Penyelenggaraan Klinik Pengobatan Alternatif dalam Tinjuan Undang-undang Perlindungan Konsumen
Health is a basic right of the people of Indonesia, as stated in Article 28 (h) of the 1945 Constitution. In practice, efforts to improve the well-being in the health sector are not only exercised in modern ways but also with alternative medicine efforts, by using various kinds of unconventional treatment, both medical and treatment products. This paper aims to find out the pattern of legal relations between the parties in the operation of alternative medical clinics without permission. it is found that the establishment of illegal clinics is against the law No. 8 of 1999, thus subject to administrative sanctions in the form of payment up to Rp. 200,000,000.00 (two hundred million rupiah). Furthermore, the trade law has occurred since the consumer decides to seek alternative treatment so that both parties must exercise their respective rights and obligations. It is suggested that consumers should be vigilant in consulting alternative medicine, and it would be better for the Health administrator to conduct surveillance on alternative medicine businesses

Penerapan Hukuman Mati Bagi Pelaku Tindak Pidana Korupsi
Research on the application of the death penalty for perpetrators of corruption is a research library , with the purpose to find out: first, setting the death penalty in law of corruption; secondly, the application of the death penalty for perpetrators of corruption in a human rights perspective. Primary data were obtained from the legislation, secondary data obtained from the criminal law books, law journals, and legal dictionaries. Data was collected to study the document. The results showed; first, setting the death penalty in the Act eradication of corruption, there is only one article setting that article 2, paragraph (2) In the article explained that the death penalty can be applied to the perpetrators of corruption in " certain circumstances"; secondly, the application of the death penalty for corruptors if only textually examined, then the application of the death penalty is contrary to human rights as dicantukan in Article 28A paragraph (1), 28I (1), in conjunction with Article 4 of Law No. 39 of 1999, in conjunction with Article 3 of the Universal Declaration . However, if examined contextually by using extentif and teleological interpretation, the actual application of the death penalty does not conflict with Human Rights
Konstitusi dalam Praktik Ketatanegaraan di Indonesia
A country has the highest legal norms called the Constitution. Undang-undang Dasar Negara Republik Indonesia Tahun 1945 is a written constitution in Indonesia. The Constitution can be used as an absolute grip in the survival of the society, the nation and the state as it is considered as the political picture. A legal force is demonstrated by the existence of a constitution, therefore it must be obeyed and upheld without the slightest deviation. Through a theoretical approach, this paper discusses the history of the development of Indonesian state administration, mostly about the constitution that was once in force. The author concludes that based on the Indonesian Constitutional history there have been several stages of change in the period of 1945 until now. The New Order's political practices caused trauma to the Indonesian people in the existing constitutional, with the idea coming up to amend the Constitution. Changes to the stages of the Constitution in Indonesia include UUD 1945, UUD RIS, UUDS 1950 and back to UUD 1945 with amendments 4 times and is valid until today. Each of these constitutional stages has a unique constitutional model. After UUD 1945 was amended it was clear that democratic life was growing better. Not only that, the progress in the constitutional system is also getting bigger, especially with the existence of a check and balance format
Penggunaan Jaminan KSK dan Akta Nikah pada Pembiayaan Murabahah Bi al-Wakalah Perspektif Mashlahah al-Mursalah
This is a field research that aims to answer how the practice of using KSK guarantees and marriage contracts in murabahah al-mursalah financing and how to analyze mashlahah al-mursalah on the practice of using these guarantees. In practice at BMT Amana Madina, murabahah financing is equipped with a wakalah contract, in which the BMT represents the customer to make the purchase of the goods themselves and then the contract is carried out with the determination of the cost of purchase and profit margin in accordance with BMT policies accompanied by the use of collateral as a bond of trust between customers and financial institutions in the form of KSK marriage certificates. The aim are embracing customers and increasing economic equity in the middle to the lower economic community with a financing value of IDR 300,000 to IDR 1,500,000. The implementation of murabahah al-wakalah financing at BMT Amana Madina is in accordance with Islamic law because it has fulfilled the requirements contained in the murabahah and wakalah contracts. Regarding the use of KSK guarantees and marriage certificates in the financing, it is included in the muamalah field which does not have arguments that justify or prohibit it, but has many benefits, both for customers and BMT Amanah Madina. The benefits have met the requirements in the use of mashlahah al-mursalah. So that, the use of KSK guarantees and marriage certificates is included in the scope of mashlahah al-mursalah
Implikasi Kriteria Visibilitas Hilal Rekomendasi Jakarta 2017 Terhadap Penanggalan Hijriah di Indonesia
Abstrak: Sabit Bulan Muda (hilal) dipergunakan sebagai acuan dalam berbagai sistem penanggalan Bulan, misalnya penanggalan Hijriah/Islam, Hindu, Yahudi, dan sebagainya. Dalam upaya untuk mewujudkan kesatuan umat dengan kalender yang unifikatif secara global dan meminimalisasi terjadinya perbedaan antar negara dalam pelaksanaan ibadah berdasarkan penentuan awal bulan Hijriah, diusulkan kriteria tunggal yaitu ketinggian hilal minimum 3 derajat dan elongasi minimal 6,4 derajat yang disebut dengan rekomendasi Jakarta. Rekomendasi Jakarta 2017 merupakan kompromi kriteria penanggalan Islam dengan hasil terbaru dari kompilasi data pengamatan hilal yang paling tipis secara empirik. Usulan kriteria baru ini mengkondisikan hilal ke dalam estimasi posisi hilal yang yang lebih tinggi dibandingkan kriteria MABIMS sebelumnya. Dari telaah awal pada penentuan awal bulan hijriah tahun 1440, terdapat perbedaan penentuan antara rekomendasi Jakarta dengan kriteria MABIMS sebanyak 3 bulan yaitu Safar, Jumadil Awal, dan Zulhijjah. Perbedaan tersebut tidak termasuk perbedaan penentuan antara MABIMS dan wujudul hilal sebanyak 2 bulan yaitu Rabiul Akhir, dan Syaban. Telaah ini dapat menggambarkan kemungkinan perbedaan awal penentuan bulan dalam penanggalan Islam akibat adanya beberapa kriteria yang digunakan.

