    A criminologia pede passagem

    This text proposes a reflection on the role of criminal judges in upholding the fundamental rights of individuals accused of committing crimes. To achieve this, it presents several criminological perspectives aimed at reducing the use of criminal law, such as non-contingent responses, adequacy/suitability, legislative representation of the prison population, respect for cultural autonomy, and culpability based on social vulnerability. Ultimately, the aim is to increase the complexity of the criminalization process, serving as a model for the Criminal Justice System.O presente texto propõe uma reflexão sobre o papel do juiz criminal na efetivação dos direitos fundamentais do cidadão acusado da prática de crimes. Para isso, são apresentadas algumas perspectivas criminológicas que buscam reduzir o uso do direito penal, tais como resposta não contingente, idoneidade, representação legislativa da população prisional, respeito às autonomias culturais e culpabilidade por vulnerabilidade social.     Recent statistical data and studies carried out in Portugal reveal the difficulty that people with visual impairment face in integrating the labour market. The present work was developed with the objective of identifying and promoting good practices that employers can (and should) adopt. We also hope that this work can contribute to the promotion of the integration of people with visual impairments in the labour market. For this purpose, a literature review was carried out, with emphasis on national and European recommendations in this field and studies carried out in Portugal whose goal was precisely centred on understanding the professional integration process of people with visual impairments.Dados estatísticos recentes e estudos realizados em Portugal revelam a dificuldade que pessoas com deficiência visual enfrentam na integração no mercado de trabalho. O presente trabalho surgiu com o objetivo de identificar e dar a conhecer boas práticas que as entidades empregadoras podem (e devem) adotar, esperando-se desse modo contribuir para a promoção da integração das pessoas com deficiência visual no mercado de trabalho. Para o efeito, recorreu-se à revisão da literatura, tendo-se privilegiado nessa revisão as recomendações nacionais e europeias neste domínio e os estudos realizados em Portugal cujo objetivo se centrava precisamente na compreensão do processo de integração profissional de pessoas com deficiência visual.Des données statistiques récentes et des études réalisées au Portugal révèlent la difficulté d’intégration des personnes ayant une déficience visuelle sur le marché du travail.     As profissões judiciais nos tribunais de 1ª instância portugueses: reflexos do conflito trabalho-família

    Neste artigo abordamos a interceção entre o trabalho e a família nos tribunais de 1ª instância portugueses, a partir da problemática do conflito trabalho-família entre magistrados/as judiciais, magistrados/as do Ministério Público e oficiais de justiça. Para tal, recorre-se aos dados recolhidos através do inquérito por questionário online aplicado aos/às profissionais judiciais portugueses/as e, em particular, a Escala de Conflito Trabalho-Família (WFCS). Complementarmente, utilizamos a informação recolhida através de um conjunto de entrevistas realizadas. Conclui-se que os/as profissionais judiciais experienciam níveis elevados de conflito trabalho-família, com um maior domínio do trabalho sobre a família do que o contrário.This article addresses the intersection between work and family in Portuguese trial and district courts concerning the issue of work-family conflict among magistrates, district attorneys and court officials. To do this, data collected through the online questionnaire survey applied to Portuguese judicial career professionals was used, particularly the Work-Family Conflict Scale (WFCS). In addition, information gathered through a series of interviews was considered. In conclusion, judicial career professionals experience elevated levels of work-family conflict, with a greater dominance of work over family than vice versa.Dans cet article, nous abordons l’intersection entre le travail et la famille dans les tribunaux portugais de première instance, en nous basant sur le problème du conflit travail-famille parmi les juges, les procureurs et les fonctionnaires de la justice. À cette fin, nous avons utilisé les données recueillies par l’enquête par questionnaire en ligne appliquée aux professionnels de la justice portugais, en particulier l’échelle de conflit travail-famille (Work-Family Conflict Scale - WFCS). En outre, nous avons utilisé les informations recueillies lors d’une série d’entretiens. Il est conclu que les professionnels de la justice connaissent des niveaux élevés de conflit travail-famille, avec une plus grande prédominance du travail sur la famille que l’inverse

    Mapping the values of digital constitutionalism: guiding posts for digital Europe?

