    The Effects of Government Regulation and Distinctive Capability on the Cost Leadership Strategy to Drive the Business Performance of Minimarket Chain

    The minimarket competition in Indonesia is very tight and dominated by the two largest minimarket chain, Indomaret and Alfamart. This study aims to examine the effects of government regulation and distinctive capability on the cost leadership strategy and its implications for the business performance of minimarket chain in Indonesia. It is based on empirical gap, not based on theoretical gap. The variables of distinctive capability and cost leadership strategy are relevant to the competitive advantage and sustainability. The method is explanatory survey, and the data is analyzed quantitatively on primary data. The unit of analysis is a minimarket chain in Indonesia. Time horizon is a cross section (one shoot). The populations are all minimarket chain companies in Indonesia which has the same set of characteristics amounted to 20. The analysis design used in this study is Partial Least Square. The coverage of samples under 100 respondents is very valid to use PLS. The results showed that cost leadership strategy dominantly was influenced by ownership of distinctive capability and was supported by government regulation. Cost leadership strategy has the most influence in directly increasing business performance. Government regulation and distinctive strategy can directly improve business performance, but the effect is smaller when compared to indirect effects through the cost leadership strategy. The findings of this study have implications for the management that efforts to improve business performance rely on the development of a cost leadership strategy, which is built on ownership of distinctive capability and adaptation of government regulation. Cost leadership strategy is suitable to be applied in this industry because of its hypercompetitive market structure.     The Influence of Transformational Leadership and Teacher Work Culture on Teacher Performance

    The purpose of this study is to analyze and examine the influence of the principal's transformational leadership on teacher performance, the effect of teacher work culture on teacher performance, and the influence of principal transformational leadership and teacher work culture on teacher performance. This research method is descriptive quantitative. The data collection techniques are observation and questionnaires to 56 teachers/respondents. The data analysis technique is carried out through regression correlation analysis with statistical data processing of SPSS 17.0. The results show that the principal's transformational leadership in SMA Sariwangi District, Tasikmalaya Regency, is in the high criteria. The hypothesis testing results indicate that the principal's transformational leadership has a positive effect on teacher performance. The more effective the transformational leadership of the principal, the more teacher performance increases. Second, the work culture of teachers in SMA Sariwangi District, Tasikmalaya Regency is in high criteria. The results of hypothesis testing indicate that teacher work culture has a positive effect on teacher performance. The higher the work culture of the teacher, the higher the teacher's performance. Third, teachers' performance in SMA Sariwangi District, Tasikmalaya Regency, is generally at high criteria. The hypothesis testing results indicate that the principal's transformational leadership and teacher work culture positively influence teacher performance. It means that the more influential the principal's transformational leadership is and the higher its work culture, the more teacher performance increases

    A Study of Factors Affecting the Performance of Micro, Small, Medium-sized Enterprises in Indonesia

    This research aims to study the factors affecting MSMEs’ performance in the Malang region and investigate the 0.5% final tax regulation role on MSMEs business in 2019. This study is quantitative research. The author conducted a survey shared to four hundred ninety-six MSMEs in Malang city and region and collected 217 questionnaires. Moreover, the author also collected  tax and government regulation, previous research, books, and the internet. This study used Structural Equation Model (SEM) using AMOS 26. The result reveals that entrepreneurial orientation, funding, government policy, and the social and economic aspect affect the MSMEs’ performance. The research shows that government policies are mediating funding in affecting the performance of MSMEs. It also explains explicitly that new tax regulation plays an essential role in enhancing the performance of MSMEs. However, marketing information and external institutions did not affect the performance of MSMEs in the Malang region

    Conducting Teacher Stage Coaching Using SAC Media during pandemic Through Techniques

Especially online learning (online) or online learning during the covid-19 pandemic, has a variety of ineffective opportunities. In addition, the problem of utilization of technology and learning media used in the implementation of learning is not maximal. The media used does not support the implementation of the teacher-selected learning model. Improving the competence and skills of teachers in using the media during the pandemic also needs to get the attention of the principal. In the Project to Improve the competence of prospective principals, the author conducts activities to improve the competence of teachers in the implementation of the learning process, especially the use of media through coaching techniques. Based on the results of the study obtained can be concluded that the use of android-based media, one of which is Smart Aplication Creator (SAC), is able to increase the activities of students in following learning from home, which is implemented during the covid-19 pandemic. This can be seen in five aspects, namely based on observation of the implementation of learning, the effectiveness of media use, the results of activities, student achievements and student wellbeing. In the observation aspect of learning implementation there was an increase from 76.50 to 90.39; from the effectiveness aspect of media use increased from 68.33 to 86.11; from the aspect of the evaluation of activities there was an increase from 74.17 to 90.00; from the student achievement aspect increased from 71.94 to 88.89 and from the student wellbeing aspect increased from 81.84 to 85.59

    This study aims to determine the effect of independent boardof commissioners, institutional ownership, audit committee, profitability, capital intensity, and to determine the effect of company size on tax avoidance. So that the approach used in this research is a quantitative approach with this type of approach, namely explanatory research. The population in this study are all consumer goods companies that have been listed on the Indonesia Stock Exchange (IDX) in 2015-2019 as many as 53 companies. So that the sample used in this study is a non-probability sampling method which is included in the purposive sampling technique. This study produces an analysis which states that the independent board of commissioners and institutional ownership are declared to have no significant effect on Tax Avoidance in consumer goods companies listed on the IDX from 2015-2019. As for the audit committee, profitability, capital intensity, and also company size have a significant effect on tax avoidance in consumer goods companies that have been listed on the IDX for the 2015-2019 period

    Analysis of Fraud in Civil on Agreements Resulting in Default

    This study aims to analyze in-depth the fraud based on Article 1328 of the Civil Code on the agreement that can result in default, as well as to examine the legal consequences of the agreement containing elements of fraud based on Article 1328 of the Civil Code, fraud can be canceled or null and void. The research method used in this research is normative research on the rule of law contained in Article 1328 of the Civil Code. The data used in this study is secondary data. The secondary data used in this study consists of primary legal materials that are authoritative which means they have authority, secondary legal materials, and tertiary legal materials. The results of this study indicate that fraud based on Article 1328 of the Civil Code in the Agreement does not result in Default. Because default and fraud in civil law have different elements. Default is regulated in Article 1243 of the Civil Code, while fraud in civil law is regulated in 1328 of the Civil Code. The consequences of an agreement containing an element of fraud can be canceled or null and void by law. The condition for canceling the agreement is that the agreement to be canceled must be reciprocal, namely an agreement that gives rights and obligations to both parties, cancellation is carried out through the court so that the cancellation of the agreement is through a judge's decision, and there must be a default. An agreement can be canceled as stipulated in article 1321 of the Civil Code, while an agreement that has prohibited things causes the agreement to be null and void, based on Article 1254 of the Civil Code

    This study discusses the spice (clove) trade in Ternate in the XV-XVII centuries by Arab, Chinese, Malay, Javanese, Makassar, Portuguese, Spanish, Dutch and English traders. The importance of clove commodities in Ternate in trading activities makes Ternate one of the international trade networks. This research uses the method of historical science and the study of multiculturalism. The research location is in Ternate City, North Maluku Province. The results showed that Ternate played an essential role in trading activities as a maritime kingdom. The spice route is not just a commodity trading route but also a commercial process that allows the exchange of values and cultures that have helped shape the identity of the Ternate community today. The impact of culture can be found in language, clothing, art, food, and settlements. In other words, the clove trade involving various nations in Ternate also brought together culture
