Ideologi Welfare State dalam Dasar Negara Indonesia: Analisis Putusan Mahkamah Konstitusi Terkait Sistem Jaminan Sosial Nasional
Are the objective of Indonesia “promoting the general welfare”, and the fifth principle of Pancasila “social justice for all people of Indonesia”, as well as the constitutional mandate to hold a social security system must be expressed in terms of the state positions itself to be responsible for ensuring a decent standard of living for all citizens? This paper will analyze whether the interpretation of welfare state ideology of the government in the Act No. 40/2004 on National Social Security System had violated the 1945 Constitution. This paper supports the argument of the Constitutional Court holding that social insurance programs adopted by the government meet the constitutional criteria. The existence of the constitutional criteria makesthe welfare state ideology of Indonesia open to interpretation, and this argument is more appropriate to the context and realistic about the ability of Indonesia to provide social security for its citizens
Pemakzulan Presiden/Wakil Presiden Menurut Undang-Undang Dasar 1945
Article 6A (1) of 1945 Constitution regulated that the President and the Vice President of the Republic elected as a pair by direct voting from all citizen. Based on this rule, the position of the President and Vice President is quite powerful, thus almost impossible to be impeached during their term. Prior to the Constitutional Amendment, there is no constitutional article that regulates on the issues and mechanism of Presidential Impeachment. The Third Amendment, which adopted at the 7th Plenary Meeting of the Peoples Consultative Assembly (MPR), November 9th 2001, regulates on the mechanism of Presidential impeachment in the Article 7A which stated, The President and/or Vice President may be dismissed from office by the MPR based on a proposal from the DPR, either when proven guilty of violating the law by betrayal of the state, of corruption, of bribery, of any other felony, or because of disgraceful behaviour, as well as when proven no longer to fulfil the conditions as President and/or Vice President
Hermeneutika Hukum: Prinsip dan Kaidah Interpretasi Hukum
This legal hermeneutic article efforts to explore and formulates norms, rules, principles, standards, and criterions that must be referenced in order to understand, analyze, interpret, and explicate the intention and complexities meaning of legal texts, not only according to literary meaning but also to reveal the whole meaning of pratices and outcome of the legal adjudication. These norms, rules, and principles link to primary or general priciples, attitudes and goodwill of intepreter, aim of interpretation, interest of people, structure of legal system, character and role of interpreter, and how to undestand and treate legal noms as text. This bibliographical study and empiris research article find out the meaning, history, and aplication of legal hermeneutic in practices of adjudication. Status Keistimewaan Daerah Istimewa Yogyakarta dalam Bingkai Demokrasi Berdasarkan Undang-Undang Dasar 1945 (Studi Kasus Pengisian Jabatan Kepala Daerah dan Wakil Kepala Daerah)
Status keistimewaan Provinsi DIY dalam kurun waktu sekian lama lebih sering diinterpretasikan sebagai istimewa dalam hal wilayah yang dulunya berbentuk kerajaan, istimewa dalam pemimpin yaitu dipimpin dwi tunggal dari lingkungan Kasultanan dan Pakualaman, dan istimewa dalam sistem pemerintahannya yang hierarkis patrimonial. Apabila dikelompokkan, pemaknaan keistimewaan Provinsi DIY setidaknya terbelah menjadi 2 (dua) yakni pihak yang pro-pemilihan dan pro-penetapan. Penetapan Sri Sultan Hamengku Buwono sebagai Gubernur dan Sri Paku Alam sebagai Wakil Gubernur Provinsi DIY tidak bertentangan dengan prinsip-prinsip demokrasi menurut UUD 1945 karena dalam Pembukaan UUD 1945, para penyusun UUD 1945 sepakat untuk mengadaptasikan bentuk dan model demokrasi yang sesuai dengan budaya dan corak masyarakat Indonesia yakni demokrasi permusyawaratan berdasar kekeluargaan. Artinya, masyarakat DIY berhak bermufakat secara kekeluargaan mengenai mekanisme yang ingin dipraktikkan, sepanjang mekanisme tersebut dipandang demokratis, dalam arti tidak bertentangan dengan gagasan demokrasi permusyawaratan serta tidak mengabaikan hakikat keistimewaan DIY, termasuk melalui mekanisme penetapan. Dalam hal menentukan kepala daerah DIY, para pengubah UUD 1945 tidak memaknai demokrasi hanya melalui mekanisme pemilihan secara langsung oleh rakyat atau oleh DPRD, melainkan membuka mekanisme lain di luar itu sepanjang mekanisme tersebut dianggap demokratis dan mendapatkan payung hukum dari undang- undang
