnitatem) i tzv. dokaznu formu ugovora (ad probationem), i skrenuti pažnju na različitost posledica koja proizlazi iz datih podela. Nijednim od analiziranih instrumenata unifikacija evropskog ugovornog prava nije dosledno sprovedena, i oba su bila pod uticajem rešenja sadržanih u nacionalnim pravnim sistemima, pa se analiza nacionalnih prava evropskih zemalja pokazuje kao korisna za njihovo tumačenje

    Rad pruža opšti osvrt na temu diskriminacije žena na tržištu rada, počev od zasnivanja radnog odnosa, preko napredovanja do prestanka radnog odnosa. Kako je reč o kompleksnoj temi čije proučavanje zahteva dosta prostora, autori rada pokušali su da skrenu pažnju i prikažu osnovne probleme s kojima se žene na tržištu rada susreću i da predlože potencijalna rešenja. Koristeći normativni metod, autori polaze sa stanovišta da nejednakosti na tržištu rada predstavljaju jedan od nivoa rodnih nejednakosti u društvu, i dalje prisutnih pod uticajem rodnih i drugih stereotipa, osnaženih nejednakostima u sferi neplaćenog kućnog rada i brige o porodici. Cilj ovog rada jeste da pruži kratak osvrt na probleme diskriminacije žena u svetu rada, koristeći relevantnu dostupnu literaturu, kao deo koncepta diskriminacije žena u društvu

    Zakon o štrajku Republike Srbije donet je 1996. godine i od tada nije noveliran. Kao takav, odoleo je promenama, iako je u periodu od njegovog donošenja Zakon o radu promenjen tri puta, donet je Ustav sa kojim imenovani zakon nije u saglasnosti i ono najvažnije, država na koju se odnosi Zakon o štrajku Savezna Republika Jugoslavija je više puta promenila državno uređenje i na kraju prestala da postoji u odnosu na vreme donošenja zakona. Čemu onda ovaj zakon duguje svoju postojanost? Autor u radu osvetljava osnove postulate funkcionisanja štrajka, kao jedno od prava iz radnog odnosa, prema postojećem zakonu, neusklađenost sa Ustavom i međunarodnim standardima, kako su ugašene mogućnosti za promenu Zakona u štrajku, kao i šta bi novi normativni okvir mogao da olakša u sprovođenju ovog vida kolektivne akcije za zaposlene. U radu ćemo razmotriti i zakonske tekstove nekadašnjih zemalja koje su činile Jugoslaviju, čija normativna rešenja mogu poslužiti kao putokaz u kreiranju novog zakonodavnog miljea u Srbiji. Osnova hipoteza rada jeste da je postojeći normativni okvir neadekvatan i da postoji potreba za njegovom promenom

    The German model of collective redress in competition law: lessons and recommendations for Serbia

    The right to seek compensation for damages arising from conduct that constitutes a violation of competition rules was introduced relatively early in Serbian law, in 2009, through Article 73 of the Competition Protection Act. However, more than a decade later, no cases have been brought before the domestic courts. This absence of proceedings largely stems from the specific nature of cartel damages, the peculiarities of competition law enforcement, and the absence of an effective collective redress mechanism. The first legislative attempt to provide for such a mechanism in the Civil Procedure Act was declared unconstitutional. Since then, the Serbian market has become increasingly monopolized by the “big players,” leaving consumers and end users with little recourse other than pursuing individual claims against cartels. Such claims, however, face significant obstacles, including difficulties in gathering evidence, quantifying damages, and disproportionate litigation costs relative to the harm suffered. The author argues that, without effective collective redress mechanism, the enforcement of competition law in Serbia cannot be considered fully consistent with EU standards. Germany is used as a benchmark due to its well-developed collective redress framework, which allows the exercise of the right to compensation through the assignment of claims to a qualified entity and represents one of the leading approaches in European practice. In light of the absence of a comparable mechanism in domestic legislation, the author recommends that Serbian courts consider adopting a model of collective redress based on the assignment of multiple claims to a designated body, similar to the German system

    Organ transplantation - Different control Strategies

    Transplantation of human organs and tissues for therapeutic purposes has been practiced since the middle of the last century. It began in a very primitive way back in ancient India (and today one method of transplantation is called the “Indian method”), through the 16th century (1551), when the first free transplantation of part of the nose was performed in Italy, and has developed to this day into an irreplaceable medical procedure aimed at saving and prolonging human life. Thousands of pages of professional literature, notes, polemical discussions, atypical medical articles, notes in the margins of read magazines or books in philosophy, sociology, criminal law literature… even representatives of the church have taken their position on events of this kind. Understanding our view of this complex and very complicated issue requires that certain solutions on the international stage be given greater attention, especially where there are certain overlaps, certain overlaps but also divergences. It is always good to hear a different opinion, because it makes you think. Therefore, in the following considerations, we have tried to answer some of the numerous and diverse questions in which these touch, but often diverge, both from the point of view of real regulations, and from the angle of medical and judicial practice, this time from the perspective of some EU member states (Germany, Poland, also expressing the position of the Catholic Church) on the one hand, and from the perspective of different moral, spiritual, cultural and other values – India and Iraq, on the other

    The Role of Police and Prosecutorial Bodies in Resolving Cases of Domestic Violence: The Example of Serbia

    The phenomenon of domestic violence is present in all countries of the world and all cultures. This problem can be considered a psychological, sociological, philosophical and theological one, but this chapter analyzes its practical side, i.e., the role of the police and law enforcement agencies in Serbia because of their utmost importance in preventing and removing social anomaly. Domestic violence is often analysed as physical violence only. Little attention is paid to other types of violence. The chapters mainly focus on intimate partner violence only. The relevance of the subject comes from the fact that the number of cases, of domestic violence in Serbia, is still on the high level, and this number grows from year to year. Using the comparative law method, it is analyzed the legal and organizational solutions in Serbia in comparison with other parts of the world, especially the EU and the regional countries. Taking into account the research findings that point to organizational weaknesses, it is proposed to improve, the work of the relevant services, especially the police and prosecution authorities

    Technological development in all spheres of human life has contributed to the fact that big data has grown rapidly in the last few years, which brings significant changes in business in practically all industries. Such changes open up new opportunities for development and innovation, but at the same time they also raise questions about ethical behavior in new circumstances. This is particularly significant in terms of privacy and data protection, which presents challenges for legal systems. Consequently, the need for appropriate comprehensive ethical and legal frameworks for the responsible use of big data is growing day by day. With this in mind, the aim of this paper is to examine how ethical and legal frameworks can jointly respond to these challenges. By applying a qualitative methodology - a comprehensive literature review, theoretical analysis and case study analysis with a compilation method - the paper develops an adaptable framework that supports the harmonization of legal norms with technological progress. The result of this research contributes to the understanding of the perspectives of the development of legal systems in the XXI century, which has already largely taken on the characteristics of the digital age, with the aim of building and strengthening trust between organizations and citizens
