Get PDFAbstract: Universality and Relativity of Human Rights. Different approaches to human rights result in two principal theories of universalistic and relativist. The first contends that human rights are integral part of human existence regardless of time and place. Human rights are solely based on the very fact of human existence. The latter theory contends that human beings are product of their life contexts, therefore human rights should also be considered in the lights of socio-cultural backgrounds. HOMOSEKSUALITAS DALAM PANDANGAN PEMIKIR BARAT DAN FUKAHA
Get PDFAbstract: Homosexuality in the Perspective of Western Thinkers and Islamic Jurisprudents. It is widely accepted that homosexuality is a damaging and immoral way of life. This presupposition seems to become as a uniting factor between the thoughts of Western scholars and Islamic jurisprudents on the legal position of homosexuality. The author argues that although Islam respect freedom in all aspects of life which belongs to every single individual, however, freedom is always recompensed with contractual responsibility to control its proper use and misuse. Accordingly, in the reality of Western world not all of the society is in agreement with substantial use of freedom occurs around them. Freedom demanded by homosexuality and social reality has led to serious concern amongstthe society about their future generation. In such a condition their human nature points to the necessity for religious and spiritual life. The author argues that they trust religion to be capable of anticipating themselves as well as their family from negative effect of homosexuality. This essay analyzes the root of homosexuality in the view of both Western scholars and Islamic jurisprudents, and relates their implication to the importance of religion. Pendekatan ini dapat disebut sebagai pendekatan sistemik, yang menekankan kesaling-terkaitan seluruh ajaran al-Qur’an mengenai berbagai hal. Karena itu, setiap ayat al-Qur’an mestilah ditafsirkan dalam konteks sistem tersebut, bukan sebagai bagian yang terpisah-pisah. Get PDFAbstract: Islam Versus Terrorism: A Legal Qur’anic Exegesis Approach. In the last decade, terrorism discourse has become one of the most important international issues. The West has claimed that Islam had supported terrorism and violence against other community, especially the West. This article attempts to elaborate the issue of terrorism in the context of Qur’anic exegesis and Islamic jurisprudence (fiqh). The author argues that Islam as the grace for the whole universe (rahmatan li al ‘âlamîn), in its very doctrines, never support terrorism, radicalism, violent actions, and destructive actions on the earth (fasâd fi al-ardh). This paper attempts to discuss how the Qur’an responses to the issue of terrorism by analyzing the interpretation of legal related verses. SYI‘AH ITSNA ‘ASYARIYAH: Beberapa Prinsip Ajaran
Get PDFAbstract: Syi‘ah Itsna ‘Asyariyah: Some Principal Teachings. The debate of ideological understanding of the rightful leadership is an important issue within the Shiates mainstream of Islam. The Shiates put ‘Ali—the fourth of al-khulafâ’ al-râsyidûn—in a special position, because they consider him as the rightful successor of the Prophet Muhammad. On the contrary, however, they consider the other three caliphs as unlawful claimers to the caliphate. However, differences of understanding in the Shiates also occur at doctrinal level that gives rise to the emergence of the Twelvers and Seveners of Shiates, the former of which holds that there are twelve lawful number of imâm whereas the latter believes that there are only seven respectively. This article traces the historical roots of divergent doctrine within the Shiites mainstream, analyses how it develop through times, and argues that the different doctrine hold by respective sects whether at a lesser or greater extent lead to different factions. Get PDFAbstract: The Prophet and the Principles of Islamic Counseling. From a professional perspective Islamic counseling is a recent origin and few scholars have addressed this area of study in a significant way. This article attempts to highlight the salient features of the principles of Islamic counseling by exploring the Qur’an, the sîrah of the Prophet Muhammad and his traditions as the role model and exemplar, and then compare it to the popular mainstream of western counseling paradigms as a dominant force in counseling and social intervention. The author asserts that psychology, as the origin of western popular counseling, is devoid of religion and foster distorted concepts of humankind that are rooted in materialism whereas counseling that is based on Islam emphasizes spiritual solutions, the main objective of which is to acquire happiness both in this world and the hereafter. As a concept, experts in general define culture as an ideational system, which include ideas, concepts, rules, and meanings that are shared by community and expressed in daily life. In its history, especially during the 17th century, Aceh, as an Islamic kingdom, developed its own culture, as it was evident in the state’s institutions and behaviors. This includes, among others, political, intellectual, ceremonial, and cosmopolitan and tolerant culture.