Abstract: Young Crescent (hilal) is used as a reference in various lunar calendar systems, for example the calendar of Hijri / Islam, Hinduism, Judaism, and so on. In an effort to realize the unity of the people with a globally unified calendar and minimize differences between countries in the implementation of worship based on the determination of the beginning of the Hijri month, a single criterion is proposed, namely a minimum hilal height of 3 degrees and a minimum elongation of 6.4 degrees called the Jakarta recommendation. The 2017 Jakarta recommendation is a compromise of Islamic dating criteria with the latest results from the empirical thinnest observation of the hilal observation data. This proposed new criteria conditions the new moon to estimate the new moon position which is higher than the previous MABIMS criteria. From the preliminary study on the determination of the beginning of the Islamic calendar in 1440, there were differences in the determination between the Jakarta recommendations and the MABIMS criteria of 3 months, namely Safar, Jumadil Awal, and Zulhijjah. The difference does not include differences between the determination of MABIMS and wujudul hilal for 2 months, namely Rabiul Akhir, and Syaban. This study can illustrate the possibility of early differences in the determination of the month in the Islamic calendar due to the existence of several criteria used.

Tindakan US yang Melakukan Penadahan Hasil Usaha Perkebunan Ditinjau dari Undang-undang Republik Indonesia Nomor 39 Tahun 2014 Tentang Perkebunan
The objective of the study is to be the partial fulfillment of the requirement for the degree of Bachelor of Law attained from Faculty of Law, University of Surabaya. he purpose of writing this scientific article is to find out and analyze the extent to which Based on Article 111 of the Civil Code Which states that every person who holds the results of plantation Business obtained from looting and/or theft as referred to in article 78 shall be sentenced to a maximum of 7 (seven) years imprisonment and a maximum fine of Rp.7,000,000,000.00 (seven billion rupiahs). This research analyzes the actions taken by the perpetrators (US), namely those who contarct plantation product in terms of law No.39 of 2014 concerning plantation. It can be started that in the case of the United States conducting extraction of plantation product is one form of imposition so that US can be subject to article 111 of law No.39 of 2014 concerning plantation.Tujuan penulisan ini sebagai suatu syarat untuk kelulusan dan mendapatkan gelar Sarjana Hukum di Fakultas Hukum Universitas Surabaya. Tujuan penulisan artikel ilmiah ini adalah untuk mengetahui dan menganalisis sejauh mana Berdasarkan Pasal 111 KUHPidana yang menyatakan bahwa setiap orang yang menadah hasil Usaha Perkebunan yang diperoleh dari penjarahan dan/atau pencurian sebagaimana dimaksud dalam Pasal 78 dipidana dengan pidana penjara paling lama 7(tujuh) tahun dan denda paling banyaj Rp.7.000.000.000,00 (tujuh miliar ruiah). Penelitan ini menganalisis perbuatan yang dilakukan oleh pelaku (US) yaitu yang melakukan penadahan hasil usaha perkebunan ditinjau dari Undang - Undang Nomor 39 Tahun 2014 Tentang Perkebunan. Hal ini dapat dinyatakan bahwa pada kasus US yang melakukan penadahan hasil usaha perkebunan merupakan salah satu bentuk penadahan sehingga US dapat dikenakan pasal 111 Undang – Undang Nomor 39 Tahun 2014 Tentang Perkebunan.

