The Impact of the Private Security Industry Regulation Act and other Legislative Frameworks on Private Securities Operating in Drinking Establishments in South Africa
Get PDFThis paper seeks to explore the legislation and regulatory frameworks that guides the functionality and operation of private securities placed in drinking establishments in South Africa. Prior research has indicated lack of clarity regarding private security personnel regulation in drinking establishments, otherwise known as bouncers. For instance, the Private Security Industry Regulatory Authority (PSIRA) is the current regulatory structure which is mandated to monitor and regulate all the private security industries in South Africa. Private security players in South Africa are obligated to comply with the PSIR Act and related laws in general. For this reason, the duty of PSIRA to oversee and monitor private securities and to ensure that they comply with the law is paramount. However, a major concern is whether nightclub security is regulated in adherence to this Act or not. Research evidence has shown that security legislation and guidelines are either not in place or not enforced at nightclubs. The purpose of this article is to examine critical legislations that South African nightclub securities must comply with to ensure legitimacy. Furthermore, it assesses the regulatory body, PSIRA, in relation to South African nightclub securities. It further explores the training requirements needed to qualify as a nightclub security. Arguably, a limited number of studies address the skills and legal requirements nightclub securities need to meet to fully qualify to work as a nightclub security in South Africa. Thus this paper will add to the body of knowledge in the field of nightclub security regulation. Strengthening the regulatory framework and increasing the authority's enforcement capacity to regulate the industry more effectively have become inevitable obligations, especially in light of the continued growth in the private security industry. The article finds that nightclub security is not adequately regulated, leading to non-compliance of the regulatory framework from the private security industry. Abortion Legalization and Child in The Womb Right to Life: A Study from Indonesia
Get PDFBased on the Indonesian legal system, women's reproductive and unborn child's rights to life are equally important. A woman has the right to determine her pregnancy period or even reject her unwanted pregnancy. On one side, legal abortion is part of women's reproductive rights. On the other side, the unborn child's life in the womb is also protected by law. Any attempt to harm the fetus' well-being or deliberately dispose of its life is illegal. Generally, Indonesian are against abortion. However, in specific cases, abortion legalization occurs when the pregnancy becomes harmful and endangering the mother's life. In fact, in certain labor cases, the doctor must do an abortion to save the mother's life. Through Health Act No. 36 of 2009 Article 75, abortion is permitted with emergencies on mothers and rape victims. This paper aims to analyze whether two indications of abortion legalization written on the Health Act are still acceptable from the standpoint of unborn child rights. Evasion Restriction of Customs Payments in the Field of Customs Affairs
Get PDFThe main aim of the study is to analyze the basic problem of evading customs payments, which entails serious financial losses for the state budget. The article seeks to discuss the problematic issues of criminal liability for evading payment of customs duties levied on an organization or an individual, as a type of customs crime. Ways of legislative improvement of criminal law norms and aimed at combating crimes in the field of customs regulation is particular, with evasion of customs duties levied on organizations or individuals at the present stage, are proposed. The article provides an analysis of the criminal law on evasion of customs payments and smuggling, and shows a method for distinguishing related offenses using the example of evasion of customs payments and smuggling. The authors give for us a comparative analysis of the criminal law of the Russian Federation, providing for liability for smuggling and evasion of customs payments, and give the criminal legal qualification of these illegal acts. The characteristics of the elements of smuggling and tax evasion fees charged to the organization or individual are given. Based on the study, the authors draw conclusions about the development and improvement of legislation on tax evasion
The Role of Digital Geography in the Development of Tourism and Tourist Activities

Tourism, as the most susceptible activity to innovations, responds to digital geography by increasing population flows, developing territories, organizing services and leads to an increase in the level of self-organization of activities. Digital technologies are actively penetrating the field of excursions and independent tourism. Mobile audio guides capture the infinite variety of urban space, help young people get involved in the process of developing audio guides, update knowledge of geography, history, culture and form the skill of digital presentation of the knowledge gained. Digital technologies contribute to the intensive development of independent tourism in places inside of the "Infrastructures oecumene ". High rates of inbound tourism are registered in Iceland. Tourism in the form of a family trip by car is largely due to the arrival of digital services for accommodation and meals, car rental. In connection with the development of digital geography in the sphere of tourism, new areas of research are taking shape. The main aim of the study is to investigate the role of digital geography in the development of tourism and tourist activities and attempt to draw some practical and innovative conclusion since the tourism industry has been one of the most lucrative industries over the last decades. Protection Indicator in the Constitutions of the European Federations
Get PDFThe article presents the results of a comparative legal analysis of the constitutions of European federal states (Austria, Belgium, Bosnia and Herzegovina, Germany, and Switzerland) with a view to identifying the norms that minimize human rights risks. The identification of such constitutional provisions is associated with the formalization of the protection of the human rights and freedoms, as well as its legal statuses and conditions. The research was based on a dialectical approach to the disclosure of legal phenomena and processes using general scientific (systematic and logical methods, analysis and synthesis) and specific scientific methods. The unity of the constitutional approach of the European federal states to formalize the judicial protection of the rights and freedoms of the individual (Austria, Belgium, Bosnia and Herzegovina, Germany, Switzerland) has been determined. The identification of such constitutional provisions are associated with the formalization of the protection of the human rights and freedoms, as well as its legal statuses and conditions. The issue statement is