Perlindungan Hukum Terhadap Debitur Pailit Perseorangan Dalam Menyelesaikan Perkara Kepailitan Di Indonesia
Penelitian ini membahas tentang perlindungan hukum terhadap debitur pailit perseorangan dalam menyelesaikan perkara kepailitan di Indonesia. Meskipun Undang-Undang Kepailitan telah memberikan dasar hukum, namun implementasinya masih menimbulkan sejumlah kendala. Evaluasi terhadap efektivitas perlindungan hukum tersebut menjadi penting untuk memastikan keadilan bagi semua pihak terlibat dalam proses kepailitan. Metode penelitian yang digunakan adalah kualitatif dengan teknik pengumpulan data melalui studi pustaka dan wawancara dengan pakar hukum kepailitan. Hasil penelitian menunjukkan bahwa debitur pailit perseorangan menghadapi tantangan dalam akses terhadap bantuan hukum, proses administratif yang rumit, serta kurangnya pemahaman akan hak-hak mereka. Upaya untuk meningkatkan perlindungan hukum bagi debitur pailit perseorangan meliputi pendidikan dan akses yang lebih baik terhadap bantuan hukum serta layanan konseling keuangan. Perlindungan hukum yang efektif juga membutuhkan perbaikan dalam proses administratif dan peningkatan kapasitas lembaga penegak hukum dalam menangani perkara kepailitan secara adil dan transparan. Implikasi dari penelitian ini menyoroti pentingnya perlindungan hukum terhadap debitur pailit perseorangan dalam menjaga stabilitas ekonomi dan keadilan hukum di Indonesia. Dengan demikian, perlindungan hukum yang efektif bagi debitur pailit perseorangan merupakan elemen penting dalam menciptakan lingkungan hukum yang kondusif bagi pembangunan ekonomi yang berkelanjutan dan keadilan yang merata bagi semua pihak. Implementasi perbaikan dalam sistem hukum kepailitan akan memberikan dampak positif yang signifikan bagi masyarakat dan perekonomian secara keseluruhan
Tanggung Jawab Hukum Terhadap Kasus Pemerasan Uang Melalui Prostitusi Online WhatssApp Video Call Sexs
Indonesia memiliki 80 kasus pemerasan uang melalui prostitusi online whatssApp video call sexs dari Januari-September 2018. Menurut Jaksa Penuntut Umum Data Direktorat II Ekonomi Khusus Unit V IT & Cybercrime Bareskrim Mabes Polri, kasus kejahatan dunia maya dalam kurun waktu 3 tahun yang dilaporkan sebanyak 37 dan 14 kasus telah dinyatakan P-21 oleh Jaksa Penuntut Umum. Maka jurnal ini mengamati terkait Bagaimana Tanggung Jawab Hukum Terhadap Kasus Pemerasan Uang Melalui Prostitusi Online WhatssApp Video Call Sexs? Penelitian ini menggunakan metode penelitian Normatif dengan hasil temuan ilmu hukum empiris dan ilmu lain untuk kepentingan dan analisis serta eksplanasi hukum tanpa mengubah karakter ilmu hukum normatif. Metode analisis data lainnya dengan menghimpun data sekunder yang meliputi bahan sekunder, primer, dan tersier baik berupa aturan-aturan hukum tertulis yang masih berlaku yang berkaitan dengan analisis normative. Tanggung Jawab Hukum Terhadap Kasus Pemerasan Uang Melalui Prostitusi Online WhatssApp Video Call Sexs Undang-Undang Nomor 19 tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Transaksi Elektronik Pasal 45 Ayat 4 jo Pasal 45 Ayat 1. Penerapan tanggung jawab hukum tersebut sudah benar namun implementasi di lapangannya harus lebih ditingkatkan agar terealisasikan dengan baik dan dapat meminimalisir kasus prostitusi online dalam pemerasan uang melalui whatsApp video call sexs
PHASE STAGES OF CULTURE SHOCK DEPICTED IN THE PICTURE BOOK YOON SERIES
The writer analyzes three picture books from the Yoon series by Helen Recorvits andGabi Swiatkowska titled "My Name Is Yoon" (2003), "Yoon And The Christmas Mitten"(2006), and "Yoon And The Jade Bracelet" (2008). This research aims to identify theconflicts that occur in the three picture books. The second element analyzed is todescribe the stages of culture shock experienced by the main character as animmigrant child after moving from Korea to America. This study uses qualitativemethods and a literary sociology approach. Yoon's struggle to adapt in Americafaces various obstacles and challenges full of twists and turns. After overcoming theproblems faced, Yoon eventually becomes a resilient and wise little girl because shecan endure the challenging process of culture shock
Deconstructing Identity: Consumerism, Masculinity, and Resistance in Fight Club
The film Fight Club (1999), directed by David Fincher, offers a complex critique of consumerism, masculinity, and resistance. This study employs Critical Discourse Analysis (CDA) and Multimodal Discourse Analysis (MDA) to examine how the film’s language and visuals critique capitalist ideologies, challenge traditional masculinity, and explore rebellion against societal norms. The findings reveal consumerism as a force that commodifies identity, masculinity as a construct in crisis, and resistance as both rebellion and chaos. By integrating CDA and MDA, the study highlights the film’s layered critique of identity, power, and societal values, positioning Fight Club as a culturally significant text that continues to provoke critical reflection
Tailoring Service Delivery Innovation Architecture: A Service-Dominant Logic Theory Perspective for Micro Small and Medium Enterprises
Although extensively discussed in previous studies, social media adoption has yet to consistently translate into improved business performance, revealing a significant research gap. In light of this, our study seeks to bridge this gap by investigating the relationship between social media adoption and performance in 261 micro-businesses within the food and beverage sector. We aim to explore the role of distinctive competencies in marketing as a mediating variable and examine the influence of service delivery innovation architecture from the perspective of service-dominant logic theory. We employ SEM-Amos as our analytical tool to test the formulated hypotheses to achieve this. The result show that this study significantly advances SDL theory by elucidating the pivotal role of social media adoption in understanding customer behavior and gaining valuable insights. In the context of SDL, this contributes to the understanding of how services are co-created between businesses and customers in a digitally connected environment. The outcomes of this research offer valuable insights for small businesses on leveraging social media adoption to enhance their distinctive competencies in marketing and service delivery innovation architecture
