Konstytucyjna zasada pierwszeństwa umowy międzynarodowej przed prawem krajowym w praktyce stosowania prawa podatkowego. Wybrane problemy
No full textUmowy o unikaniu podwójnego opodatkowania zawierają ustalenia umawiających się państw dotyczące alokacji praw do opodatkowania poszczególnych rodzajów dochodów, tj. czy prawo to przysługuje jednemu, czy obu państwom. W tym drugim przypadku dochodzi do podwójnego opodatkowania, którego wyeliminowanie jest podstawowym celem umów, ale nie jedynym – obecnie podkreśla się ich rolę w przeciwdziałaniu unikaniu i uchylaniu się od opodatkowania. Cechą umów podatkowych jako źródła prawa jest to, że nie tworzą one praw do opodatkowania, a jedynie ograniczają prawa do opodatkowania umawiających się państw. Zgodnie z polskim porządkiem prawnym wynikającym z art. 91 ust. 2 Konstytucji RP umowa międzynarodowa ratyfikowana za uprzednią zgodą wyrażoną w ustawie ma pierwszeństwo przed ustawą, jeżeli ustawy tej nie da się pogodzić z umową. Nie zawsze jednak rozstrzygnięcie, czy doszło do kolizji normy międzynarodowej i normy krajowej, jest oczywiste, o czym świadczą kontrowersje związane z pozbawieniem podatników korzyści umownych na podstawie krajowych norm przeciwko unikaniu opodatkowania. W praktyce zdarzają się jednak sytuacje bardziej oczywiste, gdy normy krajowej nie da się pogodzić z umową, chociażby z tego powodu, że nie została ona jeszcze dostosowana do wcześniej zmienionego Modelu Konwencji OECD. Zastosowanie takiej normy krajowej nie może prowadzić do pozbawienia podatnika korzyści wynikającej z treści obowiązującej umowy

No full textOpracowanie prezentuje problematykę prawnych granic wydatków publicznych, które są prawnymi ograniczeniami swobody politycznej organów władzy publicznej w kreowaniu i realizacji wydatków publicznych. Wychodząc od trzech aspektów suwerenności finansowej państwa, przedstawiono i zbadano swobodę wydatkową państwa oraz wskazano na istnienie jej prawnych granic, do których zaliczono: wydatki sztywne, obowiązek dialogu, reguły fiskalne, procedury wydatkowania oraz kontrolę wykonania wydatków. Każda ze wskazanych grup prawnych granic wydatków publicznych została w tekście scharakteryzowana wraz ze wskazaniem jej konstytucyjnych podstaw
The Association of Body Temperature with Longevity: Insights from Historical Cohorts
No full textEffective thermoregulation is crucial for maintaining homeostasis. Previous research has suggested a link between lower steady-state body temperature and longevity, particularly in physically healthy, nonobese older adults. However, the exact mechanisms behind this relationship remain unclear. Despite the physiological insights gained from studies on body temperature, limited attention has been given to its potential role as a biomarker of longevity in physically healthy older populations. This study aimed to evaluate the relationship between body temperature and longevity using historical data from two cohorts. The longitudinal cohort consisted of 142 individuals, followed for 25 years beginning at age 45, while the cross-sectional cohort included 204 individuals stratified into four lifespan categories. To examine agerelated trends in body temperature, Page’s test was employed, and ordinal regression was used. The analysis revealed a significant decrease in body temperature in women with age, while men showed no significant change. The cross-sectional analysis indicated a trend toward lower body temperatures in individuals with longer lifespans. Lower body temperature may reflect a reduced metabolic rate, thereby mitigating oxidative stress and molecular damage, both of which are known to drive aging and limit lifespan. Furthermore, lower body temperatures may signal a favorable inflammatory profile, which could translate into slower aging and increased survival. However, the observed sex-specific differences in thermoregulatory patterns raise important questions about the role of hormonal influences, such as estrogen levels. Overall, these findings suggest that lower lifetime steady-state body temperature may be a biomarker of healthy aging and longevity, warranting further exploration of its mechanistic underpinnings
Social media and mountain visits – is this ‘friendship’ sustainable?
No full textThe role of social media in tourism has already been acknowledged in the academic literature but still little is known about its specific influence on mountain tourism in the context of the growing popularity of outdoor activities that threaten to harm fragile areas. The aim of this article is to find out the effect of social media on such visits, to outline patterns of tourist behaviour, as well as to reveal social media–induced effects, both negative and positive, regarding the sustainability of mountain tourism. Using an online survey among the members of a Bulgarian mountaineering Facebook group, we found out that it was information of practical use that was mostly searched for by its members, and which in turn can be easily converted into real visits to the area, and as such mainly attracting novice mountaineers. The study uncovered purely pragmatic perceptions in terms of sharing information and pictures about places in the mountains, with limited awareness about the possible negative environmental effects from the overpopularisation of these areas. This could be classified as a consumerist attitude towards the mountains that is nurtured by social media. On the positive side, such unawareness can be tackled by social media due to its mass informative power

