Civil and Criminal Liability of Doctors in Medical Operations
In general, the Civil Code and the Civil Liability Act of 1960 on the civil liability of the physician are silent; the medical responsibility is the physician\u27s accountability for the losses that the patient enters, and the damage is due to medical duties. If the medical responsibility is based on the "theory of aggression"; the guilty plea lies with the patient or claimant, and if based on the "conventional theory", depending on whether the doctor\u27s commitment is a commitment to a "result" or "device," the subject will be different. On the other hand, the Islamic Penal Code, adopted in 2013, did not accept the sole responsibility or responsibility of the physician without a fault, according to the statements of some of the Imamiye and the criticisms of lawyers. Article 495 of the new law on the subject of the appointment of a physician in the treatment that he conducts causes the loss or damage of a body is a guarantor of the blood money, unless his practice is in accordance with medical and procedural requirements, or that he has been acquitted before the treatment and the perpetrator is not a fault, and if the exclusion from the patient is not valid for his immature or insane nature or if he is not acquainted with him for an anesthetic reason and so on, the offense is obtained from the ill patient. In this research, a new approach to the civil and criminal liability of physicians and deficiencies and challenges in this field are discussed. Then, the views on the civil and criminal liability of the physician, the nature of the treatment contract and the civil liability of the physician are reviewed and the legal concept of obtaining consent and its characteristics are explained
The effect of job burnout on the performance of the employees of the Justice Department (Case study: Employees of the Justice Department of Alborz Province)
The present study was conducted to investigate the effect of job burnout on the performance of the employees of the Justice Department (Case study: Employees of the Justice Department of Alborz Province). The research method is a descriptive-analytic type that is based on the structural equation model. The community consists of 728 administrative and judicial employees in the province of Alborz, which includes eight groups with different population ratios. For example, 252 of them were selected randomly by stratified random sampling. The measurement tool in this study is a questionnaire. To assess the appropriateness of its validity and reliability, it was measured. The questionnaire had the necessary content validity and also to determine the reliability of the questionnaire, Cronbach\u27s alpha method was used. Cronbach\u27s alpha coefficient for the whole questionnaire was 0.923, therefore, the validity of this instrument was confirmed. The results of the structural equation analysis on the proposed model showed that the model has a good and acceptable fit and showed that job burnout has a positive and significant effect on the performance of the employees of the Justice Department
The mediator effect of occupational burnout on the relationship between organizational cynicism and organizational silence (Case of study: employees of Farokhshahr social security organization hospital)
As one of the challenges in the organization, Organizational cynicism interacting with occupational burnout, play a decisive role in organizational silence. The purpose of this study is to evaluate the effect of organizational cynicism on organizational silence considering occupational burnout as a mediating variable in the relationship between these two variables. For this purpose, three hypotheses were composed. To collect the information necessary for testing the hypotheses, two standard questionnaires of James (2005) to measure organizational cynicism and occupational burnout, and the questionnaire of Nol and Van Dyke (2012) to measure organizational silence were used and they were distributed Among 189 Employees of Farokhshahr Social Security Hospital as a Sample volume of research. Liserel software was used to analyze the data and hypothesis testing. The results of the test of research hypothesis, confirmed the effect of occupational burnout on organizational silence while showing that there is a significant relationship between organizational cynicism and organizational silence, as well as the occupational burnout, and the effect of occupational burnout is great on this relationship. At the end of the research, some suggestions were also presented in accordance with the findings of the research
Fragmented Opportunistic Routing Algorithm In WSN
