Are your gains threat or chance for me? A social comparison perspective on idiosyncratic deals and coworkers’ acceptance

    No full text
Idiosyncratic deals (i-deals) refer to customized work arrangements and employment conditions employees negotiate with employers. Significant scholarly attention has been paid to understand the responses of i-deals’ recipients. However, little attention has been paid to coworkers’ reactions to the i-deals. This study examines how coworkers react to focal employees’ i-deals. We tested our hypotheses with a sample of 253 employee–coworker pairs and found that coworkers are more likely to accept focal employees’ flexibility i-deals than development i-deals. Specifically, we found that coworkers view focal employees’ development i-deals as more threatening to their status than flexibility i-deals, and status threat mediates the relationship between development i-deals and coworkers’ acceptance. In addition, flexibility i-deals increase coworkers’ perception of obtaining future i-deals more than development i-deals, and this perception mediates the relationship between flexibility i-deals and coworkers’ acceptance. Furthermore, the results show that coworkers’ relative leader–member exchange moderates the above relationships

The Angel Wears Prada, the Devil Buys It on The RealReal: Expanding Trademark Rights Beyond the First Sale Doctrine

Luxury brands derive their goodwill from the high-class exclusivity and first-rate quality signified in their trademarks. The Trademark Act of 1946, commonly known as the Lanham Act, grants trademark holders the right to control use of their mark. However, under common law, the first sale doctrine restricts trademark protection after holders authorize the initial sale of their trademarked product. Such limitation particularly jeopardizes the luxury industry as trademark holders ultimately bear the loss of goodwill when counterfeit luxury goods enter the market due to the negligence of resellers. This Comment illustrates how blockchain authentication offers all luxury industry participants—the brands, the consumers, and the resellers—added protection under the material difference and quality control exceptions to the first sale doctrine of trademark law. Furthermore, this Comment proposes codification of the “first resale” doctrine to narrow the scope of the first sale doctrine defense to trademark infringement for the purpose of fostering competition and maintaining quality in the luxury industry

Ensnared Care: How Restrictive Healthcare Laws Impact Mothers

    Get PDF
Do restrictive healthcare policies impact whether expectant mothers receive adequate prenatal care? Could such policies also affect access to alternative birthing options for delivery? Through a literature review and a two-way fixed effects model using panel data, this study investigates two categories of state-level restrictive healthcare policies: scope of practice laws and certificate of need laws. The literature demonstrates the detriments of scope of practice care on access to care and maternal health. However, the statistical models presented on scope of practice find no relationship between scope of practice laws and adequate prenatal care or alternative birthing options. Though the literature finds that on the whole, certificate of need laws negatively impact access to care, the literature has nothing to say about certificate of need and maternal healthcare specifically. To that end, this study finds that states with certificate of need laws increases the rates of inadequate prenatal care by 8%. To address this issue, policymakers should focus targeting states with certificate of need laws that regulate services related to maternal healthcare, such as West Virginia, Kentucky, and Florida
