    Interview with Roberto Vecchi: Colonial Nostalgia in the Country of Saudade – Longings for the Past in Portugal

    Roberto Vecchi is Professor at the Department of Modern Languages, Literatures and Cultures of the University of Bologna, where he holds the chair in Portuguese and Brazilian Literature, and where, together with Margarida Calafate Ribeiro, he is responsible for the Eduardo Lourenço Chair (University of Bologna/Instituto Camões). Further, he also occupies the position of Vice Rector for Teaching at the University of Bologna. He is a fellow researcher at CES (Centro de Estudos Sociais), University of Coimbra, studying trauma, colonial war and violence. Additionally, in Brazil, he is a CNPq researcher in the research group on violence and literature. He has published widely on the literature of the Portuguese colonial war, such as Portugal, Excepção atlântica. Pensar a literatura da guerra colonial (Porto, 2010).  Together with Margarida Calafate Ribeiro and Monica V. Silva, he has organized Papéis da prisão de José Luandino Vieira (2015) and has co-published an Anthology of essays by Eduardo Lourenço, Do colonialismo como nosso impensado (Lisboa, 2014), which has been relaunched recently (2024). In a forthcoming book, he analyzes nostalgic imaginations of Africa in Portuguese cultural texts

    Effectiveness of procedural agreements in securities law

    Investment funds hold important economic and social significance as a savings model that complements state pensions and pension savings plans. The current trend of retail investors gathering to the capital markets is not only attributed to evolving market dynamics; it is also driven by individuals who lack the knowledge and time to thoroughly evaluate all the legal implications of their investments. Consequently, both the total amount of assets invested in funds and the number of individuals participating in investment funds will continue to surge. As a result, the increased participation in investment funds also raises the chances of civil litigation between the involved parties. So, my objective is to evaluate this potential development and its management through procedural agreements by studying the effectiveness of procedural agreements in Securities Law

    Adoção da Norma ISO 9001:2015: um estudo tri-setorial em Portugal

    The aim of this study is to gather information on the obstacles, benefits, main practices, and lessons learnt from the adoption and revision of the ISO 9001:2015 quality management system by industries in the metalworking, woodworking, construction, and public works sectors based in Portugal. For this purpose, a quantitative methodology was adopted and the questionnaire by Fonseca et al., (2019) was used. A total of 1,105 companies from these three sectors of activity were contacted and 114 responses were obtained. Compared to previous multi-sector studies, it was concluded that the use of training and external consultants to implement ISO 9001:2015 facilitates the process of implementing and certifying the standard in all three sectors. It was also concluded that human resources should be given special attention, as it was revealed that planning changes and resistance to them emerged as the main difficulty experienced by the companies under study when implementing quality tools, followed by determining the risks and opportunities that bring the greatest difficulties, but also the greatest benefits, in relation to the certification process. Here too, the adoption of risk-based thinking and the identification of relevant stakeholders were reaffirmed as the approaches that organizations found most beneficial. Future research is suggested into the ICT criteria and requirements that computerized quality support systems should have in order to support the documentation and process of quality management systems.O objetivo deste estudo é recolher informações sobre os obstáculos, benefícios, principais práticas e lições aprendidas com a adoção e revisão do sistema de gestão da qualidade ISO 9001:2015, pelas indústrias do setor da metalomecânica, transformação de madeiras, construção civil e obras públicas sediadas em Portugal. Para o efeito adotou-se uma metodologia quantitativa, e foi utilizado o questionário de Fonseca et al., (2019). Foram contactadas 1105 empresas destes três setores de atividade tendo sido obtidas 114 respostas. Concluiu-se, comparativamente a estudos anteriores multissetoriais, que o recurso a formação e consultores externos para a implementação da ISO 9001:2015, facilitam o processo de implementação e certificação da norma nos três setores. Concluiu-se ainda que os recursos humanos devem merecer especial atenção pois revela-se que o planeamento das mudanças e resistência às mesmas surge como a principal dificuldade sentida pelas empresas em estudo, com a implementação das ferramentas da qualidade, seguida da determinação dos riscos e oportunidades que trazem as maiores dificuldades, porém também dos maiores benefícios, relativamente ao processo de certificação. Também aqui se reafirmam a adoção do pensamento baseado no risco e identificação das partes interessadas relevantes como as abordagens que as organizações consideraram mais benéficas. Sugerem-se investigações futuras sobre os critérios e requisitos de TIC que os sistemas informáticos de apoio à qualidade deveriam ter para dar suporte à documentação e processo dos sistemas de gestão da qualidade

    The development of the UN CRC’s approach to children and climate change: any impact on the future of youth-led climate litigation?

