Representation of the child’s representative by a substitute and an applicant in court proceedings
No full textTaking into account the new institution of the „child’s representative” introduced into the Polish Family and Guardianship Code, this article discusses the requirements that must be met by a person who wishes to act in court proceedings and proposes a procedure for appointing a lawyer, attorney-at-law, or other entities for this role. The article also examines the possibility for the child’s representative to use a substitute and to be represented by a lawyer’s trainee. The scope of requirements for a person acting as a substitute in court has been characterized. The aim of this article is to answer the question of whether an attorney-at-law or a lawyer acting as a child’s representative in court proceedings can use a substitute and be replaced by a trainee
The institution of the attorney-at-law’s oath in the Polish legal order
No full textThe article presents the results of a study on the institution of the attorney-at-law’s oath. The formal and dogmatic analysis of the relevant statutory and deontological provisions is supplemented by an interpretation of these provisions in judicial practice. As part of comparative remarks, the attorney-at-law’s oath is compared with the regulation of oaths taken by other professional groups, particularly those practicing legal professions. The article discusses various issues, including the concept of the oath, the text of the oath, the date and manner of taking the oath, the consequences of taking or refusing to take the oath, the obligation to remain faithful to the oath, the possibility of concluding the oath’s text with a religious invocation, and the significance of the oath under the Code of Ethics for Attorneys-at-Law. In the author’s opinion, respect for the professional ethos expressed in the text of the oath depends primarily on a reflective approach to the act of taking the oath and the internalization of the values and attitudes it conveys
The church fund in the Polish socio-political dispute after 1989
No full textThe Church Fund is a public institution serving primarily as a compensation to churches and religious associations for property seized during the People’s Republic of Poland. The aim of this text is to analyse the political and social demands related to the functioning, reform and liquidation of the Church Fund that appeared in the public space after 1989. In order to achieve this objective, four fundamental research problems are posed: (1) When and why was the Church Fund established? (2) What is the role of the Church Fund? (3) What social and political expectations of the functioning of the Church Fund are noticeable in Poland after 1989? (4) Why is there an attempt to abolish the Church Fund after 2023? Findings from the research indicate that although the Church Fund plays an important social role, social and political dissatisfaction with the involvement of the Catholic Church in Poland in the current political dispute between 2015 and 2023 has resulted in an increase in the scale and strength of demands calling for the full separation of the state and the Church, including the abolition of the Church Fund
Between the pleasure of the text and the image. The case of Alberto Fuguet
No full textW 1988 roku odbyło się referendum, w którym Chilijczycy zadecydowali o odsunięciu reżimu gen. Pinocheta od władzy. Rok później odbyły się pierwsze od 1970 roku wolne wybory, rozpoczęła się transformacja ustrojowa, stwarzająca miejsce na nowe prądy kulturowe, które w odmienionej rzeczywistości swobodniej mogły się manifestować. Jedną z pierwszych głośnych wówczas propozycji, nazwaną McOndo, stworzył debiutujący w 1990 roku chilijski pisarz i reżyser Alberto Fuguet, ostro atakujący przebrzmiały, jego zdaniem, realizm magiczny w literaturze latynoamerykańskiej i głoszący potrzebę kultury lepiej odpowiadającej otwierającemu się wówczas na świat Chile.
Celem artykułu jest ukazanie, jak Fuguet napełnia swe literackie dzieła kulturą popularną, przede wszystkim filmem, który zostaje zapisany, czy może raczej przerobiony na tekst, ale też, jak umieszcza tekst w swych filmach – nie poprzez strategie adaptacyjne, nie tylko w dialogach czy piosenkach, ale także w sensie typograficznym. Zbadanie napięcia między przyjemnością tekstu a przyjemnością obrazu w twórczości działającego na obu tych polach Fugueta, pozwolić ma przy tym na lepsze zrozumienie zmian kulturowych zachodzących w pejzażu chilijskim (i nie tylko) ostatnich dekad.In 1988, a referendum was held in which Chileans decided to remove General Pinochet’s regime from power. A year later, the first free elections since 1970 were held and the political transition began, making room for new cultural currents to manifest themselves more freely in the changed reality. One of the first high-profile proposals at the time was made by the Chilean writer and director Alberto Fuguet, who made his debut in 1990, sharply attacking magical realism in Latin American literature (which he saw as an outdated) and proclaiming the need for a culture better suited to a Chile at the time of globalization.
The aim of the paper is to show how Fuguet fills his literary works with popular culture, above all with film, which is transcribed or perhaps rather transformed into text, but also how he places text in his films – not through adaptation strategies, not only in dialogues or songs, but also in a typographic sense. Investigating the tension between the pleasure of the text and the pleasure of the image in the work of Fuguet, who is active in both fields, should also allow for a better understanding of the cultural changes taking place in the Chilean landscape (and beyond) in recent decades

W niniejszym artykule zastanawiam się, czy zwrot ku przyjemnym doświadczeniom z obszaru codzienności także może być narzędziem dążenia do zmiany. Jak przekonuję, jest to możliwe dzięki architekturze, która utrwala poczucie lokalnej tożsamości i oferuje doświadczenia wielozmysłowe. Te mogą wpływać na dobrostan i zdrowie społeczeństwa – aspekty, które uważam za konieczne, aby zajmować się zdrowiem środowiska i planety. Swoje rozważania opieram na badaniach z zakresu estetyki codzienności i somaestetyki, a ich praktyczny wymiar ukazuję poprzez analizę i interpretację wybranego projektu – domu w São Paulo. Przypadek ten stanowi inspirację, aby poszukiwać podobnych, ale szerzej dostępnych form architektonicznych. Ostatecznie zarówno on, jak i inne wskazywane realizacje, nie tylko wpływają na multisensoryczną percepcję i dobre samopoczucie, lecz także wykorzystują naturalne materiały i korzystnie wpływają na mikroklimat.Does the quest to reduce architectures negative impact on the climate have to involve “designing for discomfort”? In this text, I consider whether a turn toward pleasurable experiences in the realm of everyday life can also be a tool for pursuing change. As I argue, this is possible through meaningful architecture that perpetuates a sense of local identity andoffers a multi-sensory experience. These can affect the well-being and health of a society – aspects that I believe are necessary to address the health of the environment and the planet. I base my reflections on research in the fields of everyday aesthetics and somaesthetics, and demonstrate their practical dimension through the analysis and interpretation of a selected project. The case in question is a house in São Paulo, which serves as an inspiration to look for similar but more generally accessible architectural forms. In the end, the examples described turn out to have not only features that affect multisensory perception and well-being, but use natural materials and can affect a favorable microclimate