In wireless networks, using traditional unicast routing algorithm is inappropriate due to broadcast nature and spatial diversity of wireless links. Selecting a set of N nodes as next hop in wireless networks instead of one node, increases delivery probability relative to N. This fact led to emerging a new routing schema in wireless network in recent years naming Opportunistic Routing. Opportunistic routing takes advantages of wireless networks to get higher performance metrics by selecting multiple nodes as next hop for each node instead of selecting one node as in traditional routing algorithms, Our proposed Opportunistic routing algorithm (named Fragmented Opportunistic Routing) uses local information and easy to be applicable. It tolerates nodes\u27 failure and changes in network and upon a change in a part of network; there is no needs that all the nodes in network reconfigure their Opportunistic Routing Tables
Composite in Fiber Production and Its Application in Nanotechnology
Nanostructure fibers composite are fibers that nanoscale fillers such as nanoparticles are used in their preparation. In fact, due to the unique intrinsic properties of nanomaterials including large surface area, porosity, stability, permeability, etc., special opportunities for the production of fibers composites with specific performance is provided. It is thus possible with the use of nanomaterials with unique properties of nanoscale dimensions, high volume surface area, etc., produce conventional fibers with better properties and more practicality
The effectiveness of therapy based on the acceptance and commitment in reducing the pain intensity in patients suffering from functional gastrointestinal syndrome
Functional gastrointestinal syndrome is a common disorder characterized by frequent symptoms of the gastrointestinal tract. Suffering from functional gastrointestinal tract syndrome causes several mental disorders in the affected person. To this end, the purpose of this study is to use therapy based on the acceptance and commitment to improve the severity of pain experience in these patients. In this study with semi-experimental approach, 30 women were selected through available sampling method from all women with functional gastrointestinal disorders in Isfahan city, who had referred to Isfahan health center clinic. Then all of the subjects completed the McGill pain questionnaire and then it was performed on the admission and commitment treatment group, at 8-sessions. Analysis of the findings by using covariance test showed that there is a significant difference between test and control groups in the pain experience at a significant level of 0.05 (P <0.05). The chronic course of the disease is associated with significant psychological discomfort, social and occupational dysfunction and extreme behavior in seeking medical assistance. Training or therapy programs based on the improvement of pain experience can reduce the pain of these patients and prevent imposing the extra expenses for treatment.
Comparative Study of the mourning of Ritual Poetry in Sharif\u27 Razi, Mohtasham Kashani and Adib al-Mamalek Farahani Poems
The study of the mourning of ritual poetry of Arabic and Persian language poets has a special status among researchers and literary scholars. In this regard, the most prevalent feature of ritual content in the poems of Mohtasham Kashani is the Persian poet of the tenth century AH (1499-1587)-and Sharif Razi, Arabic language poet of the fourth century AH Which is of particular importance. Adib al-MamalekAmiriFarahani, the eulogist poet of the 13th century, has the considerable poems that is comparable to the two great poets, comparison have been carried out between the rites of ritual poems, of Razi Mohtasham and Adib al-Mamalek Farhani, from three perspectives of Karbala resort and martyrdom of and was shown that there are many similarities between all three poets although , although before this, the devotional songs of Adib al-Mamalek were not analyzed with the two poets concerned, but showed that the poem of Adib al-Mamalek can also be considered by researchers among the two well-known poet
Effect of Debt Overhang on the Development of Heavily Indebted Poor Countries: Debt Laffer Curve Analysis
This study explores that whether the debt financing or debt forgiving would be suitable for the Highly Indebted Poor Countries (HIPCs). Debt Laffer curve theory has been tested in 21 HIPCs by applying price equation of debt, maximized value of debt and price elasticity approach over the period of 1980 to 2016. The maximized value of debt criterion implies that Chad is not eligible for the debt write-off strategy in comparison with the rest of the countries. By applying price elasticity approach, it is observed that only Burkina Faso, Cameroon, Chad, and Republic of Congo are eligible for debt financing while the remaining countries should adopt debt write-off facility. The crux of the study is that overall debt forgiveness is suitable for the HIPCs. Moreover, it is also in the favor of both the creditor countries and various international financial institutions such as World Bank and IMF and HIPCs itself. The study suggests that the creditors should continue to financing along with improving structural policies and institutions of the HIPCs