    Since its development, the face of the internet has changed drastically, both in terms of the technology employed, the number of users, the impact and interwovenness with the lives of people and the activities of businesses all over the world. This rapid development, while clearing the way for increased production of wealth, facilitating communication, and allowing for the creation of new economic activities, has also had indelible impacts on the day-to-day lives of ordinary citizens and of constitutional democracies. These impacts seem to result from the increased platformisation of the internet, the concentration of market power around a handful of economic operators (gatekeepers), and the wide-ranging powers these operators enjoy in setting the conditions and restrictions they see fit in their terms of service. In this context, academia has highlighted many of the issues this scenario has brought about and the concerns it raises for the protection of fundamental rights and democracy. To address such issues, two approaches appear to take centre stage: a watered-down version of the early libertarian aspirations for the internet, on one hand; and, on the opposite side, a state-centric regulatory approach. A third path seems to have formed recently, that of digital constitutionalism, which looks to translate the traditional safeguards of modern constitutionalism to the digital realm, complementing them with innovative means, in light of the specific needs created by technologies such as algorithmic techniques, profiling and artificial intelligence. In this paper, we investigate the theory of digital constitutionalism and isolate its core values with a view to lay the groundwork for future research dedicated to assessing whether EU law and policy on digital services have adhered to them

    Can money buy rule of law? – overview of the recent instruments within the EU conditionality policy

    In recent years, the EU has been engaged in developing its rule of law toolbox to reverse the ongoing trend of backsliding. The aim of this paper is to explore the effectiveness of the rule of law conditionality instruments which contain a certain budgetary dimension. The link between financial tools and rule of law breaches is set out in Regulation 2020/2092. Hence, this solution also strives to limit the possibilities for such illiberal and corrupt practices to be (indirectly) supported by the EU funds. This contribution analyses the added value of the regulation in defining the rule of law as the Union’s founding value, and its efforts to bring EU values enforcement under the aegis of EU law. Starting from the premise that, unlike other instruments, budgetary conditionality moves from the realm of values to the less abstract realm of money, this paper explores the potential for integrating this concept into enlargement policy. Given the EU is strongly attempting to change its approach in transforming the candidate countries, one way to inspire some real reforms on the ground is to connect the fulfillment of rule of law standards with the access to pre-accession funds. Special focus is put on the Western Balkans in the light of the new geopolitical urgency to revive the EU enlargement

    The objective of this article is to discuss how the poetic work of Adília Lopes uses irony and the questioning between the real and the fictional as self-representation strategies, based on the literary staging of an autobiography marked by an ironic, critical and subversive language. Using authors such as Linda Hutcheon (1985) and Flora Süssekind (2002) as a theoretical basis, a bibliographical research was carried out through which different poems by the author are analyzed with the aim of highlighting how the self-representation procedures used tend to forge an autobiographical illusion marking her enunciative self with the same characteristics as the real self, namely, the fact of being a woman, poet, Portuguese, single, religious, as a form of affirmation of the self as being of the female gender and renewing the artifice of the self-portrait by through irony and questioning between the real and the fictional.O objetivo do presente artigo é discutir como a obra poética da autora Adília Lopes se serve da ironia e do questionamento entre o real e o ficcional como estratégias de autorrepresentação, a partir da encenação literária de uma autobiografia marcada por uma linguagem irônica, crítica e subversiva do fazer poético tradicional. Utilizando como base crítica e teórica autores como Rosa Maria Martelo (2019; 2004), Linda Hutcheon (1985) e Flora Süssekind (2002), foi realizada uma pesquisa bibliográfica por meio da qual são analisados diferentes poemas da autora com o intuito de evidenciar como os procedimentos de autorrepresentação utilizados tendem a forjar uma ilusão autobiográfica marcando seu eu-enunciativo com as mesmas características do eu-real, a saber, o fato de ser mulher, poeta, portuguesa, solteira, religiosa, como uma forma de afirmação do eu quanto ser do gênero feminino e renovando o artifício do autorretrato por meio da ironia e do questionamento entre o real e o ficcional

