    In the social relation, human as individual beings also has a role as social beings. Human’s social life in society also had been regulated by the law. Human has a lot relations with another humans mainly on doing profitable daily activities such as business interaction, familyhood, collaboration, contracts, etc. But, from those social relations also found legal issues between humans. Those legal conflict or issues need to be ended. One of the easiest ways to ending conflict is by choosing mediation process. But in Indonesia still have no specific constitution for Mediation Law. There are some legal norms void and blurry about mediation in Indonesia and this bring uncertainty of law and blurry of norms. This research is trying to explaining raising issues due to no Mediation Law in Indonesia and the urgencies to make law regulation about Mediation by using progressive law and sociological jurisprudences perspectives. This research is using normative-juridische methodes. Conclusions, urgencies to make law regulation about mediation is very important to have concerns and considered for better law advancement and enforcement in Indonesia.   Keywords:    Mediation; Progressive Law; Sociological Jurisprudences; Urgency.Dalam hubungan sosial, manusia sebagai makhluk individu juga berperan sebagai makhluk sosial. Kehidupan sosial manusia dalam bermasyarakat juga diatur oleh hukum. Manusia memiliki banyak hubungan dengan manusia lainnya terutama dalam menjalankan aktivitas kehidupan sehari-hari yang menguntungkan seperti interaksi bisnis, kekeluargaan, kerjasama, perjanjian, dan lain-lain. Namun, dari banyaknya hubungan sosial itu juga ditemukan masalah hukum antara manusia yang satu dengan manusia yang lain. Konflik atau masalah hukum tersebut perlu diakhiri. Salah satu cara termudah untuk mengakhiri konflik adalah dengan memilih proses mediasi. Tapi di Indonesia belum ada Undang-Undang yang mengatur tentang mediasi. Adanya beberapa kekosongan dan kekaburan norma tentang mediasi di Indonesia dan hal ini menimbulkan masalah kekaburan norma dan ketidakpastian hukum. Penelitian ini berusaha menjelaskan masalah yang muncul karena belum adanya Undang-Undang Mediasi di Indonesia dan urgensi pembentukan Undang-Undang Mediasi dengan menggunakan aliran hukum progresif dan perspektif sosiologi hukum. Penelitian ini menggunakan metode penelitian yuridis normatif. Kesimpulannya, urgensi pembentukan undang-undang mediasi ini amatlah penting untuk diperhatikan dan dipertimbangkan demi kemajuan hukum dan penegakan hukum yang lebih baik di Indonesia.   Kata Kunci: Mediasi; Hukum Progresif; Sosiologi Hukum; Urgensi

    LEGAL CERTAINTY CERTIFICATE OF LAND RIGHTS UNDER NATIONAL LAW

    The land is a natural resource that has strategic value in the life of society and the development of a country. Land title certificates serve as proof of the legality of land ownership and provide legal certainty to landowners. The data findings show that land ownership certificates play an important role in building legal certainty and protecting the rights of landowners. This study also examines the legal provisions governing the issuance, registration, and transfer of certificates of ownership of land, as well as the rights and obligations associated with them. This section further analyzes available legal remedies in the event of a dispute or challenge to the validity of land ownership certificates. This study uses a normative juridical method because this method plays an important role in the systematic understanding and application of the law by ensuring legal certainty and ensuring consistency of the legal process. Researchers take the problem of (1) What is the meaning and importance of legal certainty of ownership of certificates of land rights?, (2) What are the roles and responsibilities of the government in ensuring legal certainty of certificates of land rights based on national law? Hopefully, this research will contribute to understanding the legal framework around land titles in a national context and highlight the importance of legal certainty in promoting land rights and facilitating economic development. It will be able to provide insights and recommendations for policymakers, legal practitioners, and stakeholders involved in land administration to improve the effectiveness and efficiency of the land registration system and ensure the protection of land rights under national laws

    SEJARAH KELEMBAGAAN BADAN OTORITA DI INDONESIA: Sejarah pelaksanaan badan otorita di Indonesia

    The purpose of this research is to find out the history of the implementation of the otorita before otorita of the nusantara capital city. The method used in this research is a normative legal research method using a statute approach and historical approach. The result of this research is that the implementation of the otorita agency was carried out before otorita of the nusantara capital city was implemented. The first time an otorita agency was implemented in 1964, there were at least 9 (nine) otorita bodies that had been implemented. The otorita agency is only given the authority to carry out development and is temporary until the development process is complete. Thus, the position of the otorita agency was an auxiliary state's organ, namely supporting the process of implementing economic and tourism development in Indonesia at that time.Tujuan dari penelitian ini adalah untuk mengetahui sejarah pelaksanaan badan otorita sebelum otorita ibu kota nusantara. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif dengan menggunakan pendekatan masalah statute approach and historical approach. Hasil dari penelitian ini adalah pelaksanaan badan otorita pernah dilaksanakan sebelum otorita ibu kota nusantara dilaksanakan. Kali pertama badan otorita dilaksanakan pada tahun 1964, setidaknya ada 9 (Sembilan) badan otorita yang pernah dilaksanakan. Badan otorita hanya diberikan kewenangan untuk melaksanakan pembangunan dan sifatnya sementara sampai proses pembangunan selesai. Dengan demikian, kedudukan badan otorita merupakan auxiliary state’s organ yaitu menunjang proses pelaksanaan pembangunan ekonomi dan pariwisata di Indonesia pada masa itu

