    PRINCIPIO DI EFFICIENZA E RESPONSABILITA' PER DANNO ERARIALE DEI FUNZIONARI DELL'AMMINISTRAZIONE FINANZIARIA

    La stagione delle grandi riforme amministrative, inaugurata nei primi anni ‘90 e tuttora in pieno svolgimento, ha segnato il graduale ma inesorabile passaggio da un’amministrazione “per atti” ad un’amministrazione “per risultati” e, correlativamente, ha imposto ai teorici e ai pratici della materia, se non una radicale revisione, quanto meno una ricomposizione in chiave evolutiva del “sistema” delle responsabilità lato sensu connesse all’agire pubblico. Quest’ultimo, inteso sia come attività (o comportamento) dell’ “apparato”, sia come specifico comportamento (o attività) del singolo funzionario o dipendente dell’Amministrazione, si è infatti arricchito di nuovi e diversi contenuti di “doverosità” che hanno complicato ed in parte ridisegnato il rapporto tra legalità e cura concreta degli interessi pubblici, come pure quello tra “forma” e “sostanza” di atti e provvedimenti. L’odierno legislatore mostra di voler sempre più demitizzare la legalità formale dell’azione amministrativa in favore dell’effettività dei risultati da conseguire ed in nome dei principi di efficienza, efficacia ed economicità, ormai inequivocabilmente normativizzati sia quali parametri (interni) di organizzazione dei Pubblici Uffici, sia quali canoni (esterni) regolanti l’esercizio dei poteri autoritativi. Il presente lavoro si propone, previo inquadramento sistematico delle varie forme di responsabilità connesse all’agere pubblico latamente inteso, di realizzare un significativo avanzamento delle conoscenze sul fronte, per certi versi ancora scarsamente esplorato, delle responsabilità derivanti dall’esercizio inefficiente dell’attività di accertamento tributario, con precipuo e particolare riferimento alla responsabilità per danno erariale dei funzionari dell’Amministrazione Finanziaria in relazione all’adozione di atti impositivi illegittimi ed al non corretto od intempestivo uso del potere di autotutela tributaria

    Sustainability Perspectives of Development in Leh District (Ladakh, Indian Trans-Himalaya): an Assessment

    This thesis deals with a human inhabited territory in the Indian Trans-Himalaya: the Leh District, in Ladakh, at a “crossroad of high Asia”, geographically classified “cold desert”. For many centuries the local population has led a self-reliant existence mainly based upon subsistence agriculture, pastoralism and caravan trade. Modernization, due to governmental programs, and the progressive opening to external influence and resources – i.e. globalization – characterize the current development paths. In this study, emergy evaluation, an environmental accounting system, is utilized to assess the sustainability of the multiple interactions between human activities and the environment. Agricultural practices at small farm level (< 1 hectare) are investigated in detail. Site specific unit emergy values (UEV, emergy per unit product, a measure of the environmental contribution) of five staple crops (barley, wheat, pea, mustard and alfalfa) are calculated. Barley and wheat values (using manure) were 5.27E+05 and 6.64E+05 semj/J, respectively, comparable to those found in the literature for intensive modern agriculture (using chemicals), for which the order of magnitude is 10E+05 to 10E+07 semj/J. As a proxy for “man-made” agricultural soil function, a particular UEV is defined and calculated. The anthropic dynamics of the Leh District are investigated – e.g. government development programs, land-based economy, food security (calculating import dependency ratio), off-farm economy, tourism (estimating tourist receipts), imports of goods and commodities (estimating quantities) – along with physical features and other relevant aspects. Data is collected to evaluate the sustainability of development from the emergy point of view. A set of synthetic indices is calculated in time series (1999-2007) – i.e. emergy per capita (EC), renewability percentage (R%), emergy investment ratio (EIR) and environmental loading ratio (ELR). The results indicate that: the traditional farming system is efficient (UEV) in the use of environmental resources compared to those of modern farming systems (it is therefore argued that the traditional system should be preserved and conserved); the anthropic dynamics in the District have a low impact (ELR) on the environment (ecosphere); although the use of renewable resources (R%) remains high, the sustainability of development (the degree to which the District depends on renewable resources to achieve a certain level of internal organization (EIR) and standard of living (EC)) is decreasing

