    Analysis of the second additional protocol to the convention on cybercrime on enhanced co-operation and disclosure of electronic evidence

    ÖZET: Bilişim teknolojilerinin sağladığı imkanlar suçun işleniş biçiminde kolaylığa ve suçun işleniş şekillerinde çeşitliliğe sebep olmakta, failler suç işlerken teknolojinin sunduğu imkanlardan yararlanabilmektedir. Yalnızca siber suçlar değil, diğer pek çok suçun soruşturulması ve kovuşturulmasında ihtiyaç duyulan veriler bilişim ortamında bulunmaktadır ve çoğunlukla bu veriler farklı ülkelerdeki hizmet sağlayıcılar veya diğer kuruluşların bünyesinde ya da kontrolünde bulunmaktadır. Bu tür verilerin kolaylıkla saklanabilmesi, yok edilebilmesi ve değiştirilebilmesi mümkündür. Bu durum karşısında adaleti tesis edebilmek için ilgili birimlerce kanıtlara ivedi bir şekilde ulaşılması gerekmektedir. Avrupa Konseyi Siber Suç Sözleşmesi siber suçlarla mücadelede en önemli enstrümanlardan biri olarak kabul edilmektedir. Bu çalışma ile Sözleşmeye getirilen Gelişmiş İş Birliği ve Elektronik Kanıtların İfşasına İlişkin İkinci Ek Protokol incelenecektir. Bu Protokol, suçlara ilişkin soruşturma ve kovuşturma süreçlerinde ihtiyaç duyulan ve farklı ülkelerde bulunan elektronik kanıtların edinilebilmesi için öngörülen gelişmiş iş birliği önlemlerini, şartları ve teminatları düzenlemekte ve pek çok yenilik getirmektedir. Bu çalışma ile öncelikle Sözleşme hakkında bilgi verilecek, ardından Protokol ile Sözleşmeye ne tür düzenlemeler getirildiği ve bu düzenlemelerin ne tür özellikleri ihtiva ettiği incelenecek ve değerlendirilecektir.ABSTRACT: Opportunities provided by information technologies cause diversity and ease in the way the crime is committed, and the perpetrators can benefit from the opportunities offered by technology while committing crimes. The data that are needed to investigate and prosecute not only cybercrimes, but also other types of crimes are stored in the cyber environment, and mostly these data are within or under the control of service providers, and other organizations in different countries. Such data can be easily hidden, destroyed, and changed. In order to establish justice under these circumstances, it is necessary to reach the evidence immediately by the relevant units. The Council of Europe Convention on Cybercrime is considered one of the most important instruments in the fight against cybercrime. This study will examine the Second Additional Protocol on Enhanced Cooperation and Disclosure of Electronic Evidence that is brought to the Convention. This Protocol regulates the advanced cooperation measures, conditions and safeguards required for the acquisition of electronic evidence from different countries that are needed in the investigation and prosecution process, and brings many innovations. With this study, firstly the Convention will be explained, then the Protocol will be examined and evaluated in regard to the regulations that the Protocol contains, and its contributions to the Convention

