When I first met Nabae-sensei, I have to admit I was a little intimidated. 
There she was, all the way from Kobe, Japan, on my computer screen 
during a Skype interview for a job I was dying to get. But as soon as she 
spoke, I knew I had nothing to worry about. Her warmth and 
professionalism immediately put me at ease, and we began a conversation 
that continues to this day.  
In the pre-COVID days when department members could drop by one 
another ’s office for a chat, Nabae-sensei would sometimes ask me about 
some convoluted English in work she was teaching. I’d provide my 
insightful interpretation of a passage from Henry James, and she would 
typically respond with something like, “Hmm, that’s an interesting take, 
but what about this possible meaning?” It was like she had a secret decoder 
ring for English words and phrases, and I would see that the passage 
encompassed more subtle ambiguity than I had imagined. This skill  
bolsters her expertise in James’s work and is one reason why she has risen 
to international prominence in the field. Nabae-sensei is also deservedly 
well-known for her work on Lafcadio Hearn. Her book The Spirit of No 
Place: Reportage, Translation and Re-told Stories in Lafcadio Hearn  is a 
fascinating exploration of Hearn’s life and work, and every time I read 
one of his stories, I can hear Nabae-sensei’s voice guiding me through the 
narrative. 
In addition to helping me get to know James and Hearn, Nabae-sensei 
introduced me and my wife to many of her literary associates and friends.

She has a knack for bringing people together: “There’s someone that you 
should meet” is a phrase I’ve heard her speak many times. She brings 
people together for lectures, poetry readings, day trips, afternoon tea, 
dinner parties .  .  .  hers is a spirit  of gathering. Nobody can take her place 
when it comes to gathering people, and I am sure I speak for all when I 
say we are happy for her retirement, but we will miss her and her radiant 
energy to bring people together.  
 
Nabae-sensei’s farewell message would not be complete without some 
reflections from other department members who have come to know her 
well over the years.

In last year ’s university journal, it  was suggested that Nabae-sensei is a 
majo of formidable supernatural powers, and I am writing here to confirm 
the strength of those powers. Having had the pleasure and honor of 
working with her for nearly three decades, I witnessed first-hand how she 
frequently utilized her boundless and inexhaustible witchery, always for 
the good of her students, her department and colleagues, the university, 
and the academic societies she so diligently served. She also, importantly, 
initiated and organized numerous extracurricular events, which included 
inviting a wide range of guest speakers and lecturers who helped to deepen 
and enrich the curricula made available to students, faculty, and 
community. At the same time, she was always deepening herself, not only 
through her research and the forging of her widely published scholarly 
writings, but also, lest we forget, her pursuit and completion of a Ph.D. at 
Stanford University during her early years at Gaidai. All in all, a most 
magical feat. 
Just how Nabae-sensei was able to tap into the source of her 
amaranthine energies is beyond my knowing. Was it through her 
immersions into the otherworldly works of Hearn and James? Or was it 
that brew of soothing herbal tea she used to serve me when, without notice, 
I would drop by her office for a chat? Or did these energies emanate from 
something more innate, her very own wellspring of good will and good 
works?

As both colleague and friend, I am filled with a deep sense of 
appreciation for Nabae-sensei and her accomplishments. And I hope and 
trust that after she settles into what will surely be a productive retirement, 
she will allow herself,  if only for a few moments, to think back upon her 
career and be satisfied with all that she contributed and achieved.

I am one of the lucky ones who had a chance to be both Hitomi-san’s 
student and colleague. As a teacher, Nabae-sensei inspired me with her 
passion for literature as well as the poetic language she used when talking 
about the books she loved. As a colleague, Hitomi-san’s warmth and 
caring supported me during good and bad times, and I’m indebted to her 
for many fantastic years at Gaidai.

1. Introduction 
Save the Children is an independent, child-rights based organization working in around 120 countries 
to support children and to build a better future for and with children. Our founder, Eglantine Jebb, who 
was a school teacher in the UK, started to provide support to children who were distressed in the 
aftermath of the 1st World War, including to children in countries that used to be her countries’ enemies. 
She believed that "All wars, whether just or unjust, disastrous or victorious, are waged against the child". 
One hundred years on, those words resonate as strongly as ever.  
 
