    Transformasi Mahar Perkawinan Melalui Estetika di Desa Paberasan Kabupaten Sumenep

    One of the essential parts of marriage is the dowry that must be given from the prospective husband to the future wife. Dowry is not included in the pillars of marriage but needs to be delivered to respect the existence of women. This study aims to determine whether the dowry with an aesthetic concept can be affordable? To what extent is the aesthetic limit in the dowry? The research method used in this study is a mixture of library research and field research. In addition to using literature such as books, notes, and several previous studies, this study also collected data through interviews. Giving dowry by carrying out the aesthetic concept, namely using the date of marriage, no prohibition is found. As long as the dowry is affordable and the husband can give it, then it may be done, of course, with due observance, that the dowry does not conflict with the Shari'a. In aesthetics, there are five values, as described by Laurie Schneider Adams, namely: material values, intrinsic values, religious values, nationalism values, and psychological values. The most dominating value in this study is the psychological value because it can bring a reaction of happiness and pleasure to the subject. In the view of psychology, happiness can be created by oneself, and everyone has their parameters for creating happiness for themselves.     Khul' Menurut Imam Syafi'i dan Imam Hanbali: Mencari Relevansinya di Indonesia

    Khul' or divorce requested by a wife is one of the causes marital termination. According to Imam Syafi'i, khul' is a divorce (talak) with an  'iddah of three menstruat cycles. In contrast, for Imam Hanbali, khul' is fasakh in which its 'iddah is one menstrual cycle and its legality does not require a judge's decision. This difference has dissimilar legal implications when it is applied in Indonesia. Therefore, this article aims to seek the both relevancies in the context of Indonesian law, especially under the Compilation of Islamic Law and the nature of the religious practice of Indonesian Muslims. After examining the relevant literature sources, this article shows that, both Imam Syafi'i and Imam Hanbali agree that khul' is like a buy-sell contract, and hence a judge's decision is not required. However these both agremeents are not relevance under the Compilation of Islamic Laws, but the Imam Hanbali's fiqh in which khul' as fasakh would be difficult to seek its relevance. Thus, the fiqh of Imam Syafi'i is more appropriate, since beside it is used as a basis for the Compilation of Islamic Laws the majority of Indonesian Muslims embrace the Syafi’i mazhab

    Hak Asasi Manusia adalah hak-hak kudrati yang melekat dalam diri, sebagai manusia, sejak dilahirkan. Dalam perkembangannya, perlindungan atas hak-hak ini telah disepakati bersama dalam Declaration Universal Of Human Right. Di dalamnya telah diatur standart-standart universal kemanusiaan yang harus ditaati oleh seluruh negara di dunia, atau negara-negata regional dalam hubungannya dengan dokumen regional. Dalam konteks keislaman, ditemukan beberapa ketidaksesuaian dengan Declaration Universal Of Human Right, seperti perbudakan, dan diskriminasi berdasarkan agama dan gender. Hal ini disebabkan karena para para pakar hukum perintis dalam menginterpretasikan sebagian ayat Al-Qur’an dan sunnah tidak mengidentifikasi adanya upaya penghapusan diskriminasi dalam kedua sumber tersebut, sebagaimana ketika menginterpretasikan ayat 47:4. Oleh sebab itu, agar keduanya tetap sejalan, maka An-Na’in berupaya melakukan sebuah trobosan baru untuk pembaharuan hukum hukum Islam dengan caranya radikal. Menurutnya pendekatan yang efektif untuk mencapai pembaharuan yang memadai dan tepat sasaran adalah dengan pendekatan evolusi (nasakh), yang diawali degan menyebutkan sumber Al-Qur’an dan sunnah yang tidak sesuai dengan hak asasi manusia kemudian menjelaskannya dalam konteks historis. Dari sini titik ambivalensi antara HAM dan Syari’ah ditemukan, kemudian dijadikan pisau analisis untuk mencari relevansi dan merekonsiliasi kedua sistem yang awalnya sulit disatukan itu