Pandangan Masyarakat Islam Surabaya terhadap Kriminalisasi Nikah Sirri dalam Reformasi Hukum Keluarga di Indonesia
The people who committed unregistered marriage as criminal and penalized by imprisonment has created some problems. Marriage in Islam is considered as worship so it is not supposed to be criminalized. On the other hand, most leaders and figures in Surabaya opprove to criminalize who committed sirri marriage and polygamy as criminal and punished by imprisonment has created as worship so it is not supposed to be criminalized. On the other hand, most leaders and figures in Surabaya approve to criminalize sirri marriage. Furthermore, a husband who refuses to take responsibility, someone who acts as a trustee but entitled to do it and divorce which was not conducted by the judicial court can also be considered as criminal acts.Pelaku perkawinan sirri dipersepsi secara pro dan kontra oleh masyarakat Islam Surabaya. Sebagian menganggapnya sebagai sebuah pelanggaran dengan ancaman pidana penjara karena menimbulkan permaslahan tersendiri. Mengapa menikah yang nota bene merupakan ibadah justru harus dikriminalisasi. Di sisi lain, secara umum para tokoh di Surabaya menyetujui upaya pemerintah untuk mengkriminalisasi pelaku kawin sirri. Selain itu, suami yang menolak untuk bertaqnggungjawab dan seseoerang yang bertindak sebagai wali pada hal ia tidak berhak untuk melakukannya serta perceraian yang dilakukan di luar sidang pengadilan pun dapat dikenakan tindak pidana kriminal.

Supremasi Sistem Peradilan Pidana Anak di Indonesia
The criminal justice system of Juvenile has not have an obvious regulation yet. It neither formulated the legal criminal action of material. The legal formal in Juvenile Criminal Justice System has been interdependently it doubts the certainty of law as well. It does not have an equal perception of paradigm among the legal officers. The judges just consider the civil law system instead of the substantial justice for juveniles. The juvenile justice system in Indonesia does not yet have a clear legal substance, the juvenile justice law and the juvenile justice system do not formulate clear materials, the statutory law in the juvenile justice process still requires interdependence and obscures the value of legal certainty. There has not been a strong perception and equality of paradigms in the circles of legal freedom (Investigators, Public Prosecutors, Judges, Avocados and Implementers of Criminal Decisions in Children's Prison) in the discussion of correct child law. The lack of infrastructure in the juvenile justice process is also a legal problem. Enforcement of juvenile justice is still shackled by the debate on the civil law system which is more oriented to legal certainty over the value of substantive justice. The justice paradigm is still highlighted in the normative juridical aspects of the sociological juridical. The Integrated Criminal Justice System is not going well. Infra structure of children which is still not feasible. There is no clear philosophical foundation in the juvenile justice process
Pemikiran Zainal Abidin Ahmad tentang Konsepsi Negara Islam
Abstract: The discourse between Islam and the State in Indonesia is almost dominated by symbiotic-mutualistic relations. Islam considers State enforcement is one of the means for bringing people closer to Allah Almighty. One of the Indonesian prominent figures of this idea is Zainal Abidin Ahmad of Minangkabau Sumatra, a disciple of Hamka, a politician, a former deputy chairman of the House of Representatives. This paper aims to answer the question of how is the Islamic Conception of State and its Implementation in the Indonesian Territories being adjusted. At the end of the paper it is explained that the Concept of the Islamic State, according to Zainal Abidin shows three basic principles, namely (1) there is a government of the people conducted in consultation (h}uku>mah al-ummah shu>riyah), (2) it has the sources of law (us}u>l al-tashri>’), and (3) there is a demarcation of power in the State’s authority (taqsi>m al-sult}at). Furthermore, based on fiqh siyasah: in the time of the Prophet and al-Khulafa al-Rasyidin, the life of Muslims as a community (nation) is entirely discretional to the rules of the pattern that they will adopt in governing themself. But there is a set of moral and ethical principles and values that should be abided for the well-being of human life