Konstitusionalitas dan Legalitas Norma dalam Pengujian Undang-Undang Terhadap Undang-Undang Dasar 1945
The Constitutionality of norms are inseparable with the model of judicial review of laws against the 1945 Constitution of the Republic of Indonesia. It can be see from the reviews of abstract and concrete norms by the Constitutional Court of the Republic of Indonesia. The review of conrete norms in the decision of judicial review basically does not constitute authority of the Constitutional Court. Theoretically, norms review should be starting from abstract norms as the implications of the Constitutional Court authority. In order to review the constitutionality of laws, norms and abstract norms should be interpreted by the Constitutional Court. While concrete norms focuse more on the implementation or application of the norm itself. The application of norms cannot be separated from the legality of the norms, while constitutionality of norms is related to its coherence with with the Constitution. If the basis of norms review is the 1945 Constitution of the Republic of Indonesia then abstract norms should be the main subject matter to be reviewed. Otherwise, when concrete norms are the subject matters to be reviewed, then the implementation of the norms that have been applied in concrete cases. This research is using normative juridical method with case approach in which 15 (fifteen) verdicts of the Constitutional Court of Republic of Indonesia over the period of 2003-2013 in judicial review of laws against the 1945 Constitution are analyzed. The focus is on the ratio decidendi of the Constitutional Court judges in determining the constitutionality of norms. The result of this research shows that, the Constitutional Court, in the judicial review of laws against the 1945 Constitution of the Republic of Indonesia does not separate abstract norms and concrete norms dichotomously. In an attempt to protect the constitutional rights of citizens, the absence of legal remedies that can be further pursued by the applicant, as well as to provide legal certainty, the Constitutional Court, granted, in its decision, the review of concrete norms. Even though the Constitutional Court remains firm in satting that it is a concrete norms, the applicant’s petition is granted in part which is concerning the review the abstract norms only. Whereas, with respect to the verdict of the constitutional court that rejected the review of concrete norms, it is because the review is not on the constitutionality of norms but the application of the norms and also concerns a petition for an interlocutory decision which is irrelevant to the subject matter of the case. The review of concrete norms in a rejecting ruling is a form of prudence by the Constitutional Court in order not to prosecute the matters which constitute the authority the other judicial bodies, namely the Supreme Court and the lower courts. As for the ruling which declared a petition inadmissible, the Constitutional Court stated that the applicant has no legal standing and the Constitutional Court does not have the authority to test these norms. In the future the Constitutional Court needs to affirm the status of norms before further examining in depth the petition filed. In addition, the Constitutional Court should be conferred with the authority to hear constitutional complaint and constitutional question in order to create the harmonization of interpretation based on the Constitution

Libel crime is an offence attacking the honor and image of person. There are at least two elements in the libel crime in which a judge has an obligation to prove them, subjective and objective element as well as malice. An offender cannot be blamed for his/her conduct unless he/she commits these elements. In the term of article 27 (3) of electronic transaction and information act no 11 of 2008, its content is still in accordance with the rule of law conception and several articles of Indonesia Constitution of 1945 dealing with some fundamental rights of citizen and the right of freedom to express and to obtain information. State has untitled to make any limitation by prohibiting certain activities attacking the honor and image of person which is based on the same rights of the same freedom
