Die einzelnen Artikel entstammen einem zweisemestrigen Forschungsseminar an der Georg-August-Universität Göttingen und decken thematisch ein breites Spektrum an ausgewählten Standortbestimmungen in dem sich rasant entfaltenden, interdisziplinären Fach ab. Die einzelnen Beiträge verstehen sich dabei als Anregungen zu einem weiteren Nachdenken über so diverse Bereiche wie Notfall- und Intensivmedizin, Infektionsschutz, Patientenselbstbestimmung und haftungsrechtlichen Fragen im Zusammenhang mit der Aufklärung und dem Lebensende. In ihrer Gesamtschau ergeben sie ein vielgestaltiges Bild über gegenwärtige Positionen in den Grenzbereichen zwischen Medizin und Recht.The second volume of the new book series contains selected research contributions on current debates in the various areas of medical and bio-law. The individual contributions emerged from a two-semester research seminar at the Georg-August-University of Göttingen and cover a broad spectrum of selected positions in this rapidly developing interdisciplinary field. The individual contributions are intended as suggestions for further reflection on areas as diverse as emergency and intensive care medicine, infection protection, patient self-determination and liability issues in connection with the capacity to consent and the end of life. No full textSoftcover, DIN A42Der Niedersächsischen Demokratie-Monitor (NDM) hat 1000 zufällig ausgewählte Niedersächsinnen und Niedersachsen ab 16 Jahren zu ihren politischen Einstellungen befragt. Es ist die nach 2019 und dem Corona-Sommer 2021 dritte repräsentative Bevölkerungsumfrage des NDM. Zusammenfassen lassen sich die Ergebnisse der Untersuchung unter der Überschrift „Politik in der Vertrauenskrise“, da wir Folgendes feststellen: • ein sinkendes Vertrauen in politische Institutionen und Akteure; • eine Abnahme der Demokratiezufriedenheit, wobei sich nun auch die jüngste Generation in ihrer Unzufriedenheit nicht mehr von den älteren Kohorten unterscheidet; • eine schlechte Bewertung der Zukunftsaussichten – mit über 47 % auch bei der jüngsten Befragtenkohorte; • Unzufriedenheit insbesondere mit der Politik der Bundesregierung, nicht jedoch mit derjenigen der Landesregierung; • aber eine relativ stabile grundsätzliche Unterstützung der Prinzipien und Werte der repräsentativen Demokratie.The Lower Saxony Democracy Monitor (NDM) surveyed 1,000 randomly selected Lower Saxons aged 16 and over about their political attitudes. This is the third representative population survey conducted by the NDM after 2019 and the coronavirus summer of 2021. We summarise the results of the survey under the heading "Politics in a confidence crisis" which is characterised by • a decline in trust in political institutions and actors; • a decline in satisfaction with democracy, with the youngest generation no longer differing from the older cohorts in their dissatisfaction; • a poor assessment of future prospects – at over 47%, even among the youngest cohort of respondents; • dissatisfaction with federal government performance, but not with Lower Saxony state government; • but relatively stable fundamental support for the principles and values of representative democracy
Identity, Trauma, and Mourning in Contemporary Transcultural Narratives

This work examines how contemporary literary fiction reflects these tensions, exploring the complex relationship between identity and inheritance. Drawing on Vamik Volkan’s studies of large-group psychology, Judith Butler’s theory of primary human vulnerability, and Michael Rothberg’s theory of the implicated subject, this study examines how literary narratives portray identity conflicts and the weight of cultural pasts. The investigation of inheritance, which entails different forms of loss – of home, land, loved ones, or self, also considers the role of mourning, both personal and collective, in shaping a meaningful and unconflicted sense of self. By anchoring the analysis of narratives in theories of transgenerational trauma, implication, and grievability, this book reveals how literature confronts the unrepresentable, exposing the deep, often unseen ties between past and present

3D Virtual Histopathology by Multiscale X-Ray Phase-Contrast Tomography: Novel Tools and Applications
No full textSoftcover, 17x24Histological analysis has been considered as the gold standard for studying tissue architecture for over two centuries, providing essential insights into tissue morphology and organization. However, the technique is inherently destructive and limited to the microscopic visualization of two-dimensional sections. In recent years, X-ray phase-contrast computed tomography (XPCT) has emerged as a promising non-destructive imaging modality which can bridge the gap between classical histology and volumetric imaging, enabling virtual 3D histology of intact tissues on multiple length scales.
