    No full text
In Lebanon exists fifteen different religious courts treating personal status laws i.e., laws regarding marriage and divorce, one of these is the ja’farite court. The purpose of this essay is to clarify the process of marriage and divorce within the ja’farite court and to further investigate in which ways the ja’farite court violate women’s human rights. To answer these questions the research method used is a text analysis through a qualitative method where the analysis and the conclusion present the results of the research. The result and the conclusion present that the ja’farite court violate several articles from the CEDAW; Lebanon as a state has ratified CEDAW and is obligated to commit to their undertakings. Therefore, Lebanon should first and foremost engage in the abolishment of the religious courts but also establish adequate oversight mechanism to guarantee women’s human rights.

Penal Provision on the violation of a Child's Integrity

    No full text
In July 2021 a new penal provision on violation of a child's integrity, was introduced in the Swedish legal system. The penalty provision is found in Chapter 4 of the Penal Code. It entails a special criminal responsibility for a person who commits a criminal act against a person close to them, when the act is witnessed by a child. Children who witness domestic violence or other criminal acts between parents or persons close to them are a particular vulnerable group. These children often lack criminal law 1 protection. The new provision on violation of a child's integrity has mostly been well received. The child who witnessed the criminal act will now be a plaintiff with the right to his own special legal representative. There will be a chance that the new provision will strengthen the child's right under the Convention on the Rights of the Child. This specifically concerns Article 12 the child's right to be heard. Even so there seems to be several difficulties with the provision in the law enforcement. This essay will explore some of these difficulties

Batwa in Burundi : A discriminated and marginalized people

    No full text
Burundi is made up of three ethnic groups, Hutu, Tutsi and Batwa. The Batwa are the indigenous people of Burundi and the smallest ethnic group in Burundi. It is estimated that the Batwa make up about 1% of the total population. Batwa consider the forest their home. But after centuries of deforestation and forest management, the Batwa gradually abandoned their forests. When forests became pastures for colonists' animals and fields were taken by colonists, many Batwa came to rely on pottery, which replaced forests and hunting as symbols of Batwa identity. During the first half of the 20th century, Burundi's new process of industrialization, the country's gradual opening to international trade, and decreased access to clay products for Batwa led to a significant weakening of the pottery trade. This has once again disrupted the main economic activities of the Batwa, making them the most vulnerable population group in Burundi. The Batwa are excluded from many provisions of Burundi's constitution in which they are not mentioned as part of Burundi's ethnic depopulation. Discrimination is a top concern for the Batwa. This discrimination manifest in three main forms: negative stereotyping, segregation and denial of rights. Discrimination is more serious in rural areas than in urban areas, mainly among local people, including local officials. Negative stereotypes could be, for example, that people refuse to sit next to a Mutwa because they are dirty, or refuse to marry a Mutwa because they are considered incestuous and immoral, or that Batwa do not cultivate because they are lazy. The traditional system of bashingantahe is a way of conferring social status on the Batwa, thus eliminating discrimination against the Batwa by non-Batwa

The Church of Sweden’s assignment to teach : A study of theology in the assignment of teaching

    No full text
This study aims to explore the understanding about teaching in the Church of Sweden through analysis of the letter of the Bishops and interviews with a teacher of the community and a priest. The study also covers which theology that comes forward in the letter of the Bishops and in everyday life for the teacher of the community and the priest.  The study shows the relationship between learning and teaching as well as which theology that comes forward in that mission. A difference occurs between the terms learning and teaching that is not shared by everyone. It is shown that everyone’s own experience and beliefs is a crucial part of the teaching process in order to accomplish learning. The letter of the Bishops wants to connect teaching and learning while the informers says there is a difference. The mutual understanding is that we learn together, and that faith also is practice.  The teaching going on is constantly changing in the meeting with other persons, artefacts and the context. Peoples lives and the church’s traditions are in constant motion. By being aware of the authority perspective and by working with trust it will be a great lesson and learning takes place. The theology that is created takes place in the meeting that occurs between human lifes and the tradition. There is no text or tradition that individually contains theology. The theology is created in the meeting with people. The meeting requires both people and text, neither can bring out theology on its own.