    In the Indonesian legal aspect, mediation can be applied to all civil cases, even before the judge checks the lawsuit in court, the judge must direct the disputing parties to take part in the mediation session. On the contrary, mediation cannot be applied to criminal cases because it is not regulated in criminal procedural law. In Islamic criminal law, cases that can be resolved through mediation are qisas, diyat and ta`zir. Qisas and diyat known as penalties that have been determined by the nash which violate human rights (individuals) so that victims or their heirs can forgive the perpetrators. To get forgiveness from the victim's heirs, the perpetrator can ask someone, organization or government as a mediator to consult so that the victim's heirs will forgive the perpetrator's mistake. Furthermore, ta’zir is fully handed over to government policy (ulil amri), including the material law and procedural law. The government can make regulations that adopt mediation mechanisms to resolve conflicts that occur in the community

    The authority of a notary in terms of legalization of an underhand agreement, there is an abuse of authority by a notary public to be able to provide legalization directly to everyone who comes before him by entering an identity that is not in accordance with what is stated in the agreement. An underhand deed is a deed made in such a way based on the agreement of the parties and the important thing is that the date in the agreement can be made at any time in accordance with the agreement of the parties, the nature of the agreement is free. The involvement of a notary in legalizing an agreement based on false information, can be subject to Article 55 paragraph (1) of the Criminal Code as an offense for participation. Based on this, it raises several problems, namely the Legalization of the Agreement on the Binding of Purchase by a Notary with Falsification of Identity and the Responsibility of the Notary Criminal in Legalizing the Agreement on the Binding of a Sale and Purchase by a Notary with Falsification of Identity. This research is a legal study, using the statute approach, which is an approach by examining and analyzing legislation, while the types of legal materials, namely Primary Law, Secondary and Tertiary and analyzed by examining the legal issues that occur.   Abstrak: Kewenangan notaris dalam hal legalisasi terhadap perjanjian di bawah tangan, terdapat suatu penyalah gunaan kewenangan oleh oknum notaris untuk dapat memberikan legalisasi secara langsung kepada setiap orang yang datang menghadapnya dengan memasukkan identitas yang tidak sesuai dengan yang tercantum dalam perjanjian tersebut. Akta di bawah tangan merupakan akta yang dibuat sedemikian rupa atas dasar kesepakatan para pihak dan yang penting tanggal dalam perjanjian tersebut dapat dibuat kapan saja sesuai dengan kesepakatan para pihak, yang sifat dari perjanjiannya bebas. Keterlibatan notaris dalam legalisasi perjanjian yang didasarkan pada keterangan palsu, dapat dikenai Pasal 55 ayat (1) KUHP tersebut sebagai delik penyertaan. Berdasarkan hal tersebut menimbulkan beberapa masalah yakni Keabsahan Legalisasi Perjanjian Pengikatan Jual Beli oleh Notaris dengan Pemalsuan Identitas serta Pertanggungjawaban Pidana Notaris dalam Legalisasi Perjanjian Pengikatan Jual Beli oleh Notaris dengan Pemalsuan Identitas.     In examining cases relating to blasphemy, one of challenges is to distinguish between blasphemy and religious freedom. Case Number 69/Pid.B/2012/PN.Spg provides an interesting story about the importance of legal reasoning by judges to distinguish it. This research has the following problem formulation. How do judges use their legal reasoning to distinguish between religious freedom and blasphemy? and how is the legal reasoning viewed from the perspective of Human Rights? By using qualitative research methods, this study finds the following conclusions. As long as the religious opinion does not touch to question the authenticity of something sacred in a religion (such as the Scriptures), it is still safe to say as a difference in interpretation. But when the opinion has been touched to assess the authenticity or falsity of something sacred in a religion (such as the Scriptures), this opinion is vulnerable to be categorized as blasphemy because it can be considered as an expression that deliberately brings hostility or blasphemy against religion. This reasoning is in accordance with the division of two forums on religious freedom, namely the internal and external forums.     Abstrak: Dalam pemeriksaan perkara berkaitan dengan penodaan agama, salah satu tantangan terbesar adalah membedakan antara penodaan agama dengan kebebasan beragama. Perkara Nomor 69/Pid.B/2012/PN.Spg menyediakan cerita yang menarik mengenai pentingnya penalaran hukum oleh hakim untuk membedakan kebebasan beragama dan penodaan agama. Penelitian ini mempunyai rumusan masalah sebagai berikut. Bagaimana hakim menggunakan penalaran hukumnya untuk membedakan antara kebebasan beragama dan penodaan agama? serta bagaimana penalaran hukum tersebut ditinjau dari perspektif Hak Asasi Manusia (HAM)? Dengan menggunakan metode penelitian kualitatif, penelitian ini menemukan kesimpulan sebagai berikut. Sepanjang pendapat keagamaan tersebut tidak sampai menyentuh untuk mempertanyakan keaslian sesuatu yang sakral dalam suatu gama (seperti kitab suci), pendapat keagamaan tersebut masih aman dikatakan sebagai perbedaan penafsiran. Tetapi ketika pendapat tersebut telah menyentuh untuk menilai keaslian atau kepalsuan sesuatu yang sakral dalam agama (seperti Kitab Suci), pendapat ini rentan dikategorikan sebagai penodaan agama karena bisa dianggap sebagai ungkapan yang sengaja membawa permusuhan atau penodaan terhadap agama. Penalaran seperti ini sesuai dengan pembagian dua forum kebebasan beragama, yakni forum internum dan eksternum