    TMS 1 FİNANSAL TABLOLARIN SUNULUŞU STANDARDINA UYUM DERECELERİNİN BORSA ISTANBUL (BİST)’DA İNCELENMESİ

    Bu çalışmanın amacı, TMS 1 Finansal Tabloların Sunuluşu Standardı kapsamında enerji, turizm ve bilişim sektörlerinde yer alan belirli şirketlerin düzenledikleri finansal tabloların açıklamalarının TMS 1’e uyumunu pozitif muhasebe teorilerini de dikkate alarak ölçmektir. Bu çalışma kapsamında, Borsa Istanbul (BİST)’da işlem gören 39 şirket sektörel bazda incelemeye dahil edilmiş ve söz konusu şirketlerin 2019 yılı yıllık finansal raporları dikkate alınmıştır. Açıklamalardan türetilen endeks verileriyle, açıklama belirleyicileri olarak belirlenen kârlılık, kaldıraç, likidite oranları ve şirket büyüklüğü arasındaki ilişki korelasyon analiziyle gerçekleştirilmiştir. Gerçekleştirilen analiz neticesinde, TMS 1 standardının açıklama gerekliliklerine uyumda; enerji ve turizm sektörlerinde incelenen şirketlerin, her bir sektör için TMS 1’e ortalama uyum oranının yüzde 98, bilişim sektöründe incelenen şirketlerin ise ortalama uyum oranının yüzde 97 olduğu tespit edilmiştir. Enerji sektöründe, kaldıraç ve şirket büyüklüğü ile TMS 1’e uyum arasında, bilişim sektöründe ise kârlılıkla TMS 1’e uyum arasında pozitif ilişki tespit edilmiştir

    Congruence in Proportional Representation Systems: Non-Economic Issue Salience and Coalition Formation

    This article contributes to our understanding of democratic representation by analyzing government congruence - the gap between the positions of the government and the median voter - within proportional representation systems. Analyzing elections in non-post-communist, democratic OECD countries in the post-war period until 2014, we argue and show that the salience of non-economic issues such as national way of life and migration led to ideological incongruence indirectly through its effect on government formation by right-wing political parties. We suggest that in this period right-wing political parties that own and emphasize these issues found it easier to differentiate themselves from their ideological counterparts and join a coalition with them without being threatened by credit claiming conflicts. Since, everything else kept constant, right-wing coalitions were then more likely to emerge when such non-economic issues were salient in the party system, their probability to form when the median is located at the center was also higher, leading to higher levels of ideological incongruence overall.Bilim Akademisi, 2015 BAGEP Young Scholar AwardBilim Akademisi, 2015 BAGEP Young Scholar Award

    Search for heavy resonances decaying to ZZ or ZW and axion-like particles mediating nonresonant ZZ or ZH production at ?s = 13 TeV

    Abstract: A search has been performed for heavy resonances decaying to ZZ or ZW and for axion-like particles (ALPs) mediating nonresonant ZZ or ZH production, in final states with two charged leptons (? = e, ?) produced by the decay of a Z boson, and two quarks produced by the decay of a Z, W, or Higgs boson H. The analysis is sensitive to resonances with masses in the range 450 to 2000 GeV. Two categories are defined corresponding to the merged or resolved reconstruction of the hadronically decaying boson. The search is based on data collected during 2016–2018 by the CMS experiment at the LHC in proton-proton collisions at a center-of-mass energy of 13 TeV, corresponding to an integrated luminosity of 138 fb?1. No significant excess is observed in the data above the standard model background expectation. Upper limits on the production cross section of heavy, narrow spin-2 and spin-1 resonances are derived as functions of the resonance mass, and exclusion limits on the production of bulk graviton particles and W? bosons are calculated in the framework of the warped extra dimensions and heavy vector triplet models, respectively. In addition, upper limits on the ALP-mediated diboson production cross section and ALP couplings to standard model particles are obtained in the framework of linear and chiral effective field theories. These are the first limits on nonresonant ALP-mediated ZZ and ZH production obtained by the LHC experiments. [Figure not available: see fulltext.] © 2022, The Author(s)