Children around the world, especially those who are most vulnerable and marginalized, are currently 
faced with the poly-crisis of the pandemic, climate change, conflicts, and global economic recession. 
Children's right to life, protection, and education continues to be threatened by these compounding 
crises. In response to growing food insecurity, families are forced to resort to desperate measures such 
as withdrawing children out of school, sending them to work, and forcing young girls into early 
marriage. In conflict-affected areas, schools and homes which are supposed to be safe places for 
children are being attacked, forcing displacement of children and families. Some children are recruited 
as soldiers in exchange for food and protection, exposing them to devastating violence and harm. 
 
2. Children are bearing the brunt of conflicts  
Today, across the world, millions of children are caught up in conflicts they played no part in creating, 
bearing the brunt of these conflicts. 1 in 6 children, or 452 million children globally are living in a 
conflict zone and are facing the risk of the six grave violations against children – killing and maiming, 
recruitment and use of children, sexual violence, abduction, attacks on schools and hospitals, and denial 
of humanitarian access. We are seeing more children facing unimaginable mental and physical trauma; 
more children going hungry; more children falling victim to preventable diseases; more children out of

school; more children at risk of sexual violence and recruitment by armed groups; and more children 
trapped on the frontline without access to humanitarian aid. The international community fails to 
enforce children’s right to be protected according to international law. Furthermore, the pandemic has 
dramatically affected humanitarian access, education, economies, protection, health and nutrition, and 
more children are at risk of these indirect consequences of conflict (Figure 1).

3. Children are being recruited as actors of conflicts 
According to Save the Children’s report “Stop the War on Children: A Crisis of Recruitment” published 
in 2021 (Figure 2), 8,600 children were reported to have been recruited or used by armed forces or 
groups in 2020. Children in 39 countries are at risk of recruitment. Lack of legal and policy protection, 
presence of armed groups in the area, poverty, lack of education, lack of employment opportunities, 
abuse, neglect, domestic violence, discrimination, marginalization, desire for revenge, or to defend 
family, desire for power, purpose, and belonging are some of the factors behind children being 
vulnerable to recruitment by armed actors. In order to protect children from becoming agents of conflict,

4. Protecting and supporting children in conflict 
Save the Children works holistically in both programs and advocacy - across child protection, education 
and livelihoods to address children’s vulnerabilities, including vulnerability of recruitment. Child 
Friendly Spaces are set up to provide opportunities for children to restore their normalcy, providing 
mental health and psychosocial support, ensuring learning opportunities, protecting children who have 
been separated from their families, and supporting livelihoods of families and youths in difficult 
situations. Children and families are referred to specialized services so they can receive appropriate 
support. Save the Children works with partners, children, parents and communities to ensure that 
children can continue their education, including to help children return to school. Support is provided 
to communities to develop community-led approaches to child protection, community-led 
peacebuilding, and social cohesion initiatives, including to support acceptance and reintegration of 
children who have been associated with armed actors, which contributes to reconciliation and stability 
in the community (Figure 3 and 4).

5. Education as the foundation for peace 
Every child, even in situations of conflict, has the right to education. Save the Children affirms that 
education fosters mutual understanding and tolerance, which serves as the foundation for peace and 
stability. Save the Children also identifies a strong connection between children continuing their 
education in times of crisis and a reduction in grave violations against children. By attending school, 
children are exposed to multiple eyes that protect them from violence, abuse, sexual exploitation, child 
labor, child marriage, and recruitment by armed actors. Children can obtain appropriate information on 
nutrition, hygiene, health, landmines, and drugs. Continuing to learn in a safe environment gives 
children a sense of psychological security. Above all, children in conflict themselves want to receive 
an education. Surveys from the toughest places on earth in Save the Children’s report “Education 
against the Odds” show education as the top priority for children in crisis - ranking higher than 
immediate needs like food, water, and shelter. Yet only 2% of funding in humanitarian emergencies are 
allocated to education.  
 
Save the Children has pioneered integrated program approaches called Schools as Zone of Peace and 
Safe Schools to work with students and their families, schools and communities to ensure schools are 
able to stay safely open for children throughout times of insecurity, to maintain the daily routines of the 
community and the children themselves, and accept all children affected by conflict, including children 
who have been associated with armed forces, and to secure children’s protection as teams to build a 
notion that they are all connected for peace. 
 
6. Protecting schools and education from attacks  
According to the report “Education Under Attack 2022” by the Global Coalition to Protect Education 
from Attack (GCPEA), in 2020 and 2021, there were more than 5,000 reported attacks on education, 
harming more than 9,000 students and educators in at least 85 countries. There were over 630 attacks

on students, teachers, and other education personnel, and over 4,700 school students and staff were 
injured, killed, abducted, arrested, or harmed. 
 