    Regional Regulation (Perda) of Surabaya No. 6 of 2011 concerning the Implementation of Child Protection. It contains provisions regarding children and their obligations, the implementation of child protection, and the obligations of parents, families, communities, and local governments towards them including child labor in informal sector work, community, and private sector participation, Child-Friendly City Task Force, prohibition, guidance and supervision as well as administrative, investigative, and criminal sanctions. The implementation of Regional Regulation related to child protection in Surabaya City, by Regulation No. 6 of 2011 is in accordance with maqasid al-shari'ah based on the five main elements which are the objectives of the legal designation, even though in the regional regulation, hifz al-din and hifz al-mal get a smaller portion of the setting and a different degree of clarity than the other three components. Therefore, there must be a balanced aspect of five legal objectives in the regional regulation of child protection to work optimally. Apart from that, there should also be clearer regulations, especially regarding the protection of religion and children's property so as not to create different interpretations from policy implementers and other interested parties

    Pelayanan Publik Pada Dinas Kependudukan dan Pencatatan Sipil di Kabupaten Lamongan Dalam Perspektif Fikih Siyasah

    This article discusses public services at the Population and Civil Registration Service (Dispendukcapil) Lamongan according to Fiqh Siyasah. This research is field research and is qualitative in nature. Data were collected through observation, interviews, and documentation. The collected data were analyzed by the deductive method. The result of the research shows that public services in the Dispendukcapil Lamongan are related to administrative services, which include population services (KTP, KK, Transfer Certificate) and civil registration services (birth certificates, death certificates, marriage certificates, divorce certificates, child validation certificates). Even though the Dispendukcapil Lamongan has made efforts to improve services, there are still complaints from the public in several services, both from service attitudes and facilities, including in the queuing system and waiting room facilities. In the fiqh siyasah perspective, the public services provided by the Dispendukcapil Lamongan are part of the fiqh siyasah idariyyah (administrative management fiqh). In serving the people, a state employee must be trustworthy, honest, and fair. The service must be based on benefit as the rule of tasharruf al-imam ala al-raiyyah manut bi al mashlahah (Public service must be based on maslahat). Based on this, it is hoped that the Dispendukcapil Lamongan will further improve the quality of services, facilities, and infrastructure.   Abstrak: Artikel ini membahas tentang Pelayanan Publik pada Dinas Kependudukan dan Pencatatan Sipil (Dispendukcapil) Lamongan menurut Fikih Siyasah. Penelitian ini adalah Penelitian lapangan dan bersifat kualitatif. Data dikumpulkan melalui observasi, wawancara dan dokumentasi. Data yang terkumpul dianalisis dengan metode deduktif. Hasil penelitian adalah pelayanan publik di Dispendukcapil Lamongan adalah berkaitan dengan pelayanan administrasi yaitu meliputi pelayanan kependudukan (KTP, KK, Surat Keterangan Pindah) dan pelayanan pencatatan sipil (Akta Kelahiran, Akta Kematian, Akta Perkawinan, Akta Perceraian, Akta pengesahan anak). Meskipun Dispendukcapil