Get PDFThe target of the service is the Public Servant Cooperative (KPN) SMP Negeri 20 Padang which is one of the KPNs in Padang City, this PKM is a continuation of the output of previous community service activities in the form of technical guidance, to ensure that partners are able to apply Excel For Accounting properly and correct, so that they can present financial reports in accordance with the Regulation of the Minister of Cooperatives and SMEs Number 13 of 2015. It is hoped that after this assistance the Treasurer will be able to prepare annual financial reports properly and correctly in accordance with the Minister of Cooperatives and SMEs Regulation No. 13 of 2015 concerning Accounting Guidelines for Savings and Loans by Cooperatives. This activity was carried out in the form of assistance in preparing KPN Financial Reports for SMP Negeri 20 Padang City using Excel For Accounting (EFA) with the prepared modules. PEMBATALAN PERJANJIAN PENGIKATAN JUAL BELI TANAH DAN BANGUNAN SECARA DI BAWAH TANGAN YANG TERIKAT HAK TANGGUNGAN BANK
Get PDFThe Sale and Purchase Binding Agreement (PPJB) with buying and selling objects made under the hand is one of the agreements that has the potential for conflict. One of them is in the following cases where the debtor makes PPJB with other parties under the hand, the PPJB object is still bound by mortgage rights, and the debtor commits it without the creditor's permission. This shows that the debtor violated the provisions contained deed of grant of mortgage and Article 11 section (2) letter g of Law Number 4 of 1996 concerning Mortgage Rights. One year after the PPJB was made, the PPJB finally had problems, so that the PPJB was canceled by the debtor underhanded. Through the empirical juridical method, this research explained that the debtor sell the object of his mortgage rights to another party through the underhand PPJB without the creditor's permission, the buyer of the object does not carry out the obligations in the PPJB properly, and the PPJB is not in accordance with applicable legal provisions. Then, the factors causing the cancellation of the PPJB are debtors in default to creditors, debtors violating Article 11 section (2) letter g Mortgage Rights Law, and land buyers in default to debtors (land sellers); PPJB does not have legal certainty; as well as the legal consequence of the cancellation of the PPJB is that the PPJB is null and void and the object in the PPJB is executed by the bank (creditor).Perjanjian Pengikatan Jual Beli (PPJB) dengan objek jual beli yang dibuat di bawah tangan merupakan salah satu perjanjian yang mempunyai potensi untuk adanya konflik. Salah satunya pada kasus berikut dimana debitur membuat PPJB dengan pihak lain secara di bawah tangan, objek PPJB tersebut masih terikat hak tanggungan, dan debitur melakukannya tanpa sepengetahuan kreditur. Hal ini menunjukkan bahwa debitur melanggar ketentuan yang tertera dalam APHT dan Pasal 11 ayat (2) huruf g Undang-Undang Nomor 4 Tahun 1996 Tentang Hak Tanggungan. Satu tahun setelah PPJB tersebut dibuat, akhirnya PPJB ini bermasalah, sehingga dibuat pembatalan PPJB oleh debitur secara di bawah tangan. Penelitian ini menggunakan metode yuridis empiris. Hasil penelitian menunjukkan bahwa debitur menjual objek hak tanggungannya kepada pihak lain melalui PPJB di bawah tangan tanpa sepengetahuan kreditur, pembeli objek tersebut tidak melaksanakan kewajiban dalam PPJB dengan sebagaimana mestinya, dan PPJB tidak sesuai dengan ketentuan hukum yang berlaku. Kemudian, faktor penyebab pembatalan PPJB adalah debitur wanprestasi kepada kreditur, debitur melanggar Pasal 11 ayat (2) huruf g UUHT, dan pembeli tanah wanprestasi kepada debitur (penjual tanah); PPJB tidak memiliki kepastian hukum; serta akibat hukum dari pembatalan PPJB tersebut adalah PPJB batal demi hukum dan objek dalam PPJB dieksekusi pihak bank (kreditur)
PERAN NINIK MAMAK DALAM PENYELESAIAN SENGKETA GADAI TERHADAP PEMANFAATAN TANAH ULAYAT DI KENAGARIAN BUKIT LIMBUKU KABUPATEN LIMA PULUH KOTA

