Nur selten aber verfolgen die Bürger das Geschehen im Gerichtssaal unmittelbar als Zuschauer. In aller Regel informiert sich die Öffentlichkeit durch Medien wie Zeitungen, Fernsehen und zunehmend auch über das Internet. Damit erlangen aber auch die Eigengesetzlichkeiten medialer Informationserlangung und Berichterstattung Einfluss auf das Strafverfahren und dessen Bild in der Öffentlichkeit. Dem daraus resultierenden Spannungsverhältnis widmen sich die interdisziplinären Beiträge aus Theorie und Praxis, die im Rahmen eines vom Kriminalwissenschaftlichen Institut der Georg-August-Universität Göttingen veranstalteten Kolloquiums präsentiert wurden.Criminal trials often attract great public interest. This interest, again, is essential to criminal justice as such, for in democratic states under the rule of law criminal law and its application need to be asserted and accepted within the public discourse. However, most people do not follow criminal trials as spectators in the courtroom, but by means of public media, such as newspapers, television and – increasingly – the internet. Thus, media outlets gain influence on the public opinion and are able to paint the picture of criminal trials according to their own perception. The media tends to overdraw criminal cases rather than to report the unbiased facts. This leads to tensions between possibly diverging interests of the public, of the judiciary and of the media. This volume addresses these tensions from the perspectives of academics and practitioners, who discussed this issue during an interdisciplinary conference held at the Institute for Criminal Law at the Georg-August-University Göttingen

No full textSoftcover, 17x24Transkulturelle Phänomene haben in den letzten Jahren zunehmend die Aufmerksamkeit der Forschung auf sich gezogen und werden aller Voraussicht nach auch in den nächsten Jahren Gegenstand geisteswissenschaftlicher Debatten sein. Als Ergebnis eines kollaborativen Schreibaktes versteht sich der vorliegende Band sowohl als Einführung in die Untersuchung transkultureller Verflechtungsphänomene wie auch als Versuch einer systematischen Durchdringung dieses Forschungsfeldes aus unterschiedlichen mediävistischen Perspektiven.
Er befasst sich zunächst auf theoretischer Ebene mit der Entwicklung und den Entstehungshintergründen des transkulturellen Paradigmas. In zahlreichen Quellenstudien erörtert er ferner, wie transkulturelle Verflechtungsprozesse in mittelalterlichen Quellen unterschiedlicher Herkunft und Art benannt, beschrieben und bewertet werden. Auf dieser Grundlage wird der Versuch unternommen, unter Nutzung der Begriffe ‚Netzwerk‘, ‚Gewebe‘, ‚rhizomatisches Geflecht‘ und ‚Fusion‘ verschiedene Modelle transkultureller Verflechtung zu definieren und anhand der Quellen auszuarbeiten. Ergänzend erfolgt eine ebenfalls quellengestützte Beschäftigung mit den reziproken Beziehungen zwischen Verflechtungs- und Entflechtungsprozessen. Sie mündet in abschließende Überlegungen zu der Frage, welchen methodischen Chancen und Risiken sich eine historisch arbeitende Forschung ausgesetzt sieht, die das transkulturelle Paradigma für die konkrete Arbeit an den Quellen nutzen möchte.
Indem der Band die Genese aktueller methodischer Diskussionen nachzeichnet und diese anhand von mehr als fünfzig kurzen Quellenanalysen konkretisiert, eignet er sich in idealer Weise für den Einsatz in Studium und Lehre. Darüber hinaus bietet er durch die systematische Darstellung sowie die Reflexionen zu Theorie und praktischer Anwendung des transkulturellen Ansatzes zahlreiche Anregungen für die weitere Forschungsdiskussion.Having elicited much attention in the humanities in recent years, transcultural phenomena will, in all probability, remain a topic of debate in the near future. From Proteins to Networks
No full textSoftcover, 17x24The advances and technical improvements of X-ray imaging techniques, taking
advantage of X-ray focussing optics and high intensity synchrotron sources,
nowadays allow for the use of X-rays to probe the cellular nanoscale. Importantly,
X-rays permit thick samples to be imaged without sectioning or slicing. In this
work, two macromolecules, namely keratin intermediate filament (IF) proteins
and DNA, both essential components of cells, were studied by X-ray techniques.
Keratin IF proteins make up an integral part of the cytoskeleton of epithelial
cells and form a dense intracellular network of bundles. This network is built
from monomers in a hierarchical fashion. Thus, the keratin structure formation
spans a large range of length scales from a few nanometres (monomers) to
micrometres (networks). Here, keratin was studied at three different scales: i) filaments, ii) bundles and iii) networks. Solution small-angle X-ray scattering revealed distinct structural and organisational characteristics of these highly
charged polyelectrolyte filaments, such as increasing radius with increasing
salt concentration and spatial accumulation of ions depending on the salt
concentration. The results are quantified by employing advanced modelling of
keratin IFs by a core cylinder fl anked with Gaussian chains. Scanning micro-
diffraction was used to study keratin at the bundle scale. Very different
morphologies of keratin bundles were observed at different salt conditions. At
the network scale, new imaging approaches and analyses were applied to the
study of whole cells. Ptychography and scanning X-ray nano-diffraction imaging
were performed on the same cells, allowing for high resolution in real and
reciprocal space, thereby revealing the internal structure of these networks. By
using a fitting routine based on simulations of IFs packed on a hexagonal lattice,
the radius of each fi lament and distance between fi laments were retrieved.
In mammalian cells, each nucleus contains 2 nm-thick DNA double helices with
a total length of about 2 m. The DNA strands are packed in a highly hierarchical
manner into individual chromosomes. DNA was studied in intact cells by visible
light microscopy and scanning X-ray nano-diffraction, unveiling the compaction
und decompaction of DNA during the cell cycle. Thus, we obtained information on
the aggregation state of the nuclear DNA at a real space resolution on the order
of few hundreds nm. To exploit to the reciprocal space information, individual
diffraction patterns were analysed according to a generalised Porod’s law at a
resolution down to 10 nm. We were able to distinguish nucleoli, heterochromatin
and euchromatin in the nuclei and follow the compaction and decompaction
during the cell division cycle

