Application of Business Judgement Rule Doctrine in Case Settlement (Case Study of Corruption Crime of PT Asuransi Jiwasraya (Persero))
As is known in Corporate Law, corporate law experts divide 2 (two) major groups of business entity forms, one of which is a legal entity. Included in this group is the Limited Liability Company (PT) The thing that distinguishes between the two types of business entities incorporated and unincorporated lies in the responsibility of the company owner. In relation to practice, business people are more interested in establishing a business entity in the form of a legal entity, namely a Limited Liability Company ("PT"). The reasons why business people are more likely to choose a PT, namely the continuity of a business entity in the form of a PT does not depend on the personalities of the owners but on the capital accumulated, the separation of responsibilities between the company owner and the company, and because PT can be used as a means to move towards a more liberal and open business. In carrying out the management of a PT, the Board of Directors performs its duties with reference to the principle of good faith. In this case, it is actually difficult to distinguish which actions are actually carried out in good faith and which actions are reasonable in carrying out their duties. In relation to its duties and authorities, the management of the Company carried out by the Board of Directors includes running business activities, controlling, and making business decisions that have an impact on the Company, even though these decisions can cause profits or losses
The Effect of Flexible Work System, Workload, Work Ability, Job Satisfaction, Employee Engagement and Work Stress On Employee Performance (Case Study at PT Mecoindo)
This study examines the effect of flexible work systems, workload, work ability, job satisfaction, employee engagement, and job stress on employee performance. The goal is to gain a comprehensive understanding of how these factors interrelate and affect overall employee performance within the organization. This study uses a quantitative survey method approach to collect data from a sample of employees at PT Mecoindo. Quantitative analysis involves statistical techniques such as regression analysis and correlation analysis to explore the relationship between the independent variable (flexible work system, workload, work ability, job satisfaction, employee engagement, and job stress) and the dependent variable (employee performance).
The findings show that flexible work systems positively affect employee performance. In addition, workloads at moderate levels can improve employee performance. Job satisfaction was identified as a significant predictor of employee performance. Employee engagement also emerged as a key factor. On the other hand, high levels of job stress were found to negatively impact employee performance, underscoring the importance of managing stress levels in the workplace
The Influence of Transportation Infrastructure on Community Economic Improvement in Makassar Island, Baubau City
Makassar Island is an island area in Baubau City, Southeast Sulawesi Province which is included in the Kokalukuna District. It consists of two villages, namely Liwuto Village and Sukanayo Village with a land area of 1.04 km2. In general, 70% of the livelihood of residents on Makassar Island is fishing, seaweed farming, pearl oysters, fish marketing businesses, and crossing services (sea taxis). As an island area, the movement of both goods and people within this region is closely related to the infrastructure of docks and highways. This study aims to analyze the influence of transportation infrastructure in improving the economy of the people on Makassar Island. The analysis methods used in this study are Likert analysis, correlation analysis and simple linear regression analysis. Based on the results of the analysis, it was found that transportation infrastructure has a strong relationship with the community's economy. Furthermore, the results of the study are presented in the form of a crosstab between each indicator of the transportation infrastructure variable (X) with the economic variable of the community (Y) on the island
The Encounter of Christianity With The Old Religion of Minahasa
The purpose of this article is to conduct an in-depth analysis of the encounter between Christianity and the old Minahasa religion. The problems related to the revival and re-existence of the old Minahasa beliefs affect the congregation's faith in Minahasa today. The method to solve this problem is qualitative research, which involves collecting scientifically tested literature, such as books and journals, without neglecting field data. Through this discussion, the author offers a new perspective that the old Minahasa religion needs to be studied critically and constructively to highlight its local wisdom to enrich theological efforts in the Evangelical Christian Church in Minahasa. A conclusion that confirms that the goal has been achieved and the problem has been answered. This study concludes that the manguni bird symbolizes the fusion of Christianity and Minahasa old traditions that illustrate the identity of salvation and the church's role as the guardian of truth. Progressivity in Minahasa is not only caused by GMIM or the influence of Protestantism but also by actual theological teachings that affect life attitudes based on the foundation of the Bible and GMIM confession of faith; the Manguni bird as a symbol of GMIM represents religious values, historical, sociological, and anthropological as well as the role of the church in building contextual theology, there is a hereditary call to preserve nature and build Minahasa culture based on biblical teachings with the duty to fellowship and serve amid the diversity of society
Fiduciary in Civil Law and Bankruptcy Law Perspective
The fiduciary gives the creditor the right to pledge his property to the debtor as security for the debt given. In practice, there are often disputes between creditors and debtors related to fiduciaries. This dispute can occur due to various factors, such as the default of the debtor or the bankruptcy of the debtor. The purpose of this study is to identify and analyse the regulation and practice of fiduciaries from the perspective of civil law and bankruptcy law. This study used normative research methods. Data collection techniques are carried out by literature study. The data that has been collected is then analysed in three stages, namely data reduction, data presentation and conclusions. The results showed that fiduciaries, in the perspective of civil law and bankruptcy law, are a type of guarantee provided by fiduciaries to other parties in terms of collateral transactions. Fiduciaries are generally included in the fiduciary guarantee, which is a guarantee received by the party applying for financing to guarantee payments to be made by the fiduciary to the party applying for financing. From a civil law perspective, legal liability is for a fiduciary who transfers or leases the object of a fiduciary guarantee to another party without the written consent of the fiduciary beneficiary. Whereas in the perspective of financial law, a fiduciary assigns or leases the object of fiduciary guarantees to another party without the written consent of the fiduciary recipient
