    Law in Indonesian has regulated the procedures for marriage, divorce, and reconciliation in Law No. 1 of 1974 concerning Marriage. And also stated in Law No. 22 of 1946 concerning the Recording of Divorce and Referrals. From the explanation contained in the positive law, it can be seen that the meaning of divorce is the breaking of the marriage ties of a married couple as a result of the failure to carry out the marriage due to several things such as death and court decisions. Divorce in law of Indonesian must be announced before the court. The pronouncement of divorce before the court is a mandate from article 115 of the Compilation of Islamic Law (KHI) which reads “Divorce can only be conducted in front of a Religious Court hearing after the Religious Court has tried and failed to reconcile the two parties.” But in fact, there are still many Indonesian people who do divorce not before the court. Divorce which is done outside the court is very negative, especially for the wife. Divorce is done only by word alone without going through a pledge in front of the court, then the state does not want to recognize the divorce, so that if the wife wants to remarry with another person, then it cannot be done because the wife does not have an official divorce certificate from the court

    A good zakat management requires both professional management and socialization. In 2016 the target achieved by BAZNAS Gresik Regency was 5 billion. This number is still small compared to the potential for compulsory zakat in East Java, which is around 15 trillion. If we look more closely, the muzakki in BAZNAS Gresik Regency are mostly civil servants. This is seen in contrast to the vision of BAZNAS zakat socialization which is aimed at increasing public awareness in general, not only for civil servants. The results of this study are: first, the steps taken by BAZNAS in Gresik Regency in increasing the number of muzakki are to approach the local government; second, the Gresik Regency BAZNAS strategy in increasing the number of muzakki, among others, makes Gresik Regency BAZNAS a reckoned organization, as a zakat service center for a populist community; third, prioritizing the public relations approach by optimizing zakat income and generating ziswaf by installing banners, stickers, online zakat websites, social media, as well as by establishing partnerships with a number of electronic media and conducting counseling/audiences

    Hubungan Antara Partisipasi Masyarakat, Pembentukan Undang-Undang dan Judicial Review

    Community participation in national and state life today is an important study. This is because in a democratic country, public policy cannot be separated from public participation. This study seeks to discuss the relationship between community participation, the making of Act and the implementation of judicial review. The results showed that: (1) Public participation in the making of Act and the implementation of judicial review can: (a) Provide a better basis for public policy making in creating good governance. (b) Increase citizens' trust in the executive and legislative branches. (c) Save human resources, because with the involvement of the community in public policy making, the resources used in public policy socialization can be minimized. (2). Community participation in evaluating Act becomes an important activity, in order to establish control whether an Act is in accordance with its objectives or not. The public can submit a judicial review to the Supreme Court (MA) or the Constitutional Court (MK) if they judge that their rights have been impaired by certain Act. (3). The relationship between community participation and the making of Act and the implementation of judicial review is very close. Without community participation, the Act produced does not reflect the interests of the community and only prioritizes the interests of certain groups. The Constitutional Court (MK) and the Supreme Court (MA) will not conduct a judicial review if there is no request from the public.Partisipasi masyarakat dalam kehidupan berbangsa dan bernegara dewasa ini menjadi kajian penting. Hal ini dikarenakan bahwa dalam negara demokrasi, kebijakan publik tidak bisa dilepaskan dari partisipasi masyarakat. Penelitian ini berusaha membahas hubungan antara partisipasi masyarakat, pembentukan Undang-Undang dan pelaksanaan judicial review. Hasil penelitian menunjukkan bahwa: (1) Partisipasi masyarakat dalam pembentukan Undang-Undang dan pelaksanaan judicial review dapat: (a) Memberikan landasan yang lebih baik untuk pembuatan kebijakan publik dalam menciptakan suatu good governance. (b) Meningkatkan kepercayaan warga kepada eksekutif dan legislatif. (c) Efisiensi sumber daya manusia, sebab dengan keterlibatan masyarakat dalam pembuatan kebijakan publik, maka sumber daya yang digunakan dalam sosialisasi kebijakan publik dapat diminimalisir. (2). Partisipasi masyarakat dalam mengevaluasi Undang-Undang menjadi satu kegiatan penting, demi mengadakan kontrol apakah sebuah Undang-Undang sudah sesuai dengan tujuannya atau belum. Masyarakat dapat mengajukan judicial review kepada MA atau MK apabila merasa haknya dirugikan oleh Undang-Undang tertentu. (3). Hubungan antara partisipasi masyarakat dengan pembentukan Undang-Undang dan pelaksanaan judicial review sangatlah erat. Tanpa partisipasi masyarakat, Undang-Undang yang dihasilkan kurang mencerminkan kepentingan masyarakat dan hanya mengutamakan kepentingan segelintir orang. Adapun MK dan MA tidak akan melakukan judicial review jika tidak ada permintaan dari masyarakat