    ABSTRACT: I was at the age of fifteen when I first moved away from home and I was exactly five thousand miles away. In order to understand the meaning of being at home and the condition of coexistence, this study, is an attempt that look for the prospect of a return to write autobiography, and ask whether or if this possibility —the possibility of mediation in my distorted memory, or, perhaps more importantly, the specific disjunctions between the mediation of what I remember and what I don't remember in terms of lived experience— can ever be justified by rational frameworks. Considering such an argument as an issue, I based my investigations on certain nouns and idioms found in everyday life, such as affiliations, gatherings, engagements, differences, postponements, negotiations/recognitions, invitations, hospitality: coming side-by-side at the age of diaspora. It is important to note that the study treats theoretical debate as a reason rather than an objective representation of the truth, as Jacques Derrida also puts it: "Theoretician is not a demigod telling the magnificent truth." The theory only seeks to transcend the limits and boundaries of life and texts promised by institutions such as authorships, the academy, and so on. With this expression, the theory also strives to find the “niche” where the idea of writing autobiography can inhabit hands in hands with the boundaries of both life and text to the manifestation of friendship. This entails placing life that's engaged, congruent, side by side with the text. In this manner, to renegotiate all the sources, the methodology varies auto-ethnographic collages with short text in dialogue with an Indian artist “Zarina Hashmi”, biographical interviews with my mother and grandfather, family photographs, and literature review of “postcolonialism” to bring something that could be called a collective narrative. Ultimately, the research suggests that it is the agency, to realize once again that "we" (those who call themselves researchers) are continually engaged with the group behavior and the dialectical relationship in the form of organic connections between abstract principles and ethics. Therefore, it is the agency to perhaps realize once again, that the researcher is not an abstract agent who looks out of the thinking machine by citing reasons such as "they" or "them"; on the contrary, the researcher is nothing more than the ordinary subject who tries to look for the possibilities to “return” to the familiarities in which the relationships between "we" and "us" are embodied together.ÖZET: İlk kez Ev’den çıktığımda on beş yaşındaydım ve tam olarak beş bin mil uzaktaydım. Bu çalışma, bu nedenle “evde olma” ve “bir arada yaşama” koşulu anlayışını yeniden kuramsallaştırmak için, otobiyografi yazmaya olasılığını arayan bir girişimdir ve bu olasılığın geri dönmek için mücadele eden çarpık belleğe dönüş mu yoksa belki de en önemlisi arasındaki özgül ayrımlar mı— sorusunu sorma girişimidir. Yaşanmış, geride bırakmış olanlar açısından, “hatırladıklarım veya hatırlamadıklarım”, rasyonel çerçeveler tarafından her zaman haksız mı çıkarılır sorusunu sorma girişimdir. Böylece bir tartışmayı bir mesele olarak kabul ederek, araştırmamı, bir aradalıklar, ilişkiler, farklılıklar, ötelemeler, dayanışma/tanışlar, davetler, konukseverlik ve yan yana gelmeler gibi günlük hayatta bulunan bazı isim ve deyimlere dayalıdır. Çalışmanın teorik tartışmayı, gerçeğin nesnel bir temsilinden ziyade bir sebep olarak ele aldığını belirtmek önemlidir; Jacques Derrida'nın da dediği gibi, "Teorisyen muhteşem gerçeği söyleyen bir yarı tanrı değildir." Böylece teori, yazarlık, kitap birliği, akademi vb. kurumlar tarafından vaat edilen yaşamın ve metinlerin sınırlarını aşmaya çalışmaktan başka bir şey yapmaz. Kuram bu ifadeyle aynı zamanda otobiyografiye dönüş fikrinin bu dostluk tezahürüyle hem hayatın hem de metnin sınırlarıyla el ele, yaşayabileceği nişi bulmaya çalışır. Bu, bağlantılı, olumsal bir aradalık olan hayatı metinle yan yana yerleştirmeyi çalışır.     Design of a Routing Algorithm for Efficient Order Picking in a Non-traditional Rectangular Warehouse Layout

