    Determining teachers' attitudes about in-service training activities

    Bu çalışmada, devlet okulu ve özel okulda çalışmakta olan ilköğretim ve ortaöğretim seviyelerindeki öğretmenlerin hizmet içi eğitimlere karşı tutumları araştırılmıştır. Bu hizmet içi eğitim etkinliklerine ilişkin tutumlarının cinsiyet, branş, okul türü, kıdem ve öğretmenin girmiş olduğu sınıf seviyesi değişkenlerine göre farklılaşıp farklılaşmadığı belirlenmeye çalışılmıştır. Öğretmenlerin hizmet içi eğitim etkinliklerine ilişkin tutumlarını belirlemek amacıyla “Hizmet içi Eğitim Etkinliklerine İlişkin Tutum Ölçeği” kullanılmıştır. Bu amaç doğrultusunda tarama modeli kullanılarak yapılan bu araştırmada 2020-2021 öğretim yılında İstanbul ili, Eyüp ilçesi, Göktürk mahallesinde görev yapan 89 öğretmene araştırma anketi uygulanmıştır. Araştırmada yapılan analizler sonucunda öğretmelerin hizmet içi eğitimlere karşı tutumlarının okul türü ve branşa göre anlamlı farklılık gösterdiği, öğretmenin girmiş olduğu sınıf düzeyi, cinsiyet ve deneyimine göre anlamlı bir farklılık göstermediği sonucu elde edilmiştir

    Identification of uncertainty levels of acoustic properties of biocomposites under different mounting conditions in impedance tube tests

    Impedance tube method is widely used to measure acoustic properties of materials. Although this method yields reliable acoustic properties for soft textured materials, uncertainty levels of measured acoustic properties for hard materials, including biocomposites, can be quite large, mainly due to uncertain mounting conditions. Here, the effects of mounting conditions on the acoustic properties of biocomposites in an impedance tube are investigated. First, nominally identical biocomposite samples with a diameter equal to the inner diameter of impedance tube are manufactured and their acoustic properties are determined. As hard materials practically cause fitting problems in the impedance tube, the diameters of samples are reduced, as in practice, by small amounts and acoustic properties of modified samples are determined. Furthermore, in order to match the diameters of samples to the inner diameter of impedance tube, different materials such as tape, petroleum jelly and cotton are applied around samples to close the air gap between the samples and the tube's inner wall. All the results are compared, and the uncertainty levels caused by different mounting conditions on the acoustic properties of biocomposites are identified. The results show that the transmission loss (TL) measurements are dramatically affected by the mounting conditions while the sound absorption conditions are less sensitive to the mounting conditions. The deviations in the measured TL levels are highest for the samples with tape and wax (10–15 dB).     Acoustic cavitation model based on a novel reduced order gas pressure law

    The thermal behavior of a spherical gas bubble in a liquid excited by an acoustic pressure signal is investigated by constructing an iterative solution of the energy balance equations between the gas bubble and the surrounding liquid in the uniform pressure approximation. This iterative solution leads to hierarchy equations for the radial partial derivatives of the temperature at the bubble wall, which control the temporal rate of change of the gas pressure and gas temperature within the bubble. In particular, a closure relation for the hierarchy equations is introduced based on the ansatz that approximates the rapid change of state during the collapse of the bubble from almost isothermal to almost adiabatic behavior by time averaging the complex dynamics of change of state over a relatively short characteristic time. This, in turn, leads to the desired reduced order gas pressure law exhibiting power law dependence on the bubble wall temperature and on the bubble radius, with the polytropic index depending on the isentropic exponent of the gas and on a parameter that is a function of the Péclet number and a characteristic time scale. Results of the linear theory for gas bubbles are recovered by identifying this parameter as a function of the Péclet number based on the Minnaert frequency. The novel gas pressure law is then validated against the near-isothermal solution and against the results of the numerical simulations of the original energy balance equations for large amplitude oscillations using spectral methods. Consequently, an acoustic cavitation model that accounts for phase change but that neglects mass diffusion is constructed by employing the reduced order gas pressure law together with the Plesset–Zwick solution for the bubble wall temperature and the Keller–Miksis equation for spherical bubble dynamics.     Structural assessment of the 13th century great mosque and hospital of Divrigi: A world heritage listed structure

