    Jurisdiction of the Native Courts in Sabah

    The Native Courts in Sabah are established under the Native Courts Enactment 1992. The courts serve as a crucial institution for administering justice within the native communities of the state. The jurisdiction of Native Courts in Sabah is designed to uphold and administer native customary law. These courts have the authority to adjudicate matters among others, breach of customary law, land disputes, inheritance, marital issues and adoption. This paper explores the scope of jurisdiction exercised by Native Courts. It highlights the importance of these courts in preserving natives' rights and also discusses the legal issues pertaining to the jurisdiction of the courts, and proposes suggestions to address the legal issues. Ultimately, this study illustrates the significance of Native Courts in fostering social cohesion and safeguarding the balance between tradition and modernity, ensuring that justice is served in a manner that resonates with the values of the native populations in Sabah

    A Literature Review on the Livelihood Resilience in Relocation Areas for Poverty Alleviation

    The report discusses the resilience of farmers’ livelihoods and factors that impacting it before and after the relocation for poverty alleviation, which is important for improving farmers’ adaptability and cultivating the sustainable livelihood development. By strengthening resilience, it not only promotes sustainable development in impoverished areas, but it also lay the solid ground for individuals and communities to get rid of poverty. Poverty alleviation must go beyond material support, which should also focus on cultivating the livelihood resilience of relocated farmers to achieve sustainability that lasts. However, the academic community has not yet established a standard for measuring resilience, which has limited studies researching on this concept to relocation and farmers’ livelihoods. Also, it is also controversial about the role of resilience in improving the welfare of the poor, with limited understanding of the formation and mechanisms. The study uses review to investigate the likelihood resilience of farmers in relocated areas, that brought up the concept of livelihood resilience, and also compare its levels before and after relocation. The influencing factors are then identified with proposed strategies for livelihood development. By mitigating these gaps, the study provides insights for precise poverty alleviation, preventing the reoccurrence of poverty, and supporting sustainable development for farmers in impoverished regions.&nbsp

    The Influence of Teaching Presence on Students Satisfaction toward MOOC Based Flipped Classroom

    Student satisfaction plays a crucial role in ensuring effective flipped learning. This study designed a flipped "Fundamentals of Computer Application (FCA)" course based on Chaoxing MOOC platform and investigated 442 students' satisfaction with the model and the relationship between teaching presence and students satisfaction. The results showed that student satisfaction with the model was high (M = 19.37, SD = 2.694, total 129 in the affective coding, of which 79 were positive and only 2 were negative), and that the three dimensions of Teaching Presence(TP), Instructional Design and Organization(IDS) (r = 0.410, p < .001), Facilitated Discourse (FD) (r = 0.355, p < .001), Direct Instruction (DI) (r = 0.362, p < .001) were all positively and significantly related to satisfaction, with Instructional Design and Organization(IDS) (β = .239, t = 4.555, p = < .001) , and Direct Instruction (DI) (β = .218, t = 2.468, p = < .05) were able to significantly predict satisfaction. The findings indicated that students are highly satisfied with the flipped model in the FCA course, which is mainly practical and hands-on. Consequently, teachers should carefully plan and organize their lessons, give students direct guidance when needed, foster a safe learning environment, and provide more opportunities for students to give speeches. All of these strategies will contribute to students' increased satisfaction with flipped learning

    Bako National Park's Circumstances Amid the COVID-19 Pandemic: Perspectives on Biodiversity and Community Well-being

    Bako National Park (BNP) is the oldest and smallest national park in Sarawak, Malaysia and its richness in biodiversity of flora and fauna here is indeed a major attraction for international and local tourists to watch proboscis monkeys. However, this COVID-19 pandemic instigates challenges to tourism development in the BNP because the number of tourists is very low compared to before pandemic season. This also has a huge impact on the local community and wildlife in this area. These new norms bring challenges and benefits to human and nature life. The following photos were taken during our five-day visit to BNP from 24th to 28th August 2020. The purpose of our short visit was to observe the circumstances of BNP in the midst of pandemic by emphasizing the aspects of biodiversity and the well-being of local communities. Thus, the photographs taken describe the situation in this area that elucidate the challenges and benefits to wildlife and community livelihood. Based on this study, it is clear that humans and biodiversity have complex and interdependent relationships with each other that need to emphasized by relevant stakeholders towards social sustainable development

    Analysing Part-of-Speech Errors in Job Interviews Among Malaysian Fresh Graduates in Malaysia: Implications for Communication Competence