Order picking is the process of finding and removing products from a warehouse to fulfil customer orders. Order picking is the most time-consuming and costly operation in manual picker-to-parts warehouses. Order picking problem is similar to Traveling Salesman Problem in the sense that the order picker corresponds to the salesman whereas items to be picked correspond to cities to be visited. Hence, order picking problem is known to be NP-hard. The objective of order picking problem is to minimize total travelled distance of an order picker. For only single-block and two-block traditional rectangular warehouses, optimal picker routing can be found. However, there is no optimal algorithm for three or more block traditional rectangular warehouses. Some popular routing heuristics are applied for single-block and multi-block traditional rectangular warehouses, such as S-Shape, Largest Gap, Aisle-by-aisle, Combined/Combined+ heuristics. In this study, we consider the order picking problem of a merchandising company. The objective of the company is to minimize total travelled distance during order picking which leads to an increase in throughput (the number of picks per time). The warehouse under consideration can be said to be non-traditional rectangular due to its block and aisle configuration. Therefore, order picking heuristics, which are proposed for traditional rectangular warehouses, cannot be directly implemented. Accordingly, we modified popular picker routing heuristics to apply for the non-traditional rectangular warehouse layout. Then, a meta-heuristic algorithm is implemented to obtain the best picking sequence of items and order picking route.     Search for single production of a vector-like T quark decaying to a top quark and a Z boson in the final state with jets and missing transverse momentum at ?s = 13 TeV

    Abstract: A search is presented for single production of a vector-like T quark with charge 2/3 e, in the decay channel featuring a top quark and a Z boson, with the top quark decaying hadronically and the Z boson decaying to neutrinos. The search uses data collected by the CMS experiment in proton-proton collisions at a center-of-mass energy of 13 TeV, corresponding to an integrated luminosity of 137 fb?1 recorded at the CERN LHC in 2016–2018. The search is sensitive to a T quark mass between 0.6 and 1.8 TeV with decay widths ranging from negligibly small up to 30% of the T quark mass. Reconstruction strategies for the top quark are based on the degree of Lorentz boosting of its final state. At 95% confidence level, the upper limit on the product of the cross section and branching fraction for a T quark of small decay width varies between 15 and 602 fb, depending on its mass. For a T quark with decay widths between 10 and 30% of its mass, this upper limit ranges between 16 and 836 fb. For most of the studied range, the results provide the best limits to date.     Consumer complaining behavior in hospitality management

    The purpose of this study is to investigate the impacts of assertiveness, aggressiveness, and perceived risks on consumer complaining behavior (CCB) in the tourism and hospitality sector. This research utilized a quantitative methodology through the implementation of a two-stage study based on surveys. Study 1 examined the impacts of assertiveness, aggressiveness, and perceived risks on CCB in the context of low-quality summer vacation, while Study 2 further investigated the relationships in the research model by replicating the survey within the framework of high-quality summer vacation. The results were then analyzed through factor and regression analyses. Both of the studies demonstrated that assertiveness positively influences CCB directly and also indirectly via the mediating effect of perceived risks. It was found that aggressiveness positively influences CCB when consumers have high service quality expectations but when they have low expectations for service quality, it is insignificant

    SpaceChase A Dynamic and Interactive Tool for Architectural Design Process

    13th International Space Syntax Symposium, SSS 2022 -- 20 June 2022 through 24 June 2022 -- -- 185052Architectural design, as a cognitive activity, has always been fed by architectural knowledge based on practice and theory, and it has been questioned how creative and generative design processes can benefit from scientific methods. Through inquiry and experimentation, the architect develops his or her ideas, constructs and analyzes the space, and continuously improves it. However, this is a subjective process. There are design tools and methods that provide objective criteria for the assessment of the design decisions and their potential for the designed space whilst iterating with feedback. This study intends to explain how scientific data might be functionalized to search for spatialities that have yet to be designed, and Space Syntax was analyzed to see if it could be included in such a process as a scientific approach. Following discussions on the characteristics of the architectural design process, the study focuses on the development and testing of SpaceChase for Grasshopper, a software plug-in that allows designers, architects, and students to build and analyze dynamic and interactive network structures. This experimental plug-in is intended to be used by architects as a generative and mind-opening design tool during the design process. © 2022 Proceedings 13th International Space Syntax Symposium, SSS 2022.