    . The Great Mosque and Hospital of Divrigi is located in the central eastern part of Turkey, in Divrigi, Sivas. The historical facility consists of a monumental mosque and a two-story hospital, which are adjacent to each other. The structure dates back to 13th century Mengujekids period and has been listed by the UNESCO as a World Heritage since 1985. Great Mosque and Hospital of Divrigi is particularly notable for its monumental stone portals that are decorated with three-dimensional ornaments carved from stone. The structural system of the monument consists of multi-leaf stone masonry walls and stone piers that support the roof structure which consists of stone and brick arches and vaults. The structure is located about 90 km away from the North Anatolian Fault Line, that has been causing several destructive earthquakes. Consequently, the structure is prone to destructive seismic activities. In this study, after a brief introduction on the structural system and current condition of the structure, the structural performance of the Great Mosque and Hospital of Divrigi is investigated through site observations and structural analyses. For this purpose, linear and nonlinear 3D finite element models of the structure are developed and the structure is examined under the effects of vertical loads and seismic actions.     This interdisciplinary volume examines how nine arid or semi-arid river basins with thriving irrigated agriculture are doing now and how they may change between now and mid-century. The rivers studied are the Colorado, Euphrates-Tigris, Jucar, Limarí, Murray-Darling, Nile, Rio Grande, São Francisco, and Yellow. Engineered dams and distribution networks brought large benefits to farmers and cities, but now the water systems face multiple challenges, above all climate change, reservoir siltation, and decreased water flows. Unchecked, they will see reduced food production and endanger the economic livelihood of basin populations

    Development of a new solar, gasification and fuel cell based integrated plant

    Despite its shortcomings, fossil-based fuels are still utilized as the main energy source, accounting for about 80% of the world's total energy supply with about one-third of which comes from coal. However, conventional coal-fired power plants emit relatively higher amounts of greenhouse gases, and the derivatives of air pollutants, which necessitates the integration of environmentally benign technologies into the conventional power plants. In the current study, a H2–CO synthesis gas fueled solid oxide fuel cell (SOFC) is integrated to the coal-fired combined cycle along with a concentrated solar energy system for the purpose of promoting the cleaner energy applications in the fossil fuel-based power plants. The underlying motivation of the present study is to propose a novel design for a conventional coal-fired combined cycle without altering its main infrastructure to make its environmentally hazardous nature more ecofriendly. The proposed SOFC integrated coal-fired combined cycle is modeled thermodynamically for different types of coals, namely pet coke, Powder River Basin (PRB) coal, lignite and anthracite using the Engineering Equation Solver (EES) and the Ebsilon software packages. The current results show that the designed hybrid energy system provide higher performance with higher energy and exergy efficiencies ranging from 70.6% to 72.7% energetically and from 35.5% to 43.8% exergetically.     Branch-and-price-and-cut methods for the electric vehicle routing problem with time windows