No full textThis article touches on the issue of human-technology relations in the age of artificial intelligence. It poses questions about the changes that have taken place in the field of art under the influence of advanced machine learning systems. The last decade of AI’s successes enforces the need to rethink the aesthetic categories, including an attempt to redefine the place and role of the artist in a technologically determined reality. The cited historical examples of aesthetic reflection accompanying computer art of the 1960s largely anticipated the changes taking place today, while also serving an important metacritical function. Today’s critical AI art can play a key role in raising awareness of the processes taking place and uncovering the workings of artificial intelligence algorithms, which are often locked in black boxes and their operations and assumptions inaccessible to human understanding.Niniejszy artykuł porusza kwestię relacji człowiek-technologia w dobie sztucznej inteligencji. Stawia pytania o zmiany, jakie zaszły w polu sztuki pod wpływem zaawansowanych systemów uczenia maszynowego. Ostatnia dekada sukcesów AI wymusza konieczność przemyślenia kategorii estetycznych, w tym próbę redefinicji miejsca i roli artysty w zdeterminowanej technologicznie rzeczywistości. Przytoczone historyczne przykłady refleksji estetycznej towarzyszącej sztuce komputerowej lat 60. XX wieku w dużej mierze antycypowały zachodzące dziś zmiany, pełniąc jednocześnie ważną funkcję metakrytyczną. Dzisiejsza krytyczna sztuka AI może odegrać kluczową rolę w podnoszeniu świadomości na temat zachodzących procesów i odkrywaniu pracy algorytmów sztucznej inteligencji, które zamknięte w czarnych skrzynkach, są niedostępne ludzkiemu zrozumieniu

Lessing’s work in the period of the Polish People’s Republic on the example of theatre programs for Minna von Barnhelm and Emilia Galotti. The analysis of archival materials and press reviews showed that the process of ideologization of Lessing’s works, presented on Polish stages during the Polish People’s Republic, was visible pri-marily in theatre programs for staging the dramas by the classic German author. However, the material of the performances of Lessing’s plays defended itself against political appropriation by socialist cultural functionaries

The early medieval cemetery in Lubień in the context of funerary rituals of Central Poland - specificity and impact
No full textThe early medieval cemetery in Lubień reveals its specificity in many respects, especially when compared to other early medieval cemeteries from central Poland. This article discusses several aspects of the scale of the burial site and selected elements of the grave goods. In terms of the number of discovered graves and their content, the cemetery in Lubień is the largest, the richest and at the same time the oldest – next to Lutomiersk – archaeologically recognised cemetery of the early Piast period in the discussed area. Some of the items belonging to the grave furnishings are finds of exceptional importance, not only on a regional scale but also for the entire Polish lands in the early Middle Ages. They reveal interregional connections of the local community (probably representatives of the elite), sometimes of a long range, and indicate the ability to adapt ideas and values coming from the outside, not only in the material but also in the spiritual sphere. Some of them can be considered as markers of the status of the buried people, an expression of prevailing tastes, as well as a material trace of beliefs related to the burial of the dead at the time when the old pagan rituals merged with the ritual requirements of the Christian faith.Stowarzyszenie Naukowe Archeologów Polskich, Oddział w Łodz
Photographic Representations of Old Age: Between Sensitization and Social Anesthesia
No full textIn this article we focus on several key questions about the relationship between photography and old age. Without undertaking the task of mapping the entire potential area of exploration, we focus on several points of contact, such as: the history of the medium in the context of taking up themes concerning people of advanced age, the commercial shaping of the image of the elderly, the documentary approach to the subject (private document, public document), the nostalgic and subversive approach to old age. We consider how the various genres of photography create the image of old age, but also for what purposes these images are intended. In doing so, we take into account the negative/ironic/distanced attitude of contemporary society toward old age, being aware that photography both sensitizes and desensitizes us to certain phenomena and, by co-creating them, also perpetuates our ideas of what aging and old age are.W niniejszym artykule autorzy skupiają się na kilku kluczowych pytaniach dotyczących relacji między fotografią i starością. Nie podejmując się zadania zmapowania całego potencjalnego obszaru badania, koncentrują się na kilku punktach stycznych, takich jak: historia medium w kontekście podejmowania wątków dotyczących ludzi w zaawansowanym wieku, komercyjne kształtowanie wizerunku osób starszych, dokumentalne ujęcie tego tematu (dokument prywatny, dokument publiczny), nostalgiczne i subwersyjne podejście do starości. Zastanawiają się nad tym, jak poszczególne gatunki fotografii kreują wizerunek starości, ale także do jakich celów wizerunki te mają służyć. Biorą przy tym pod uwagę negatywne/ironiczne/zdystansowane nastawienie współczesnego społeczeństwa do starości, mając świadomość tego, że fotografia zarówno uczula, jak i znieczula na określone zjawiska, a współkreując je, utrwala wyobrażenia także o tym, czym są starzenie się i starość
