    Nadzór Komisji Nadzoru Finansowego nad działalnością zarządzających alternatywnymi spółkami inwestycyjnymi

    The aim of the article is to present the issue of the Polish Financial Supervision Authority’s oversight over the activity of the managers of alternative investment funds (AIFMs). The supervision is exercised on the basis of legality criterion and its main goal is to ensure the proper functioning of the capital market. The author classified the supervision instruments by dividing them into preventive supervision instruments and routine supervision instruments. Among routine supervision instruments he distinguished informative and repressive instruments. He then divided repressive instruments into ad rem and in personam instruments. According to the author, as a rule, the least burdensome measures of supervision should be used first, and only when they prove ineffective then should more burdensome measures be used.Celem artykułu jest przedstawienie zagadnienia nadzoru Komisji Nadzoru Finansowego nad działalnością zarządzających alternatywnymi spółkami inwestycyjnymi (ZASI). Nadzór sprawowany jest na podstawie kryterium legalności, a jego nadrzędnym celem jest zapewnienie prawidłowego funkcjonowania rynku kapitałowego. Autor dokonał klasyfikacji środków nadzoru, dzieląc je na środki nadzoru prewencyjnego oraz środki nadzoru bieżącego. Spośród środków nadzoru bieżącego wyróżnił informacyjne oraz represyjne środki nadzoru. Środki represyjne podzielił na środki ad rem oraz środki in personam. Zdaniem autora należy co do zasady w pierwszej kolejności stosować środki nadzoru możliwie najmniej dolegliwe, a dopiero gdy okażą się one nieskuteczne można skorzystać ze środków bardziej uciążliwych

    This study attempts to demonstrate the understanding of the term “the best interests of the child” across international law and through the lens of applicable domestic regulations, with a particular focus on the judicial output of administrative courts. The main goal is to examine whether the lack of legal definition of the term poses a substantial obstacle to applying the children’s rights regulations by the administrative courts, thus lowering the standards of children’s protection.W opracowaniu podjęto próbę ukazania jak pojęcie „dobro dziecka” jest rozumiane w aktach prawa międzynarodowego oraz na gruncie obowiązujących regulacji krajowych, ze szczególnym uwzględnieniem dorobku judykacyjnego sądów administracyjnych.     Burnout in a medical institution, especially in the frontline of medical service and following the difficult time of the SARS-CoV-2 pandemic, is an urgent challenge that leaders need to understand and address directly. The aims of the article are: 1. getting to know the causes of fatigue and burnout as well as the impact they have on a person; 2. defining the role of leadership in creating an organizational culture based on team involvement and promoting the well-being of employees in a medical institution; 3. proposing a strategy for building an atmosphere of mutual support as well as preventing fatigue and burnout. The research method was the review and analysis of professional literature, including articles in international journals and training materials. There are many definitions of the phenomenon of burnout in the literature on the subject. It is a syndrome of emotional exhaustion, depersonalization, and a lowered sense of personal achievement. In the case of healthcare professionals, the depersonalization of patients may initially be expressed in a tendency to avoid patients and shorten the time spent with them.Primary factors influencing the occurrence of burnout are: lack of fairness and mutual respect, unmanageable workloads, lack of role clarity, poor communication or support from the manager, unreasonable time pressures and poor workflows, lack of meaningful connections. Factors that emerged during the pandemic are: growing backlogs, expectations to work outside areas of expertise, and the so-called emotional toll. The key role of leaders is to create a culture of respect and continuous improvement that integrates team members and helps them support one another in the most difficult moments of their professional work. It is extremely important to implement strategies which promote building and maintaining employees’ well-being and resilience to stress. These strategies should be individually developed by people who experience burnout. In medical teams, it is worth considering what the medical staff owes to patients and reassessing their values, building their hierarchy, and rethinking what is real and valuable in life. In order to reach such important conclusions, it is often necessary to discuss difficult and painful matters.Wypalenie zawodowe w placówce medycznej, szczególnie na pierwszej linii świadczenia usługi medycznej i po trudnym czasie pandemii COVID-19, jest pilnym wyzwaniem, które przywódcy powinni zrozumieć i bezpośrednio rozwiązać. Celami artykułu są: 1) poznanie przyczyn oraz wpływu zmęczenia i wypalenia zawodowego na człowieka; 2) określenie roli przywództwa w tworzeniu kultury organizacyjnej opartej na angażowaniu zespołów i promującej dobre samopoczucie pracowników w placówce medycznej oraz 3) zaproponowanie strategii budowania atmosfery wzajemnego wsparcia oraz zapobiegania zmęczeniu i wypaleniu zawodowemu. Metodą badawczą są przegląd i analiza literatury branżowej, w tym artykułów w międzynarodowych czasopismach oraz materiałów ze szkoleń. W literaturze przedmiotu istnieje wiele definicji zjawiska wypalenia zawodowego. Jest to zespół wyczerpania emocjonalnego, depersonalizacji i obniżonego poczucia dokonań osobistych. W przypadku personelu medycznego depersonalizacja pacjentów może początkowo wyrażać się w tendencji do unikania osób chorych i skracania czasu spędzanego z nimi. Czynnikami pierwotnymi wpływającymi na występowanie wypalenia zawodowego są brak uczciwości i wzajemnego szacunku, obciążenia, którymi nie można zarządzać, brak jasności ról, słaba komunikacja lub brak wsparcia ze strony przełożonego, nieuzasadniona presja czasu i brak ludzi do pracy, brak znaczących relacji międzyludzkich. Czynnikami, które pojawiły się w czasie pandemii, są rosnące zaległości, oczekiwanie na oddelegowanie do innej pracy oraz tak zwany koszt emocjonalny. Kluczową rolą liderów na różnych szczeblach w hierarchii jednostki jest tworzenie kultury szacunku i ciągłego doskonalenia, która integruje członków zespołu we wzajemnym wspieraniu się w najtrudniejszych momentach pracy zawodowej. Niezwykle ważne jest wdrażanie strategii promujących budowanie i utrzymywanie dobrego samopoczucia i odporności pracowników na stres. Strategie te powinni indywidualnie do swoich potrzeb tworzyć ludzie, którzy doświadczają syndromu wypalenia. W zespołach medycznych warto zastanowić się, co personel medyczny zawdzięcza pacjentom, i ponownie dokonać oceny wartości, zbudować ich hierarchię i przemyśleć, co w życiu jest prawdziwe i cenne. Aby dojść do tak ważnych wniosków, niejednokrotnie trzeba omówić sprawy trudne i bolesne