    Funding agency : Turkiye Bilimsel ve Teknolojik Arastirma Kurumu (TUBITAK) Grant number : 118M412In this paper, we address the electric vehicle routing problem with time windows and propose two branch-and-price-and-cut methods based on a column generation algorithm. One is an exact algorithm whereas the other is a heuristic method. The pricing sub-problem of the column generation method is solved using a label correcting algorithm. The algorithms are strengthened with the state-of-the-art acceleration techniques and a set of valid inequalities. The acceleration techniques include: (i) an intermediate column pool to prevent solving the pricing sub-problem at each iteration, (ii) a label correcting method employing the ng-route algorithm adopted to our problem, (iii) a bidirectional search mechanism in which both forward and backward labels are created, (iv) a procedure for dynamically eliminating arcs that connect customers to remote stations from the network during the path generation, (v) a bounding procedure providing early elimination of sub-optimal routes, and (vi) an integer programming model that generates upper bounds. Numerical experiments are conducted using a benchmark data set to compare the performances of the algorithms. The results favour the heuristic algorithm in terms of both the computational time and the number of instances solved. Moreover, the heuristic algorithm is shown to be specifically effective for larger instances.     Avrupa Ekonomik Komisyonu (ECE) tarafından 19 Mayıs 1956 tarihinde imzaya açılan ve 2 Temmuz 1961 tarihinde yürürlüğe giren Eşyaların Karayolundan Uluslararası Nakliyatı İçin Mukavele Sözleşmesi'ne ("CMR") Türkiye 4 Ocak 1995 tarihinde taraf olmuştur. CMR'nin 1. maddesi uyarınca yükleme veya boşaltma yerlerinden birinin âkit ülke olması halinde CMR'nin öncelikli olarak uygulanması taraf devletler bakımından zorunluluk teşkil etmekte olup yükleme veya boşaltma yeri Türkiye olan bütün karayolundan taşımalarda CMR hükümleri öncelikle uygulama alanı bulmaktadır. Çalışmamızda, CMR'ye tabi taşımalarda, taşıyıcının yardımcı kişilerin, özellikle de alt taşıyıcıların eylemlerinden doğan sorumluluğu ve yine CMR'ye tabi taşımalarda taşıyıcılar arası rücu ilişkileri incelenecektir. CMR'de taşıyıcının yardımcı kişinin eylemlerinden doğan sorumluluğunun ve taşıyıcılar arası rücu ilişkilerinin kapsamının tespit edilebilmesi için ilk olarak CMR'nin uygulama alanının belirlenmesi gerekmektedir. Bu doğrultuda, çalışmanın ilk bölümünde CMR'nin tarihçesinden bahsedildikten sonra bir taşımanın CMR'ye tabi olmasının şartları, taşıma sözleşmesinin unsurları ve CMR kapsamında kimin taşıyıcı olarak kabul edildiği açıklanacaktır. Bunu takiben, CMR m.3 hükmünde düzenlenen taşıyıcının yardımcı kişinin eylemlerinden doğan sorumluluğunun temellerinin ortaya konabilmesi için; borçlunun yardımcı kişinin eylemlerinden doğan sorumluluğunu düzenleyen 6098 s. Türk Borçlar Kanununun (TBK) 116. maddesi ele alınacaktır. Bu doğrultuda, borçlunun yardımcı kişinin eylemlerinden doğan sorumluluğunun hukuki temelleri ortaya konacaktır. Ardından CMR m.3 hükmü detaylı olarak incelenecektir. CMR m.3 hükmü uyarınca taşıyıcı kendi çalışanlarının, temsilcilerinin ve bağımsız yardımcı kişilerinin sebep olacağı zararlardan, bizzat kendi fiili gibi sorumludur. Beri yandan, CMR m.3 hükmü uyarınca taşıyıcının sorumluluğuna gidilebilmesi için, öncelikle sorumluluğu doğuran sebebin CMR kapsamında kalması gerekir. Bu doğrultuda, CMR m.3 hükmü kapsamında taşıyıcının çalışanları, temsilcileri ve bağımsız yardımcı kişilerinin sebep olduğu zararlardan taşıyıcının sorumluluğunun hukuki temeller, şartları ve kapsamı açıklanacaktır. Bunu takiben CMR m.3 uyarınca açılacak sorumluluk davasının şartları özellikle de davalardaki dava takip yetkisi incelenecektir. 6102 s. Türk Ticaret Kanununun ("TTK") dördüncü kitabı olan "Taşıma İşleri"nin büyük ölçüde CMR'den ve 1998 tarihli Alman Taşıma Reform Kanunundan ("1998 Alman-TRG") iktisap edilmiş olması ve CMR'de boşluk bulunan hallerde tamamlayıcı hukuk kuralı olarak kanunlar ihtilafı kuralları dikkate alınarak ulusal mevzuata başvurulacak olması gerekçeleriyle, TTK'da taşıyıcının yardımcı kişilerin eylemlerinden doğan sorumluluğu mülga 6762 s. Türk Ticaret Kanunu ile karşılaştırılarak incelenecektir. Ayrıca, doktrindeki bazı görüşlere göre CMR'de dava takip yetkisi düzenlenmemiş olup dava takip yetkisinin belirlenmesi açısından kanunlar ihtilafı kurallarına ve ulusal mevzuata başvurulması gerektiğinden TTK'ya tabi kara taşımalarından doğan uyuşmazlıklarda ikame ettirilecek sorumluluk davası ve Türk Hukuku bakımından yeni bir hüküm olan ve dava takip yetkisini düzenleyen TTK m.871 f.1 kaynak HGB § 421 f.1 ile birlikte hükmü ele alınacaktır. CMR m.3 hükmündeki genel düzenleme haricinde, birden fazla taşıyıcı tarafından gerçekleştirilen taşımalara ve taşıyıcılar arası rücu ilişkilerine ilişkin CMR'de yer alan tek düzenleme, CMR'nin VI. Bölümde m.34 ila 40 hükümlerinde düzenlenen müteakip taşıma hükümleridir (Resmi Türkçe tercümeye göre: Taşımacılar Tarafından Ortaklaşa Yapılan Taşımalarla İlgili Hükümler"). Bununla beraber, doktrinde ve âkit ülkelerde, müteakip taşımanın ayrı bir bölümde yer alması ve CMR m.34 hükmünün belli başlı şartlar getirmesi sebebiyle, müteakip taşıma hükümlerinin CMR'ye tabi bütün alt taşımalarda uygulanıp uygulanamayacağı, bir başka söyleyişle, CMR m.34 hükmünde öngörülen şartlar gerçekleşmeden müteakip taşıma hükümlerinin alt taşımalara ilişkin sorumluluk davalarına ve rücu davalarına tatbik edilip edilemeyeceği tartışmalıdır. Bu soruna bir yanıt aramak için müteakip taşıma hükümleri, bu düzenlemeye ilişkin doktrindeki ve yargı kararlarındaki yaklaşım açıklanacaktır. Çalışmamızın VI. ve son bölümünde ise, CMR'ye tabi taşımalarda taşıyıcılar arası rücu ilişkileri incelenecektir. Bu amaçla ilk olarak âkit ülkelerdeki özellikle de Alman Hukukundaki uygulama ve görüşler ele alınacaktır. Ardından, CMR'ye tabi alt