Get PDFLa presente investigación jurídica lleva por título: “Determinación de la aplicación de cadena perpetua con un agravante en feminicidio generado por violencia familiar para garantizar la eficacia del proceso (Lima Este, 2018-2019). Objeto de investigación: Determinar, que con la aplicación de la pena cadena perpetua, como marco legal adecuado, por la comisión de una única agravante del delito de feminicidio generado por violencia familiar, se permitirá alcanzar un proceso penal eficaz (Lima Este, 2018-2019). Metodología: La presente investigación fue esbozada bajo la forma de investigación aplicada, cuyo diseño de la investigación corresponde a un estudio de tipo explicativo, por la realidad actual en que se encuentra, desplegando un enfoque mixto con un esquema observacional, de estilo transversal; habiéndose cuantificado la población por conveniencia, determinándose muestras en: 22 policías especializados de comisaría de familia, 01 mayor comisario, 01 fiscal y 01 abogado defensor público especializados en casos de violencia familiar generador del delito de feminicidio en la jurisdicción de Lima Este. Como resultado: se logró validar la hipótesis de investigación: Si, se aplica la pena de cadena perpetua, como marco legal adecuado, por la comisión una única agravante para el delito de feminicidio generado por violencia familiar, entonces, se logrará un proceso penal eficaz (Lima Este, 2018-2019). Conclusión: el presente estudio nos ha permitido llegar a determinar que, de aplicarse la cadena perpetua con única agravante del delito de feminicidio en casos de violencia familiar, basado en un marco legal adecuado brindado por el legislador patrio a los operadores de justicia, esto influirá considerablemente a llevarnos alcanzar un proceso penal eficaz, que contrarreste la impunidad y favorezca la prevención.The present legal research is titled: “Determination of the application of life imprisonment with an aggravating factor in femicide generated by domestic violence to guarantee the process effectiveness (Lima, Este, 2018 – 2019)”. Research objective: Determine that with the application of life imprisonment, as an appropriate legal framework, for the commission of a single aggravating factor of femicide crime generated by domestic violence, will allow to achieve an effective criminal proceeding. (Lima, Este, 2018 – 2019). Methodology: The present research was outlined in an applied research form, whose research design corresponds to an explanatory study, due the current reality in which it is found, deploying a mixed approach with a cross-sectional observational scheme, cross-sectional styled; having quantified the population for convenience, determining samples in: 22 specialized police officers from family stations, 01 chief commissar, 01 fiscal and 01 public defence lawyer specialized in domestic violence cases generator of femicide crime in Lima Este's jurisdiction. As a result: the research hypothesis was validated: If, life imprisonment penalty is applied, as an appropriate legal framework, for the commission of a single aggravating factor for femicide crime generated by domestic violence, then, an effective criminal proceeding will be achieved (Lima, Este, 2018 – 2019). Conclusion: The present research has allowed us to determine that, the application of life imprisonment penalty with a single aggravating factor of femicide crime in domestic violence cases, based in an appropriate legal framework provided by the national legislator to justice operators, this will considerably influence to lead us to achieve an effective criminal process, that counters impunity and favours prevention
La terminación anticipada y su implicancia en los delitos de enriquecimiento ilícito
Get PDFEn la presente investigación vamos a demostrar de qué forma la figura procesal de la terminación anticipada interactúa de manera directa con el delito de enriquecimiento ilícito, puesto que, si bien este delito especial es tratado en la Fiscalía de la Nación, hasta la fecha no se ha podido advertir cualquier acción procesal donde los investigados en la etapa de diligencias preliminares acepte las imputaciones y pueda activarse la conclusión pertinente del proceso penal.
Ante dicha situación, dentro de la experiencia de la autora, se ha podido advertir que ninguno de los investigados ha planteado un mecanismo legal defensor que establezca algún beneficio dentro del trámite de las investigaciones en el área especializada en estudio.In the present investigation we are going to demonstrate how the procedural figure of early termination interacts directly with the crime of illicit enrichment, since, although this special crime is dealt with in the Office of the Prosecutor of the Nation, to date it has not been able to notice any procedural action where those investigated in the preliminary proceedings stage accept the accusations and the pertinent conclusion of the criminal process can be activated.