Implikasi Putusan Mahkamah Konstitusi Nomor 101/Puu-VII/2009 terhadap Pelaksanaan Profesi Advokat di Daerah Istimewa Yogyakarta
The research showed that: (1) the response of the lawyers who have not sworn by the high court of Yogyakarta is that the Constitutional Court decision No. 101/PUU-VII/2009 expected to solve the problems KAI advocates, however, the constitutional court decision has not been carried out by competent parties.Recently, the KAI Advocate cannot administering the advocate’s oath in the open court of high court of Yogyakarta (2) the decision of the constitutional court no. No. 101/PUU-VII/2009 was not provide any implications for the organization advocates and implementation of professional lawyers in Yogyakarta, (3) the attitude of judges towards lawyers who are not appointed by the high court in the court’s proceedings, there was no difference attitude compared to the prior existence of the constitutional court decision.Practically, judges allow lawyers who have not sworn to proceed and become a legal counsel at the hearing, the proceedings if the advocate or be accompanied by legal counsel or stuck in a legal advocate and has been sworn in, (4) there was not any action of high court of Yogyakarta as the implementation of the constitutional court decision No. 101/PUU- VII/2009. This is due to the high court of Yogyakarta was not as a party in the constitutional court decision, thus they were not implement the decision
Kewenangan Mahkamah Konstitusi dalam Pemakzulan Presiden dan/atau Wakil Presiden di Indonesia
The idea of impeachment (pemakzulan) towards the incumbent president of Indonesia surfaces recently. This could be the cause of two main grounds. First, regarding the ongoing investigation process of the Century Bank case. In the beginning, the presumption charges merely towards the monetary policy officials and the concerning president’s assistants, but during the further investigations, a number of political parties, in not so vigorously manner pointed the charges to the incumbent presidents because of the indication of responsibility toward the bailout process of Century Bank. Second, the idea of presidential impeachment got its nudge when the Constitutional Court also declaring that its components are ready in processing the impeachment petition, after it has surfaced the Constitutional Court Rule (Peraturan Mahkamah Konstitusi) No. 21/PMK/2009 on the Guidelines in Judicial Procedures in Hearing the Parliamentary Petition in Violation Charges Towards President of the Republic and/or Vice President of the Republic. Third, Presidential and / or Vice Presidential Impeachments has already been occurred in the history of Indonesian nation, namely towards past Indonesian Presidents such as Sukarno, Suharto and KH. Abdurrahman Wahid.This writing attempts to discuss issues regarding presidential impeachment in Indonesia, such as the power of the Constitutional Court in impeachment process, the legal grounds of impeachments, reasons for impeachments and the procedural mechanism of impeachment. Constitutionally, the procedures and mechanism of presidential and / or vice presidential impeachment has been regulated comprehensively in the Constitution of the Republic of Indonesia, specifically in Article 7 B, Article 24 (2), and Article 24 C of the 1945 Constitution after the Third Amendment. Based on these regulations, impeachment is not a simple process, but requires a long process and involving a number of high state institutions, namely People’s Representative Council (DPR), The Constitutional Court, and People Consultative Assembly (MPR). The involvement of the Constitutional Court in the impeachment process can be related toward historical experiences and as a logical consequence of the constitutional transformation of Indonesia. Konsekuensi tanggung jawab peribadi berkaitan dengan tanggung jawab pidana. Menurut Philipus M. Hadjon,117 tanggung jawab jabatan, difokuskan pada legalitas tindakan dengan parameternya peraturan perundang- undangan dan asas-asas umum pemerintahan yang baik. Sedang tanggung jawab pribadi, difokuskan pada perlakuan atau perbuatan tercela dalam konteks tanggung jawab pidana, yakni tanggung jawab atas perbuatan yang tidak patut dilakukan dengan cara melawan hukum, karena itu bertentangan dengan rasa keadilan dan norma- norma sosial yang berlaku dalam kehidupan masyarakat