taşımalara ve taşıyıcılar arası uyuşmazlıklara ilişkin Türk Hukukunda çelişkili mahkeme kararları ortaya konarak doktrindeki bu konudaki yaklaşımlara yer verilecektir. Türk Hukukunda CMR'ye tabi taşımalarda birden fazla taşıyıcının dahil olduğu taşımalara ilişkin hem sorumluluk hem de rücu davalarında Türk Hukukunda yeknesak bir uygulama ve doktrinde bir uzlaşı olmaması sebebiyle, sürpriz karar yasağı kuralına uygun olarak taşıyıcılar arası rücu davalarında başvurulabilecek yollar açıklanacaktır. Son olarak, CMR'ye tabi taşıyıcılar arası rücu davalarında Türk Hukukunda yeknesak bir uygulama olmaması sebebiyle, Türk Hukukuna ve CMR'ye en uygun düştüğünü düşündüğümüz çözüm yolu önerilecektir.Turkey has become a party to the Convention on the Contract for the International Carriage of Goods by Road ("CMR") on 4 January 1995, which was opened for signature by the Economic Commission for Europe ("ECE") on 19 May 1956 and has entered into force on 2 July 1961. Briefly, in accordance with Article 1 of the CMR, if one of the taking over of the goods or the place designated for delivery is a contracting country, the CMR shall be applied to the carriage by road. Therefore, the CMR shall be applied to all international carriages by road from and to Turkey. In our study, the liability of the carrier arising from its agents' and servants' and of any other persons' acts or omissions, especially the sub-carriers', of whose services it makes use for the performance of the carriage and additionally, the recourse relations between the carriers in the carriages by road falling within the scope of the CMR will be examined. In order to determine the liability of the carrier arising from the acts and omissions of its persons and the scope of the recourse relations between the carriers under the CMR, the scope of application of the CMR must first be determined. Accordingly, in the first part of the study, following the brief explanation on the history of the CMR, the conditions for a carriage to be subject to the CMR, the elements of the contract of carriage and who is deemed as a carrier within the scope of the CMR will be explained. Following that in order to specify the legal ground of the liability of the carrier arising from the acts or omissions of its persons under the CMR, Article 116 of the Turkish Code of Obligations numbered 6098 ("TCO") which regulates the liability of the debtor arising from the acts or omissions of its person will be discussed. Then Article 3 of the CMR will be examined in detail. Pursuant to Article 3 of the CMR, the carrier is responsible for the damages caused by its persons, as if such acts or omissions were his own. On the other hand, in order to hold the carrier liable in accordance with Article 3 of the CMR, the reason giving rise to the liability must fall within the scope of CMR in the first place. Accordingly, the legal basis, conditions and scope of the liability of the carrier for the damages caused by the carrier's persons under Art.3 of the CMR will be explained. Following that, the conditions of the lawsuit to be filed against the carrier and its persons for the claims falling under the scope of the CMR Art.3, especially the title to sue, will be clarified. Due to the fact that the fourth book of the Turkish Commercial Code numbered 6102 ("TCC") namely "Transport Affairs", was mostly acquired from the CMR and the German Transport Reform Law of 1998 ("1998 German-TRG") and due to the fact that the national law as a complementary legal rule shall be applied by taking into account the conflict of laws rules in case there is a gap in the CMR, the liability of the carrier arising from the acts and omissions of its persons under the TCC as well as under the former Turkish Commercial Code numbered 6762 will be analysed. In addition, according to certain opinions in the doctrine, as the title to sue is not regulated in the CMR, it is necessary to apply to the rules of conflict of laws and national legislation in order to determine the title to sue. In this respect, a brand-new provision in terms of Turkish Law, Article 871/1 of the TCC regulating the title to sue, will be discussed by way of comparing with HGB § 421/1. Except for the general regulation of the Art.3 of the CMR, the only regulation in the CMR with regard to the carriage performed by more than a single carrier and recourse relations between the carriers are the Provisions Relating to Carriage Performed by Successive Carriers stipulated between the Articles of 34 and 40 in the Chapter VI. However, in the doctrine and in the contracting countries, it is controversial whether the successive carriage provisions can be applied to all sub-carriages without taking into consideration the conditions specified in Art.34 of the CMR. In order to seek an answer to this problem, the provisions regarding the successive carriage, the approach in the doctrine and judicial decisions with regard to the successive carriages and sub-carriages will be explained. In the VI. Part of this study, recourse relations between the carriers subject to the CMR will be examined. For this purpose, first of all, the practices and opinions in the contracting countries, especially in the German Law, will be discussed. Then, conflicting court decisions and approaches in the doctrine in Turkish Law concerning the sub-carriages and recourse disputes between carriers subject to CMR will be put forward. Since there is no uniform application and doctrine opinion in Turkish Law in both liability and recourse cases with regard to the carriages performed by more than one carrier in the carriages subject to CMR, the ways that can be applied in such cases will be set forth taking into account the rule of legal certainty. Finally, due to the lack of a uniform application in Turkish Law in recourse cases between carriers subject to CMR, the solution method that we believe is the most suitable for Turkish Law and CMR will be suggested