    Mechanisms of memory formation and consolidation in hippocampal and cortical pyramidal mouse neurons

    The roles of hippocampus and cortex in recent and remote memory processing is well assessed and the association of experience-dependent behavioural modifications with hippocampal and anterior cingulate cortical (ACC) neuron morphological changes at different time points after contextual fear conditioning has been characterised. Although the association between such morphological modifications and biochemical changes related deserves further characterisation. Here, we have previously observed that during the formation of recent contextual fear memory, hippocampal CA1 neurons display morphological changes in parallel with rapid accumulation of EphrinB2, a cell adhesion factor known, in association with its receptor(s), to influence synaptic plasticity and the dynamics of dendritic spines. To investigate whether this process may represent a general marker of induced neuronal plasticity, we studied the conversion of recent -to-remote memory, which ultimately depends on an increase in dendritic spine number of pyramidal neurons of the anterior cingulate cortex (ACC), by analysing the effect of contextual fear conditioning on EphrinB2 levels in these neurons. To this end, we determined dendritic complexity and EphrinB2 levels 24 hours (recent), 7 days (imtermediate) and 36 days (remote) after conditioning in C57BL/6N mice. We observed that EphrinB2 accumulation parallels the increase in spine density of CA1 neurons of conditioned mice, at the recent and intermediate time point, subsequently decreasing at the remote time point. In addition, a similar parallel pattern was observed for neuronal EphrinB2 levels and dendritic complexity in the ACC, which were both increased at the remote time point. The increase in EphrinB2 levels observed in the hipppocampus 24 hr post conditioning and in the ACC 36 days after was prevented by post-training anisomycin treatment. On the contrary, late anisomycin treatmen (24 days post conditioning) didn't prevent EphrinB2 increase in the cortex. These results suggest that accumulation of EphrinB2 is involved in memory-associated cellular modifications detected in both the hippocampus and ACC, and may therefore represent a more general biochemical marker of conditioning-induced neuronal rearrangements