Given this situation, within the experience of the author, it has been noted that none of those investigated has proposed a legal defense mechanism that establishes some benefit within the processing of investigations in the specialized area under study
La regulación estatal en los contratos de transferencia tecnológica en el Perú
Get PDFLa investigación delimita la importancia del control normativo sobre contratos en tecnología y su relación con la transferencia tecnológica. Se analizaron los conceptos relativos a la transferencia tecnológica enumerando desde el enfoque normativo las principales dificultades que enfrenta el Perú como país receptor, la relación del proceso con el Derecho de Propiedad Intelectual (DPI); La formalización del contrato de transferencia tecnológica según el régimen regulatorio, la estructura básica del contrato con las principales cláusulas restrictivas que suelen formar parte de los mismos. Se analiza el ejercicio del control estatal sobre estos contratos incluyendo la exploración de aquellos principios contractuales relacionada, el detalle de regulación directa e indirecta en el caso peruano. En el escenario actual, este proceso de transferencia se configura como una herramienta importante del Perú como país que acelera su crecimiento económico carente de normativa especializada. El presente estudio aplicó investigación documental y bibliográfica con método inductivo de estructura monográfica. Con la recopilación de información y análisis posterior, se pudo concluir que nuestro país como receptor tecnológico tiene dificultades en desarrollar las propias y explotar de mejor manera tecnologías recibidas. Esto se deriva de una serie de factores sociales, económicos, gubernamentales, pero también de la forma como se estructuran los contratos, presentando condiciones restrictivas que terminan impidiendo una explotación legítima con desventajas.The research delimits the importance of regulatory control regarding technological contracts, relating it to transfers of its content to receiving countries. It seeks to understand the entire process of technology transfer as a whole, the obstacles that Peru faces in this type of contract are analyzed, addressing the relationship with intellectual property rights (IPR); This research aims to identify, from the legal technique, the meaning contained in the form of technology transfer contracts provided as a legal framework little discussed in our country, its debate in favor of science, technology and innovation being important. The research integrates the concept of technology transfer contracts in the absence of a national legal framework in improving regulatory tools in innovation, identifying the legal devices that relate to technology transfer contracts, relating contractual agreements with the aim of a better understanding that facilitates the construction of rules and processes in relation to this new contractual instrument according to the needs of the country. Bibliographical and documentary inquiries about inductive methods with monographic presentation were carried out. Compiling information that was analyzed later, concluding how the receiving country had difficulties in the development of technologies. The elements of a social, economic and governmental nature are the cause of the problem and the formalization of contracts accelerates the situation with great disadvantage

El estudio tuvo un nivel descriptivo y se basó en recopilar información de diversos autores acerca de las variables de estudio, los que están mencionados en los antecedentes y bases teóricas. Toda la información trata y explica las variables motivación y desempeño laboral.
Este trabajo de investigación es un aporte para la empresa CEDITEVD S.A.C. También sirve como una fuente de información que dé a conocer cómo motivar a los trabajadores de una empresa y puedan lograr un mejor desempeño laboral.The main objective of this research work was how work motivation is related to the performance of workers in the Human Resources area in the company CEDITEDV S.A.C.

La motivación es en lo que más deberían preocuparse hoy los gerentes y dueños de la empresa ya que un alto grado de motivación genera mayor satisfacción en los empleados, y estos trabajadores son muy importantes para la empresa ya que éstos son los que logran los resultados de la empresa y muchas veces ellos son la clave del éxito de una organización. Hoy en día motivar a un trabajador es muy importante porque hace que el colaborador se sienta más comprometido con la empresa, esto ayuda a mejorar la productividad y potencia el desempeño de los colaboradores.
La presente investigación pretende determinar la relación entre la motivación y el desempeño laboral de los trabajadores de una empresa Panificadora. La empresa motivo de estudio es muy exitosa ya que comercializa productos de panificación tanto en el mercado nacional como internacional. Pero a pesar del éxito de esta organización los altos mandos descuidan mucho este tema, debido a que no buscan estrategias para motivar a su talento humano, y eso es un error de parte de esta empresa porque gracias a sus colaboradores ellos tienen buenos resultados. Por este motivo, en la parte final de investigación se hacen las recomendaciones para que esta empresa pueda tomar mejores decisiones.Motivation is very important in every company, since the behavior of the workers when performing their tasks often depends on it, while a worker is more motivated, he or she puts more effort, dedication and commitment. Motivation is what managers and owners of the company should worry about most today because a high degree of motivation generates greater satisfaction in employees, and these workers are very important to the company because they are the ones who achieve the results of the company and often they are the key to the success of an organization. Nowadays, motivating a worker is very important because it makes the collaborator feel more committed to the company, this helps to improve productivity and enhances the performance of the collaborators.
