    No full text

Reinterpreting marital maintenance: A Maqāṣid al-Sharī’ah study on skincare and cosmetics consumption in Indonesia and Algeria

In Islamic law, research on marital maintenance (nafkah) has traditionally focused on clothing, food, and shelter. In contrast, the role of skincare and cosmetics as part of a wife’s maintenance remains underexplored, especially in a comparative context between Indonesia and Algeria. Prior studies limit nafkah to basic needs, overlooking emerging consumption patterns shaped by health awareness and modern self-care practices. This study addresses this gap by reinterpreting nafkah through the lens of maqāṣid al-sharī’ah and ‘urf, employing a normative-comparative approach. The research examines classical and contemporary fiqh sources, national regulations—including Indonesia’s Marriage Law and Compilation of Islamic Law, and Algeria’s Code de la Famille—and recent socio-cultural dynamics in both countries. Findings suggest that skincare, due to its preventive and health-related functions, aligns with ḥifẓ al-nafs (protection of life/health) and ḥifẓ al-’irḍ (protection of dignity), and thus qualifies as obligatory nafkah bil-ma’rūf. Cosmetics are conditional, required only if they were part of the wife’s pre-marital habits (‘urf khāṣṣ) or requested by the husband, falling under taḥsīniyyāt. Comparative analysis highlights differences in family law orientation: Indonesia tends toward a formalistic approach, whereas Algeria adopts an adaptive framework emphasizing ‘urf through the Maliki school. This study contributes to contemporary Islamic family law discourse by illustrating how consumption culture, gender expectations, and modern health practices intersect with marital obligations

Reconstruction of absolute competence of religious courts in criminal cases of domestic violence in Indonesia

The authority of the religious courts in Indonesia in cases of domestic violence is limited to the civil sphere as grounds for divorce. Conversely, the District Court is responsible for resolving cases with criminal elements. This legal fragmentation prevents victims from obtaining comprehensive justice due to the lengthy and complex legal process. This research highlights the legal gap by analyzing the need for reconstruction of the absolute authority of the religious court to handle the criminal aspects of domestic violence cases. This research is a normative legal statutory and conceptual approach. Analysis of legal materials is done by qualitative methods. The results of this research are legal reconstruction offered in the form of expansion of the absolute competence of the religious court in handling the criminal aspects of domestic violence with the authority to provide protection orders to victims during the judicial process and impose criminal sanctions on perpetrators of domestic violence. The success of this reconstruction, based on the analysis of Soerjono Soekanto's theory of legal effectiveness, depends on harmonizing regulations, increasing law enforcement's competence, providing adequate facilities, increasing public legal literacy, and cultural transformation that supports justice and equality. This legal reconstruction contributes to the efficient resolution of domestic violence cases in line with the principles of judicial power, namely the achievement of simple, fast, and low-cost justice

Introduction: According to the National Survey of Financial Literacy and Inclusion conducted in 2019, the number of Islamic stocks and Islamic capital market assets has increased in Indonesia, but the level of Islamic financial literacy and Islamic capital markets of the Indonesian population is still very low compared to conventional ones. This study aims to determine the effect of Islamic financial literacy and religiosity on investment interest in the Islamic capital market. Methods: This research employed quantitative methods with regression analysis. Data were collected using a questionnaire through Google Forms, resulting in a sample of 203 students in Malang, Indonesia. Results: The results showed that, either partially or simultaneously, Sharia financial literacy and religiosity variables had a significant positive effect on investment intention in the Islamic capital market. Moreover, it had a high coefficient determination of about 0.752, indicating that the financial literacy and religiosity variables can influence the investment intention variable by 75.2%. Conclusion and suggestion: Based on the findings, it was demonstrated that religiosity had a greater impact on the intention to invest in the Islamic capital market compared to Sharia financial literacy. This could be due to the fact that the level of Sharia financial literacy among respondents remains low. Thus, to boost young participation in the Islamic capital market, it is recommended that academic institutions educate young people about Sharia financial literacy through formal education. Also, the businesses could provide informal information about investing in the Islamic capital market

Islamic law in the era of artificial intelligence: A systematic literature review

This systematic literature review examines the intersection between Islamic law and artificial intelligence, aiming to identify how Shariah principles address the ethical, legal, and practical challenges posed by emerging AI technologies. The study applies the PRISMA method to analyze 67 peer-reviewed publications from 2010 to 2025 sourced from central databases. The reviewed literature is catego rized into five core themes: Shariah-aligned AI ethics, AI personhood and legal responsibility, the integration of AI in Islamic finance and judiciary systems, AI-assisted fatwa issuance and ijtihad, and regulatory gaps in aligning AI with maqasid al-shariah. Findings suggest an increasing scholarly engagement with Islamic jurisprudence as a moral compass for technological governance. However, the research also reveals inconsistencies in theological interpretations and a lack of policy frameworks within Muslim jurisdictions. The review concludes that a cohesive Shariah-based framework for AI ethics is both necessary and timely, and it proposes strategic directions for future research and the development of institutional policy