    Il lavoro di ricerca ha voluto offrire un contributo in merito alla disamina del nesso di causalità esistente tra la patologia di mente e l’acting di comportamenti aggressivo-violenti e/o criminosi. Primo obiettivo di ricerca era il tentativo di comprendere se sia oggi risolta, ed in che modo, l’annosa diatriba sulla liceità di associare alla malattia mentale la presenza di un potenziale di rischio per l’adozione di condotte violente e/o criminose. Nello specifico, era in intento di annoverare quali certezze esistano nelle controverse indicazioni poste in oggetto dalla letteratura, che da un lato intende impossibile prevedere la recidiva di un comportamento violento e/o criminoso, e dall’altro ammette la possibilità di un giudizio obiettivo, se frutto dell’adozione di strumenti scientificamente validi. A monte di tale disamina si collocava la personale curiosità scientifica, culturale e professionale, verso il percorso che conduce a mutare un rischio (di comportamenti aggressivo-violenti) in qualcosa che nella sua sussistenza o permanenza (la pericolosità sociale) vede il protrarsi di uno stato che vorrebbe accogliere in sé il rispetto del diritto costituzionale alla cura del malato ed il rispetto della necessità di garantire la difesa di una società “civile”. Secondo obiettivo di ricerca, connesso al precedente, era la volontà di approfondire quale scenario sia oggi indicativo delle possibilità e delle necessità di trattamento di autori di reato affetti da malattia di mente, nell’analisi del contrasto che sorge dall’incontro di due discipline molto diverse: da un lato la psichiatria forense, che ha onere di condurre l’indagine sulla personalità di un soggetto malato, prima ancora che autore di reato, e che in uno scenario così vasto lascia aperti molteplici percorsi; dall’altro la giurisprudenza, che stabilisce invece limitate possibilità al trattamento/contenimento di tale particolare utenza. In tale prospettiva, si è ritenuto necessario porre una riflessione sull’odierno impegno scientifico e normativo volto al tentativo di definire quale organizzazione funzionale e strutturale deve essere data alle sedi, vecchie (gli OPG) e nuove (le strutture territoriali cosiddette Residenze Psichiatriche ad Alta Sorveglianza), atte alla presa in carico di soggetti penalmente prosciolti in quanto malati di mente.E' stata condotta una pregressa review della letteratura per approfondire i motivi della disputa culturale e scientifica inerenti le criticità di poter formulare un corretto giudizio predittivo sulla pericolosità sociale di pazienti psichiatrici. Tale review ha condotto ad intendere come l’odierna comunità psichiatrico-forense, al di là dell’escludere del tutto una significatività nella correlazione tra malattia di mente (in particolare gravi disturbi quali schizofrenia e psicosi) ed adozione di condotte violente e/o criminose, pone nell’attenta analisi di alcuni fattori di rischio insiti nella malattia di mente la risorsa più efficace per orientare la prevedibilità del concetto di pericolosità sociale psichiatrica, nonché le indicazioni più idonee per orientare la presa in carico ed il trattamento penitenziario dei cosiddetti folli rei. Usando a campione un gruppo di soggetti dichiarati non imputabili per una condotta penalmente rilevante in quanto affetti da vizio di mente, e viepiù ritenuti socialmente pericolosi e dunque sottoposti a Misura di Sicurezza detentiva psichiatrica ovvero internato in Ospedale Psichiatrico-Giudiziario (OPG), si è provveduto alla disamina delle correlazioni e delle associazioni tra alcuni fattori di rischio ed il livello di gravità del giudizio di pericolosità ottenuto dall’applicazione della scala HCR-20 (Violence Risk Assessment Scheme – Version 1 Webster, Eaves, Douglas, & Wintrup, 1995; Revision Webster, Douglas, Eaves, & Hart, 1997), strumento tradizionalmente annoverato in molti contesti scientifico-culturali internazionali per la predittività della pericolosità sociale psichiatrica. I risultati ottenuti dall'indagine si sono mostrati interessanti. L'intero percorso di ricerca ha posto come auspicio per il futuro la necessità che lo strumento utilizzato, qui in Italia poco conosciuto (mancante di validazione italiana), possa quanto prima divenire di comune fruibilità nel lavoro degli operatori del settore psichiatrico e forense, pena il mantenimento di una condizione di arretratezza culturale che non può orientare il lavoro di prevenzione, previsione e trattamento socio-sanitario

    T cell exhaustion and microRNAs

    Functional exhaustion of antigen-specific T cells is a feature of many chronic viral infections and the role of miRNAs in this process are not well understood. A typical exhausted T cell is characterized by dysfunctional responses such as low proliferative potential and decreased ability of cytokine production such IL-2, TNF-α and IFN-γ. These defects have been associated with upregulation of inhibitory receptors such as programmed death-1 ( PD-1), a member of the B7:CD28 family, capable to induce T cell exhaustion following the interaction with its own ligands (PD-L1 expressed on all cells and/or PD-L2 particularly expressed on dendritic cells). In this project we studied the early phases of PD-1-dependent T cell exhaustion in healthy individuals and we correlated this phenomenon with the microRNAs profile in these cells. PD-1 positive and PD-1 negative PBL populations from six healthy donors were FACS-sorted and the functional features of CD4+ and CD8+ T cells/ expressing or not PD-1 were analyzed for the intracellular cytokine production in response to polyclonal stimuli. The exhaustion is a gradual process in which IL-2 production is the first function to be lost: our data demonstrated that two samples analyzed were characterized by PBLs/PD-1+ in terminal exhaustion because they produced less IL-2 and IFN-γ after antiCD3/CD28 stimulation than PD-1- T cells; the other four samples analyzed instead were characterized by T lymphocytes in early exhaustion, because PD-1+ T cells produced only less IL-2 when stimulated with antiCD3-CD28. This result demonstrates that PD-1 expression correlates with different degree of exhaustion. To validate both PD-1 and TIM-3 as exhaustion markers, we stimulated T cell clones with mitogenic stimuli in vitro and we analyzed the expression level of both PD-1 and TIM-3, as well as the cytokine production upon the appropriate stimuli. In these conditions, T cell clones upregulated both PD-1 and TIM-3 in relation with impaired cytokine production. Interestingly, upon repeated rounds of stimulation in vitro, T cell clones rescued the capacity of performing their functions in relation with a dramatic downregulation of both PD-1 and TIM-3, suggesting that the exhaustion phenomenon is reversible. This was confirmed by experiments showing rescued cytokine production by PD-1+ T cell clones that had been stimulated in the presence of a blocking anti-PD-L1 antibody. To identify candidate microRNAs in early phases of the exhaustion process, we analyzed the microRNAs expression profile by Taqman Low density array on PD-1+ T cells producing low amounts of IL-2, but normal IFN- The analyses showed that only 23 microRNAs are deregulated in PD-1+ PBLs compared to PD-1- PBLs and that miR-21 resulted the most upregulated. The upregulation of miR-21 were also validated by RT-PCR in functionally-exhausted CD4+ T cell clones coexpressing PD-1 and TIM-3. This dimostrated that miR-21 could be a candidate microRNA in the early phases of T cell exhaustion