    Tożsamość „ławicowa” w filmie „Barwy ochronne” Krzysztofa Zanussiego

    Krzysztof Zanussi’s film Camouflage (Barwy ochronne, 1976) is a portrayal of the academic community and the conformist attitudes of its representatives. The plot takes place during a scientific symposium. The students participating in it are to present short study papers and their lecturers are to choose the best one. Two of the main characters — Jakub Szelestowski, a professor of linguistics, and Krzuszewski, a young assistant — are foregrounded. The first one is a cynical player who manipulates both scientists and students. The second one seems naive and honest, but he turns out to be an act. The two men discuss major ethical issues such as truthfulness, courage, and scholarly ethos. The main reason for this dispute is the course of the competition for the best study paper. The plot of the film reveals a very complex world of intrigue and interests, in which individual people, adopting a conformist attitude, lose their identity. Instead, they assume a collective, shoal-like mentality. They deliberately hide behind it not to expose themselves to threats that could put a stop to their career. The main thesis of this article is that both communism and liberalism lead to nihilism in which people lose their individual identity and assume a collective one that is in constant flux, and thus threatens their freedom

    On Reminding and Forgetting: Care about Moral Responses in the Case of Alzheimer’s Disease

    In this article, caring, remembering and sharing memory are presented as moral responses, the case study being Alzheimer’s disease (AD). Memory connects memories and images, while care connects individuals, which is an ethical issue. When a person’s memory is lost, the care of others becomes the only thread connecting them to the world. AD deprives a person of memories, body control, makes it impossible to remember, communicate, move, recognize the environment, and disrupts consciousness. Caring for a patient with a neurodegenerative brain disease requires constant reminding and reiteration; the presence of a caring person reminds of what the patient themselves can no longer remember. Lost memories do not mean that life or relational values have also lost their meaning. The description of the memory movement emphasizes the importance of repetition in the moral act. Highlighting the matter of care, also in scientific work, is the aim of this text. To care is to remember, on behalf of the AD patient, about the patient’s life. Within bioethical research, moral responses are an important point for projects which seek to improve the condition of patients—not only the condition of health but also the comfort of life. This improvement will not be possible without attentive, committed caregivers and their responsible attitude in the face of the phenomenon of memory loss

    The topic of the article is the confrontation of the vision of surveillance capitalism, as outlined by Shoshana Zuboff in 2019, with Friedrich von Hayek’s neoliberal doctrine. The main research goal is to answer the questions whether Hayek has been rightly accused by Zuboff as being responsible for the rise of this threatening form of capitalism and for his alleged hostility to democracy. Similar objections against Hayek have also been raised by Andrzej Szahaj. This study diagnoses changes of turnover in services structure. The spatial scope covers Central and Eastern European countries, the time range — the years 2015–2021. The article is theoretical and analytical in nature.     Metaphorical Indicators of the Hyperthemes of “Dune: Part One” (2021): A Multimodal Cognitive-Linguistic Case Study

    In Denis Villeneuve’s Dune: Part One, the 2021 film adaptation of Frank Herbert’s seminal science-fiction novel from 1965, the general themes, or “hyperthemes”, of the fi lmic story are often represented metaphorically, by means of more or less transparent textual indicators. The present article explores the metaphorical indicators of three hyperthemes of Villeneuve’s film—(1) “The power hierarchy Spacing Guild > Imperium > Great Houses > Fremen”, (2) “The feuding Great Houses: House Atreides and House Harkonnen”, and (3) “The colonization of Arrakis by the Imperium and Great Houses”—in an analytical framework combining the tenets and tools of multimodal analysis and cognitive linguistics.