Kabupaten Lamongan telah berusaha meningkatkan pelayanan, masih terdapat keluhan masyarakat dalam beberapa pelayanan baik dari sikap pelayanan maupun fasilitas, di antaranya dalam sistem antrian dan fasilitas ruang tunggu. Dalam perspektif fikih siyasah, pelayanan publik yang diberikan Dispendukcapil Kabupaten Lamongan merupakan bagian dari fikih siyasah idariyyah (fikih pengelolaan administrasi). Dalam melayani rakyat, seorang pegawai negara harus amanah, jujur dan adil. Pelayanan tersebut harus didasarkan pada kemaslahatan sebagaimana kaidah tasharruf al-imam ala al-raiyyah manut bi al mashlahah (Pelayanan publik harus didasarkan pada maslahat).     This paper aims to determine the views of Judge PA Pasuruan about the punishment of Sirri marital offenders in the Marriage Law Draft Bill on Marriage, which will then be analyzed with the theory of mas} lah} ah mursalah. At the end of the paper, it was concluded that, first, the Judges of the Pasuruan Religious Court mostly agreed on the punishment for the perpetrators of marriages sirrî in article 143 of the Draft Law of the Religious Courts in the field of Marriage, because there were too many negative impacts caused by marriagesirrî, such as the recognition of civil rights. wife, is not considered a legitimate wife and is not entitled to gonogini assets in the event of separation. The basic consideration of the judge of the Pasuruan Religious Court agreed to the punishment for the perpetrators of marital sirrî, namely by using the concept of mas} lah} ah mursalah which is something that is good according to reason with consideration of realizing good or avoiding evil for humans, what according to reason is also in harmony and in line with the objectives syara 'in establishing the law. The punishment for the perpetrators of the marriage of sirrî is solely intended to seek the benefit of humans because of the more harm that arises from the marriage of Sirri.     Implementasi Kaukus dalam Mediasi Berdasar PERMA RI Nomor I Tahun 2016 Perspektif Hakim Mediator Pengadilan Agama Pasuruan

    The phenomenon of failure to implement mediation as a modus operandi for divorce settlement in the Religious Courts is because the mediator has not fully used robust mediation techniques in dispute resolution. Caucus techniques as regulated in Perma NO. 1 of 2016 article 14 letter e is a technique that has been used by mediating judges in the Religious Courts. However, mediator judges have various considerations. There are those who do caucus techniques when there is pressure on the parties, do caucus techniques when the parties are less open in disclosing their problems or there is hidden information or do caucus techniques when communication is less conducive. The results of research at the Pasuruan Religious Court, the mediator judges differed in their opinion on the caucus technique in mediation, some said that the caucus technique did not affect the success of the mediation and some were of the opinion that the caucus technique was very effective in reconciling the parties, the implementation of the caucus technique should be done in any mediation. The success rate of implementing the caucus by the mediator judge PA Pasuruan, from 2018 to become a Mediator at the State Religious Court 71% of 24 mediation cases succeeded in peace 19 cases, in 2019, 81% of 31 mediation cases succeeded in peace 26 cases, and in 2020 when they became The mediators at the Pasuruan Religious Court reached 100%. The 14 cases mediated by all of these cases were all successful”
