Unpacking the Debate on Social Protection Floors
No full textSocial protection policies have been adopted by numerous international actors and are embedded in a wide array of policy and legislative instruments. Conceptually, social protection is ambiguous. This is also true of its different embodiments, such as the concept of vulnerability, and the idea of protection floors. This article looks at social protection floors as manifested in a human rights-based approach and in the context of the International Monetary Fund (IMF). The article situates protection floors in the protection of socio-economic rights, and uses that regime as a reference point for examining the materialization of protection floors in IMF policy-making. Against this background, this article revisits two ongoing debates around social protection: the dichotomy between universalism and targeting, and the capacity to induce change. The article calls for a more nuanced debate on protection floors

Reconciling the Irreconcilable? – The Extraterritorial Application of the ECHR and its Interaction With IHL
No full textThis article examines the extraterritorial application of the European Convention on Human Rights (ECHR) during international armed conflict. After a brief discussion of the different historic origins of international human rights law and international humanitarian law (IHL), the article examines the test for establishing jurisdiction under Article 1 of the ECHR. A critical analysis of some contentious legal issues regarding derogations completes the picture of when jurisdiction is established. Subsequently, the article considers the interaction between the ECHR and IHL in international armed conflicts and concludes by arguing that a balance must be found between protecting human rights in international armed conflicts while not interfering unduly with IHL

No full textGegenstand der abgedruckten Falllösung sind die Abhandlung der dinglichen Ansprüche von T gegen A aus Frage eins und zwei. Die Lösung enthält einen Überblick über sämtliche Ansprüche des Mobiliarsachenrechts, lässt jedoch vorgeschaltete Fragen auf Verpflichtungsebene, insb. die Vereinbarung eines Eigentumsvorbehalts, außen vor. Durch Gegenüberstellung der beiden Tatkomplexe (Fragen eins und zwei) können die Unterschiede zwischen rechtsgeschäftlichem und gesetzlichem Eigentumserwerb im Rahmen eines Tankvorgangs an einer Selbstbedienungstankstelle erlernt werden. Aufgrund der Länge wurde auf den Abdruck der Bearbeitung der dritten Frage verzichtet