    Consumers are everyone who uses goods and/or services available in society, both for their own interests, as well as for their families and other people as well as other living things and not for trading. In practice, of course, business actors are responsible for the goods and services consumed by consumers, and if the goods and services are in accordance with what was agreed upon, it will provide benefits for consumers, but if it turns out that the goods or services purchased do not provide the results desired by consumers, such as experiencing damage, hidden defects, the consumer has the right to ask for compensation from business actors, and it is given in accordance with consumer rights based on the principle of justice so that legal protection for consumers can be fulfilled. The purpose of this study is to find out how the principles of benefit and justice are harmonized in providing legal protection for consumers, including in fulfilling the existence of fair compensation in resolving consumer disputes with business actors, so that harmony with the principles of benefit and justice can provide legal protection for consumers and responsibilities to business actors in accordance with their respective rights and obligation

    One way to get a mate that is done by Muslims is ta'aruf. This ta'aruf process usually begins by exchanging personal biodata or what is known as a CV mediated by a mediator or a third party, namely a teacher, ustadz or ustadzah. Along with the development of the era, the practice of ta'aruf can also be done online. This research aims to find out the perspective of Islamic law on the online ta'aruf process.This research was conducted using a type of field research with a qualitative descriptive analysis method. The approach used is an empirical normative approach. This research was conducted at the Palembang online dating agency CV. The results of the study stated that there were processes that had to be carried out by ta'aruf participants, starting from filling out the form to meeting the parents of both sides of the ta'aruf pair if the ta'ruf was successful. All of these processes are always accompanied by a third party, namely an ustad or ustadzah from Palembang's online dating agency CV. Some of the social media used in Palembang's online dating agencyCV which helps its development, such as Instagram, Whatshaap, Facebook and websites. In the study of Islamic law, the ta'aruf process is appropriate because its implementation is always accompanied until the end, that is, the couple agrees to marry or cancels the ta'aruf. This is done so that each party avoids bad things, such as fraud, adultery or things that are close to adultery and so on

    There are still found the cases of the law facts about human traficing which is happend in jurisdiction of police of Metro, Province of Lampung. The obsatcle which is found in this reasearch is how to eradicat the criminal act, and the factors which obstruct the eradication of human trafficing. Eradication of human trafficking crime act is held by penal and non penal approach. Penal approach is beheld by counseling, social education in aim to develop human social responsibility about awareness to human trafficking criminal act, law knowledge counseling, re-socialization, workshop, and another activity. Then, those activities beheld in crime vulnerable area or crime object treatment. Penal approach beheld by legal effort; it means that the criminals or the actor of human trafficking action have to be procced by the enactment and sentenced to the court and execution. The aim is to get and to guarantee the legal certainty in a neighborhood. The factors which obstruct the eradication of human trafficking are such; facility factors, society factors, and culture factors.Fakta hukum yang terjadi saat ini masih ditemui kasus terkait tindak pidana perdagangan orang di Wilayah Hukum Polres Metro. Permasalahan dalam penelitian ini adalah: Bagaimana pemberantasan tindak pidana perdagangan orang. Apa faktor-faktor penghambat pemberantasan tindak pidana perdagangan orang.   Perdagangan Orang adalah tindakan perekrutan, pengangkutan, penampungan, pengiriman, pemindahan, atau penerimaan seseorang dengan ancaman kekerasan, penggunaan kekerasan, penculikan, penyekapan, pemalsuan, penipuan, penyalahgunaan kekuasaan atau posisi rentan, penjeratan utang atau memberi bayaran atau manfaat, sehingga memperoleh persetujuan dari orang yang memegang kendali atas orang lain tersebut, baik yang dilakukan di dalam negara maupun antar negara, untuk tujuan eksploitasi atau mengakibatkan orang tereksploitasi. Penelitian ini menggunakan pendekatan secara yuridis normatif dan yuridis empiris. Jenis data yang digunakan adalah data primer dan data sekunder. Data yang diperoleh secara analisis kualitatif. Hasil analisis data dapat dilanjutkan dengan menarik kesimpulan secara induktif.              Berdasarkan hasil penelitian dan pembahasan menunjukkan bahwa Pemberantasan tindak pidana perdagangan orang dilaksanakan dengan menggunakan sarana non penal dan sarana penal. Pendekatan non-penal dilakukan dengan penyuluhan, pendidikan sosial dalam rangka mengembangkan tanggungjawab sosial warga masyarakat sadar akan tindak pidana perdagangan orang, penyuluhan hukum, resosialisasi, workshop, dan lain sebagainya khususnya dilakukan dilingkungan-lingkungan yang rawan dengan kejahatan, penanganan objek kriminalitas. Pendekatan penal dilakukan dengan upaya hukum yakni pelaku tindak pidana perdagangan orang diproses hukum berdasarkan ketentuan peraturan perundang-undangan sampai ke tingkat pengadilan dan eksekusi guna mendapatkan sanksi pidana dan menjamin kepastian hukum di masyarakat. Faktor-faktor penghambat pemberantasan tindak pidana perdagangan orang meliputi: Faktor fasilitas, Faktor masyarakat, dan Faktor budaya.   Saran dalam penelitian ini adalah agar penegak hukum lebih memaksimalkan dalam memberikan sanksi pidana terhadap pelaku tindak pidana perdagangan orang agar mampu memberikan efek jera terhadap pelaku

