Untangling the Russian-Ukrainian Knot: Representations of the neo-imperialistic Russian political discourse and its analysis in the Polish press materials in the period of 2013–2014 and 2022
No full textMilitary conflicts have symbolic foundations. Be it religion, identity, values, or language, they all may serve as ‘weapons of war’ that either help to rationalize the military action or mobilize the nation. The Russian-Ukrainian war is no exception. The ongoing conflict exceeds the premises of a geo-political game or a socioeconomic ambition and proves itself to be deeply entrenched in a cultural conflict between the two countries. Therefore, the thrust of the paper is to explore the cultural-historical context of the Russia-Ukraine war.Russian imperialistic desires have been whetted by neo-romantic historical narration for the past two decades. The article comprises of two parts – historical and empirical. When the former depicts the history of direct imperial Russian rule over Ukraine, then the latter is a critical overview of Polish press materials commenting on the change in the Russian political discourse concerning Ukraine in the years 2013–2014 and 2022. Such an analysis sheds different light on the current Russian-Ukrainian war, but it also indicates that the conflict we are witnessing now has been carefully prepared on both military and socio-political levels

No full textKara pozbawienia wolności ma zawierać pełną dolegliwość wyrażającą potępienie dla popełnionych czynów zabronionych. Kodeks karny wykonawczy wskazuje, że celem kary pozbawienia wolności jest wzbudzanie w skazanym woli współdziałania w kształtowaniu jego społecznie pożądanych postaw, w szczególności poczucia odpowiedzialności oraz potrzeby przestrzegania porządku prawnego i tym samym powstrzymania się od powrotu do przestępstwa, a co za tym idzie – zapobiegnięcie powrotu do przestępstwa. Zasadniczym zadaniem jest przygotowanie skazanego do życia na wolności, kształtowanie jego odpowiedzialności za czyny, a także woli współdziałania na rzecz jego readaptacji społecznej. Z uwagi na powyższe ustawodawca wprowadził do Kodeksu karnego wykonawczego instytucję trzech systemów wykonywania kary i tym samym przyznał wysoki stopień problematyce oddziaływań podejmowanych w trakcie wykonywania kary pozbawienia wolności, dodatkowo ją akcentując w nadanej każdemu systemowi nazwie. W niniejszym opracowaniu posłużono się analizą danych statystycznych wynikających z prowadzonych badań własnych oraz literaturą przedmiotu w zakresie omówienia systemów wykonywania kary pozbawienia wolności oraz ich wpływu powrotność do przestępstwa. Co powoduje, że skazani po odbyciu kary pozbawienia wolności decydują się na powrót do przestępstwa? Czy rzeczywiście dobrze dobrany system wykonywania kary pozbawienia wolności pozwoli zapobiec ryzyku powrotu do przestępstwa?The penalty of imprisonment is to contain a full ailment expressing condemnation for the committed prohibited acts. The Executive Penal Code indicates that the purpose of imprisonment is to “arouse in the convict the will to cooperate in shaping his socially desirable attitudes, in particular the sense of responsibility and the need to comply with the legal order and thus refrain from returning to crime”, and thus – preventing recidivism. The main task is to prepare the convict for life in freedom, shaping his responsibility for his actions, as well as the will to cooperate for his social readaptation. In view of the above, the legislator introduced the institution of three punishment enforcement systems into the Executive Penal Code and thus gave a high degree to the issue of interactions undertaken during the execution of a penalty of imprisonment, additionally emphasizing it in the name given to each system. This study uses the analysis of the resulting statistical data from own research and literature on the subject in the scope of discussing the systems of execution of the penalty of imprisonment and their impact on recidivism. What causes convicts to return to crime after serving a sentence of imprisonment? Will a well-chosen system of serving a prison sentence really prevent the risk of recidivism

