Rahn as a Financing Bridge for Business Incubator Tenants: A Case Study on Graduation to Micro and KUR Financing at BSI Ciledug
Business incubator tenants often face limited access to productive financing due to the absence of formal financial records. Under such conditions, Rahn functions as an entry-level liquidity instrument that provides rapid gold-backed funding in compliance with Sharia principles. Nevertheless, the mechanism through which Rahn facilitates graduation to productive schemes such as Micro and KUR financing remains underexplored. This study aims to analyze the role of Rahn in building payment discipline and transaction history, identify key graduation gates, and design a condition-based graduation model grounded in product-contract fit and Sharia governance. A qualitative case study was conducted at BSI Ciledug using semi-structured interviews with branch officials and document analysis of official product guidelines and digital financing manuals. Data were analyzed through thematic coding and source triangulation to ensure validity and analytical rigor. The findings reveal that the graduation process from Rahn to productive financing is condition-based, determined by document completeness, post-Rahn account activity, and branch-level verification. Digital platforms accelerate verification accuracy and transparency, yet human oversight remains essential to uphold Sharia compliance and risk control. The study proposes an audit-ready graduation model that strengthens Sharia financial inclusion and supports the scalability of MSME financing pathways

Conditional Death Penalty in National Criminal Code: Study in Frame of Human Rights and Maqāsid Al-Sharīʿah
Conditional death penalty has become one of the important issues in the Indonesian criminal justice system, especially after the enactment of the national Criminal Code (KUHP). In it, the death penalty is no longer considered a primary punishment, but rather a last resort with certain conditions. This article focuses on the study of the concept of conditional death penalty in the national Criminal Code from the perspective of human rights (HAM) and maqashid as-syariah. From the perspective of human rights, the application of conditional death penalty demonstrates an effort to compromise between the protection of the right to life, which is a essential human right, and the need to provide a deterrent effect against serious criminals. Through conditional regulation, the Criminal Code (KUHP) seeks to bridge the need for law enforcement against serious crimes while still respecting humanitarian values. The probation period granted can serve as a time for introspection for the convicted. This reflects a humanistic approach, that the legal system not only punishes but also gives a second chance. Meanwhile, the application of the death penalty in Islam is very cautious, prioritizing public welfare and preventing greater harm in accordance with the objectives of Islamic law. Conditional death penalty reflects this value, as it provides the convicted person with the opportunity to repent and improve themselves, while still delivering justice to the victim and society.

Agensi Ulama Perempuan Indonesia: Merespon Rumusan Keagamaan Yang Menentang Fatwa Perlindungan Perempuan Dari Bahaya Pemotongan Dan Pelukaan Genitalia
This article examines how female Islamic scholars (ulama perempuan) exercise their agency in responding to the position of the Forum Musyawarah Pondok Pesantren (FMPP) of East Java regarding the fatwa on female circumcision, issued during the Second Religious Congress of the Kongres Ulama Perempuan Indonesia (KUPI) at PP Hasyim Asy’ari, Jepara. Public contestation emerged when the FMPP questioned the KUPI fatwa, referring to classical fatwas of earlier scholars (ulama salaf) that endorsed both male and female circumcision as part of religious tradition. Within its deliberations themed “The Controversy of the KUPI Fatwa,” the FMPP produced conclusions that contradicted the fatwa previously established by KUPI. Employing a socio-anthropological approach, this study investigates the agency of female Islamic scholars as manifested in their public statements and in the construction of narratives concerning the fatwa on female circumcision. The study argues that female ulama, through the KUPI trilogy—ma’ruf (ethical goodness), genuine justice for women, and mubadalah (reciprocity)—which embodies principles of equality and inclusivity, adopt an egalitarian stance in responding to opposing views of the KUPI fatwa. The agency of female ulama is expressed through dialogical and participatory strategies, including community education on the adverse effects of female circumcision, the promotion of gender-just religious interpretations through discussions, tadarus (scriptural study sessions), scholarly forums, and the development of reformative, knowledge-based narratives to elucidate the substantive meaning of the fatwa.