Implementation of the Kirkpatrick Model in Evaluating the Use of Digital Technology in Counseling Guidance Programs at SMP Negeri 1 Matan Hilir Utara
This research aimed to evaluate the Guidance Counseling (BK) service program in the use of digital technology at SMP Negeri 1 Matan Hilir Utara using the Kirkpatrick Evaluation Model. This research method was quantitative with a descriptive approach. Data is technically collected using questionnaire techniques which are the main data source. The subjects in the research were 60 class VIII students who were determined based on a saturated sampling technique where all members of the population were used as research samples. In the context of this research, students act as evaluators or beneficiaries, while the guidance and counseling teachers and school principals are the parties who evaluate the guidance and counseling program services that are implemented. The results of the research show that: 1) At the reaction level, BK services are perceived as showing a scale using digital technology that is on a medium scale with an average of 3.35, 2) At the learning level, BK services in terms of technology use obtain an average of 3. 57 in the high category, 3) At the behavior level with indicators of application of values in the program it is in the medium category with an average of 3.38 in aspects of technology use that need special attention to be optimized, 4) At the results level, students assume that the use of technology is in the medium category with an average of 3.35 which needs to be maximized to improve the quality of the BK program at the research location
The Effect of Principal's Supervision Competency on Improving the Quality of Education in the Driving School Program
This study aims to determine the effect of the principal's supervision competence on improving the quality of education in the driving school program at SMA Se-Jakarta Selatan Region 1, namely SMA Negeri 86 Jakarta, SMA Negeri 109 Jakarta, and SMA Avicenna Jakarta. This study used a quantitative approach, with two variables, namely the competence of the principal's supervision (X) and improving the quality of education (Y) with a sample of 93 respondents. The results of this study show that there is a partial influence between the principal's supervision competence on improving the quality of education positively by a significance level of 0.001 less than 0.05 and a calculated value of 11.058 greater than the value of the 19867 table So that in this study it can be concluded that there is a positive and significant influence between the principal's supervision competence on improving the quality of education
Strategies to Build Customer Trust Based on Service Quality and Relationship Quality: Anchorage Study in Riau Islands
This study examines the potential of anchor services in Riau Islands Province (Kepri), focusing on service quality and customer relationships that can affect the satisfaction of anchor service users. Data from a survey of 100 vessels using anchor berthing services in Kabil Kepri waters shows that the quality of service and customer relationships significantly affect customer satisfaction. The regression analysis results show that service quality and relationship quality simultaneously contribute significantly to customer satisfaction, with the value of the coefficient of determination reaching 68%. Service quality has a more significant influence than relationship quality on customer satisfaction. The implications of this study show that quality service and good customer relations can increase customer satisfaction when using anchor services. The conclusion of this study emphasises the need for a comprehensive strategy to improve service quality and customer relations in anchorage management in Riau Islands waters. Suggestions for further research are further exploration of more representative indicators of service quality and customer relations and increased academic studies in port marketing, primarily related to anchorage objects
The Mediating Role of Positive Emotion in the Nexus of Marketing Strategies and Sustainable Marine Tourism: Study on Coral Reef Conservation Area at Mengiat Beach, Bali
This study investigates the impact of relationship marketing and education-based marketing on sustainable marine tourism, utilizing positive emotion as a mediating factor. Through a quantitative approach and purposive random sampling with 100 respondents, the research underscores the significance of relationship marketing and education-based marketing in shaping positive emotion and its correlation with sustainable marine tourism. Data were collected through questionnaires and analyzed using the Partial Least Square (PLS) method in Smart PLS Version 3.0. Relationship and education-based marketing emerge as critical influencers of positive emotion and contribute positively to sustainable marine tourism. Positive emotion is a crucial mediator, linking emotional experiences to advancing sustainable marine tourism. The study's implications for marketing management emphasize the pivotal role of relationship marketing in cultivating positive customer emotions and its subsequent influence on sustainable marine tourism. Marketing practitioners can leverage these insights by prioritizing personalized engagement strategies and loyalty programs, strengthening emotional connections between tourists and destinations. Integrating educational initiatives, such as partnerships with environmental organizations and awareness campaigns, is essential for promoting marine conservation and sustainable practices. The study emphasizes the necessity of diverse marketing approaches to evoke positive emotional responses, offering practical guidance for marketers to benefit marine conservation efforts and enhance the tourism experience
Comparison of Physical Activity Levels by Sex in Public Elementary Schools and Private Elementary Schools
In the development process of primary school students, physical activity plays an important role in supporting this development. Several factors, including school type and student gender, can cause differences in physical activity levels. This study sought to review how physical activity levels are based on school type and how physical activity levels differ between male and female students in public and private primary schools. This study was conducted in Purwakarta Regency, Wanayasa District, and took a population of 3 public and three private elementary schools, with a sample of 60 people. This type of research is descriptive quantitative and uses the Physical Activity Questionnaire for Older Children (PAQ-C) research instrument. From the results of the study, it is known that public primary schools have better physical activity levels compared to private primary schools. Male and female students in public primary schools have better physical activity levels than private primary school students