No full textArtykuł składa się z trzech części. Pierwsza – wstępna, omawia status prawny ordynacji
rodowych istniejących na terenie Rzeczypospolitej w momencie odzyskania niepodległości,
a następnie działania władz zmierzające do ich likwidacji w powiązaniu z palącą
w tym okresie kwestią agrarną i reformą rolną. Przedstawione zostały kolejne akty prawne
dotyczące omawianej problematyki, przede wszystkim ustawa w przedmiocie dóbr donacyjnych
oraz ustawy o reformie rolnej.
W części drugiej zawarto analizę aktów prawnych związanych z likwidacją ordynacji
rodowych w byłym zaborze pruskim (bez Śląska) – zarówno polskich aktów wewnętrznych,
jak i układów polsko-niemieckich.
Część trzecia przedstawia dzieje kilku ordynacji na tym terenie od początku istnienia
państwa polskiego aż po ich likwidację. Krótko zaprezentowane zostały zlikwidowane
jeszcze w II Rzeczypospolitej: Księstwo Krotoszyńskie książąt Thurn und Taxis oraz
majorat smogulecki Hutten-Czapskich. Bardziej szczegółowo omówione zostały zlikwidowane
już po II wojnie światowej ordynacje Ostromecko Alvenslebenów i Jarocińska
książąt Radolińskich.An article consists of three parts. The first – the introductory one, describes the legal
status of familial fideicommissa, existing in territories of the Second Polish Republic when
regaining independence. It focuses on authorities’ activity to liquidate fideicommissa concerning
urgent agricultural issues and land reform. Subsequent legislative acts on those
problems, primarily the act on so-called donation estates and act on land reform are presented.
The second part consist of an analysis of legislative acts on liquidating familial fideicommissa
in former Prussian territories (without Silesia) – both Polish internal legislation
and agreements between Poland and Germany.
The third part presents a history of a few fideicommissa in those territories from 1918
to the time of their liquidation. Abolished even before Second World War fideicommissa
on the Krotoszyn estate (so-called ‘Duchy of Krotoszyn’) of Thurn und Taxis princely family
and the Smogulec estate of Hutten-Czapscy family, were shortly presented. More details
were given on fideicommissa liquidated after the Second World War: on the Ostromecko
estate of the Alvensleben family and the Jarocin estate of the princely Radolińscy family

Kwestia ta jest szczególnie ważna dla uczniów zagrożonych niedostosowaniem społecznym, ponieważ bazowanie na potencjale posiadanym przez tych młodych ludzi może prowadzić do ich szybszego uspołecznienia. W artykule zdefiniowano termin „zdolność” oraz ukazano spektrum zdolności wyróżnionych przez Janinę Uszyńską-Jarmoc, Beatę Kunat i Jerzego Mantura. W dalszej części zaprezentowano sposoby rozwijania poszczególnych rodzajów zdolności wychowanków Młodzieżowego Ośrodka Socjoterapii w Solcu nad Wisłą.Developing students’ abilities and talents is both a task and a challenge of modern education. This issue is particularly important for students at risk of social maladjustment, because building on the potential possessed by these young people can lead to their faster socialization. The paper presented here defines the term “abilities” and the spectrum of abilities distinguished by Janina Uszynska-Jarmoc, Beata Kutnar and Jerzy Mantur is shown. Politicians with a Polish migration background in the Bundestag: activities of Agnieszka Brugger and Paul Ziemiak
No full textW artykule ścieżki kariery politycznej oraz główne obszary aktywności partyjnej rozpatrzone zostały przez pryzmat oceny artykułowania preferencji politycznych oraz kreowania korpusu osiągnięć w polityce. Podstawą faktograficzną jest analiza aktywności w niemieckiej przestrzeni publicznej (głównie w Bundestagu) polityków z polskim tłem migracyjnym: Agnieszki Brugger (Sojusz 90/Zieloni) i Paula Ziemiaka (CDU). Celem artykułu jest odpowiedź na pytanie, w jaki sposób Brugger i Ziemiak, specjalizujący się w obszarze polityki międzynarodowej, wpisują się w tożsamość reprezentowanych partii politycznych i formułują nowe propozycje dotyczące reagowania na współczesne i prognozowane wyzwania i zagrożenia. Wskazane zostały główne punkty ich działalności, m.in. związane z zapobieganiem międzynarodowym kryzysom. Ponadto artykuł miał na celu ocenę, czy propozycje Brugger i Ziemiaka wpisują się w klasyczny wizerunek reprezentowanych partii politycznych, czy też wykraczają poza typowe ramy wpływu polityków na przeobrażenie programowe reprezentowanych ugrupowań. Rozpatrzono także, w jakim zakresie opisywani politycy wpływają na relacje polsko-niemieckie.In the article career paths and the main ways of party activity are seen through the prism of evaluation of the articulation of political preferences and the creation of the political corps. The factual basis is the analysis of activity in German public space (mainly in the Bundestag) of politicians with a Polish migration background – Agnieszka Brugger (Alliance 90/The Greens) and Paul Ziemiak (CDU). The purpose of the article was to answer the question, how Brugger and Ziemiak, specialized in the area of international politics, are included in the identity of the represented political parties and formulate new propositions regarding the reaction to current and forecasted challenges and threats. The main points of their activities are given, including the ones related to prevention of the international crisis. In addition, the article aimed to assess whether the proposals of Brugger and Ziemiak fit in a classic image of the represented parties, or whether they influence beyond the typical framework and concern about influencing program transformation of the represented groups. The scale in which the politicians influence Polish-German relations was also evaluated

