No full textTrafficking is a new form of slavery in the modern age. In the context of trafficking crimes, at least in Indonesia there are laws that guarantee respect for humanity and prosecution of all forms of injustice that can be used to take action against crimes that injure humanity, namely Law Number 21 of 2007 concerning the Eradication of Trafficking Crimes People (Law Trafficking).Article 48 paragraph (1) of Law Number 21 of 2007 concerning the Eradication of the Crime of Trafficking in Persons (Law Trafficking), states "every victim of the crime of trafficking in persons or their heirs has the right to obtain restitution". Furthermore, paragraph (3) states "the restitution is given and stated at the same time in the court decision regarding the criminal case of trafficking in persons. The purpose of this study is to find out and explain about law enforcement granting the right of restitution to victims of the crime of trafficking in persons. The law and customary courts in Aceh have guaranteed legal certainty regarding the granting of restitution rights for victims of Trafficking However, the right to restitution for victims of from Trafficking cases that exist in the jurisdiction of the Courts in Aceh is not perfect "Getting Restitution". Compared to the losses they have experienced. This can be seen from the decision of the case which has permanent legal force. Legal certainty is not only written in statutory regulations, but also must be applied to concrete events. Something that is contained in the law is an abstract thing. Therefore the abstract becomes certain when it is applied concretely in reality. It is suggested to the authorities to make implementing regulations regarding mechanisms or procedures as well as oversight on how to ensure legal certainty of the restitution rights of Trafficking victims. It is recommended to the authorities to provide legal certainty for victims of Trafficking in accordance with the new Trafficking Law and local wisdom in Aceh so that it contains clear and useful legal certainty regarding the restitution rights of Trafficking victims. No full textAbstract The Covid-19 pandemic is occurring worldwide and is one of the most massive pandemics in history. All regions in Indonesia face this problem including Aceh. The execution of the Cambuk Punishment experienced a long debate and Aceh entered the era of the Covid-19 pandemic. The existence of the execution of cambuk punishment in the field in Aceh is starting to disappear. The Indonesian government started enforcing PPKM and limiting crowds. Based on this background, this study tries to analyze the existence of cambuk in the application of Aceh's Islamic Shari'a after the Covid-19 pandemic. This research was conducted using a sociological approach (Sociological Approach). This sociological approach is used to examine the existence of the implementation of cambuk in the application of Aceh's Islamic Shari'a after the Covid-19 pandemic. This is related to the culture and situation of the people of Aceh which are increasingly changing and continue to experience development from time to time. The results of this study indicate that: The existence of cambuk as a punishment during and after Covid-19 can be seen from the achievement of the goals of punishment by using cambuk, namely that it is seen that the recedive rate or repetition of crimes for convicts who underwent cambuk execution in Aceh was very successful, especially in the pandemic era who are vulnerable to crime. Indicators of this success can also be seen in the reduced spike in cases and repetition of crimes committed by former cambuk convicts. If we look back, this situation is in stark contrast when compared to those convicted of imprisonment or fines when the country is experiencing a pandemic such as Covid-19. Cambuk punisment is a new step to reduce the transmission rate of Covid-19 and cut Aceh's budget during the last Covid-19 pandemic era. Keywords: Cambuk, Aceh, Post Pandemic Covid-19

No full textThis paper discusses the Review of Islamic Business Ethics Against the Cancellation of Sales and Purchases of Building Materials by Drop Order by Buyers at Tunas Baru Stores, Bandar Dua District, Pidie Jaya Regency (Analysis of One-sided Cancellations in the Salam Buy and Sell Concept). Buying and selling activities in everyday life inseparable from the desired needs. Even buying and selling itself is now inclined and can be developed according to the needs of the community, such as buying and selling building materials by DO which resembles the concept of a salam contract. This sale and purchase is a contract with the delivery of goods ordered by the seller at a predetermined time and the payment is made immediately by the buyer when the contract takes place. However, in practice, it sometimes causes unwanted things, such as unilateral cancellation by the buyer, as was the case in Bandar Dua District, Pidie Jaya Regency. The problem of this research is how are the implications and resolution of the cancellation of the sale and purchase contract by DO for building materials for the sellers and buyers and how is the review of Islamic Business Ethics towards unilateral cancellations made by the buyer in the sale and purchase contract of building materials by DO at the Bandar Dua Building Materials Store Pidie Jaya Regency. The method used is descriptive analysis method through primary data obtained from field research and secondary data obtained from library research. The results of the study show that the implications for the seller besides the loss are also profitable, as well as for the buyer who also benefits even though there is a loss. The unilateral cancellation in this case is according to a review of Islamic Business Ethics. Thus, the cancellation here becomes valid based on the settlement carried out by way of peace by the new Tunas shop, and there has been agreement between the parties who made the contract. Pattern of communication single parent in shaping the discipline the of children carrying out the teachings of Islam in the district of Medan Helvetia is generally carried out at dinner, when relaxed or at the right times, in which the child is always with parent to prioritize the interests of children and control their children, being rational , always an underlying on the ratio or thoughts that are appropriate logic .; 2). The impact of the lack of communication singel parent to disciplin children implement the teachtings of Islam, among others changes in the behavior of children to be rigit (hard), tent to be emotional and to be refused, the child irritable, fearful, sad and feeling unhappy, easily distracted, stressed, have ni future direction clear front and unflidly, distracted chid psychologhy and identity crisis; 3). Contraints faced by