En la segunda parte, denominada Ciencias criminales: diálogos entre Alemania y el resto del mundo, se agrupan aquellos trabajos en los que las ciencias criminales si bien son trabajadas desde el contexto alemán tienen por objeto las interrelaciones culturales e internacionales y el diálogo entre distintas tradiciones jurídico-penales. Finalmente, se destacan dos breves homenajes dedicados a los Profesores Winfried Hassemer y Horst Schüler-Springorum. Interestingly, an increasing number of RNA helicases have been shown to be required for more than one cellular pathway. Therefore, protein cofactors have been suggested to recruit multifunctional RNA helicases to their substrates and regulate their activity. The best characterised family of helicase cofactors are G-patch proteins, which all contain a glycine-riche domain. This work focuses on the characterisation of the yeast RNA helicase Prp43 and its G-patch protein cofactors. Additionally, a new G-patch protein cofactor of Prp43 was identified and characterised. Together, the data suggest that protein cofactors can regulate the distribution and activity of RNA helicases in different pathways

Es verpflichtet die Hersteller von Elektro- und Elektronikgeräten zur Einrichtung einer privatrechtlich organisierten Gemeinsamen Stelle und weist ihr zahlreiche in eigener Verantwortung wahrzunehmende Aufgaben zu. Die Bedeutung der Gemeinsamen Stelle für den Vollzug des ElektroG wird dadurch gesteigert, dass sie zusätzlich hoheitliche, ihr im Wege der Beleihung übertragene Aufgaben übernimmt. Dieser nicht alltäglichen Doppelfunktion widmet sich die vorliegende Arbeit und beleuchtet die Rechtsstellung und Organisation der als Gemeinsame Stelle eingerichteten Stiftung Elektro-Altgeräte-Register. Des Weiteren untersucht die Arbeit die in der Praxis wichtigsten Aufgaben der Herstellerregistrierung und Koordination der Altgeräteabholung sowie die bislang wenig erforschte Aufgabe der Festlegung der für den Vollzug wichtigen Gerätearten. Abgerundet wird die Arbeit durch ein eigenes Kapitel, das sich dem Rechtsschutz gegen die Maßnahmen der Stiftung Elektro-Altgeräte-Register vor allem in ihrer Funktion als beliehene Stelle widmet.The Electrical and Electronic Equipment Act (ElektroG) that took effect in 2005 follows an independent method as opposed to the conventional execution carried out by state authorities with regards to the legal execution. It commits the producer of electrical and electronic equipment to the establishment of a private law Clearing House (Gemeinsame Stelle) and assigns it numerous tasks to be carried out on its own responsibility. The significance of the Clearing House for the implementation of the Electrical and Electronic Equipment Act is heightened by the fact that it assumes additional sovereign tasks assigned to it within the scope of the designation. This unusual double function is applied to the task at hand and illuminates the status and organisation of Stiftung Elektro-Altgeräte-Register that is set up as Clearing House. The task furthermore examines the most important tasks in practice of producer registration and the coordination of WEEE collection, as well as the thus far little researched task of specifying the equipment types important for implementation. The work is rounded off by a chapter dedicated to the issues of legal protection against the measures of Stiftung Elektro-Altgeräte-Register, particularly in its function as designated agency

