Prediction of Loan Decisions with Optical Neuroimaging (fNIRS) and Machine Learning
No full textThe successful applications of neuroscientific methods and artificial learning approaches have increased in applied fields such as economics, marketing, and finance in the last decade. In this study, a prediction model was developed using the output of optical neuroimaging (fNIRS) measurements from the prefrontal brain regions while 40 participants made decisions for 35 credit offers. The aim was to predict participants' responses to credit offers using artificial learning methods based on four metrics obtained over time from the optical neuroimaging system. The findings of the study indicate that the first 6 seconds (prior to the response entry) are particularly critical. Supporting novice mathematics teachers: The impact of an ementoring and video-based professional development program on teachers’ noticing skills
No full textThis paper focuses on e-mentoring of novice mathematics teachers as professional development, and reports findings of the e-mentoring practices enriched with videos to improve noticing skills of novice teachers. A single group pre- and post-test study was conducted with the participation of 17 mentees, novice middle school mathematics teachers. Participants’ noticing skills were assessed through a whole-class teaching video shown to them before and after the intervention. The responses of the teachers to the video assessment were analyzed considering attending, interpreting and decision-making dimensions of noticing. The results revealed that the ementoring program improved the novice mathematics teachers’ noticing skills significantly in all dimensions.Nisa
Judicial Remedy About the Action for Annulment of Collocation Table Organized by the Savings Deposit lnsurance Fund in the Light of the Decisions of the Court of Jurisdictional Disputes
No full textBu çalışmada Tasarruf Mevduatı Sigorta Fonu (TMSF) tarafından bankaların iflas tasfiyesi sürecinde düzenlenen sıra cetveline itiraz davasının görüleceği yargı yolu hakkında Uyuşmazlık Mahkemesi'nin verdiği kararlardan yola çıkılarak bir inceleme yapılmıştır. Sıra cetveline itiraz davasında görevli mahkeme, İcra ve İflas Kanunu'nun 235. maddesinin 1. fıkrasına göre asliye ticaret mahkemesidir. Buna karşılık TMSF'nin yürüttüğü iflas tasfiyesi bakımından sıra cetveline itiraz davası açılması, TMSF'nin işleminin idari işlem olup olmadığı ve bu işleme açılan davalar bakımından idari yargının görevli olup olmadığı tereddüt doğurmaktadır. Çalışmanın konusu olan dava bakımından Uyuşmazlık Mahkemesi'nin kimi zaman adlı yargıyı kimi zaman da idari yargıyı görevli kabul ettiği ve birbiri ile çelişen kararları bulunmaktadır. Bu doğrultuda Uyuşmazlık Mahkemesi'nin söz konusu kararları incelenmiş, ardından TMSF'ye karşı açılan sıra cetveline itiraz davasının hangi yargı yolunda görülmesi gerektiği konusunda açıklamalar yapılmıştır.An examination was made on the basis of the decisions of the Court of Jurisdictional Disputes regarding the judicial remedy in which the action for annulment of collocation table, in which the bankruptcy liquidation process of the banks was organized by the Savings Deposit lnsurance Fund, will be heard. The court in charge of the action for annulment of collocation table is the commercial court of first instance, according to the 1st paragraph of Article 235 of the Enforcement and Bankruptcy Law. On the other hand, filing an action for annulment of collocation table in terms of the bankruptcy liquidation carried out by the TMSF raises doubts whether the TMSF's transaction is an administrative action and whether the administrative judiciary is responsible for the lawsuits filed against this transaction. The case that is the subject of the study, the Court of Jurisdictional Disputes has sometimes conflicting decisions, which considers the judicial and sometimes the administrative judiciary to be their duty. in this direction, the said decisions of the Court of Jurisdictional Disputes were examined, and then, explanations were made about which judicial way the appeal against the Savings Deposit lnsurance Fund should be filed.Hazira

Mechanisms to Enhance Women Representation in Corporate Boards
No full textKadınların şirket yönetim kurullarında temsilinin sağlanmasına yönelik yaklaşımının temelinde sürdürülebilir kalkınmanın sağlanabilmesinin koşullarından biri olarak toplumsal cinsiyet eşitliğinin tesisini öngören bakış açısı yer almaktadır. Gerçekten 2015 yılında Birleşmiş Milletler Genel Kurulu'nda kabul edilen on yedi adet Sürdürülebilir Kalkınma İlkesi arasında yer alan beş numaralı ilke, toplumsal cinsiyet eşitliğinin tesisini sürdürülebilir kalkınmanın sağlanabilmesi için ulaşılması gereken bir hedef olarak ortaya koymaktadır.Toplumsal cinsiyet eşitliğinin sağlanması öncelikle kadınların ve kız çocuklarının maruz kaldıkları cinsiyet temelli ayrımcılığın ortadan kaldırılması; bunun yanında özellikle kadınların ekonomik kaynaklara ulaşma ve bunlar üzerinde eşit haklara sahip olmaları; siyasi, sosyal ve ekonomik karar alma mekanizmalarında temsillerinin sağlanması gibi yaklaşımları da beraberinde getirmektedir. Sürdürülebilir bir gelecek, ancak toplumsal cinsiyet eşitliğinin sağlanması ile mümkün olacaktır. Cinsiyet temelli ayrımcılığın ortadan kaldırılması, basit bir insan hakları hukuku meselesi gibi ortaya çıkmaktaysa da aynı zamanda ekonomik gelişme ve büyümenin sağlanmasının da anahtarıdır.
Konuya şirketler hukuku cephesinden baktığımızda, kadınların ekonomik karar alma mekanizmalarında temsilinin sağlanması bakımından en etkili araçlardan biri kadınların şirket yönetim organlarında temsilidir. Temsile ilişkin bu mekanizmanın kurulması, farklı hukuk sistemlerinde bu sistemlere uygun enstrümanlar kullanılmak suretiyle gerçekleştirilmiştir.The enhancement of women's representation in company boards serves for the very purpose of sustaining gender equality, which is principle number five among seventeen Sustainable Development Principles adopted by the United Nations General Assembly in 2015. According to that principle gender equality must be sustained in order to achieve sustainable development. More specifically ensuring gender equality primarily entails elimination of gender based discrimination against women and girls; and in addition to that, granting women's access to economic resources and equal rights over them. it alsa requires creation of tools such as ensuring their representation in political, social and economic decision making mechanisms. A sustainable future will only be possible with the realization of gender equality. Eliminating gender based discrimination appears to be a simple matter of human rights law, but is alsa key to achieving economic development and growth.From a perspective of company law, one of the most effective tools in terms of ensuring the representation of women in economic decision making mechanisms is the representation of women in company management bodies. The establishment of these representation mechanisms has been carried out in different legal systems by way of using different legal instruments suitable for these systems.Aralı
