Penanganan Perkara Menguasai Tanah Tanpa Izin: Studi Putusan Mahkamah Agung Nomor 1091 K/Pdt/2021
Get PDFThis study discusses the land ownership trial between Defendant I, Defendant II, and Defendant III based on the Decision of the Pematang Siantar District Court Number 81/Pdt.G/2019/PN PMS. This dispute gives rise to different interpretations of the validity of the Kotapradja Letter which is used as evidence of land ownership. This study uses a normative legal method with a descriptive analytical nature, a normative approach, and secondary data collected through document studies, analyzed qualitatively. The results of the study indicate that the validity of the Kotapradja Letter is weak because after the enactment of the Basic Agrarian Law (UUPA), all land certificates must be re-registered to obtain strong legality. At the first level, the panel of judges granted the plaintiff's lawsuit based on documentary evidence and witness statements. However, at the appeal level, the defendant succeeded in overturning the initial decision with additional evidence. The case brought to the Supreme Court showed that SHM 326 of 1995 belonging to the plaintiff and SHM 0042 of 1984 belonging to Defendant I were in accordance with the measurement results, so that the land controlled by Defendant I was legally valid. This study emphasizes the importance of legal certainty in maintaining land and the need to verify the legality of documents to prevent ownership conflicts

Get PDFThis study aims to analyze the implementation of provincial roadworthiness based on Governor of North Sumatra Regulation No. 48 of 2023 on the Road Traffic and Transport Safety Action Plan 2024–2028, with a particular focus on the Aek Nabara–Ajamu road segment. The research applies a normative legal method with juridical and conceptual approaches, supported by primary legal materials such as laws and regulations, as well as secondary materials including academic literature and the thoughts of classical and contemporary Islamic scholars. The analysis is conducted qualitatively through systematic interpretation and the integration of maqashid al-shari’ah principles, particularly hifzh al-nafs (protection of life) and hifzh al-mal (protection of property). The findings reveal a significant gap between normative law and empirical conditions, as many provincial roads fail to meet roadworthiness standards. From the administrative law perspective, this situation constitutes a violation of legality and accountability principles, while from the siyasah dusturiyah perspective, it reflects negligence in fulfilling leadership responsibilities
Penguatan Kapasitas Kelompok Sadar Wisata (Pokdarwis) dalam Mengembangkan Ekowisata Berkelanjutan di Kepulauan Kabupaten Mempawah
Get PDFMempawah Regency has abundant marine tourism potential, especially on Datuk, Setinjan, and Temajo Islands, which can be a driver of economic growth for the local community. However, the utilization of this potential is still constrained by the limited managerial capacity of the Jejak Nusa Tourism Awareness Group (Pokdarwis), the lack of supporting facilities, and the weak marketing strategy. The Partnership Community Service (PKM) Activity, funded by the Directorate of Research and Community Service, Directorate General of Research and Development, Ministry of Higher Education, Science, and Technology, aims to strengthen the capacity of Pokdarwis through training, mentoring, and the application of technology and innovation to realize sustainable ecotourism. The implementation method is carried out in a participatory manner through five stages, namely socialization, training, technology application, mentoring and evaluation, and program sustainability planning. Steps include preparing organizational work programs, providing business and financial management training, offering digital marketing assistance through blogs and social media, offering snorkeling facilities and underwater cameras, and facilitating cooperation with the village government and ship owners. The results of the activity showed a significant increase in the aspects of organizational management, finance, and digital marketing of Pokdarwis. Additionally, the presence of new tourism facilities encourages the growth of tourist interest, increases the community's income potential, and fosters social solidarity and environmental awareness. Thus, this program has succeeded in creating an ecotourism-based community empowerment model that supports economic welfare while maintaining the sustainability of marine ecosystems