    Study of the performances of innovative materials for the treatment of contaminated water

    In this thesis were evaluated the performances of various type of “zeolite like” adsorbents used for wastewater treatment in P&T or PRB installations. This was made up by characterizing the equilibrium behavior, through the construction of isotherms and how they behave in a flow system through the study and evaluation of breakthrough curve. In particular, we take into account water contaminated by emulsified and dissolved oil, high concentrations of organic contaminants (> 100 ppm), inorganic ions, cations as Cd2+, Pb2+, Mn2+ and anions of As. This is a typical situation of produced water or groundwater underlying refineries, depots and petrol stations. It will also evaluate the effect of the presence of salts in solution, because the sites are often located in coastal areas where there are often significant phenomena of saline intrusion. To solve such complex situations of contamination, it was imagined an intervention strategy based on the coupling in series of different adsorption processes, agents selectively on different fractions of contaminants and based on the use of different adsorbent materials. In particular it has been suggested to use: - amorphous mesoporous materials (MSA) for the removal of dispersed and emulsified oil. Mesoporous materials with appropriate open channels have been found effective in removing dissolved and emulsified oil, the result made evident by GC and GC-MS treated real water. We observe the disappearance/reduction of the peaks relating to trimethylbenzenes, naphthalenes and the hydrocarbon fraction to C-33. For these materials can thus hypothesize a plant types used in P & T. Mesoporous materials were used also for the removal of high concentrations of organic contaminants. For this materials we hypothesize an use in the In Well Air Stripping. application, because the inability of these materials to work in the aqueous phase and the good performance in the vapor phase. - titanium silicate materials known from the literature, such as cation exchangers: from the three considered materials, ETS-4 resulting the most promising and not affected to the presence in solution of a salt concentration (NaNO3). - amorphous mesoporous materials functionalized with organic chelating agents for the removal of anions and cations simultaneously. MCM-41, SBA-15 and silica were functionalized with amine pendants for the removal of cations and thiol pendants for removing anions. The MCM-41 material was more promising in the removal of cations, SBA-15 in the removal of arsenic. The obtained results allow to affirm that both type of materials used for the inorganic contamination removal could be used in systems like P & T and PRB. At this point it is necessary to have some consideration about the costs of used materials. For a right evaluation of the total costs it must be keep care all the process from the installation to the end of the reclamation. Immediately, it turn out to have a comparison with the activated carbon that today is the prince of the adsorbent material in P&T and PRB installation, it is clear that for zeolitici materials the unitary cost is bigger. First of all it must be considered that the materials considered in this work are synthesized on a laboratory scale, while it is not possible a direct relation with materials usually produced and used on industrial scale. Besides, as in all the process, the bigger is the required quantity, to small will be the price. Otherwise it need to consider that zeolite like materials compared to activated carbons have some advantages that diminish the total cost of the process. Firstly, the services of the activated carbon are influenced by the presence in water of humic acids and saline concentrations, differently zeolite like materials are not influenced. Zeolite may be regenerated because they have high thermal and mechanical stability, contrary to activated carbon that must be disposed after the use. At the end, but not for importance, zeolite and related materials are selective for the contaminants differently to the activated carbon