Schools are being deliberately targeted for different reasons. Schools are often used for military 
purposes during conflicts and thus become objects of attacks or seen as agents or symbols of a state 
system, or a political or ethnic group that armed groups oppose. Parties to conflict may use explosive 
weapons in populated areas where schools and universities are located. 
 
A female survivor of an attack on a girls’ school in Afghanistan in May 2021 says: 
“I thought of the explosion, and I thought they would come and kill every student […] I can’t 
concentrate in my studies. When we think about our future, we can’t see anything.” 
 
Save the Children is actively working with GCPEA, including Human Rights Watch, UNHCR, 
UNICEF, and others to call on all states and non-state actors to endorse the Safe Schools Declaration, 
a commitment to stop attacks and military use of schools. There are so far 115 states which have 
endorsed the Safe Schools Declaration, however, the Japanese government has not yet endorsed the 
Declaration, in spite of the continuous advocacy efforts towards the government. Attacks on schools 
must stop, and it is important that all states as well as non-state actors uphold this important Declaration. 
 
7. Children as agents of peacebuilding 
Children and young people can make unique contributions to peace. It is their right to participate in 
decisions that affect them, including in situations affected by violence and conflict. Children living in 
conflict have themselves expressed that education breaks down ethnic barriers, gives children hope, and 
can bring peace in their community. Save the Children supports the role of children and young people 
as agents of peace, and supports them to develop key peacebuilding skills, foster reconciliation and 
strengthen relationships across divides. It is important to systematically support the inclusion of 
children in peace-making and peace-building efforts. 
 
In Japan, Save the Children Japan works to mobilize and empower Japanese children and youth as 
peacebuilders (Figure 5 & 6). Children and youth have voiced their views towards our government and 
diet members to increase government support for education in conflict, and to endorse the Safe Schools 
Declaration. Children have rallied along with global children’s movement to express their will to stop 
the war on children. We have also supported dialogues between Japanese youth and youth from 
Palestine and Syria to hear the situation of living in conflict situations. We believe these actions are 
small but important steps towards building solidarity and foundation for peace.

Save the Children also works with various partners for peacebuilding. Our ambition for change builds 
on our 100 years’ experience of bringing communities, civil society, governments, businesses and 
donors together to achieve lasting change for children. In working with partners, it is important to agree 
upon common set of values, norms, and standards, as well as mechanism for accountability, and 
strengthen the commitment for peacebuilding. And the most important common value should be the 
internationally agreed-upon human rights standards. Dialogue should foster mutual understanding, trust 
and solidarity. In this process, addressing the rights, needs and concerns of all groups, especially the 
vulnerable groups including children, is fundamental to social cohesion and peace. It also requires 
changing pervasive social norms and power hierarchies that limit the agency and voice of these people.

Abstract 
This short essay will address the situation of children impacted by conflicts, and how Save the 
Children is working on the ground as well as in advocacy to protect and support these children 
and their communities, including children who are recruited by armed actors to become agents 
of conflict. It will also address the importance of education as the foundation for peace and

stability, and how Save the Children works with partners to protect schools and education from 
attacks. Lastly, it will address the importance of including children in peace-making and peace-
building efforts as agent of change, introducing some examples of working with children and 
youth in peacebuilding.

 本論文集は、2019 年度神戸市外国語大学研究支援制度 Research Project B 採
択課題「公共調達をめぐる協調行動に関する法と経済学的研究：関係的契約
(relational contract)の視点から」の成果報告の一部である。研究プロジェクト
は、 
  田中  悟  (神戸市外国語大学教授：産業組織論専攻) 
  森谷 文利  (神戸市外国語大学准教授：組織の経済学専攻) 
  林  秀弥  (名古屋大学大学院法学研究科教授：競争法専攻) 
  高  重迎  (中国河南財経政法大学法学研究科教授：経済法専攻) 
の経済学・法学専攻の研究者４名を構成メンバーとする学際的な研究プロジ
ェクトとして組織された。 
本研究プロジェクトは、大規模で国家的な調達プロジェクトにとって、そ
の品質確保が極めて重要である一方で、品質が事前に確証できない
(non-verifiable)性質を有することに注目し、発注者が品質確保に失敗するリス
クを恐れる結果として協調行動を促す可能性があるのではないかという着想
とプロジェクト構成メンバー間での討議から開始された。品質が事前に確証
できない性質を持つときの調達メカニズムは、経済学的には関係的契約理論
として近年精力的に研究が進められてきた研究領域である。他方、調達をめ
ぐる協調行動は、談合事案として競争法上違法行為とされるから、この種の
協調行動については従来より競争法上の中心的な問題として議論されてきた。
そこで、研究プロジェクトの目的を、品質が事前に確証できない性質を持つ
状況下で、発注者が抱く品質確保の失敗リスクを回避する行動がどのような
効果をもたらすかを、日中の公共調達活動の比較分析を通じて経済学・法学
の学際的観点から明らかにする点に置き、2019 年度より２年間の研究プロジ
ェクトをスタートさせたのである。 
 2019 年度においては、おおむね順調に研究プロジェクトを進捗させること
ができたものの、2020 年初頭より生じた新型コロナ感染症による世界的なパ
ンデミックのために、2020 年度前半期には研究の中断を余儀なくされること
となった。このため、研究期間延長の願い出を提出すると共に、2020 年度後
半期よりメールやオンライン会議の形で研究の進捗を図ってきた。当初は、
研究プロジェクト構成メンバー全員による研究報告会を開催した後に、その