Kemacetan banyak terjadi di kota-kota besar, Berdasarkan hal ini Dengan diberlakukannya Peraturan Pemerintah Republik Indonesia No. 18 Tahun 2016 tentang Perangkat Daerah dan ditindaklanjuti dengan Peraturan Daerah Kabupaten Sambas No. 4 Tahun 2016 tentang Pembentukan dan Susuna Perangkat Daerah Kabupaten Sambas, serta dengan diterbitkannya Peraturan Bupati Sambas No. 46 Tahun 2016.
Adapun fokus masalah dalam penelitian ini yaitu: Bagaimana implementasi Peraturan Bupati Sambas Nomor 46 Tahun 2016 Terkait Kinerja Kepala Dinas Perhubungan Kabupaten Sambas (Studi di Pasar pagi Desa Jagur Kecamatan sambas), dan apa faktor pendukung dan penghambat Dinas Perhubungan Kabupaten Sambas mengimplementasikan Peraturan Bupati Sambas Nomor 46 Tahun 2016 dalam penertiban terhadap pedagang Kaki Lima yang bertempat di Pasar Pagi Desa Jagur Kecamatan Sambas.
Penelitian ini menggunakan metode penelitian normatif empiris yaitu mengkaji-mengkaji peraturan perundang-undangan pada konteks ini adalah Peraturan Bupati Sambas No. 46 Tahun 2016 tentang keselamatan transportasi, serta melihat kondisi fakta-fakta yang ditemukan dilapangan yaitu di Pemerintah Desa Jagur, Kantor Dinas Perhubungan, Kantor Sat.POL.PP Sambas, dan elemen masyarakat Desa Jagur Kecamatan Sambas. Untuk memperoleh data, peneliti menggunakan pedoman wawancara dan observasi.
Berdasarkan hasil peneliti bahwa Pelaksanaan keselamatan transportasi masih belum maksimal dikarenakan kurang penataan dan pengaturan serta kebijakan yang baik oleh Pemerintah Daerah agar tidak terjadi gangguan dalam bertransportasi sehingga kegiatan pasar dapat berjalan lancar. Kemudian, Khusus pengamanan/keselamatan transportasi menjadi kewenangan instansi yang mengatur lalu lintas yaitu Dinas Perhubungan.Sedangkan faktor-faktor penghambat pertama memang dinas perhubungan melihat kondisi sekarang mereka memang kekurangan tenaga yang dikatakan spesial dalam arti Dinas Perhubungan mempunyai sekolah khusus yang mana DISHUB Sambas hanya mempunyai jatah dua atau 3 orang saja, seharusnya kebutuhan instansi dari DISHUB Sambas yakni lima atau tujuh orang

IMPLEMENTASI MEDIA GAMBAR DALAM MENINGKATKAN KETERAMPILAN MENULIS PADA MATA PELAJARAN BAHASA INDONESIA KELAS II SDN 22 SULUR MEDAN TAHUN PELAJARAN 2024-2025
Get PDFPenelitian ini berawal dari ditemukannya keunikan guru kelas II dalam menggunakan strategi pembelajaran menarik meskipun ditengah keterbatasan sarana dan fasilitas belajar. Tujuan dari penelitian ini adalah untuk mengungkap tentang: (1) Perencanaan guru dalam menggunakan media gambar untuk meningkatkan keterampilan menulis pada mata pelajaran bahasa Indonesia kelas II di SDN 22 Sulur Medan Tahun Pelajaran 2024-2025. (2) Pelaksanaan dalam menggunakan media gambar untuk meningkatkan keterampilan menulis pada mata pelajaran bahasa Indonesia kelas II di SDN 22 Sulur Medan Tahun Pelajaran 2024-2025. (3) Implikasi dari penggunaan media gambar untuk meningkatkan keterampilan menulis pada mata pelajaran bahasa Indonesia kelas II di SDN 22 Sulur Medan Tahun Pelajaran 2024-2025. Penelitian ini menggunakan pendekatan kualitatif dan jenis penelitian deskriptif. Teknik pengumpulan data menggunakan wawancara, observasi, dokumentasi dan tes. Adapun teknik analisis data yang digunakan adalah kondensasi data, display data dan drawing and verifying conclusions. Hasil penelitian menunjukkan bahwa: (1) Perencanaan guru dalam menggunakan media gambar dilakukan melalui penyusunan modul ajar yang mencakup enam komponen utama, yaitu tujuan pembelajaran, materi atau bahan ajar, metode pembelajaran, media pembelajaran, sumber belajar, dan penilaian hasil belajar. (2) Pelaksanaan penggunaan media gambar dilakukan melalui tiga langkah, yaitu menjelaskan sifat dan fungsi objek gambar kepada siswa, memberi kesempatan kepada siswa untuk bertanya, serta meminta siswa menulis kata atau kalimat berdasarkan gambar menggunakan kertas tugas menulis atau LKPD. (3) Implikasi dari penggunaan media gambar menunjukkan adanya peningkatan keterampilan menulis siswa, yang terlihat dari penggunaan huruf kapital dan tanda baca yang tepat, kelengkapan huruf dalam kata, keterbacaan tulisan, serta kesesuaian isi tulisan dengan gambar yang diamati.