No full textRozbiory Rzeczpospolitej nie przekreśliły istnienia szeregu dotychczasowych rozwiązań
w dziedzinie skarbowości. W początkach XIX wieku w Księstwie Warszawskim
i Królestwie Polskim zachowano liczne konstrukcje z epoki staropolskiej. Zmiany zaszły
przede wszystkim w dziedzinie zarządu fi nansami państwowymi, lecz już w przypadku
poszczególnych podatków wiele z nich przetrwało długo – zmieniane i reformowane, niektóre
świadczenia publiczne dotrwały nawet do XX wieku. Również struktura dochodów
publicznych nie uległa większym zmianom w epoce porozbiorowej. Dostrzec też można
liczne podobieństwa pomiędzy epoką przedrozbiorową a czasami Księstwa i Królestwa
w przypadku kształtu wydatków publicznych. W XIX wieku na ziemiach polskich w dziedzinie
skarbowości i prawa skarbowego nowe rozwiązania sąsiadowały więc z licznymi
reliktami epoki przedrozbiorowej.The partitions of the Polish-Lithuanian Commonwealth did not cancel out a number
of existing solutions in the sphere of public finance. At the beginning of the 19th century,
a number of structures from the Old Polish era were preserved in the Duchy of Warsaw
and the Kingdom of Poland. Changes took place primarily in the area of the management
of state finances, but in the case of individual taxes many of them lasted for a long
time. Changed and reformed, some public services even survived into the 20th century. The
structure of public revenue did not change much in the post-partition era either. One can
also see many similarities between the pre-partition era and the times of the Duchy and
the Kingdom in the shape of public expenditure. Thus, in the 19th century in the Polish
territory in the field of public finance and fiscal law, new solutions were juxtaposed with
numerous relics of the pre-partition era