In this thesis, we explore the potential of XPCT as a tool for morphometric analysis and three-dimensional tissue characterization, with applications in neuroscience, pathology, and preclinical studies. The first section introduces the fundamentals of X-ray imaging, phase contrast formation and quantitative analysis. The second section investigates whether Neodymium acetate is suitable as a new staining agent for enhanced contrast in XPCT. In section three, XPCT is used to study a variety of neurodegenerative disease hallmarks in human brain tissue. The fourth section evaluates lung imaging, focusing on physiological and pathological features. In section five, whole-organ imaging of human placentae is addressed, with a focus on vasculature segmentation and three-dimensional tissue visualization across several length scales. Finally, section six demonstrates XPCT’s scalability for laboratory, high-throughput imaging in preclinical models of SARS-CoV-2 infection in combination with morphometric tissue analysis.
Combining advanced optics, phase retrieval algorithms, and morphometric analysis, this work establishes XPCT as a viable, non-destructive alternative to traditional histology, offering high-resolution 3D visualization of tissue morphology
Multi-scale X-ray phase-contrast tomography of the cochlea
No full textSoftcover, 17x24The organ of Corti in the mammalian cochlea is the receptor organ for hearing, transducing sound into auditory nerve signals.
In order to further extend our understanding of the underlying neurophysiology, three dimenstional (3D) imaging capabilities are required that are able to quantify the micro-anatomy of the cochlea.
Due to the subtle and intricate structure of the cochlea, a non-destructive imaging method such as 3D virtual histology by propagation-based X-ray phase-contrast computed tomography (XPCT) is preferred.
This thesis investigates the structure of the mammalian cochlea of different animal models and humans with XPCT. The scales covered range from mm-sized tissue segments up to small-animal heads and the human temporal bone.
Experiments have been performed at dedicated imaging beamlines at synchrotron radiation facilities and at in-house laboratory µ-CT setups, exploring sample embedding and staining protocols. Datasets in this thesis include the visualisation of noise-induced hearing loss in the guinea pig, segmentation of spiral ganglion neuron nuclei and the visualization of the orientation of cochlear implants

Die Kolloquienreihe beschäftigte sich im Sommersemester 2023 mit den Themen „Rahmenbedingungen für eine (voll-) digitale Videoverhandlung“ und „Möglichkeiten und Grenzen der Beweiserhebung in der (voll-) digitalen Verhandlung“. Die Autorinnen und Autoren zeichnen in diesem Band mit ihren innovativen und hoch aktuellen Beiträgen die neusten Entwicklungen der Digitalisierung des Zivilverfahrensrechts auf nationaler Ebene nach und begleiten den Gesetzgebungsprozess zur Videoverhandlung.
Das Wintersemester 2023/2024 der Digitalisierungskolloquien war geprägt durch den Blick „über den Tellerrand“. Mit Referenten aus dem europäischen Ausland wurden internationale Aspekte der Digitalisierung im Kolloquium zu dem Thema „Herausforderungen der Prozessrechtsdigitalisierung aus rechtsvergleichender Perspektive“ diskutiert. Den Abschluss der Kolloquienreihe bildete das Kolloquium „Der Zivilprozess der Zukunft unter besonderer Berücksichtigung von Inkassodienstleistungen und Schiedsgerichtsbarkeit“. Die praktischen und dogmatischen Beiträge der Autorinnen und Autoren finden sich im zweiten Teil des vorliegenden Doppeltagungsbandes.The fourth conference volume of the “Göttingen Colloquia on the Digitalization of Civil Procedure Law” is once again being published as a double volume and contains the written versions of the presentations given by the speakers at the digitalization colloquia during the summer semester of 2023 and the winter semester of 2023/2024.
