DIVERSI DALAM PENEGAKKAN HUKUM IN CONCRETO (PERSPEKTIF HUKUM PIDANA ISLAM)
The enforcement of in concreto law refers to the practical implementation of law, transforming it from an abstract concept into a concrete application. Diversion, as an alternative resolution for juvenile cases outside the formal criminal justice system, aims to prevent stigmatization and allows children to reintegrate into their social environment in a balanced manner. This study employs a library research method with a juridical-normative approach, collecting data through documentation and analyzing it descriptively. The findings reveal that restorative justice and diversion focus on restoring losses suffered by victims, providing opportunities for offenders to participate in the recovery process, and involving the community in maintaining equitable peace. However, despite the extensive discussion of restorative justice and diversion in existing literature, there remains a gap in integrating Islamic legal principles, particularly As-sulh, into their application for juvenile cases. Women\u27s Inheritance Rights in Indonesia from the Perspective of the Triangular Concept of Legal Pluralism
Indonesia\u27s plural legal system, which includes Islamic, customary, and national laws, often leads to disparities in women\u27s inheritance rights, particularly when national and customary laws interact, frequently disadvantaging women. This study aims to analyze the inheritance rights of girls in Indonesia through the lens of Wermer Menski\u27s triangular concept of legal pluralism. It Utilizing uses a doctrinal approach focusing on legislative frameworks, concepts, cases, and interpretations,. Then, the research relies on secondary data, including primary and secondary legal materials, to draw conclusions and make recommendations. The findings reveal that inheritance rights are typically reserved for sons in patrilineal societies, while daughters are excluded but may receive gifts from the inheritance. Customary law prioritizes family harmony in inheritance distribution, allowing dissatisfied parties to pursue legal action. However, judicial decisions at lower courts vary, with some adhering to customary law that denies daughters inheritance rights while others apply state law granting daughters equal rights. The Supreme Court\u27s Cassation Decision Number 197K/Sip/1961 affirmed equal inheritance rights for daughters, a consistently upheld stance culminating in jurisprudence Number 3/Yur/Pdt /2018. Analyzing this development through Menski\u27s legal pluralism model suggests that women\u27s inheritance rights in Indonesia have evolved to from level- 2 to level- 4, recognizing international legal influences. Meanwhile, Level- 5 is not by Indonesian law because the element of religious law is removed and replaced with natural law. For Level 5 to follow Indonesian law based on the Almighty God, further research is still needed
USIA PERNIKAHAN DI ERA MODERN: MENELUSURI KEBIJAKAN UNDANG-UNDANG NOMOR 16 TAHUN 2019 DAN BKKBN MELALUI PERSPEKTIF MASHLAḤAH MURSALAH
Indonesia as a legal country has laws and regulations that regulate various matters, including marriage issues. The marriage age is one of the regulations regulated in Law Number 16 of 2019 to overcome the occurrence of early marriage which of course has various negative impacts. Meanwhile, the National Population and Family Planning Agency (BKKBN), through the Marriage Age Maturation (PUP) program, states that the ideal age for marriage is 21 years for women and 25 years for men. This research formulates several problems, namely what are the factors behind the determination of the age of marriage according to Law Number 16 of 2019 and the National Population and Family Planning Agency (BKKBN) and what is the mashlaḥah murlah analysis of determining the age of marriage in Law Number 16 of 2019 and the Agency National Population and Family Planning (BKKBN). This research is normative juridical in nature using a library research approach. The data sources used are directly related to the research content in the form of primary legal materials, secondary legal materials and tertiary legal materials. The data analysis technique uses qualitative descriptive analysis techniques with deductive conclusions to determine the underlying factors and mashlaḥah murlah analysis of determining the age of marriage in Law Number 16 of 2019 and the National Population and Family Planning Agency (BKKBN). From the research results, it can be stated that the factor behind determining the marriage age is early marriage which results in various kinds of negative impacts on the couple and the prospective children who will be born. Meanwhile, the benefits of determining the marriage age include mashlaḥah dharūriyyāt, namely ḥifzh al-nafs (maintaining the soul) and ḥifzh al-nasl (maintaining offspring)
Sociological Analysis of Pre-marital Intercourse Activities (Zina) (Criticism of Legal Interpretation Surah An-Nur Verse 3 Tafsir Al-Misbah)
Adultery and marriage are discussed concerning ideality. Marrying an adulterer becomes a legal issue that needs to be studied due to the impropriety of marrying an adulterer. This study analyzes the effect of adultery on future marriages in interpreting Al-Misbah surah An-Nur verse 3, written originally by M. Quraish Shihab. In addition, the interpretation by Quraish will also be parsed with Rebbeca F. Plante\u27s sociology of sexuality analysis to connect the context study of an adulterer\u27s marriage described in Tafsir Al-Misbah with the stigma of sexuality that occurs due to the act of penetration before marriage. The method used is qualitative with a normative-juridical approach, and to sharpen and deepen this study, a sociological analysis of sexuality is used. This study explains that Tafsir Al-Misbah interprets verse 3 of Surah An-Nur with circumstances that benefit one gender and harm the female to achieve the ideal of marriage. With a social approach, there is an implicit stigmatization effort in the interpretation of verse 3 of Surah An-Nur by labeling adulterous females as partners who are not ideal for marriage. This also indicates that socially, a female with such stigmatization is presented as having a bad sexual reputation and provides space for injustice for a female to choose a partner with ideal considerations as befits a male who desires a partner with ideality towards marriage. Thus, the interpretation of the law in verse 3 of surah An-Nur in Tafsir Al-Misbah appears to disadvantage one gender (female) subjectively
