Get PDFAbstract: Productive Waqf in Indonesian Islamic Law: A Philosophical Analysis of Law No. 41/2004 on Waqf. One of the most marked feature of the Law of Republic of Indonesia number 41 year 2004 concerns with management of productive waqf. The law introduces some new rules which reformulate the prior waqf rules, the law namber 28 year 1977. The Law number 28/1977 and the prior wakaf law are considered less effective, dynamic and consumptive. Its regulation is oriented to property land (unmoveable object). What the purpose to include the productive waqf (moveable property) in the law number 41 year 2004 and how it manages and regulates the nazir waqf and when the productive waqf could be applied are becoming a question. Religious pluralism has been an object of hot debates for decades, partly because of the recurring conflicts among different ‘religious’ communities. The present writer attemps to analyze the relations between Islam and Judaism in the contexts of religious pluralism, applying in the main Qur’anic exegesis method. The choice is interesting not only because of the close relation between the two in the history of Abrahamic religions but also in the context of the seemingly endless Israeli-Pelestine. Get PDFAbstract: The Politic of Early Child Education In Indonesia: A Historical Analysis of Raudhatul Athfâl and Kindergarten. Child education at early age for native citizen was out of the attention of the Dutch colonial administration because it did not confirm with its political target. Concern for child education at early age has only emerged to the surface since the Indonesian Republic postindependence era which marked by the introduction of Regulation of 1954. However, this law discriminates the Islamic Kindergarten (Raudhatul Athfâl). The introduction of Law No. 20 of 2003 gives more strength of in the position Raudhatul Athfâl in Indonesia. Sociologically, following the issuance of such legal foundation, competition between Raudhatul Athfâl and Kindergarten (TK) occurred. Get PDFAbstract: Social Reality Nuances in Formulating the Qualifications of Mujtahid and Mufti. The relationship between law and social change is a problem faced by all legal systems and the case of Islamic law is not an exception. In formulating Islamic legal theory is found dialectic process between the formulator and with the social reality being faced not a mere following the view of the imâm. The changes of this view among other things are conducted through academic tradition of sharh which plays a role of introducing new views. The phenomenon of modernizing the preconditions of mufti and mujtahid indicate an effort of synergizing realities of condition with religious exigencies. TANTANGAN PENGKAJIAN ISLAM DALAM BIDANG TEOLOGI DI MALAYSIA
Get PDFAbstract: The Challenges of Islamic Studies on Theology in Malaysia. Theology is a branch of Islamic Studies specifically designed to safeguard Islamic tenets and ideology from outsiders’ attact throughout history. In Malaysia, the study of theology has been carried out from the pesantren era of Islamic Kingdoms to the present day era of universities. Some of the universities that offer this course work include Academy of Islamic Studies, University of Malaya, Faculty of Islamic Studies, and National University of Malaysia. The author argues that nowadays, the study of theology in Malaysia is facing some predicaments from some schools of thought, such as Liberal Islam, Shi’ism, and Wahhabism. These schools of thought and new challenging trends have to be faced with certain steps by those in charge of designing curriculum of theology. The existence of Islamic banking in Indonesia gains recognition with the introduction of the government regulation of 1992 concerning the foundation of Islamic banking. Six years later the government introduced Law No. 10/1998 on reform of the banking system. As a result, reform of banking system, (conventional bankis possible to provide branch office based on syari’ah principles); reform of Islamic banking programs as well as monetary system; and reforms in accelerating of the Islamic banking development.
