Enforcing trade and sustainable development provisions in the EU’s agreements with third countries: towards an implied duty?
No full textThe provisions on trade and sustainable development in the EU’s trade agreements with third countries are understood to be largely political and their enforcement by the Union is, therefore, considered discretionary. The article revisits this long-established doctrine and demonstrates why it is not only detrimental to achieving sustainable development objectives, but also legally outdated. Building upon the analysis of the post-Lisbon architecture of EU law in general and Opinion 2/15 of the Court of Justice in particular, this contribution demonstrates that there might be an implied duty of the Union to enforce the provisions on trade and sustainable development found in the EU’s agreements with third countries. This article theorises this implied duty chiefly by means of teleological interpretation of the primary law of the Union but also based on the growing role of trade and sustainable development commitments in the EU’s trade agreements, and some notable novelties found in those recently concluded. The piece also looks into the content of this duty, the possible consequences it might entail, and how it fits into the broader picture of the EU’s attitude towards trade and sustainable development
Biometric technologies and the law: developing a taxonomy for guiding policymakers
No full textDespite the increasing adoption of biometric technologies, their regulation has not kept up with the same pace, particularly with regard to safeguarding individuals’ privacy and personal data. Policymakers may struggle to comprehend the technology behind biometric systems and their potential impact on fundamental rights, resulting in insufficient or inadequate legal regulation. This study seeks to bridge this gap by proposing a taxonomy of biometric technologies that can aid in their effective deployment and supervision. Through a literature review, the technical characteristics of biometric systems were identified and categorised. The resulting taxonomy can enhance the understanding of biometric technologies and facilitate the development of regulation that prioritises privacy and personal data protection
Harmonising privacy: the protection of personal data and digital rights in the European Union. Legal, political and technical barriers to a unified digital privacy framework across EU Member States
No full textThis paper analyses the fragmented protection of individuals’ personal data in the European Union, arguing that the General Data Protection Regulation (GDPR), while comprehensive in scope, falls short of ensuring uniform enforcement across Member States. Moreover, a theoretical framework around the evolving notion of personal data proves how combinations of anonymised information can re-identify individuals, challenging the GDPR’s current definitional limits. This study thereby situates the GDPR within the broader, interdependent EU data governance framework, revealing overlaps and inconsistencies that undermine harmonisation. Using comparative case studies of Ireland, Spain, Italy, and Latvia, this paper demonstrates that enforcement diverges significantly across Member States due to differing institutional capacities, political wills, and administrative traditions. Applying theories of policy implementation and multi-level governance, it argues that EU-level law is weakened by practical differentiation. This analysis coincides with the European Commission’s 2025 Digital Omnibus proposals, which aim to overhaul GDPR procedures and underscore the structural challenges examined in this paper

No full textFramed within the field of Medical Humanities, this article reflects on human existence and the impact of death, the process of dying, and faith on mental health, based on a clinical case described by Dr Ana Cláudia Quintana Arantes, within the scope of Medical Humanities. It promotes dialogue between medicine, nursing, philosophy, psychology, and theology, supported by scientific evidence and narrative reflection. The discussion highlights the positive role of spirituality and religion in care and in adjustment to the end of life, as well as the challenges involved in integrating spiritual care into clinical practice. It concludes that each life story is unique; that life and death are inseparable dimensions of the human condition; that death is also represented through multiple metaphors; that training in spiritual care is essential; and that, in the experience of dying, faith may open a path to transcendence and love endures as a lasting legacy.Inserido no âmbito das Humanidades Médicas, o artigo propõe uma reflexão sobre a existência humana e o impacto da morte, do processo de morrer e da fé na saúde mental, a partir de um caso clínico descrito pela médica Ana Cláudia Quintana Arantes. Articulando medicina, enfermagem, filosofia, psicologia e teologia, sustenta-se num tratamento interdisciplinar que conjuga dados científicos e reflexão narrativa. Destaca o papel positivo da espiritualidade e da religião no cuidado e no ajustamento ao fim da vida, bem como os desafios da integração do cuidado espiritual na prática clínica. Conclui que cada história de vida é singular; que vida e morte constituem dimensões indissociáveis da condição humana; que a morte é também representada por múltiplas metáforas; que a formação em cuidado espiritual é essencial; e que, na experiência do morrer, a fé pode abrir à transcendência e o amor prevalece como legado

Pretende explorar la realidad virtual como un espacio de múltiples posibilidades, diseñado para maniobrar la percepción de los espectadores a través de experiencias inmersivas. Para ello, la investigación comienza examinando los fundamentos ontológicos del concepto de realidad virtual, para pasar a un enfoque epistemológico que analiza diversos ejemplos de ilusión y espacios de inmersión a lo largo de la historia occidental. Este examen pretende dilucidar la creciente utilización de la realidad virtual en el contexto de la operacionalización tecnológica.El viaje de investigación hace hincapié en la exploración de las experiencias estéticas de los espectadores con obras de arte que emplean la realidad virtual como vehículo de expresión en momentos cruciales a lo largo de la historia. En este contexto, un análisis meticuloso del marco histórico mejora la comprensión del creciente interés de los artistas por los enfoques inmersivos y la adopción de la realidad virtual como medio de expresión creativa.Este estudo fornece uma análise pormenorizada do estado da arte da realidade virtual como um meio significativo na estética. To this end, the research begins by examining the ontological foundations of the concept of virtual reality, progressing to an epistemological approach that analyzes various examples of illusion and immersion spaces throughout Western history. This examination aims to elucidate the increasing utilization of virtual reality within the context of technological operationalization.

No full textEste artigo discute a exclusão digital como uma barreira invisível à formação continuada de professores que atuam na educação prisional no estado do Rio de Janeiro. A pesquisa, de abordagem qualitativa e natureza exploratória, foi desenvolvida a partir de um curso online realizado em outubro de 2024, com 70 inscritos, dos quais 57 participaram efetivamente. Os dados foram coletados por meio de formulários digitais e atividades formativas, e analisados de forma descritiva e interpretativa. O estudo identificou desafios relacionados ao letramento digital e evidenciou que a exclusão digital de segunda ordem ainda constitui um obstáculo estrutural ao acesso e à permanência em processos formativos. Conclui-se que a democratização da formação digital docente requer políticas e práticas inclusivas, sensíveis à diversidade do corpo docente, com trilhas formativas diferenciadas, suporte afetivo e estratégias de inclusão desde o processo de inscrição, a fim de romper o ciclo da exclusão e promover uma educação mais equitativa.This paper discusses digital exclusion as an invisible barrier to the continuing education of teachers working in prison education in the state of Rio de Janeiro. The study, which adopted a qualitative and exploratory approach, was developed from an online training course held in October 2024, with 70 teachers enrolled, of whom 57 effectively participated. Data were collected through digital forms and formative activities and analyzed descriptively and interpretatively. The study identified challenges related to digital literacy and revealed that second-order digital exclusion still constitutes a structural obstacle to access and permanence in professional development processes. It is concluded that the democratization of teachers’ digital training requires inclusive policies and practices that are sensitive to the diversity of the teaching body, with differentiated learning paths, affective support, and inclusion strategies beginning at the registration stage, in order to break the cycle of exclusion and promote a more equitable education
