Securing Muslim Children’s Civil Rights: Debate on State Legal Policy towards The Issuance of Family Cards for Unregistered Marriage Couples
The government, in ensuring children\u27s identity rights, has issued a policy regarding the issuance of family cards for unregistered marriages. This policy facilitates access to birth certificate registration for children from unregistered marriages. However, in practice, the implementation of this policy has sparked issues among judges and marriage registrars. The research was to analyze the debates surrounding the state legal policy on the issuance of family cards for couples in unregistered marriages in an effort to protect the civil rights of Muslim children. The study was an empirical legal research with a socio-legal approach. Primary data was obtained from legal officials from the KUA and religious courts in Kediri to describe the debates surrounding this regulation, which were then analyzed using the theory of contestation. The findings of this study indicated that children\u27s rights in Islamic families include administrative rights as citizens and inherent rights as members of the Muslim family. The policy regulating the issuance of family cards for couples in unregistered marriages has become a polemic among Islamic legal officials, such as religious court judges, headmen, and KUA officials because it is seen as conflicting with the established Islamic family marriage rules in Indonesia. Living Ihya and Harmonizing the Spiritual Essence: Sheikh Washil\u27s Fiqh-Sufistic as the Bedrock of Spiritual-Based Islamic Law in Nusantara
The harmonization of Islamic law through the spiritual dimension and the transformation of Islamic teachings in seems to be a disconnect between the spiritual essence of Islam and its legal framework in contemporary times. This disconnect raises questions about the extent to which current Islamic law fully embraces the spiritual principles that have become an integral part of the Nusantara heritage. Therefore, this research aimed to explore how Sheikh Washil\u27s fiqh-sufistic can function as an Islamic legal framework, based on the spiritual principles of the Nusantara and answer contemporary issues. This research used an interdisciplinary approach with two approaches, History and Islamic Law. This research explored the literature of Sheikh Washil including his contribution to Islamic law. The findings of this study: first, fiqh-sufistic contributes to spiritual studies within a legal framework in order to understand and practice the characteristics of Islam Nusantara with an inclusive approach through the values of living ihya in da\u27wah and thought. Second, fiqh-sufistic presents a balanced approach to Islamic law, which is in harmony with the cultural context and heritage. The integration of fiqh-tasawuf shows the harmonization of Islamic law and the transformation of Islamic teachings in the context of the Nusantara. Third, the prevalence of fiqh-sufistic has had a transformative impact on the inclusive religious landscape, encouraging a deeper understanding of Islam as a way of life, not just a set of legal rules
Walking Together: Dynamics of Muslim Wives Dual Role in Rural Areas Pursuing Career and Household Responsibilities
The social reality today in rural areas, a wife works to help the family economy, besides having to do domestic tasks. The concept of gender does not prohibit a wife from working. However, this will be a problem if it creates gender inequality. This study aims to reveal the problem of fulfilling domestic duties for career wives in terms of gender perspective. This research is qualitative with the type of literature study, descriptive analytical method with based on a gender approach. The result of this study is that the career wife in fulfilling domestic duties in rural areas based on a gender perspective can be seen from the role that must be carried out. The wife\u27s roles in a gender perspective are: a) mother\u27s role, b) wife\u27s role, c) social role, d) family\u27s motivator. Getting many roles, apart from being a housewife and also having to work is not an easy thing for a wife. This role must be shared with the husband so that it can be balanced so as to create harmony in a household. A woman who already has a role as a mother, wife, member of the community and also has to play a role in the family, but the husband must help and support fully
Polygamy Law Reform Through the Development of the Aceh Qanun: A New Approach to Protecting the Rights of Women and Children in Indonesia