This research aims to determine the relationship between motivation and work performance of workers in a Bakery company. The company under study is very successful since it commercializes bakery products in the national and international market. However, despite the success of this organization, the top management neglects this issue because they do not look for strategies to motivate their human talent, and this is a mistake on the part of this company because thanks to its employees they have good results. For this reason, in the final part of the research, recommendations are made so that this company can make better decisions

En conclusión, “se ha demostrado que el empleo del marketing digital como estrategia, incide significativamente en la oferta inmobiliaria en Lima Moderna, Lima 2021 (p<0.05)”Digital marketing is made up of different strategies used by managers to market their services and products through digital channels, since people currently use different social networks to find what they are looking for, including housing, since singles, couples, family, looking for a place to settle, therefore, look for real estate offers to be able to acquire, since the well-being of both them and those who have dependent children, need to stabilize.

Get PDFLa presente investigación tiene como título Implementación de medios digitales para la formalización de contratos de financiamiento bancario con intervención notarial. Esta investigación pretende analizar y determinar los costos de transacción que se ahorraría en los procesos de contratación de financiamiento, realizándolas de manera electrónica. En nuestro país existen estos procesos que son engorrosos, sumados a errores asociados a las firmas manuscritas de documentos (firma en el lugar equivocado, falta de sello de la empresa, falta de facultades del representante), por último, no existe sistema legal unificado que encuentre el procedimiento eficaz de la firma manuscrita de pagare, presentación, traslado y logística para su custodia. Podemos advertir una seria de problemas que superar a efectos de lograr constituir hipotecas sin la necesidad de acudir directamente a un notario público, asimismo existe falta de dinamismo en el otorgamiento de escrituras públicas de los contratos de financiamiento con garantía hipotecaria se recomienda modificar la normativa comercial, transformación a procesos digitales que por estos días son necesarios.The title of this research is Implementation of digital media for the formalization of bank financing contracts with notarial intervention. This research aims to analyze and determine the transaction costs that would be saved in the financing contracting processes, doing them electronically. In our country, these processes are cumbersome, added to errors associated with the handwritten signatures of documents (signature in the wrong place, lack of company seal, lack of powers of the representative), finally, there is no unified legal system that can be found the effective procedure of the handwritten signature of the promissory note, presentation, transfer and logistics for safekeeping. Planeamiento financiero y la rentabilidad en la Empresa Inversiones Mildaza SCRL, San Luis, 2021
Get PDFLa presente investigación se realizó con el objetivo de determinar la influencia que tiene el Planeamiento Financiero en la Rentabilidad de la empresa Inversiones Mildaza SCRL, San Luis, 2021. Cada año se cierran nuevos emprendimientos causado por la baja rentabilidad y pocas oportunidades de financiamiento (Global Entrepreneurship Monitor, 2021). Por eso resulta importante realizar una planificación mediante la formulación de presupuestos para poder administrar eficientemente los recursos. Así se podrá determinar si la empresa es capaz de solventar sus inversiones o tomar un adecuado nivel de endeudamiento para producir un efecto multiplicador en la rentabilidad financiera. (Argüelles et al., 2018)
El enfoque de la investigación fue cuantitativo, de tipo aplicada, nivel correlacional, diseño no experimental, tuvo una población censal de 16 colaboradores, utilizando para la recolección de datos la técnica de la encuesta y como instrumento el cuestionario con mediciones de escala de Likert. Los instrumentos constaron de 40 ítems, los cuales fueron sometidos al análisis de confiabilidad de alpha de conbach obteniendo como resultado un coeficiente de 0,915 considerándose como altamente confiable.
En la investigación se concluyó que el planeamiento financiero sí tiene influencia significativa en la rentabilidad de la empresa Inversiones Mildaza SCRL, San Luis, 2021, teniendo como resultado en la prueba estadística de Rho de Spearman un valor p=0,000, menor que el nivel de significancia de 0,05, con un grado de correlación de 0,779 representando una correlación positiva muy fuerte, de esta manera, se rechazó la hipótesis nula y se aceptó la hipótesis alternativa.This research was carried out with the objective of determining the influence that Financial Planning has on the Profitability of the company Inversiones Mildaza SCRL, San Luis, 2021. Every year new ventures are closed due to low profitability and few financing opportunities (Global Entrepreneurship Monitor, 2021). That is why it is important to plan through budgeting in order to efficiently manage resources. In this way it will be possible to determine if the company is capable of paying for its investments or taking an adequate level of indebtedness to produce a multiplier effect on financial profitability. (Argüelles et al., 2018)
The research approach was quantitative, applied type, correlational level, non-experimental design, it had a census population of 16 collaborators, using the survey technique for data collection and the questionnaire with Likert scale measurements as an instrument. The instruments consisted of 40 items, which were subjected to the reliability analysis of Conbach's alpha, obtaining as a result a coefficient of 0.915, considered as highly reliable.
