No full textУ статті здійснено комплексне дослідження процесуальних гарантій як ключового інструменту забезпечення прав і свобод осіб, які беруть участь у кримінальному провадженні. Основну увагу зосереджено на уточненні змісту та правової природи поняття «процесуальні гарантії». Розкрито проблемні аспекти реалізації прав учасників досудового розслідування, з урахуванням сучасної правозастосовної практики. Проведено аналіз існуючих наукових підходів до трактування кримінально-процесуальних гарантій, виділено їх сутнісні ознаки. Окрему увагу приділено ролі криміналістики у забезпеченні реалізації процесуальних прав на досудовій стадії. Зокрема, акцент зроблено на значенні криміналістичної тактики при проведенні слідчих (розшукових) дій, які потребують неухильного дотримання прав підозрюваних, потерпілих, свідків та інших учасників провадження.
Розглянуто криміналістичні рекомендації щодо документування слідчих дій, застосування спеціальних знань, а також запобігання порушенням процесуальної форми. Обґрунтовано, що впровадження криміналістичних засобів і методів дозволяє не лише ефективно розкривати злочини, а й гарантувати дотримання правових стандартів у кримінальному процесі, зокрема - у межах забезпечення процесуальних гарантій.The article conducts a comprehensive study of procedural guarantees as a
key tool for ensuring the rights and freedoms of persons participating in criminal
proceedings. The main attention is focused on clarifying the content and legal
nature of the concept of "procedural guarantees". The problematic aspects of the
implementation of the rights of participants in the pre-trial investigation are
revealed, taking into account modern law enforcement practice. An analysis of
existing scientific approaches to the interpretation of criminal procedural
guarantees is carried out, and their essential features are highlighted. Special
attention is paid to the role of forensics in ensuring the implementation of
procedural rights at the pre-trial stage. In particular, emphasis is placed on the
importance of forensic tactics in conducting investigative (search) actions, which
require strict observance of the rights of suspects, victims, witnesses and other
participants in the proceedings. Forensic recommendations on documenting
investigative actions, applying specialized knowledge, and preventing violations
of procedural form are considered. It is substantiated that the introduction of
forensic tools and methods allows not only to effectively solve crimes, but also to
guarantee compliance with legal standards in the criminal process, in particular -
within the framework of ensuring procedural guarantees

Авторкою зазначено, що безпека як загальнонаукова категорія передбачає стан захищеності буття нації, людства, особистості, родини – захисту їх іманентної сутності, умов існування та життя загалом. Розкриті основні вітчизняні та зарубіжні науково-юридичні підходи до дефінітивного окреслення феномену національної безпеки. Уперше запропоновано застосування категорії «концептуалізація національної безпеки», яка відображає ключові з точки зору теорії права державноправові закономірності виникнення, функціонування та змін явища національної безпеки в системі суспільних відносин, що мають необхідний, цілеспрямований і закономірний характер.The thesis for the first time in Ukrainian jurisprudence carried out a theoretical generalization and proposed a new solution to the scientific problem of theoretical and legal conceptualization of the phenomenon of national security in modern Ukraine. The author notes that security as a general scientific category implies the state of security of the existence of a nation, humanity, individual, family – protection of their immanent
essence, conditions of existence and life in general. The thesis reveals the main domestic and foreign scientific and legal approaches to the definition of the phenomenon of national security. Однак після завершення війни такі зміни можуть стати необхідними для адаптації правової системи до нових реалій. При цьому важливо, щоб будь-які конституційні зміни відповідали міжнародним стандартам захисту прав людини, були результатом виваженого суспільного діалогу і не порушували основ демократичного правопорядку.It is emphasized that amendments to the Constitution of Ukraine under martial law are unacceptable. However, after the end of the war, such amendments may become necessary to adapt the legal system to new realities. At the same time, it is important that any constitutional amendments comply with international standards for the protection of human rights, be the result of a balanced public dialogue and do not violate the foundations of democratic rule of law