Get PDFThe turtle egg trade threatens the existence and population of turtles themselves. Until now, the trade in turtle eggs is still found in Sebubus Village. Turtle protection has been regulated in Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Their Ecosystems. There are two focus problems in this research, namely how to implement turtle conservation on the Belacan River Beach; and what is the effectiveness of article 21 paragraph (2) letter e of Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Ecosystems for the protection of turtles on the Belacan River Beach in Sebubus Village, where to date the theft and trade in turtle eggs is still rampant in Sebubus Village. The type of research is qualitative, namely by collecting data from the field and direct interaction with informants. The approach used is an empirical approach, namely looking at the application of the law based on facts in the field. To obtain research data, researchers used observation and documentation interview techniques. Based on the research results, it was found that the implementation of turtle conservation at Sungai Belacan Beach carried out by the Wahana Bahari Paloh Community Group was very good in reducing the level of turtle egg theft. That the effectiveness of Article 21 Paragraph (2) Letter e of Law Number 5 of 1990 concerning Conservation of Biological Natural Resources and Ecosystems in protecting turtles on Belacan River Beach, Sebubus Village, Paloh District, is still not effective. Research shows that there are still many cases of theft of turtle eggs which cause huge losses to the turtle population. The stolen eggs are then traded illegally. This condition shows that although there are clear regulations prohibiting the collection and trade of turtle eggs, their implementation is less effective in preventing these illegal cases

Get PDFThis community service program aims to foster the development of MSMEs in Sirnabaya Village, Karawang Regency, through the utilization of digital technology. The initiative focused on providing mentorship in the use of TakeApp as a simple and effective online marketing tool. The partner involved in this program was Mrs. Sri, the owner of a home based “nasi kuning” business established in 2022. The activity commenced with a Focus Group Discussion (FGD) at Hall 1 of Karawang University of Public Works, organized by the Management Study Program, to identify the needs of MSMEs. This was followed by a hands-on coaching clinic designed to enable business owners to create accounts and operate the application independently. The mentoring program resulted in improved understanding and digital skills among MSMEs, equipping them to develop new, broader, and more efficient marketing channels suitable for home-based businesses. This activity is expected to enhance MSME competitiveness, expand market reach, and promote technology-driven local economic growth
Analisis Maqāṣid al-sharī’ah dalam Transaksi Jual Beli Ornamen Keagamaan Nonmuslim
Get PDFThis research examines the maqāṣid al-sharī’ah perspective in the context of buying and selling non-Muslim religious ornaments with a contemporary fiqh muamalah approach. The main focus of the research is to analyze the legal aspects, limitations, and implications of the transaction within the framework of maintaining the five fundamental aspects (ḍarūriyyah al-khams). The research methodology uses a qualitative approach with descriptive-normative analysis, combining classical and contemporary literature studies, as well as comparative analysis of scholarly opinions. Primary data is obtained from classical fiqh books, fatwas of contemporary scholars, and documentation related to the practice of buying and selling religious ornaments. Secondary data includes journals, scientific articles, and related research results. The results of the study show that: First, there are variations of scholarly opinions in determining the law of buying and selling non-Muslim religious ornaments. Second, this practice is permissible as long as it does not violate sharia principles, such as supporting activities that are contrary to Islam or harming the ummah. This transaction must maintain maslahat, tolerance and social harmony without obscuring Islamic identity

Using a historical-analytical approach and literature review, the research reveals how knowledge, philosophy, art, and technology from the Islamic world were transmitted to Europe through key channels such as Al-Andalus, trade routes, the Crusades, translation movements, and Islamic educational centers. The findings show that Islamic contributions played a pivotal role in laying the foundation for the Renaissance and the intellectual awakening in the West, despite being frequently overlooked in mainstream historical narratives. This study also emphasizes the need for a fair and inclusive historical reconstruction to fully understand the interconnectedness of Islamic and Western civilizations