    This article discusses the practice of wakalah contracts at BMT Amanah with Bojonegoro. This research is field research. Data collection was carried out through interviews, observation, and documentation. The collected data were analyzed deductively. Baitul Mal wat Tamwil (BMT) is a micro institution that is operated on the principle of profit-sharing, growing, and developing micro-business to elevate the degree and dignity and defend the interests of the poor. In the BMT Amanah Bersama, the most frequently used financing is the murabahah contract but still does not rule out other contracts such as the wakalah contract. The wakalah contract at BMT Amanah Bersama does not stand alone, but from the wakalah contract, the BMT can receive income earned through ujrah (fees) which is used as a reciprocal between the BMT institution and the customer so that both are mutually beneficial. Based on this practice, the wakalah contract carried out at BMT Amanah Bersama is by the principles of Islamic law

    This study aims to explore the model of management and development of company waqf assets in Malaysia and Singapore, and their relevance to the development of company waqf construction in accordance with Indonesian waqf law and the wisdom of traditions that have developed. By using an interpretive explorative type qualitative approach, this research resulted in the finding, that the construction of the management model and development of corporate waqf assets in Indonesia in accordance with the context of Indonesian waqf law and traditional wisdom are business entities, banks, universities, foundations, hospitals, cooperative. So as to realize the strengthening of the holistic corporate waqf model in Indonesia, it is necessary to strengthen the regulatory stakeholders as well as an integrative and holistic understanding among scholars.Penelitian ini bertujuan untuk menggali model pengelolaan dan pengembangan aset-aset wakaf perusahaan di Malaysia dan Singapura, serta relevansinya bagi pengembangan konstruksi wakaf perusahaan yang sesuai dengan hukum wakaf Indonesia dan kearifan tradisi yang telah berkembang. Dengan menggunakan metode pendekatan kualitatif tipe eksploratif interpretatif, penelitian ini mengasilkan temuan, bahwa konstruksi model pengelolaan dan pengembangan aset-aset wakaf perusahaan di Indonesia yang sesuai dengan konteks hukum wakaf Indonesia dan kearifan tradisi adalah badan usaha, bank, universitas, yayasan, rumah sakit, koperasi. Sehingga untuk mewujudkan penguatan model wakaf korporasi holistik di Indonesia diperlukan penguatan pada pemangku regulasi sekaligus pemahaman yang integratif dan holistik di kalangan ulama

    The act of terrorism involving children certainly raises its own concerns. How not, if the child is faced with a formal justice process then besides he will lose his independence, he will also lose his future because of stigmatization as a terrorist who is attached for life. However, if the model of diversion through restorative justice is adopted, the legal process will be blocked by the provisions of Article 7 paragraph (2) of Law No. 11 of 2012 concerning the Child Criminal Justice System. Then what is the meeting point between the two? How is this diversion approach in the perspective of Maqashid al-Shari'ah? This article tries to describe the diversion model through a restorative justice approach in the perspective of maqashid al-shari'ah. The type of method used in this study is a qualitative method. The data collection technique used is library research sourced from various literatures such as books, books and journal articles. After the data is collected, an analysis will be carried out using descriptive-analytical methods. This study concludes that restorative justice through a diversion model is in line with the principles of maqashid al-syari'ah, this legal approach aims to help children of terrorists realize, feel and restore humanitarian relations that were damaged between the perpetrators and victims. This is due to the fact that the child of the terrorist is not an actor in the real sense, but he is the real victim of the results of his parents' indoctrination or other parties.Aksi terorisme yang melibatkan anak-anak tentu mengundang keprihatinan tersendiri. Bagaimana tidak, bila anak tersebut dihadapkan pada proses peradilan formil maka selain ia akan kehilangan kemerdekaannya, juga kehilangan masa depannya karena stigmatisasi sebagai pelaku teror yang dilekatkan seumur hidup. Namun bila ditempuh model diversi melalui keadilan restoratif maka dalam proses hukumnya akan terhadang oleh ketentuan Pasal 7 ayat (2) UU No. 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Lalu bagaimanakah titik temu antara keduanya? Bagaimanakah pendekatan diversi ini dalam perspektif Maqâshid al-Syarî?ah? Artikel ini mencoba untuk mendeskripsikan model diversi melalui pendekatan restorative justice dalam perspektif maq?shid al-syarî?ah. Jenis metode yang digunakan dalam penelitian ini adalah metode kualitatif. Teknik pengumpulan data yang digunakan adalah telaah pustaka (library research) yang bersumber dari berbagai literatur seperti buku-buku, kitab dan artikel jurnal. Setelah data terkumpul, akan dilakukan analisis dengan menggunakan metode deskriptif-analitis. Penelitian ini menyimpulkan bahwa keadilan restoratif melalui model diversi selaras dengan prinsip-prinsip maq?shid al-syarî?ah, pendekatan hukum ini bertujuan untuk membantu anak pelaku teror menyadari, merasakan sekaligus memulihkan kembali hubungan kemanusiaan yang sempat rusak antara pelaku dan korban. Hal ini disebabkan pada dasarnya anak pelaku teror bukanlah pelaku dalam arti sebenarnya, namun ia adalah korban sesungguhnya dari hasil indoktrinasi orangtuanya ataupun pihak lain