    This study examined the utilisation of parts of speech in job interviews to assess their accuracy due to a lack of English language proficiency among job applicant candidates. Data was gathered from 26 fresh graduates applying for customer service executive and officer positions across three distinct recruitment organisations. Utilizing a qualitative method, the analysis focused on identifying instances of parts of speech using Bachman and Palmer's (1996) framework, emphasizing the crucial role of grammar competence in effective communication. The findings highlighted prevalent errors, particularly in verbs and conjunctions, while adverbs and adjectives exhibited fewer mistakes. Additionally, the study revealed a lack of awareness among candidates regarding the importance of parts of speech in both spoken and written communication. These results underscore the urgent need for collaborative efforts among involved parties in job interviews to enhance communication skills, specifically targeting proficiency in using parts of speech. The implications stress the vital significance of mastering parts of speech in job interviews, as adept linguistic abilities significantly influence candidates' capacity to convey qualifications and skills effectively, thus impacting their suitability for employment opportunities. Implementing measures to refine part-of-speech competence can substantially enhance candidates' abilities to articulate ideas accurately and professionally, thereby positively affecting their success in job interviews

    Instrumen Literasi Pentaksiran Terbeza Guru dalam Konteks Pendidikan di Malaysia: Sorotan Literatur Bersistematik

    Pentaksiran terbeza merupakan amalan pentaksiran sistematik dalam menerima pelbagai kaedah penilaian sebagai bahan bukti hasil pembelajaran murid di dalam bilik darjah. Dilaksanakan seiring dengan intruksional dan bahan terbeza bagi murid pelbagai latar belakang, ia menjadi kayu ukur kejayaan proses pengajaran dan pemudah caraan berlandaskan pendekatan terbeza serta berupaya memberikan maklum balas bermakna bagi semua pihak untuk mengurangkan jurang pendidikan di dalam bilik darjah. Pentaksiran terbeza mempunyai kelebihan signifikan bagi membantu guru menilai perkembangan setiap murid serta melaksanakan aktiviti pengajaran yang seiring dengan pencapaian murid. Maka, kajian ini bertujuan mengenal pasti instrumen literasi pentaksiran terbeza guru dari seluruh dunia serta menganalisis konstruk yang digunakan dalam instrumen berkenaan menggunakan kaedah sorotan literatur bersistematik. Metod yang diguna pakai ialah berdasarkan aliran kerja Preferred Reporting Items for Systematics Review and Meta–Analyses (PRISMA) dan bertumpukan kepada tiga pangkalan data utama iaitu Web of Science, SCOPUS dan Google Scholar. Dapatan kajian menunjukkan terdapat 18 konstruk yang digunakan dalam 12 instrumen yang dinilai di mana konstruk pentaksiran berterusan, motivasi murid dan tahap pengetahuan guru didapati menjadi konstruk yang diguna pakai secara lebih meluas berbanding konstruk-konstruk lain. Instrumen yang dipilih merentasi 5 benua juga menunjukkan kesepakatan dalam penilaian literasi pentaksiran terbeza guru kerana kesemua instrumen tersebut menilai domain guru, murid dan persekitaran. Hasil kajian ini diharapkan mampu menjadi panduan bagi literasi pentaksiran terbeza guru serta penambahbaikan amalan pentaksiran di dalam bilik darjah. Di samping itu, hasil kajian ini juga berupaya memberikan sumbangan penting kepada pembinaan instrumen literasi pentaksiran terbeza yang khusus bagi guru di Malaysia

    Kesediaan bekerja merupakan faktor mustahak kepada pelajar untuk menjadikan mereka cekap dan berkeyakinan diri. Ini adalah faktor penting yang membolehkan mereka ditempatkan dalam pasaran industri pekerjaan. Kajian ini dijalankan bertujuan untuk mengetahui efikasi kendiri sebagai mediator dalam hubungan antara sokongan sosial dan kesediaan bekerja. Populasi kajian melibatkan pelajar daripada 6 buah Kolej Vokasional di Kelantan. Sampel kajian adalah pelajar tahun akhir Diploma Kolej Vokasional (DVM) iaitu seramai 248 orang. Sampel yang dipilih adalah berdasarkan persampelan rawak kelompok. Kajian ini menggunakan pendekatan kuantitatif manakala soal selidik menggunakan pautan Google Form yang dianalisis secara deskriptif, kolerasi dan regresi berganda dengan menggunakan Statistical Package for Social Science (SPSS). Hasil dapatan bagi kesemua pemboleh ubah berada di tahap tinggi. Dapatan kajian juga menunjukkan hubungan yang positif sederhana di antara sokongan sosial dengan kesediaan bekerja. Jenis pengantaraan hasil dari analisa adalah mediator separa (partial mediation) kerana kesan langsung dan tidak langsung signifikan. Hasil kajian ini dapat membantu pihak kolej vokasional dapat mengorak langkah dalam membentuk program yang lebih berkesan yang berkaitan dengan aspek-kesediaan bekerja

