SEEKING JUSTICE IN ISLAMIC LEGAL PLURALISM: The Dispute of Child Best Interests in Marriage Dispensation in Indonesia

The principle of the best interests of children must be the main consideration in adjudicating applications for marriage dispensation. However, its implementation becomes problematic when faced with provisions on the ability to grant marriage dispensations for urgent reasons. This article examines how the best interests of children are implemented in legal applications for marriage dispensation in religious court. It employs a socio-legal approach with a maqāsid al-syarī'ah cum-mubadalah perspective. This article proposes that the principle of the best interests of children is yet considered by judges effectively in deciding the cases. This does not reflect the protection of the child’s life, heredity, intellect, property, and religion, and does not consider the unique experiences of women both biologically and socially. Judges have a biased perspective in measuring the meaning of maturity and readiness of girls to marry, ignoring children's rights in education and reproductive health, and subordinate women in the spiritual realm

THE DISCOURSE OF RITUAL “BARITAN” AND ITS RELATION TO NATURE IN THE ONLINE WEBSITE

Most ritual meanings are often constructed only as a medium to maintain social harmony and religious tolerance or, in the most straightforward language, as a ‘rasa syukur’ to God. Thus, the depictions of rituals in the mass media do not convey the moral code of nature as highlighted. Based on these considerations, this research wants to discover ritual discourse and its relationship with nature. In particular, this study focuses on online news published by various websites using the keyword ‘baritan.’ The data was collected on May 23-25, 2023, with data coverage from 2018 - 2023, while obtaining 136 news articles. The data were analyzed using Van Dijk’s method of discourse analysis, which seeks to reveal social cognition using a linguistic analysis approach. Although this research will not talk much about power, it wants to determine the dominance of discourse in depicting ritual and ecology in the media. The other theory to portray the result is Bruno Latour’s concept about the Parliament of Things and how to represent the ‘non-humans’ in this political democracy. This concept of political democracy is constructed based on two things: (1) science and technology and (2) nature that can be connected to become an arena for political practices. This research reveals that the media’s construction of rituals has a major effect dominating the discourse on ritual actors, actions, and networks. The dominance of this discourse makes the knowledge that should be local/personal not get enough space to develop, especially regarding the moral messages stored in rituals. Cultural interpretations of ecological issues may be personal experiences not covered by global meanings. By revealing the diversity of local meanings about the relationship between nature and humans through the baritan ritual, it is hoped that this ritual can become a ‘Parliament of Things’ where actors, human and non-human, feel each other’s presence and rebuild commitments for the sustainability of the actors’ live

NEGOTIATING PROFESSIONAL IDENTITY: A CASE STUDY OF CULTURAL LEARNING OF ENGLISH TEACHERS AT MTS NAHDLATUT THALIBIN

    No full text
This research aims to explore the negotiation process of the professional identity of English teachers at MTs Nahdlatut Thalibin, a pesantren based madrasah that prioritizes local religious and cultural values. This study identifies how English teachers negotiate their roles amid the demands of a national curriculum based on global competencies and local values upheld in madrasas. Through a qualitative approach with in-depth interviews, observations, and documentation, three main themes were found: (1) teachers' perception of their professional identity, (2) adaptation strategies in learning, and (3) challenges faced in negotiating professional identity. The results of the study show that teachers at MTs Nahdlatut Thalibin view their identity as more than just language teaching, but also as cultural agents who must transfer local religious and cultural values. Strategies used by teachers include the selection of teaching materials that are sensitive to local culture, the insertion of religious values in English learning, and the translation of foreign terms using local cultural analogies. However, the main challenge facing teachers is the tension between the demand to teach English based on a global curriculum and the need to maintain local religious and cultural values. This research provides insight into how English teachers in faith-based madrassas negotiate their identities and demonstrates the importance of developing a curriculum that is sensitive to local and religious contexts in language learning

THE PHENOMENON OF FREE DATING AFTER ENGAGEMENT: A REVIEW OF THE INTERPRETATION OF THE KHITBAH SHARIA IN THE QUR'AN

The phenomenon of unrestricted dating after engagement has sparked a critical debate within Islamic thought concerning the enforcement of Sharia law. Society perceives dating after engagement as a means to better understand each other to prevent divorce, alongside the assumption that khitbah is considered a permissible form of dating. Based on this issue, the researcher aims to re-examine the interpretation of khitbah in the Qur'an. The method employed is qualitative, categorized under library research, utilizing documentation techniques with historical analysis. The findings of this study indicate that Islam encourages its followers to marry as a means of safeguarding themselves from sinful acts and fulfilling the principles of sunnatullah. Marriage in Islam is regarded as a form of worship aimed at creating a harmonious, loving, and respectful family. The practice of unrestricted dating after khitbah or engagement is seen as deviating from the Islamic purpose of marriage. Commitment to Sharia and adherence to religious boundaries are key in the process of establishing a legitimate relationship. Therefore, preserving honor and following religious guidance in premarital relationships represent a Muslim's responsibility in upholding Islamic values and Sharia law