    Scienza dentro e fuori: modelli di produzione e trasmissione del sapere scientifico nella società della conoscenza

    Il lavoro esamina le trasformazioni nei meccanismi di produzione e di trasmissione del sapere scientifico nella nuova cornice della società della conoscenza. Quello che è stato definito il passaggio da un'era "accademica" a un'era "post-accademica" della scienza (Ziman 1987) introduce un profondo mutamento sia epistemologico che pratico del mondo di fare scienza che implica il superamento dei confini disciplinari da un lato e l'apertura verso nuovi centri di produzione della conoscenza dall'altro. Analoghe trasformazioni si riscontrano anche sul versante della trasmissione della conoscenza scientifica sia in termini di insegnamento che di trasferimento della conoscenza agli ambienti produttivi. Da ultimo, la natura di "bene pubblico" che la conoscenza assume nella società contemporanea impone che venga posta l'attenzione anche sulla comunicazione esterna della scienza e sulle possibilità che il pubblico dei "non esperti" ha di accedere ed utilizzare le conoscenze scientifiche nell'esercizio dei propri diritti di cittadinanza. Il quadro teorico così delineato viene specificato all'interno del contesto universitario, assunto come campo di osservazione empirica dell'indagine. Da sempre istituzione egemonica nella produzione della conoscenza scientifica, l'università contemporanea è, infatti, sottoposta a diverse pressioni, dovendo raccogliere le sfide dell'era post-accademica pur continuando a offrire una base solida di ricerca e didattica. Le trasformazioni riguardanti la produzione, la trasmissione e la comunicazione della scienza, infatti, si ripercuotono sull'accademia ridefinendo le sue tradizionali "missions" – insegnamento e ricerca - a cui se ne aggiunge una terza – la "terza missione", appunto - che racchiude le diverse e complesse modalità di relazione con il mondo esterno. Tra i diversi attori coinvolti in questo sistema in trasformazione la figura dello scienziato accademico riveste un ruolo particolare in quanto, operando sia sul piano della produzione del sapere che su quello della sua trasmissione, dentro e fuori l'accademia, è chiamato a raccogliere le nuove sfide che la società impone all'università. La parte empirica di questo lavoro, prende le mosse da una serie di interviste in profondità a un gruppo di docenti della Sapienza, membri del Cerms (Centro di Ricerca in Metodologia delle Scienze) e afferenti a diversi settori scientifico-disciplinari, assunti come testimoni privilegiati di questi cambiamenti. Attraverso una traccia articolata in tre sezioni dedicate rispettivamente alla dimensione della ricerca, della didattica e della comunicazione della scienza si sono delineati i principali tratti del mutamento e il ruolo che l'università sta assumendo in questo nuovo scenario. Dal punto di vista metodologico, l'analisi delle interviste è stata svolta ricorrendo ad un approccio mixed che integra l'analisi lessicometrica e l'analisi ermeneutica dei testi, svolte con l'ausilio dei software TalTac2, SPAD e Atlas.ti. In particolare, l'analisi statistica dei frammenti ha consentito, in primo luogo, di far emergere delle prime dimensioni semantiche attraverso la prossimità delle parole presenti nei frammenti di testo analizzato, che hanno guidato la successiva fase ermeneutica di codifica dei contenuti. Questa, a sua volta, ha permesso di addentrarsi all'interno dei concetti espressi dagli intervistati, realizzando una convergenza tra i risultati dei due metodi. Infine, a partire dalle evidenze emerse, si è giunti alla formulazione di un modello interpretativo, rappresentato in una mappa concettuale, attraverso cui leggere le trasformazioni in atto all'interno dell'università sia in chiave epistemologia che in chiave empirica, alla luce del contesto socio-culturale della società della conoscenza in cui essa è inserita