In the summer semester of 2023, the series focused on the topics “Framework and conditions for a (fully) digital video hearing” and “Potentials and limitations of the taking of evidence in (fully) digital proceedings.” In this volume, the authors present innovative ideas that trace the latest developments in the digitalization of civil procedure law and critically reflect on the ongoing reform process concerning video hearings.
The winter semester 2023/2024 of the digitalization colloquia was shaped by a “look beyond the horizon.” With speakers from other European countries, international aspects of digitalization were discussed in the colloquium on the topic “Challenges of the digitalization of procedural law from a comparative law perspective.” The series concluded with the colloquium on “The civil procedure of the future, with special consideration of debt recovery services and alternative dispute resolution.” This second part of the double conference volume comprises the authors' practical and doctrinal contributions, offering in-depth analyses of the topics discussed
Zur notwendigen Ausgestaltung kollektiver Entscheidungsstrukturen in einem Sozialisierungsgesetz
No full textSoftcover, 17x24Die Dissertation untersucht Artikel 15 GG, der es ermöglicht, Grund und Boden, Naturschätze und Produktionsmittel durch Gesetz in Gemeineigentum oder andere Formen der Gemeinwirtschaft zu überführen. Obwohl die Sozialisierung seit dem Inkrafttreten des Grundgesetzes bisher noch nicht umgesetzt wurde, gewinnt sie in Zeiten sozialer und wirtschaftlicher Krisen wieder an Aktualität, zuletzt deutlich sichtbar durch die Berliner Initiative „Deutsche Wohnen & Co enteignen“, die Wohnungsbestände in Berlin in Gemeineigentum überführen möchte.
Die Sozialisierungsnorm kann einerseits nicht in die herkömmlichen Verfassungsnormkategorien der Grundrechte, Staatszielbestimmungen oder Einrichtungsgarantien eingeordnet werden, ist andererseits aber mehr als eine bloße Ermächtigungsgrundlage: Artikel 15 GG ist dogmatisch als „kollektives Verfassungsrecht sui generis“ zu kategorisieren. Dies hat Folgen für die Umsetzung durch ein Sozialisierungsgesetz – etwa für die Anwendung des Verhältnismäßigkeitsgrundsatzes und für die Sozialisierungsentschädigung. Aus der dogmatischen Einordnung sowie aus dem Begriff der Gemeinwirtschaft folgt außerdem, dass kollektive Eigentumsformen auch kollektive Entscheidungsstrukturen erfordern, die in einem Sozialisierungsgesetz zwingend auszugestalten sind, um eine Teilhabe der Allgemeinheit an Eigentumsbefugnissen sicherzustellen. Dementsprechend wird in der Arbeit auch der Frage nachgegangen, inwiefern sich aus dem Demokratieprinzip Anforderungen an eine demokratische Legitimation der Entscheidungsberechtigten innerhalb des Rechtsträgers des Kollektiveigentums ergeben. Anhand der Struktur der Sozialisierungsnorm wird deutlich, dass die Rechtsträger von sozialisiertem Eigentum der funktionalen Selbstverwaltung zuzuordnen sind. Als Beispiel wird schließlich das Konzept einer Anstalt öffentlichen Rechts der Initiative „Deutsche Wohnen & Co enteignen“ untersucht.This dissertation examines Article 15 of the German Constitution, which permits land, natural resources, and means of production to be transferred to common or other forms of public ownership by law. Although socialisation has not been implemented since the Constitution came into force, the topic is gaining renewed relevance in times of social and economic crisis. A recent example is the Berlin initiative ‚Deutsche Wohnen & Co enteignen‘, which seeks to transfer housing stock in Berlin into common ownership.
