Legal Consequences of the Auction of the Auction Object Related to the Beneficial Owner of the Auction Object Over the Buyer
A competitive auction consists of a public sale managed by a second manager, where sellers and buyers exchange assets as specified in mutual documents. According to the provisions of Article 38(c) of the Financial Regulation No. 4662; these officials cannot purchase goods directly or indirectly in their presence, in accordance with the Secondary Officials Law No. 189/PMK.06/2017. However, the fact that the legislation does not specify specific conditions regarding the concept of "direct or indirect purchase" causes confusion. This ambiguity raises concerns about abuses such as buy-side consultants participating in money laundering (TPPU). This study examines two important issues: the limitations of the term "buyer" in Section 38(c) and the legal benefits provided to employees associated with the buyer-owner. Remain loyal to the judicial system, use law and techniques to analyse the interpretation of the law. The study ends with the clarification of the scope of the ban and the investigation of the legal consequences of non-compliance with the ban. These findings can form the basis for recommendations to the relevant authorities on resolving legal issues and preventing abuse of the auction process, complying with legislation and ethical rule
Legal Protection for Traditional Market Traders in the Face of Competition with Modern Retailers
Traditional markets play an important role in the Indonesian economy, especially in supporting micro, small and medium enterprises (MSMEs). However, in recent decades, the existence of traditional markets has been increasingly threatened by the expansion of modern retailers that offer more competitive prices, shopping convenience, and attractive promotions. This competitive imbalance raises legal issues related to the protection of traditional market traders so that they can continue to compete fairly. Therefore, this study aims to examine existing legal arrangements and challenges in their implementation to protect traditional market traders. This research uses a normative legal research method, which focuses on analyzing relevant laws and regulations, such as Presidential Regulation No. 112/2007, Law No. 5/1999 on the Prohibition of Monopolistic Practices and Unfair Business Competition, and various Regional Regulations (Perda) that regulate zoning and licensing of modern retail. In addition, this study also examines various concrete cases that reflect the weak implementation of legal protection for traditional market traders. The results show that although regulations have regulated the protection of traditional market traders, their implementation still faces various obstacles, such as weak supervision, lack of sanctions against zoning violations, and lack of support in modernizing traditional markets. Therefore, it is necessary to strengthen policies, improve supervision, and provide incentives for traditional market traders in order to survive in the midst of competition with modern retailers. With more effective legal protection, it is expected that traditional markets can still contribute to the national economy and the welfare of the community

This study investigates the impact of government financial assistance, profit reinvestment, and credit risk management on the long-term survival of Micro, Small, and Medium Enterprises (MSMEs). Given the significant role MSMEs play in economic development, understanding the key determinants of their sustainability is critical. Using data collected from MSME owners and managers through structured questionnaires, the research employed Structural Equation Modeling (SEM) with Smart PLS to test the proposed relationships. Among them, profit reinvestment had the strongest effect, indicating the strategic importance of internal financial planning for sustained growth. The study contributes to the literature by integrating external and internal financial practices as joint predictors of MSME survival and offers practical implications for policymakers and business practitioners. Recommendations include promoting integrated financial support mechanisms and capacity-building programs to improve risk management and reinvestment practices among MSMEs
Criminalization of Lesbian, Gay, Bisexual and Transgender (LGBT) Behavior in Indonesia from the Perspectives of Maqashid Shari'ah and Utilitarianism
This study aims to analyze the formulation of legal regulation for the criminalization of LGBT sexual behaviour in Indonesia through the perspectives of Maqashid Syari'ah and Utilitarianism. In a country with a Muslim-majority population, the LGBT phenomenon frequently raises a conflict between human rights protection and religious values. Using a normative juridical approach, this study examines legislation, legal theories, and relevant secondary data. Findings indicate that there is no explicit national regulation criminalizing LGBT behaviour. The Maqashid Syari'ah perspective emphasizes the protection of five fundamental principles: religion, life, intellect, lineage, and property. Meanwhile, Jeremy Bentham's Utilitarianism asserts that legal policy should maximize societal benefit. The study concludes that integrating these two approaches provides a balanced foundation for criminal policy formulation that upholds moral values and public interest without compromising justice and human rights
Legal Review of the Validity of a Power of Attorney to Sell as an Executorial Guarantee in a Breach of Performance Case : Case Study of Batang District Court Number 64/Pdt.G.S/2022/PN.Btg
The power of attorney to sell is frequently employed as an alternative form of security in debt agreements outside of formal collateral mechanisms. Nonetheless, in practical application, such powers of attorney are often misused and treated as executorial guarantees, leading to legal complications when execution is attempted. This study seeks to assess the legal validity of a power of attorney to sell when used as an executorial guarantee in cases of default, and to evaluate the legal reasoning employed by the judges of the Batang District Court in Decision Number 64/Pdt.G.S/2022/PN.Btg. A normative juridical method was utilized, incorporating a statutory and case-based approach. Data were collected through literature reviews and judicial decision analyses and were examined using qualitative methods. The findings demonstrate that a power of attorney to sell cannot be equated with executorial collateral instruments such as mortgage or fiduciary security, as this contravenes the foundational principles of collateral law in Indonesia. The Batang District Court adjudicated that the said power of attorney lacked executorial force and thus required a civil lawsuit mechanism to execute the sale of the collateral. This judgment aligns with the principles of legal prudence and debtor protection, preventing potential abuse of legal authority. Accordingly, the use of a power of attorney to sell must be contextualized within its proper legal function and should not be construed as a substitute for executorial guarantees

Occupational safety is an important aspect of the work environment, especially in high-risk building operations. This study is expected to provide recommendations for companies, especially shopping centers in Indonesia, to improve occupational safety programs. Increasing occupational safety knowledge and awareness is expected to create zero accidents. This study uses a quantitative approach with a survey research design. The data obtained will be analyzed using the SPSS application. The t-test was conducted to compare the average knowledge and awareness of occupational safety before and after attending a safety briefing. In addition, regression analysis will be used to identify factors that influence the increase in occupational safety knowledge and awareness. This study shows that there is a strong relationship (84%) between the implementation of safety briefings, knowledge, and awareness of K3 in realizing zero accidents in the work environment