singel parent in child discipline implement the teachings of Islam, among others, lack of time because of busy parent outside the home so as to give emphasis or affirmation to implement the teachings of Islam can not be done at any time. No full textAmong the good protections of Islam and its respect for women is that Islam gives them property rights. Because, in the period of ignorance, women became the party whose rights were oppressed and abused in their association. Islam wants to get rid of remnants of the ignorance system regarding women's affairs and their dowry. Mahar is a voluntary gift which is a symbol of a man's sincerity, honesty, and commitment in marrying a woman. Giving a dowry to a prospective wife is mandatory, marriage without mentioning the dowry "Tafwidh marriage" is legal, failure to mention the type and amount at the time of the marriage ceremony, does not cause the marriage to be cancelled. The scholars of the madhhab agree that dowry is not one of the pillars of the contract, but is one of the consequences of the existence of the contract. Therefore, the marriage contract may be carried out without mentioning the dowry. The scholars of the school of thought agree that there is no maximum amount in dowry, but they differ on the minimum limit. The dowry may be paid at the beginning (before intercourse) or at the end (after intercourse), as it can also be paid at the beginning of a part and at the end of another part. Dowry may be terminated under two conditions, let the time to be paid be known, and do not delay payment for too long. There are two types of dowry, musamma dowry and mitsil dowry. Mahar musamma is the dowry agreed upon by the bride and groom as stated in the editorial contract. While the mitsil dowry is the dowry that should be given to women that is usually accepted by other women who are equal to them, both in terms of age, beauty, wealth, mind, religion, virginity, widowhood, and country when the marriage contract is held. No full textThe Qur'an and hadith have given guidance and demands to mankind to act along predetermined lines. This article discusses how to guide people through increasing coaching between intellectual and spiritual intelligence, so that it will be understood how the relationship and virtue in applying and prioritizing between the two. The focus of the author's research concerns guiding the ummah in Islam between intellectual and spiritual intelligence, where the author wants to know between intellectual and spiritual intelligence both in relation to the levels and virtues between the two. This research is a type of library research. What is called literature research or often also called literature study, is a series of activities related to methods of collecting library data, reading and recording and processing research materials. From the changes made, it was concluded that intellectual and spiritual intelligence are interrelated, because the command to learn and do good and maintain the heart of the soul is an interconnected commandment, but it can be understood that intellectual intelligence cannot certainly affect spiritual intelligence while spiritual intelligence will be able to affect intellectual intelligence.(;).Al-qur’an dan hadist telah memberikan tuntunan serta tuntutan kepada umat manusia untuk berbuat sesuai dengan garis yang telah ditentukan. Artikel ini membahas bagaimana upaya membimbing umat melalui peningkatan pembinaan antara kecerdasan intelektual dan spiritual, sehingga akan dapat dipahami bagaimana hubungan dan keutamaan dalam menerapkan serta mengedepankan diantara keduanya. Fokus penelitian penulis yang menyangkut membimbing umat dalam islam antara kecerdasan Intelektual dan spiritual, dimana penulis ingin mengetahui antara kecerdasan intelektual dan spiritual baik dalam kaitannya begitu pula tingkatan dan keutamaan diantara keduanya. Penelitian ini merupakan jenis riset kepustakaan (library research). Apa yang disebut dengan riset kepustakaan atau sering juga disebut studi pustaka, ialah serangkaian kegiatan yang berkenaan dengan metode pengumpulan data pustaka, membaca dan mencatat serta mengolah bahan penelitian. No full textThis study aims to describe the existence of social media on student behavior and the inhibiting factors of PAI teachers in anticipating the impact of social media in SD Negeri Kota Subulussalam. This research is a qualitative research using pedagogical, psychological, sociological, and normative theological approaches. The data sources are primary data from school principals, PAI teachers, and students through interviews, while secondary data is taken from documents related to research. The results of the study show that in the role of religious education teachers in anticipating the impact of using social media for students at SD Negeri Subulussalam City:1. Students of SD Negeri Kota Subulussalam Utara use social media as a platform to show their existence to the outside world. Everyone is competing to display and create branding about himself to the outside world. Not infrequently even a person can act excessively to just show his existence to others,2. As for what is hindering PAI teachers in anticipating the impact of social media at SD Negeri Kota Subulussalam, namely the lack of cooperation between teachers and parents in anticipating the use of social media. However, Islamic principles in human resource management not only consider the interests of advancing institutions, schools, and organizations, but also focus on the needs of employees, learners, and the demands of the wider community. By integrating these aspects, work effectiveness can be achieved, and predetermined goals can be realized. Recognizing the importance of human resources in organizations or educational institutions as a challenge in achieving effective and efficient educational goals, the author is motivated to conduct research on human resource management in the Islamic educational institution, MAN I Tanah Jambo Aye, North Aceh Regency. The author formulates several problems related to human resource management in the Islamic educational institution, with a focus on improving the quality of employees and educational standards. This study adopts a qualitative research design, specifically field research, using data collection techniques such as interviews, observations, and documentation.The conclusion drawn from this research is that to enhance the quality of human resources, the school principal undertakes various activities such as assigning tasks, organizing workshops, and providing training tailored to the respective fields of the teachers. The aim is to develop the knowledge and skills possessed by the teachers, advance the educational institution, and encourage learners to expand their knowledge in the field of education.