No full textW artykule opisano przypadek 67-letniej pacjentki, która została przyjęta do Oddziału Chirurgii Ogólnej z powodu niedrożności przewodu pokarmowego. Śródoperacyjnie stwierdzono przepuklinę rozworu przełykowego. W trakcie odprowadzenia worka przepuklinowego przepukliny przeponowej do jamy otrzewnej stwierdzono linijne pęknięcie na tylnej ścianie żołądka. Przemieszczenie żołądka do klatki piersiowej u chorych z przepukliną rozworu przełykowego stwarza warunki anatomiczne do wystąpienia objawów podobnych do objawów zespołu Boerhaavego. Pęknięcie cewy pokarmowej w obrębie klatki piersiowej z następowym zapaleniem śródpiersia jest obciążone bardzo wysokim ryzykiem zgonu, sięgającym 40%. W publikacji zaprezentowano opis samoistnego pęknięcia tylnej ściany żołądka przemieszczonej do klatki piersiowej. Opisany przypadek, będący jednym z pierwszych w literaturze światowej opisów pęknięcia żołądka w śródpiersiu, wskazuje, że współistnienie rozległej przepukliny rozworu przełykowego, otyłości i perforacji żołądka z następowym zapaleniem płuc jest bardzo trudną w leczeniu sytuacją kliniczną.This article describes the case of a 67-year-old female patient who was admitted to the Department of General Surgery for gastrointestinal obstruction. Intraoperatively, an esophageal hiatal hernia was found. During drainage of the diaphragmatic hernia sac into the peritoneal cavity, a linear rupture was found on the posterior wall of the stomach. The stomach displacement into the thorax in patients with hiatal hernias creates anatomical conditions similar to those in a typical Boerhaave syndrome. Rupture of the gastrointestinal tube in the thorax with subsequent mediastinitis carries a high death risk of up to 40%. In this paper, we describe a spontaneous rupture of the posterior wall of the stomach displaced into the thorax. This case, one of the first descriptions in the literature on gastric rupture in the mediastinum, shows that the coexistence of extensive hiatal hernia, obesity, and gastric perforation with subsequent pneumonia is a very difficult clinical situation to treat
Turkey – the big winner or the big loser of the Russo-Ukrainian war?

Turkey is balancing between Moscow and Kiev, trying to gain ground as a mediator, but also looking after its interests, especially economic ones. The text aims to analyse Turkish-Russian and Turkish-Ukrainian relations, especially since the outbreak of the war, and to answer the question of what the possible consequences of the Russian-Ukrainian war are for Turkey, whether it will be the big winner or rather the big loser of the situation
China -Taiwan relations and their implications for international security
No full textThe victory of the communist forces in the civil war in China resulted in the flight of the government, with the defeated leader Chiang Kai-shek and about 2 million followers, to the island of Taiwan. Hoping for a change in the situation, the President of the Republic of China announced temporary move of the capital of China to Taiwan. At the same time Chinese Communist Party, led by Mao Zedong, took control of the entire territory of mainland China, with the capital in Beijing, announcing the establishment of the People’s Republic of China. This article deals with the assessment of the relationship between those two entities, that have coexisted unchanged since 1949. During this period, they followed different political pathways, but they invariably absorbed international opinion and affected the level of international security. Inspiration to take up this topic came from the significant deterioration of the international situation, influenced by the relationship between the People’s Republic of China and the Republic of China

No full textNiniejszy artykuł poświęcony jest zagadnieniu możliwości uprzywilejowania członka rady nadzorczej spółki z o.o. przez przyznanie mu prawa weta (głosu aprobującego) na forum rady nadzorczej. Zagadnienie to wiąże się z problemem tzw. złotej akcji. Prawo głosu piastuna organu handlowej spółki kapitałowej jest wyrazem osobistego charakteru uprawnienia. Zatem jedna osoba dysponuje jednym głosem. „Złote prawo głosu” jest niedopuszczalne na forum rady nadzorczej z wyjątkiem przypadku, w którym wspólnik wyłaniający swojego przedstawiciela w radzie nadzorczej może decydować samodzielnie o sprawach spółki z o.o.This article is devoted to the issue of the possibility of favoring a member of the supervisory board of a limited liability company. by granting him the right of veto (vote of approval) in the forum of the supervisory board. This issue is related to the so-called “golden stock”. The voting right of the supervisor of the body of a commercial capital company is an expression of the personal nature of the entitlement. So one person has one vote. The “golden right to vote” is inadmissible on the forum of the supervisory board, except for the case in which a shareholder who appoints his representative in the supervisory board may decide independently about the affairs of the limited liability company