    Hukukun uluslararası alanda birleştirilmesi (unification), ulusal hukukların yakınlaştırılması veya denkleştirilmesi (rapprochement) ya da hukuk düzenlerinin uyumlaştırılması (harmonization) amacıyla, uluslararası kuruluşlar (BM, Avrupa Konseyi, WIPO vb.) tarafından genellikle uluslararası sözleşmeler (international convention) yapılması veya model kanunlar (model laws) hazırlanması yöntemlerine başvurulmaktadır. Ancak uluslararası deneyimler ortaya koymaktadır ki, bu yöntemler başarılı olmamakta; sözleşmelerin hazırlanması veya model kanunların oluşturulmasındaki coşku ve heyecan, bu belgelerin kabul ve onaylanma aşamalarında gücünü yitirmekte; üye devletlerin çeşitli siyasal ya da sosyal olaylarla uğraşmak zorunda kalmaları birleştirme, denkleştirme veya uyumlaştırma etkinliklerini engellemektedir. Bu nedenledir ki, söz konusu amaçlara varılabilmesi için yasa çıkarma ya da hukuk kuralları koyma yöntemleri yerine, birleştirilmiş veya uyumlaştırılmış hukuk normlarını içeren belgeler veya derlemeler oluşturulmasının amaca daha uygun olacağı tavsiye edilmektedir. İşte "Uluslararası Ticari Sözleşmelere ilişkin Unidroit İlkeleri" bu yaklaşımın tipik ve en başarılı örneklerinden biridir.