    Challenges on Translating the Elements of Traditional Chinese Medicine in Hong Lou Meng

    This study aimed to investigate the challenges associated with translating elements of Traditional Chinese Medicine (TCM) within the context of Hong Lou Meng. Building upon the identified challenges, the study delved into solutions aimed at employing effective strategies in the translation of diverse Traditional Chinese Medicine. This study employed a qualitative method to investigate the translation of TCM terms in the English version translated by Hawkes and     Minford (2014) from the perspective of translation aesthetics. The study carefully chose representative examples from different facets of TCM in the source text, encompassing TCM theories, disease diagnosis and syndromes, and terminologies and formulas. The translated content was juxtaposed with the source text to scrutinize the translation methods employed in the translation. Based on this analysis, the study assessed both the achievements and shortcomings in translating various TCM terms from the perspective of translation aesthetics. Ultimately, the study consolidated solutions and compensation methods on how to retain the aesthetic and cultural value of Chinese medicine elements in the translation of classical literature. The study findings indicate that the challenges of translating TCM lie in conveying the difficult TCM theories, the recreation of the strict and beautiful language structures in disease diagnosis and syndromes, and the accurate reproduction of TCM terminologies. It shows that to overcome the challenges, translators should adopt various methods flexibly, such as annotating the TCM theories, recreating the content using similar sentence structures by adopting domestication plus transliteration, or foreignization plus annotation to translate Chinese medicine terminologies and formulas

    The Main Factors Impacting on The Success of Higher Education Internationalisation in Modern China

    Higher education internationalisation has become a widespread phenomenon, but the route choice constitutes an important issue. This research intends to evaluate how higher education internalisation is influenced by several factors: the leveraging of globalisation and localisation, inflow and outflow of education resources. After reviewing the theories on the patterns of internationalisation and education flows, telephone interview is conducted with six participants from several universities of Xi'an China, include Xi’an University, Northwest University, Xi’an Jiaotong University. Indicated by interview data, universities show strong inclinations of globalising, because the education shall be oriented towards the future career of the students in a globalised business world. However, the globalisation level is not satisfactory for some students. For example, the international branch campuses could be built to a higher level. This means that the campuses could be funded by the local and foreign universities. In addition, the challenges of leveraging globalisation and localisation include vague standards for leveraging the extents of being localised and globalised, cultural barriers and the conflicting ideas among relevant stakeholders such as the education ministry officials, the principal, professors and students. Demonstrated by interview data, outward flows are exemplified by exchange learning. In order to facilitate inward resource flows, universities in modern China tend to attract international students in various ways: travels to some foreign countries to capture the attention of the audiences there; hire some dealers in foreign countries to seek international students; deliver the most recent documents to some foreign agencies that help students apply for studying abroad

    Short Bursts, Big Impact: Exploring Microlearning’s Potential in Malaysian Higher Education

    The rapid transformation of Malaysian higher education, prompted by technological advancements and evolving job market demands, highlights the critical need for institutions to adopt microlearning approaches. These microlearning approaches align with the country's Education Blueprint 2015-2025, emphasising lifelong learning and the acquisition of industry-relevant skills. Developing credentials that are outcome-based, personalised, on-demand, secure, and transparent is crucial for ensuring education remains relevant and responsive to both learner and employer needs. This study employed a systematic literature review, adhering to PRISMA guidelines, to identify best practices in developing and implementing microlearning strategies within Malaysian higher education institutions. The review revealed that effective microlearning strategies are characterised by their ability to break down complex subjects into manageable chunks, combat cognitive overload, and enhance knowledge retention. This paper concludes that for Malaysian higher education to remain competitive and adaptable, a strategic emphasis on microlearning is imperative. These strategies not only cater to the dynamic needs of the job market but also align with the lifelong learning objectives outlined in the national education blueprint, thereby preparing graduates for successful careers in the 21st century