    On August 22, 2023, the UN Committee on the Rights of the Child published General Comment No. 26 on Children’s Rights and the Environment, with a Special Focus on Climate Change (GC26). This GC is remarkable for being the first one entirely dedicated to environmental and climate protection in light of the United Nations Convention on the Rights of the Child. This contribution aims to explore the role of GC26 in the practice of the Committee in light of its first – and so far, only – decision in this regard, Sacchi et al. v. Argentina et al., and positions it in the context of youth-led climate litigation which reached a breakthrough since the Committee’s 2021 decision. The article also assesses the potential impact of GC26 on ongoing and future climate change cases and points out what could be done in order to enforce the perspective of future generations in the context of climate change

    In this article we intend to make a comparative approach to the reforms of the Universities of Salamanca and Coimbra, in the second half of the 18th century, influenced by the Catholic Enlightenment. Starting from the hypothesis that this Catholic background forced the adoption strategies of ideas that circulated in the European space, we intend to identify in a comparative way the adoption of pedagogical and scientific ideas in the curricular construction, but also in the adoption of new works for the classes. Seeking, also, to establish parallels with the general lines that characterized other university reforms in Europe.Neste artigo pretendemos realizar uma abordagem comparativa das reformas das Universidades de Salamanca e de Coimbra, na segunda metade do século XVIII, influenciadas pelo Iluminismo Católico. Partindo da hipótese de que este fundo católico obrigou a estratégias de adoção de ideias que circulavam no espaço europeu, pretendemos identificar de forma comparada a adoção de ideias pedagógicas e científicas na construção curricular, mas também na adoção de novas obras para as aulas. Procurando, também, estabelecer paralelos com as linhas gerais que caracterizaram outras reformas universitárias na Europa

    State aid, sustainable management of natural sites and services of general economic interest

    Part of the Green Deal policy of the EU is the restoration of nature. This policy is not new as Directive 92/43 on the conservation of natural habitats and of wild flora and fauna has already resulted in the designation of special areas of nature conservation. Recently, the draft regulation on nature restoration was adopted after a heated debate in both the European Parliament and the Council. It is clear from the outset that the need to protect natural sites is high on the agenda of the EU. The Member States are responsible for implementing the EU rules on the management of natural sites. It goes without saying that this implementation will trigger huge investments by these States. This raises issues of EU State aid law: if entities engaged in economic activities receive funding with a view to the management of natural sites, it has to be examined whether this is in line with Articles 107-109 TFEU. In this paper it will be explored whether the concept of Services of General Economic Interest (SGEI) is capable of accommodating nature management concerns in the application of the EU State aid rules. This concept has been used for striking a balance between the necessity to ensure undistorted competition in the EU internal market and various public interest policies. It will be argued that on the basis of arguments derived from ecological solidarity and ecological heritage, the management of natural sites may be designated as a SGEI mission. However, in this regard, it is of great interest to acknowledge that this management consists of three categories of activities: 1) the acquisition of natural sites (in order to make the management of natural sites possible), 2) nature conservation (aimed at the preservation and protection of natural sites), and 3) exploitation of natural sites (such as the selling of wood and touristic activities). The current approach developed in the decisional practice of the Commission and the case law of the Union Courts do not pay due consideration to the special characteristics of these activities and, as a result, it suffers from conceptual problems. This prevents EU Member States from financing projects geared towards the sustainable exploitation of natural sites. In this contribution, an alternative approach will be developed in order to do justice to the wide variety of nature management activities. Such an approach could contribute to the attainment of the Green Deal goals

    Synergies between the CSDDD and EU competition law: a toxic relationship?

    Corporate sustainability due diligence (CSDD) is needed in order to achieve a transition towards a green economy and deliver the UN Sustainable Development Goals. Therefore, the Commission proposed the Corporate Sustainability Due Diligence Directive (CSDDD) in 2019. In March 2024, the Council and the European Parliament finally reached an agreement on the CSDDD. This Directive obliges companies, if need be, to “collaborate” within the supply chain in order to reach the goals of the act, as long as such collaboration is in compliance with “Union law, including competition law”. This begs the question how much room these companies will have under EU competition law to collaborate with other companies in the value chain. In this article, a discussion will take place on the different aspects at stake. Companies should collaborate with subsidiaries and business partners. These companies will, from a competition law perspective, sometimes be seen as part of one undertaking. In instances where we have different undertakings, Article 101 will play a role. This article will then further delve into the question of how much room undertakings will have in light of the cartel prohibition to create agreements with the aim of achieving the CSDDD goals. Therefore, the article will also discuss whether such agreements do infringe the cartel prohibition