Die Ausbildung des eigenen Geschmacks spielt im Alltag eine wesentliche, wenn auch nicht immer offensichtliche Rolle. Gewohnheiten und gelegentliche Neuerungen im Umgang mit dem TV-Angebot prägen sowohl Wochenstrukturen als auch soziale Beziehungen und das geschmackliche Empfinden. Langlaufende Reihen wie der »Tatort« geben dabei Orientierung.
Christine Hämmerling legt eine Ethnografie des »Tatort«-Publikums vor, bei der sie auf die sozialen Positionierungen fokussiert, die Zuschauende vornehmen, wenn sie sich den Krimi ansehen, sich darüber austauschen, ihn online kommentieren oder im Interview darüber reflektieren. Dabei gilt: Was das Publikum über den »Tatort« sagt, sagt mehr über das Publikum als über den »Tatort«.Watching television plays an important role in our daily lives. Especially serial narratives like the popular German police procedural Tatort (FRG, since 1970) bear great potential to catch and keep their viewer’s interest. Analysing the integration of the long running TV series Tatort into its viewers’ weekly routines, this study investigates movements in the realm of what is called ‘social positioning’.
In online fora, in discussions or while watching the latest episode, television audiences share their impressions. They compare inspectors and crime sites and express their views upon socio-political debates. At the same time watching series for many is a deeply social activity. The series helps its viewers to get together with friends, partners or the family on a regular basis, others enjoy sharing their viewing experience in social networks. Together they laugh or discuss the issues that are brought up by the police investigation. The practice of watching Tatort thereby provides a wide range of possibilities to act upon one’s perspective on how the social world is structured.
The ethnographic approach towards practices of social positioning is based upon participant observations in viewing situations over three years, 43 semi-structured narrative interviews, as well as an online ethnography concentrating on Facebook and the fan page Tatort-Fundus.
This approach allows for two kinds of findings: Current perspectives on ‚the cultural other‘ as a figure that is bound to situational practices of positioning are enlightened by comparisons to fictional criminals and investigators as well as representations of social, professional and ethnic groups in Tatort. On a more theoretical level, the ethnographic insights on biographies, viewing situations, and practices in between the episodes call for corrections of the still persistent model of taste as a reliable indicator of people’s standing in society.
Instead, the study points out the importance of situational and serial acts of positioning. Watching Tatort is a cultural practice with much variation. Still, how its viewers deal with Tatort as a narrative as well as a cultural practice is linked to a set of discursive fields. Describing the practice of watching Tatort as bound to activity/passivity, pleasure/critique, tension/relaxation, real/unreal, entertainment/information, and femininity/masculinity as well as to German/not-German reveals that all of these oppositions are continuously under negotiation. And Tatort viewers are usually positioned in-between

No full textSoftcover, 17x24Kern der vorliegenden Arbeit ist die praktisch bedeutsame Frage der Beweislastverteilung im deutschen und im norwegischen Markenrecht. Besonders relevant wird dieser Vergleich dadurch, dass das Markenrecht Deutschlands und Norwegens nicht bezugslos nebeneinander stehen, sondern durch die Richtlinie 2008/95/EG (Markenrechtsrichtlinie) und deren Übernahme in das EWR-Abkommen europäisch harmonisiert werden. Vor diesem Hintergrund widmet sich die Arbeit sowohl dem nationalen Recht der beiden Länder, als auch den europäischen Herausforderungen. Zudem wird der Frage nachgegangen, welche Bedeutung dem Beweismaß in diesem Zusammenhang zukommt. Zuletzt geht der Verfasser noch auf die Frage ein, inwieweit sich die Ergebnisse dieser Arbeit auf andere Richtlinien im Bereiche des gewerblichen Rechtsschutzes übertragen lassen