    Fraud is an act that is very harmful and disruptive to society. Based on Chapter XXV of the Criminal Code, various forms of fraud are contained in Article 378 of the Criminal Code. One form of criminal act of fraud is fraud with a blank transfer slip. One of them is contained in Decision Number: 926/Pid.B/2017/Pn.Tjk, which states that it has been legally and convincingly proven that the defendant committed fraud by using a giro. then the formulation of the problem is: a.) What is the legal review of fraud perpetrators using Bilyet Giro (Decision Study Number: 926/Pid.B/2017/Pn.Tjk)? b.) What factors become obstacles in applying sanctions against perpetrators of fraud by using Bilyet Giro (Decision Study Number: 926/Pid. /2017/Pn.Tjk)? This research uses normative juridical and empirical juridical methods. Based on the results of a legal review of fraud perpetrators using Bilyet Giro (Decision Study Number: 926/Pid.B/2017/Pn.Tjk) stated that the defendant was legally and convincingly proven guilty of committing the crime of "fraud" as in the first alternative indictment and sentenced the defendant therefore to imprisonment for 3 (three) years and 3 (three) months. The Judge's decision is in accordance with Article 378 of the Criminal Code concerning fraud. What factors become obstacles in the application of sanctions against perpetrators of fraud by using Bilyet Giro (Decision Study Number: 926/Pid.B/2017/Pn.Tjk) include: a. Legalfactors, b.     Corruption is internationally recognized as an extraordinary crime. According to a report by Transparency International, Indonesia's Corruption Perception Index (CPI) score will be 34 on a scale of 0-100 in 2022, making Indonesia the 5th most corrupt country in Southeast Asia. In the end, corruption that stems from greed will only cause great harm to the country and its people. Therefore, this study aims to provide information related to the impact of corruption on the life of the nation and state and how the government resolves the cooking oil corruption case. By using normative juridical research methods, the results show that corruption has a significant impact on the quality of people's welfare. To anticipate the occurrence of corruption, the President emphasized that the bureaucratic mechanism must be guided by a good governance system, and prioritize community participation through social change as a preventive measure to increase the number of corruptors in Indonesia

    INHERITANCE LAW IN THE PERSPECTIVE OF LAMPUNG SEBATIN TRADITIONAL LAW AND ISLAMIC LAW

    Inheritance law is regulated in Islamic law, namely regarding the law that regulates the transfer of assets from someone who dies to their heirs. Inheritance law is part of civil law whose regulation is dualism and pluralism. The Lampung Sebatin traditional community, which is predominantly Muslim, divides inheritance. There are usually two kinds of inheritance laws that are commonly used, namely inheritance according to Islamic law and Lampung Sebatin traditional law, but customary law is more dominant. The position of sons in the family of the Lampung Sebatin traditional community is very important in terms of hereditary succession, because the Lampung Sebatin traditional community adheres to a male majority inheritance system. The research focus in this study is (1). How do the Lampung Sebatin indigenous people resolve inheritance disputes? (2). How is the inheritance system of the Lampung Sebatin traditional community viewed from Islamic law? The aim of this research is to describe the system of distribution of inheritance according to the customary law of the Lampung Sebatin traditional community, and to describe the traditional inheritance system of Lampung Sebatin as viewed from Islamic law. In this research, researchers used a qualitative approach method. Meanwhile, data collection uses interviews, observation and documentation. Meanwhile, the analysis uses analytical descriptive. The results of this research show that the Lampung Sebatin traditional community uses an inheritance system that prioritizes sons over daughters

    Aceh as one of the special regions in Indonesia has privileges in managing the life of its people, including maintaining social life in the community in terms of imposing sanctions on violators who violate the rules in the gampong where the community lives. In addition to having a keuchik, the gampong also has a set of eight tuha in customary social life. By using the literature methodology and review of qanuns in Aceh, we want to see the extent of the role of the tuha lapan in imposing sanctions for customary violations in gampong. From the results of the research, it was concluded that competence under the Tuha Lapan Gampong Customary Court includes issues of Article 13 of Qanun Number 9 of 2008 concerning Fostering Traditional Life and Customs