Therefore, customary land may not be traded, it can only be pawned under certain conditions and must be redeemed or returned to the pawnbroker within the agreed timeframe. In terms of utilization of ulayat land, a ninik mamak must be able to manage ulayat land in accordance with applicable customary provisions and not conflict with government regulations. In this paper, the researcher discusses the role of ninik mamak in resolving pawning disputes over the use of communal land in Kenagarian Bukit Limbuku, Fifty Cities Regency and the obstacles encountered in settling pawn disputes over the use of communal land in Kenagarian Bukit Limbuku, Fifty Cities District. The research method used by researchers is the empirical juridical method. Based on the results of the research, the researchers found that pawning disputes over the use of ulayat lands are still occurring, how are legal arrangements regarding prevention and punishment for lenders of ulayat lands without ninik mamak permits who commit acts that violate and harm the partiesTanah ulayat bermanfaat untuk kesejahteraan anak dan kemenakan. Maka dari itu tanah ulayat tidak boleh diperjualbelikan, hanya boleh digadaikan dengan syarat-syarat tertentu dan harus ditebus atau dikembalikan lagi kepada penggadai sesuai jangka waktu yang telah disepakati. Dalam hal pemanfaatan tanah ulayat seorang ninik mamak harus bisa mengelolah tanah ulayat sesuai dengan ketentuan adat yang berlaku dan tidak bertentangan dengan peraturan pemerintah. Pada tulisan ini peneliti membahas peran ninik mamak dalam penyelesaian sengketa gadai terhadap pemanfaatan tanah ulayat di Kenagarian Bukit Limbuku Kabupaten Lima Puluh Kota serta kendala-kendala yang ditemui dalam penyelesaian sengketa gadai terhadap pemanfatan tanah ulayat di Kenagarian Bukit Limbuku Kabupaten Lima Puluh Kota. PELAKSANAAN PEMBATALAN RESTORATIVE JUSTICE DALAM PERKARA TINDAK PIDANA PENGANIAYAAN DI KEJAKSAAN NEGERI PADANG
Get PDFRestorative justice that has been implemented in Indonesia is one of the efforts in resolving cases to change the formality of punishment which focuses on the sanctions that will be given to the perpetrator and the misery of the perpetrator into mediation involving the victim, relatives of the perpetrator/victim and parties involved in the case that creates an agreement to settle cases that are fair to both parties which aims to restore the pattern of good relations between the perpetrator and the victim. One of the cases that was resolved by the Padang District Attorney through the settlement method was the case of the crime of persecution. It started with the suspect and the victim who were both traders at the Padang Raya market. The suspect and the victim were fighting over the buyer, in the end the buyer gave the victim his wares. The suspect does not accept and fights with the victim and if the victim suffers an injury to the back of the head. The suspect's actions are punishable by Article 353 of the Criminal Code. In this case the prosecutor took the initiative to carry out restorative justice efforts for cases of abuse committed by the suspect. The formulation of the problem includes: 1) how is the legal arrangement related to the crime of persecution; 2) how is the process of resolving restorative justice in the crime of persecution; 3) what are the causes of the cancellation of restorative justice for the crime of persecution. To answer the problem the approach used is Juridical Empirical research where from this research the conclusions are obtained 1) this crime of persecution can be charged with articles 351-358 of the Criminal Code 2) the mechanism for settling cases in restorative justice justice stages start from the prosecutor's facilities to carry out peaceful efforts to record into the P-21 register book as a problem of restorative justice is counted as problem solving 3) factors that cause the cancellation of peace efforts that have been facilitated by the prosecutor due to a feeling of defeat towards the parties involved in the problem being carried outRestorative justice yang telah diterapkan di Indonesia merupakan salah satu upaya dalam penyelesaian kasus untuk mengubah formalitas pemidanaan yang menitikberatkan pada sanksi yang akan diberikan kepada pelaku dan kesengsaraan pelaku menjadi mediasi yang melibatkan korban, kerabat pelaku. /korban dan pihak-pihak yang terlibat dalam kasus yang membuat kesepakatan penyelesaian kasus yang adil bagi kedua belah pihak yang bertujuan untuk memulihkan pola hubungan baik antara pelaku dan korban. Salah satu kasus yang diselesaikan oleh Kejaksaan Negeri Padang melalui metode penyelesaian adalah kasus tindak pidana penganiayaan. Berawal dari tersangka dan korban yang sama-sama pedagang di pasar Padang Raya. Tersangka dan korban