In the investigation it was concluded that financial planning does have a significant influence on the profitability of the company Inversiones Mildaza SCRL, San Luis, 2021, resulting in a statistical test of Rho of Spearman a value p = 0.000, lower than the level of significance of 0.05, with a degree of correlation of 0.779 representing a very strong positive correlation, thus, the null hypothesis was rejected and the alternative hypothesis was accepted

En la presente investigación se apoyó a la teoría de Díaz, García y Porcell (2008) precisó que es la identificación tres principales en la cadena de suministro: provisión, producción y distribución y a la teoría de CEPLAN (2017) definió que es el análisis prospectivo constituye la exploración del futuro. Se analiza entornos y sectores, reconociendo tendencias y factores estratégicos para construir escenarios de futuro, estudiando oportunidades y riesgos. Concluyó que las informaciones el área de Logística, es necesario la implementación de un sistema central interno (SCI) que le permitirá efectuar acciones de control previo simultáneo y de verificación a la gestión de recursos, bienes de modo que estas se efectúen de modo correcto y eficientemente para el cumplimiento de las metas y objetivos institucionales.The present research entitled: Logistics management and the execution of the strategic plan in a public entity of Integral Health Insurance, Lima, 2022, whose objective was to determine the relationship between logistics management and the execution of the strategic plan in a public entity of Integral Health Insurance, Lima, 2022. Importancia y desafío de las MYPES frente a la pandemia COVID-19
Get PDFConsiderado el año perdido, el 2020 trajo consigo numerosos desafíos, y rompió con todos los estándares en general. Muchos sectores se han visto afectados a nivel mundial, y las empresas no han sido la excepción. Gran cantidad de estas se vieron afectadas severamente en su propia actividad, generando incertidumbre sobre el futuro. En los últimos años la participación de las Mypes a nivel mundial, representan alrededor del 90%, emplean el 60% de la mano de obra y contribuyen a generar el 50% del PBI mundial. (mype,2020). En el Perú el sector empresarial está representado por las Mypes, y las cuales representan un papel fundamental en la economía peruana porque contribuyen al crecimiento del PEA (Población económicamente activa), disminuyen la pobreza e incrementan el PBI (producto bruto interno). Asimismo, se estima que estas fueron las más perjudicadas, ocasionando que muchas se vieran obligadas a tomar medidas drásticas como cerrar y otras a asumir grandes desafíos para mantenerse operativas. La cuarentena obligatoria y el estado de emergencia generaron que la demanda de sus productos caiga estrepitosamente. Esto impidió que contaran con la mano de obra necesaria para realizar sus labores. En consecuencia, los responsables de las Mypes, se vieron en la obligación y la necesidad de actuar en función de adoptar nuevas estrategias, para hacer frente a los retos actuales. Para lo cual, el presente trabajo de investigación muestra de una manera detallada, datos disponibles de las Mypes, en el contexto actual.Considered the lost year, 2020 brought with it numerous challenges, and broke with all standards in general. Many sectors have been affected globally, and businesses have been no exception. Many of these were severely affected in their own activity, generating uncertainty about the future. In recent years, the share of Mypes worldwide represents around 90%, employs 60% of the workforce and contributes to generating 50% of global PBI. (mype,2020). In Peru, the business sector is represented by the Mypes, which represent a fundamental role in the Peruvian economy because they contribute to the growth of the PEA (Economically Active Population), reduce poverty and increase PBI (gross domestic product). Likewise, it is estimated that these were the most affected, causing many to be forced to take drastic measures such as closing and others to assume great challenges to remain operational. The mandatory quarantine and the state of emergency caused the demand for their products to fall precipitously. This prevented them from having the necessary manpower to carry out their work. Consequently, those responsible for the Mypes, were obliged and needed to act in order to adopt new strategies, to face the current challenges. For which, the present research work shows in a detailed way, available data from the Mypes, in the current context