because the ethnocultural examination of the Turkic peoples' communicative behavior permits us to look at the ethnos' communicative culture in the modern context and distinguish typical and distinctive characteristics of the Tatar's communicative culture Turkish peoples. This survey investigates the ethnocultural stereotypes of the communicative behavior of the Tatar and Turkish linguistic cultures expressed in the paroemiological fund. The analysis is based on the Tatar and Turkish languages' phraseological and paroemiological units within this article's framework. The research adopted descriptive, stylistic, and comparative techniques. Moreover, The methodological framework is the linguoculturological, cognitive-linguistic aspects of the investigation of paroemiological units. The most substantial typical categories of the Tatars' communicative culture are the culture of communication, politeness, sociability, verbiage, silence, conflict communication, and effective communication. In paroemias, truth is proclaimed before lie, laconicalness before loquacity, silence before speaking, deed before the word, listening before speaking. The examination of stereotypes of communicative behavior reveals that the Tatars persist faithfully to the observance of folk traditions and particular speech cultures
Factors and Determinants of Political Participation of Ethnic Groups
Get PDFThis paper discusses the problem of identifying factors and determinants of the political participation of ethnic groups in politics. Analysis of scientific literature allows us to identify several approaches to solving this problem. Some people view the political participation as an activity by which individuals try to influence the government through ethnic groups so that it takes the actions they want. This impact on the processes of political decision-making and the implementation of political programs related to them. Others believe that the driver of political activity is the need for internal improvement of an individual, when political participation contributes to their full functioning in the life of the state and gives them a sense of involvement in political processes. A comprehensive approach to determining the essence of the political participation of ethnic groups will be justified, according to which the institution of political participation is a multifaceted sociocultural phenomenon that affects many aspects of the socio-political dynamics of modern society. In accordance with this approach, political participation is equally manifested in both democratic and non-democratic political regimes; at the same time, the trigger of political mobilization can be not only the impact of political leaders, but also their own need for people to actively participate in political processes
The Contribution of Social Entrepreneurship to the Development of Human Capital of Students
Get PDFThe article presents the author’s vision of the place and role of social entrepreneurship in the development of the human capital of students. The authors note that the ongoing changes in society and the economy pose the most important task - the study of a phenomenon such as human capital. Training in social entrepreneurship of students can somehow contribute to the formation of the individual human capital of a student to more successfully adapt to the modern labor market. The authors proposed a model of human capital consisting of seven components, which served as the basis for the development and implementation of a modular curriculum in the work of several universities. The article presents a pedagogical experiment on testing a modular program at universities in the South and North Caucasus Federal Districts and evaluates its results. Suggestions were made for the development of an urgent and state-important strategic direction for universities - a focus on the formation of positive human capital for students

There is a gap in understanding this scourge against LGBTIQ. Additionally, there is a dearth of research on GBV within the social work fraternity despite the profession’s mandate to protect vulnerable groups. A comprehensive understanding of this hate crime is critically important in the current times where incidents of violence based on one’s gender are on the rise in South Africa. Social workers are in a privileged position to educate communities about these appalling crimes and to inform inclusive policies to curb this pandemic against members of the homosexual community
Organization of Research Activities as a Factor in Increasing the Efficiency of Training International Students in Host Russian Universities
Get PDFThis article summarizes the practices of organizing research activities that can improve the training of international students in Russian universities. The authors analyzed and identified the correlation between the internal costs of research and development (R&D), the equipment in university research laboratories, and the number of foreigners studying at Russian universities. The authors used the methods of analysis and synthesis and a systematic approach to explore the experience of Russian universities in the training of international students. To identify the impact of internal R&D costs and the equipment of university research laboratories on the number of foreigners studying in Russian universities, the authors applied correlation and regression analysis, which included building a regression equation, calculating the correlation coefficient, the t-test, the coefficient of elasticity, and the coefficient of determination. This research paper revealed a strong correlation between the number of international students in the Russian Federation on the internal R&D costs and the cost of fixed assets and the equipment of Russian universities, which was proven by the calculated correlation coefficients, elasticity coefficients, and determination coefficients. The authors concluded that universities could influence the number of international students. This article proposes some methods for organizing the research activities of international students that increase their academic mobility and form the most relevant scientific and professional competencies. Higher educational institutions of any major can implement these recommendations for managing the research activities of international students. The novelty of this study lies in the fact that the authors performed the correlation and regression analysis and revealed the dependence of the number of international students in the Russian Federation on internal R&D costs, the cost of fixed assets, and the equipment of Russian universities. The authors illustrated the analysis results with the trend predictive values of factorial features and the value of the effective feature estimated according to the regression equations built. Using the calculated MAPE and Forecast Accuracy indicators for these predicted values, the authors concluded that the level of factorial features and the effective feature were predicted with high accuracy. Thus, host Russian universities can increase the number of international students through effective organization of research activities