成果を論文の形でまとめることを計画していたものの、研究報告会の開催を
断念した点が心残りであり、これについては他日を期したいと考えている。 
 非常に変則的な研究計画の実施になったものの、各構成メンバーが単独あ
るいは共同して研究を進めた結果、本論文集に掲載したように、４本の論文
を上梓することができた。以下では、４本の論文の研究プロジェクト上の位
置づけと概要について紹介することにしよう。 
 森谷・田中共著論文「サプライヤーの品質改善投資と調達オークションの
デザイン」は、品質が事前に確証できない状況下での調達オークションを、
近年盛んに研究が進められている関係的契約の観点から分析した理論研究を
統一的枠組みで展望したものである。品質の維持にとって、入札前ないしは
入札後のサプライヤーによる投資活動は、とりわけ複雑な調達プロジェクト
については非常に重要な活動となる。本論文では、そうしたサプライヤーに
よる事前・事後の投資活動が品質の確保にとって重要であるとき、発注者が
取るべき調達デザインはサプライヤー間の競争性を弱める形で設計するべき
ことが示されている。 
 田中・林共著論文「関係的契約理論からみたリニア中央新幹線談合事件」
は、そうした経済学からの知見をベースにしながら、入札以前の段階でサプ
ライヤーである建設企業が大きな投資活動を行ってきたリニア中央新幹線工
事に焦点を当て、品川駅・名古屋駅新設工事をめぐって生じた談合事件の背
景について論じたものである。そこでは、サプライヤーによる事前投資の段
階では発注者・受注候補者間の関係的契約が存在していたが、受注者決定段
階に至って関係的契約が破棄され、これが談合事件を引き起こす契機となっ
たとの解釈が示されている。 
 林単著論文「入札談合と市場の画定」は、公共工事をめぐる談合事件にし
ばしば存在する基本合意――競争事業者間で協定される受注予定者の選定等
の決定手続きであり、個々の工事に係る談合はこの手続きに応じて決定され
る――が存在しない(ないしはその立証が不可能な)場合に、個別の受注調整
行為について独占禁止法上の「一定の取引分野」を観念し、不当な取引制限
規制を適用できるか否かという経済法学上の重要な課題に対して論じたもの
である。そこでは、学説・判例・公正取引委員会実務を概観することによっ
て、この問いに対して、個別の調整行為の場合でも「一定の取引分野」の成
立を認めるという肯定説（非限定説）の立場を支持している。 
 高単著論文「政府調達における調達者と供給者間の協調的行為の動機と規
制の論理」は、中国における政府調達において大きな問題とされている、調
達者と供給者間の協調行為(いわゆる官製談合)に焦点を当て、これらの協調

成果を論文の形でまとめることを計画していたものの、研究報告会の開催を

これらの研究成果が所期の目的を達成しえたか否かは読者の判断に委ねる
他ないが、研究のプロセスを通じて追究すべき新たな課題も明らかになりつ
つある。品質確保が重要である一方で品質が事前に確証できない状況下での
調達をめぐる発注者のコミットメントのあり方や、調達の制度が大きく異な
る日中の調達制度が協調行動に与える効果の相違点といった課題がそれに当
たる。こうした問題の究明については、別の機会に委ねたいと考えている。 
 最後に、本研究プロジェクトへの研究助成並びに研究期間延長の許可に対