Limitasi Penerapan Doktrin Safe Harbor terhadap Platform Berbasis User-Generated Content atas Pelanggaran Data Pribadi
Digital Platform menjadi inti dari perkembangan infrastruktur digital dalam berbagai jenis pelayanan. User Generated Content merupakan salah satu bentuk dari pelayanan yang diberikan oleh digital platform. Layanan berbasis User Generated Content merupakan sebuah layanan yang mana konten dalam layanan tersebut diproduksi oleh publik yang pada umumnya didistribusikan di Internet, walaupun hanya berbentuk komentar. Konten dalam layanan berbasis User Generated Content dapat memuat pelanggaran atas data pribadi. Pertanggungjawaban atas konten tersebut menjadi sebuah isu penting dalam masalah perlindungan data pribadi. Penelitian ini dilakukan menggunakan metode penelitian normatif. Hasil penelitian ini menunjukan bahwa perlu adanya perlindungan tehadap platform berbasis user generated content dalam hal terjadinya pelanggaran data pribadi yang dilakukan penggunanya. Perlindungan tersebut hanya dapat diberikan terhadap platform yang telah melakukan tindakan permulaan. Dalam hal platform tidak melakukan tindakan permulaan maka platform tersebut dapat ikut bertanggungjawab atas kerugian yang timbul dari pemilik data pribadi
Enhancing Holistic Value in Human Transformative Service through Religious Interaction Capability
This research investigates the impact of Interaction Capability on Customer Participation, influencing the development of Perceived Holistic Value in transformative human services aimed at enhancing customer well-being. An innovative aspect introduced in this study is Religious Interaction Capability, which supplements the existing dimensions of Interaction Capability: Individualized Interaction, Relational Interaction, Empowered Interaction, and Ethical Interaction Capability. The study involved 192 outpatient participants from Islamic hospitals in Central Java, Indonesia, selected through purposive sampling. Data analysis utilized Structural Equation Modeling (SEM) with AMOS 22.0. The results suggest that Religious Interaction Capability and other interaction capabilities significantly motivate religiously oriented patients to seek and responsibly share information. Furthermore, all factors facilitating Customer Participation contribute to the formation of Perceived Holistic Value, extending beyond transactional aspects such as process and outcome value to include a broader dimension of religious value. These findings have implications for strengthening the Resource-based View theory
Forging Pathways to Success: Innovative Approaches to Private Higher Education in Central Java
This research identifies leadership styles at private universities in Central Java, analyzes organizational culture, and formulates strategies for the success/survival of private universities. Primary data was obtained through in-depth interviews with 9 university leaders as informants, with stratified sampling based on excellent, excellent, and good accreditation categories. Semi-structured interviews focused on leadership approaches, organizational culture, success strategies, and challenges. The data were analyzed using ATLAS.TI with thematic analysis. The results show that private universities have characteristics, such as leadership styles, that form different organizational cultures. There are differences in higher education management strategies between accreditation categories, especially in strategic priorities according to institutional goals. Superiorly accredited universities tend to prioritize research excellence, international collaboration, and innovative academic programs. The implication is that understanding the relationship between leadership, organizational culture, and strategic priorities can help universities align these elements for optimal effectiveness in achieving success in the competitive environment of higher education
The Position and Revitalization of Customary Criminal Law in the Perspective of National Criminal Law
This research aims to describe and analyze the status of customary law in Indonesia and the revitalization of customary criminal law from the perspective of Indonesian criminal law. This study employs normative legal research methods by analyzing various literatures. The research approach used is based on legislation, utilizing secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials, presented in a qualitative descriptive manner. The results indicate that although official authorities such as the police and courts remain significant, customary institutions often serve as the first point of mediation for resolving conflicts within communities, especially in cases involving minor material losses and other issues rooted in local concerns. This suggests that traditional values and culture hold an important place in society and influence how people interact with the formal legal system. Additionally, the revitalization of customary law is necessary, particularly in the recognition of customary legal norms, which is crucial for creating an optimal balance between modernity and the preservation of traditional values. This contributes positively to justice, welfare, and cultural sustainability in Indonesi
FAIR TRIAL FOR PERSONS WITH DISABILITIES: IDEALITY VS REALITY
The purpose of this research is to analyze the barriers in fulfilling the rights of persons with disabilities in the fair trial process to provide legal protection to persons with disabilities. The type of research used in this study is juridical normative research using secondary data obtained from previous research. The data analysis method used is qualitative by collecting data in the form of applicable laws, books, journals related to persons with disabilities and law enforcement, and interviews with stakeholders involved. The research results show that fair trials for persons with disabilities are still an ideal that has not been fully achieved. Real commitment and action from the government, law enforcement, and society are needed to ensure the protection of the rights of persons with disabilities in the justice system. There is still a lack of understanding and awareness of their needs, but increased awareness and training can help address this issue. Fair trials must consider limited physical accessibility and alternative communication facilities, and ensure adequate training for court staff. Concrete actions are needed to improve awareness, training, and accessibility in the justice system
