    No full text
This research examines Abdul Wahab Khallaf’s views on corruption, collusion, and nepotism in the context of dhoruroh (emergency) and compares them with the basic principles of Islamic law. This research uses a qualitative method with a comparative study approach of fiqh siyasah and qowaidhul fiqhiyyah. The results show that corruption, collusion, and nepotism can be avoided through preventive, repressive, and investigative strategies. Khallaf’s view that actions that are usually prohibited can be allowed in an emergency sparked debate among contemporary Islamic law scholars and academics. This research found that his view is incompatible with the basic principles of Islamic law on justice and integrity. Therefore, this study recommends more effective strategies to prevent corruption, collusion, and nepotism in leadership, such as a broader and more comprehensive application of the laws of fiqh siyasah and qowaidhul fiqhiyyah

Termination of Türkiye's Trade Relations with Israel and Its Consequences

    No full text
This article aims to provide an overview of the changes in Turkish political policy that previously did not affect foreign trade policy. However, the war between Israel and Gaza has made Türkiye sever its trading relations with Israel. Türkiye will not carry out any activities with Israel until a ceasefire and humanitarian aid is sent to Gaza. By carrying out a literature study using a descriptive analysis approach, the authors study the data that seems to suggest that the termination of this relationship is detrimental to Turkey given the significant inflation the country is currently experiencing. As a result of this termination, Israel’s aviation, weapons, and automotive industries will be disrupted. However, the results the authors found confirmed that the entrepreneurs who carry out foreign trade are the Jewish community in Turkey, so the circulation of capital will continue to be in the hands of the Jews. With the cessation of immigration activities with Israel, the circulation of Jewish capital in Türkiye will naturally slow down. Terminating Israel’s trade relations with Turkey will not significantly impact Turkey. Israel, on the other hand, will have difficulty procuring raw materials for its industrial purposes

Jurisdiction on the Implementation of the Decision of the National Sharia Arbitration Board

    No full text
Sharia economy is an economic business or activity carried out by individuals, groups of people, and business entities in order to meet commercial needs according to sharia principles. In the last three decades, Sharia economy has increased the potential for disputes. The disputing parties tend to choose a non-litigation path through Alternative Dispute Resolution (APS), one of which is with the National Sharia Arbitration Board. This judicial institution has the authority to resolve sharia economic disputes. The results of this study show that the authority of the National Sharia Arbitration Board in resolving sharia economic disputes is determined by the existence of an Arbitration Agreement, either made before the dispute arises (Pactum Compromittendo) or made after the dispute occurs (Acta Compromis). Thus, the legitimacy of the authority of the National Sharia Arbitration Board in resolving sharia economic disputes is based on the Pacta Sunt Servanda principle and the Consensual Principle regulated in the Civil Code. Furthermore, the registration and execution of the Decision of the National Sharia Arbitration Board should be carried out by the Religious Court, including in legal efforts to cancel the Decision. This is based on two factors, namely the legal basis of the absolute competence of the Religious Court in resolving sharia economic disputes as regulated in Article 49 of Law Number 3 of 2006 concerning Religious Courts and the basis of the relevance of the substance of Islamic law used by the National Sharia Arbitration Board

Opposition Parties as Checks and Balances for the Government After the 2024 Presidential and Vice-Presidential Elections

    No full text
Opposition parties are the political parties in Indonesia that are not part of the governing coalition following the presidential and vice-presidential elections. Typically, this term is applied to parties that did not succeed in these elections, although there are instances where unsuccessful parties subsequently join the winning coalition. Opposition parties play a crucial role in the system of checks and balances, serving as overseers to ensure that government programs are implemented effectively. In 2024, the parties supporting the elected presidential and vice-presidential pair, Prabowo Subianto and Gibran Rakabuming Raka, comprised nine political parties. The role of the opposition is particularly evident in policy discussions within the House of Representatives of the Republic of Indonesia (DPR RI), where they possess the right to participate in legislative processes and oversight. However, not all opposition parties are represented in the DPR as they fail to meet the parliamentary threshold (PT) of 4%. This situation results in a scenario where the number of supporting parties exceeds that of the opposition. To ensure effective checks and balances, it is ideal for opposition parties to have a minimum representation of 50% in the DPR. Moreover, there exists a perception that opposition parties often seek to engage in political vendettas against the victorious government