Article 15 cannot be easily categorised within the conventional constitutional norm categories of fundamental rights, state objectives, or institutional guarantees. Nevertheless, it is more than a mere enabling provision. Rather, Article 15 should be regarded as a sui generis collective constitutional right. This classification has significant implications for the implementation of a socialisation law, particularly with respect to the principle of proportionality and the requirement for socialisation compensation. Furthermore, the dogmatic classification and the concept of a common economy imply that collective forms of ownership necessitate collective decision-making structures. Such structures are essential in socialisation law to ensure public participation in ownership. Accordingly, this thesis explores the extent to which the democratic principle necessitates democratic legitimisation of those empowered to make decisions within the legal entity of collective ownership. The structure of the socialisation provision makes it evident that the legal entities managing socialised property fall within the scope of functional self-administration. Finally, the concept of a public-law institution, as proposed by the initiative ‚Deutsche Wohnen & Co enteignen‘, is analysed as a practical example

Die gesellschaftliche Lebenswirklichkeit offenbart jedoch einen Pluralismus moralischer Richtigkeitsvorstellungen und Gewissensüberzeugungen, häufig durch unterschiedliche kulturelle bzw. soziale Prägungen bedingt, nicht allein auf Seiten der Patientinnen und Patienten sowie ihrer Angehörigen, sondern ebenso auf Seiten der Behandelnden und der – unter Umständen konfessionell gebundenen – Einrichtungen. Das Recht steht dabei im explosiven Spannungsfeld zwischen der Forderung nach Standardisierung um der Versorgungssicherheit willen und der Anerkennung höchstpersönlicher Freiheit, gerade auch von Minderheiten.The ideal of the “therapeutic partnership” is characterized by a consensus of assessments on the meaningfulness of therapeutic options in a doctor-patient relationship. However, the reality of life in society reveals a pluralism of moral concepts of rightness and convictions of conscience, often caused by different cultural or social influences. These are not only based on the part of patients and their relatives, but also on the part of those providing treatment and the - possibly denominationally bound - institutions. The law is caught in the disruptive field of tension between the demand for standardization for the sake of care security and the recognition of highly personal freedom, especially for minorities
Ästhetik der Kinder- und Jugendliteratur im weltliterarischen Kontext
No full textSoftcover, 17x24Die vorliegende Habilitationsschrift fokussiert die literaturtheoretischen Aspekte der Kinder- und Jugendliteratur mit dem Ziel, einen Beitrag zu ihrer Theorie und ihrer Ästhetik leisten zu können. Sie überprüft die folgenden Thesen: Erstens wird angenommen, dass die konkurrierenden heteronomen und autonomen ästhetischen Positionen nicht nur für die wichtigsten Gegensätze der (Kinder- und Jugend-)Literaturwissenschaft ausschlaggebend sind, sondern auch die Genese der Kinder- und Jugendliteratur maßgeblich beeinflusst haben und beeinflussen. Zweitens kann deren Entwicklung als eine kontinuierliche Oszillation zwischen dem Pol der ästhetischen Autonomie und dem Pol der Heteronomie beschrieben werden.
Die komparatistische Dimension der Untersuchung resultiert aus der Analyse internationaler kinder- und jugendliterarischer Texte. Die Auswahl der Werke beschränkt sich auf das 21. Jahrhundert und berücksichtigt dabei die folgenden verschiedenen Textarten unterschiedlichen Inhalts: psychologische Kinder- und Jugendromane, kulturökologische Narrative, Kriminalgeschichten und Verbrecherliteratur und schließlich historische Narrative.This habilitation thesis undertakes a rigorous examination of the literary-theoretical dimensions of children's and young adult literature, with the objective of contributing to its theoretical and aesthetic discourse. At the core of this investigation lie two principal hypotheses. First, it is asserted that the persistent dialectic between heteronomous and autonomous aesthetic positions not only constitutes a foundational tension within children's and young adult literary studies but has also been instrumental in shaping both the historical trajectory and contemporary evolution of the genre. Second, the development of children's and young adult literature may be conceptualized as a continuous oscillation between the poles of aesthetic autonomy and heteronomy, reflecting broader shifts in literary, cultural, and ideological paradigms.
Employing a comparative methodological framework, this study engages with an array of international children's and young adult literary texts published in the 21st century. The selection encompasses diverse textual forms and thematic orientations, including psychological fiction, cultural-ecological narratives, crime literature, and historical fiction. This corpus serves as the foundation for an in-depth exploration of the dynamic interplay between aesthetic imperatives and extraliterary determinants in contemporary children's and young adult literature, elucidating the ways in which these works navigate the dialectic between artistic self-determination and external sociocultural forces