    This article discusses the juridical analysis of the reasons for the discovery of a fake novum as the basis of a second review in a civil case. This study aims to answer the question of how are the reasons for the discovery of a fake novum as the basis for a second review in a civil case? and how are the legal analysis of a reason for the discovery of a fake novum as a the basis for a second review in a civil case. The reason for receiving the second review in the civil case is based on the discovery of a novum which was declared false by the Criminal Judge of the Bandung District Court that has inkracht, is a reason that falls within the criteria of Article 67 letter (a) which reads: “If the decision is based on a lie or a ruse the opposing party that is known after the case has been decided or based on evidence which is later declared to be false by the criminal judge”, is not classified as a reason for finding novum or the reason there are two conflicting judicial decisions. Secondly, the second review in the pedata and criminal case is only limited to the reason that there are two Judicial Decisions that are interrelated with one another (SEMA Number 10 Year 2009), so in addition to these reasons, the Supreme Court has never issued a policy related to the second mechanism Judicial Review, including on the grounds that a novum has been legally and convincingly found false by a public court

    Abstract: The Sidogiri Integrated Joint Business BMT Cooperative, abbreviated as "Koperasi BMT UGT Sidogiri" began operating on 5 Rabiul Awal 1421 H or 6 June 2000 AD in Surabaya and then obtained a Cooperative Legal entity from the Regional Office of the PK and M Cooperative Office of East Java Province with a decree Number: 09 / BH / KWK.13 / VII / 2000 dated 22 July 2000. There are two products at BMT UGT Sidogiri Waru, namely: financing products and savings products. The mudharabah agreement at BMT Sidogiri is used for savings products consisting of general sharia savings, al-haromain savings, umrah al-hasanah savings, Eid al-Fitr savings, qurban savings, savings from student care institutions, term mudharabah savings, and term mudharabah savings. Based on the analysis of Islamic law, the practice of mudharabah at BMT Sidogiri has fulfilled the pillars and requirements of mudharabah. Customers as shahibul mal and BMT as mudharib, capital, and ratio are also explained in detail in each product, the consent of the qabul is contained in the contract and BMT Sidogiri has the authority to manage customer funds. Produk di BMT UGT Sidogiri Waru ada dua yaitu: produk pembiayaan dan produk simpanan. Akad mudharabah di BMT Sidogiri digunakan pada produk simpanan yang terdiri dari tabungan umum syariah, tabungan haji al-haromain, tabungan umrah al-hasanah, tabungan idul fitri, tabungan qurban, tabungan lembaga peduli siswa, tabungan mudharabah berjangka, dan tabungan mudharabah berjangka plus. Berdasarkan analisis hukum Islam praktik mudharabah di BMT Sidogiri telah memenuhi rukun dan syarat mudharabah. Nasabah sebagai shahibul mal dan BMT sebagai mudharib, modal dan nisbah juga dijelaskan secara rinci di setiap produk, ijab qabul tertuang dalam akad dan BMT Sidogiri memiliki kewenangan mengelola dana nasabah.