sempat berebut pembeli, akhirnya pembeli menyerahkan barang dagangannya kepada korban. Tersangka tidak terima dan melawan korban dan jika korban mengalami luka di bagian belakang kepala. Perbuatan tersangka diancam dengan pasal 353 KUHP. Dalam hal ini kejaksaan berinisiatif melakukan upaya restorative justice atas kasus penganiayaan yang dilakukan oleh tersangka. Rumusan masalah meliputi: 1) bagaimana tatanan hukum terkait dengan tindak pidana penganiayaan; 2) bagaimana proses penyelesaian restorative justice dalam tindak pidana persekusi; 3) apa penyebab dibatalkannya restorative justice atas tindak pidana persekusi. Untuk menjawab permasalahan tersebut pendekatan yang digunakan adalah penelitian Yuridis Empiris dimana dari penelitian ini diperoleh kesimpulan 1) tindak pidana penganiayaan ini dapat dijerat dengan pasal 351-358 KUHP 2) mekanisme penyelesaian perkara dalam tahap peradilan restorative justice dimulai dari sarana kejaksaan untuk melakukan upaya damai dicatat ke dalam buku register P-21 sebagai masalah keadilan restoratif dihitung sebagai penyelesaian masalah 3) faktor penyebab batalnya upaya perdamaian yang telah difasilitasi oleh kejaksaan karena perasaan kekalahan terhadap pihak-pihak yang terlibat dalam masalah yang sedang dilakuka
Strategi Pengembangan Bisnis PT. Dharma Samudera Fishing Industries, Tbk Jakarta
Get PDFDharma Samudera Fishing Industries, Tbk experienced a decrease in volume of production and sales value. It happens because of a lack of raw material, the case of rejection by the importing country and the global economic crisis. The purpose of this study were to evaluate the internal and external conditions of PT. Dharma Samudera Fishing Industries, Tbk, to formulate alternative of business development strategy and to determine its priorities. The data was collected from April-June 2012 and involved seven respondents. Descriptive analysis, analysis of IFE and EFE, Internal-External analysis, SWOT analysis and the analysis QSPM were used to analyze the data. There were three strategies that can be applied by PT. Dharma Samudera Fishing Industries, Tbk. The priority of strategic alternative were consecutively implementing supply chain management; find a new country to develop a market; and increse an operation cooperation procedure to maintain a quality of raw material.

PT. Dharma Samudera Fishing Industries, Tbk mengalami penurunan volume produksi dan nilai penjualan. Hal tersebut terjadi karena kurangnya bahan baku, kasus penolakan oleh negara pengimpor dan krisis ekonomi global. Tujuan dari penelitian ini adalah untuk mengevaluasi kondisi internal dan eksternal dari PT. Dharma Samudera Fishing Industries, Tbk, merumuskan alternatif strategi untuk kelangsungan bisnis dan menentukan prioritas strategi yang paling efektif untuk mengembangkan bisnis PT. Dharma Samudera Fishing Industries, Tbk. Pengambilan data dilakukan dari bulan April-Juni 2012 dan melibatkan tujuh responden. Analisis yang digunakan untuk menganalisis data adalah analisis deskriptif, analisis IFE dan EFE, analisis matriks IE, analisis matriks SWOT dan analisis QSPM. Dihasilkan tiga rumusan alternatif strategi yang dapat diterapkan oleh PT. Dharma Samudera Fishing Industries, Tbk. Jika dilihat sesuai dengan urutan prioritas yang pertama adalah menerapkan supply chain manajemen, kedua adalah pengembangan pasar ekspor ke negara penjualan baru dan yang ketiga adalah meningkatkan pola kerjasama operasi (KSO) yang sebelumnya sudah dilakukan guna menjaga kualitas bahan baku
Studi Komparatif Pelaksanaan Tugas Besar Perencanaan Geometrik Jalan Secara Daring Dan Luring
Get PDFPerubahan metode pembelajaran selama masa Pandemi Covid 19 menuntut banyak penyesuaian yang berpengaruh pada hasil pembelajaran. Salah satunya yaitu pelaksanaan Tugas besar Perencanaan Gometrik Jalan yang dahulunya dilaksanakan secara luring, sekarang dilaksanakan secara daring. Dalam pengerjaan tugas besar secara daring diperoleh rerata pemahaman mahasiswa terhadap materi pembelajaran dan tugas besar Perencanaan Geometrik jalan yaitu 68,78%. Sedangkan persentase tingkat pemahaman mahasiswa dalam pengerjaan tugas besar secara luring yaitu 69,46%. Terdapat perbedaan tingkat pemahaman mahasiswa sebesar 0,68%. Perbedaan ini menunjukkan bahwa pembelajaran dan pengerjaan tugas besar Perencanaan Geometrik Jalan secara luring lebih mudah difahami dibandingkan pengerjaan secara daring