Aiming to legalize the practice of polygamy through the Raqan regulation, which is then outlined in the family Qanun, it needs to have restrictions on practicing polygamy, such as the concept of justice and sanctions for abuse committed by a husband. The purpose is to protect women as human beings whose rights must be protected along with the obligations and be executed. Then, the research aimed to analyze the construction of Islamic law reform in the family sector, especially in protecting the position of women and children in the context of the structure of the legal order and the occurrence of polygamy without the permission of the Mahkamah Syar’iyah in Nanggroe Aceh Darussalam. The research was qualitative using non-doctrinal juridical or sociological methods to reform the legal order of polygamy in Raqan using studies of legal order theory, al-hudud (legal boundaries), and al-maslahah, using a historical approach and a legal philosophy approach. The findings showed that the idea of a legal order for polygamy in the family law community in Nanggroe Aceh Darussalam is the implementation of the idea of legal governance between compliance with Sharia and state law perfectly through Raqan renewal. Legal reform is an illustration and parameter in implementing polygamy to realize benefits for individuals and society. And, protect the position of women and children who have not been accommodated in marriage law, so that they can live a harmonious life
From Islamic Education to Learning Turkish: Indonesian Muslim Gelin\u27s Motivation to Learn Turkish
This article aims to explore Indonesian brides’ motivations (Gelin) to learn Turkish. This article is a qualitative study with a phenomenological approach. Data collection was conducted in January-April 2024 in Sakarya city with in-depth interviews and participant observation. There are seven informants in this study with different backgrounds. The data obtained were then analyzed using the Miles and Huberman qualitative analysis model: data reduction, data display, and conclusion. The study found that the Indonesian Gelin Muslims in Sakarya perceive Turkish as challenging to acquire, especially for Indonesians. However, there are two primary motivations for Muslim Gelin in Sakarya to learn Turkish consistently. First, to teach Islam to their children. The motivation is based on the fact that religious lessons are limited in most Turkish schools. Therefore, Gelin considers it necessary to provide additional religious lessons to her children at home, where the communication process uses Turkish. Second, nationalism motivation, which is to be able to interact socially while expressing and introducing Indonesia and its culture to the Turkish community. The findings show that religion not only mobilizes its adherents in ritual practices but can also be a vital motivating factor in foreign language acquisition
Contemporary Da’wah: Bullying in Schools as a Da’wahProblem: Dakwah Kontemporer: Bullying di Sekolah sebagai Masalah Dakwah
Bullying can cause adverse physical and mental effects on victims, including stress, depression, and social isolation. Bullying contradicts the values of Islamic teachings, which emphasize compassion, justice, and respect for others. In the context of da\u27wah (Islamic preaching), it is important for preachers (da\u27i) to understand and address the issue of bullying in accordance with religious teachings. The purpose of this research is to discuss the bullying issues occurring in society and provide recommendations and solutions for da\u27i in addressing or delivering da\u27wah related to bullying cases. This study is descriptive-qualitative research using a literature review approach. The primary data sources include the Qur\u27an, hadith, and relevant documents. Secondary data are derived from scientific studies, articles, journals, and books discussing the phenomenon of bullying. Data analysis is conducted by deeply interpreting the collected data and then concluding. The research results identified several factors contributing to bullying in schools, including individual factors, such as a sense of superiority (having power), lack of supervision by teachers or educators, family or parental influences, and peer factors. Preventive steps for da\u27i to address bullying are by giving an understanding of retaliating with no harm action, building friendships, supporting networks, relocating to a better environment (hijrah), self-defense, education, and awareness. As da\u27i, they can share stories of the Prophet and his companions that illustrate good behavior, instill empathy and tolerance, and encourage positive behavior to prevent bullying
The Implementation of The Medina Charter Values in Preventing Religious and Global Humanitarian Tensions
This study aims to explore why the values of the Medina Charter (Piagam Madinah) have begun to be abandoned by major world powers, resulting in disruptions to global peace and the persistence of conflicts, such as those between Israel and Hamas, Myanmar and the Rohingya ethnic group, as well as the Syrian civil war, which has claimed numerous lives. The data collection method involved systematic procedures through a literature review. The findings reveal that the reasons for the abandonment of the Medina Charter stem from political and social factors. Politically, countries such as the United Kingdom and the United States support Israel as a gesture of gratitude, as these nations received assistance from Jewish individuals during World Wars I and II. Additionally, human rights violations, a social factor, manifest in forms such as discrimination, as seen in Myanmar against the Rohingya ethnic group. Also, the civil war in Syria was caused by political and social factors