    The objective of this article is to evaluate the use of Geographic Information Systems (GIS) in the study of monastic domains during the Middle Ages. This analysis is based on the cartographic representation and spatial analysis of several monasteries and their domains, studied through the Claustra, Spiritual Landscapes, Monastic Landscapes, F-Atlas and Freilas research projects. These examples highlight the potential of georeferencing, digital mapping and algorithmic analysis (clustering, interpolation, distance calculation) in understanding the impact of monastic settlements on the territory, economy, and society of their time. The maps resulting from this mapping process serve as valuable sources of knowledge, that allow us to approach the management strategies of monastic property during the medieval period. Our methodology aligns with the principles of Digital Humanities and has a strong vocation for social transfer, through the design and implementation of geospatial data servers, cartographic viewers, and interactive catalogues. These tools are freely accessible and useful to both the scientific community and the social transfer.El presente artículo tiene como objetivo valorar el uso de los Sistemas de Información Geográfica (SIG) en el estudio de los espacios de dominio monástico durante la Edad Media. Lo hacemos a partir de la representación cartográfica y el análisis espacial de diversos monasterios y dominios monásticos de origen medieval, estudiados a través de los proyectos de investigación Claustra, Paisajes Espirituales, Paisajes Monásticos, F-Atlas y Freilas. Tales ejemplos ponen de relieve el potencial de la georeferenciación, del mapeo digital y del análisis algorítmico (clusterización, interpolación, cálculo de distancias) en el estudio del impacto de la implantación monástica sobre el territorio, la economía y la sociedad de su tiempo. Los mapas resultantes de este proceso de mapeo constituyen verdaderas fuentes de conocimiento, que permiten aproximarnos a las estrategias de gestión de los bienes de propiedad monástica en época medieval. Nuestra metodología de trabajo se incardina en el ámbito de las Humanidades Digitales y tiene una fuerte vocación de transferencia social, a través del diseño e implementación de geoservidores de datos, visores cartográficos y catálogos interactivos de libre acceso y útiles tanto para la comunidad científica como para la transferencia social

    In recent years, Geographic Information Systems (GIS) have made possible what could not be achieved before: the reconstruction of historical political spaces. This article presents a methodology that, in our view, enables the reconstruction of the jurisdictional boundaries of Early Modern Castile’s lordships by utilizing and georeferencing administrative data from the General Survey of the Cadastre of La Ensenada (1749-1754). This survey is one of the discipline’s most extensively used and valuable sources; however, a digital map of the lordships does not yet exist to spatially organize the data from past studies and future research on Early Modern CastileLos Sistemas de Información Geográfica (SIG) han permitido en los últimos años lo que con anterioridad a esta tecnología no pudo llevarse a cabo: la reconstrucción de espacios políticos previos a la disposición actual. En este artículo se presenta la metodología que permite a nuestro juicio reconstruir la planta de los señoríos jurisdiccionales de la Edad Moderna en la corona de Castilla, a partir de la explotación y georreferenciación de los datos administrativos contenidos en el Interrogatorio General del Catastro de La Ensenada (1749-1754), una de las fuentes más y mejor explotadas por la disciplina pero de la cual, sin embargo, todavía no se dispone de la cartografía señorial en formato digital sobre la cual disponer las distribuciones espaciales de todas las realidades ya estudiadas y por estudiar de la Castilla moderna

    A Hipertelevisão no Cenário Mediático Brasileiro: Uma Análise das Estratégias Adotadas Pela Plataforma de Streaming Globoplay

    Este artigo visa examinar como a televisão brasileira tem respondido às tendências tecnológicas no contexto da convergência mediática, com foco específico na plataforma de streaming do Grupo Globo, o maior conglomerado de média da América Latina, conhecida como Globoplay. O argumento central deste artigo gira em torno das várias formas de engajamento empregues pela organização enquanto procura adaptar-se ao cenário de constante mudança dos média. Utilizando o método de estudo de caso (Yin, 2015), esta pesquisa correlaciona o quadro teórico com três pontos centrais destinados a discutir as noções de engajamento na era da convergência dos média como base para as relações da televisão com os seus anunciantes, a criação de produtos e projetos audiovisuais e, sobretudo, a sua relação com a audiência. A análise destaca o uso de técnicas como inteligência artificial e aprendizagem automática, que ajudam a plataforma a remodelar as suas estratégias e processos de tomada de decisão. À luz dos resultados e discussão subsequentes, pode-se inferir que o objetivo principal dessas iniciativas consiste em adaptar-se ao contexto hipertelevisivo e ampliar o modo como o Grupo Globo se relaciona tanto com o seu público como com os seus anunciantes.This article endeavours to examine how Brazilian television has responded to technological trends in the context of media convergence within the realm of Brazilian television, with a specific focus on the streaming platform of Globo Group, the largest media conglomerate in Latin America, known as Globoplay. The central argument of this paper revolves around the various forms of engagement employed by the organisation as it seeks to adapt to the changing landscape of media. Using the case study method (Yin, 2015), this research correlates the theoretical framework with three central points aimed at discussing engagement in the era of media convergence as a foundation for television’s relationships with its advertisers, the creation of audiovisual products and projects, and, most importantly, its relationship with the contemporary audience. The analysis underscores the use of techniques such as artificial intelligence and machine learning, which aid the platform in reshaping its strategies and decision-making processes. In light of the findings and subsequent discussion, it can be inferred that the primary goal of these initiatives is to foster engagement among both its audience and advertisers
